3 Minutes of a Special Meeting of County Council RED DEER COUNTY Thursday, June 15, CALL TO ORDER The Special Meeting of Red Deer County Council was held in the Library at the Penhold Multi-Plex, 1 Waskasoo Avenue, Penhold, Alberta, and was called to order by Mayor J.J. Wood at 6:03 p.m. PRESENT: Mayor J.J. Wood, Deputy Mayor D.B. Church, Councillors J.M. Bota, C.R. Huelsman, R.R. Lorenz, P.J.R. Massier and C. Moore. STAFF PRESENT: Assistant County Manager R. Henderson, Corporate Services Director H. Surkan. Planning and Development Administration R. Barr and R. Moje and Legislative Services Administration N. Lougheed. This special meeting of County Council was scheduled for the holding of a joint public hearing with the Town of Penhold in relation to the proposal to adopt the Town of Penhold / Red Deer County Intermunicipal Development Plan. Resolution No. CC , adopted April 25, 2017, provided the authority for this special meeting of Council to be held. Proposed Penhold / Red Deer County Intermunicipal Development Plan (IDP) Red Deer County and Town of Penhold Planning administration presented a summary of the proposed IDP. 2.0 PUBLIC HEARING A listing of the persons who attended and spoke at the public hearing is attached and is considered to be a part of these minutes. Lorenz to approve in principle the Summer Village of Norglenwold s proposed annexation, pursuant to the proposed process for negotiation and consultation as presented by the Summer Village in its formal notice of intent to annex lands from the County. Stephansson Society to purchase a historical property (Buttermaker House) in the Hamlet of Markerville. CC Moved by Councillor R.R. Lorenz to approve financial support of $125,000 to the Stephan J. Stephansson Society for the purchase of the Buttermaker House located in the Hamlet of Markerville (Lots 6 to 10, Block 1, Plan XX1) on the condition that the Society makes application for both municipal and provincial historical designation of the property with the funds to come from the Municipal Reserve account and to amend the 2017 budget accordingly. Symington reported on the request for funding support for the restoration of the Holy Trinity Anglican Church. CC Moved by Councillor P.J.R. Massier to approve financial support of $75,000 to the Holy Trinity Anglican Church at Pine Lake to assist with the costs of restoration of the Historical Designated Church with the funds to come from the Community Reserve account and to amend the 2017 budget accordingly. 9 July 4, 2017 Report No. 6.1 ADMINISTRATION REPORT Date: July 4, 2017 Memo To: County Council From: Subject: Planning & Development Services Town of Bowden Annexation Background Report 1.0 PURPOSE To advise Council that Red Deer County has received the Town of Bowden and Red Deer County Annexation Background Report for Annexation Proposal, dated June, 2017 (see attached) from the Town of Bowden and to request Council s consideration of the report. 2.0 LEGISLATIVE AUTHORITY Section 118 of the Municipal Government Act provides that following negotiations, the municipal authority initiating the annexation is to prepare a report that describes the results of the negotiations. This report is to be approved (signed) by the municipality where lands are being annexed from (i.e. Red Deer County). 3.0 BACKGROUND / DISCUSSION The Background Report summarizes the process that the Town and County have followed in considering annexation and acts as the Town s official application to the Municipal Government Board (MGB). The required contents of the Negotiation Report are described in Section 118 of the Municipal Government Act and include the following: Description of the lands to be annexed; List of all matters agreed upon and those of which no agreement between municipalities was reached; Description of the public consultation process; Summary of the views expressed during the public consultation. The Annexation Negotiation Report also provides indication to the MGB on how the Town wishes to proceed with respect to the timing of annexation and the conditions that the Town and County wish to have placed on in the Town s annexation application. Once County Council approves the Town s Background Report for Annexation, the Town will forward a complete application package including the Report to the MGB. Once the MGB receives the Town s application, they will determine if a public hearing is required Town of Bowden Annexation Background Report consideration... Page 9 of 96

10 and, if necessary, arrange and hold a public hearing. At this point it is doubtful that a hearing will be required given the feedback from all parties involved and the fact that majority of the lands are owned by the Town of Bowden. There is no time limit for the MGB to reach its decision on the Town s application. The final decision on annexation comes from the Provincial Cabinet in the form of an Order-in- Council. 4.0 RECOMMENDATIONS That County Council approve the following resolutions: 1. Red Deer County approves the Background Report For Annexation Proposal from the Town of Bowden dated June 2017; and 2. The Municipal Government Board is advised that Red Deer County agrees with the annexation of the lands described in this report subject to the items agreed to as set out in the Background Report For Annexation Proposal. 15 Town of Bowden / red deer county 1) PREAMBLE The following is intended to be used as a background submission in support of a notice of intent to annex certain lands from the Red Deer County to the Town of Bowden. The Town of Bowden is located within Red Deer County, approximately 43 kilometres south of the City of Red Deer on the Queen Elizabeth II Highway. A location map of is provided on the following page. This report has been prepared in accordance with Division 6 of the Municipal Government Act (MGA) which establishes: How an annexation proposal is to be initiated, and Guidelines for negotiations including reporting requirements. The Town and County have reached an agreement on the terms for the annexation. This submission includes generally agreed upon conditions for consideration by the Municipal Government Board. 2) SUBJECT LANDS NW Pt. NE Pt. SW Adjoining Roadways The quarter-section, which features a lift station and waste-water lagoon that is part of a regional system, is currently accessible through a forced road in the northeast corner of the property. The lift station is located within Block 1, Lot 1, Plan Undeveloped land adjoining the west boundary of the railway right of way, accessible through the same roadway as the NW 14 (described above). The property contains a non-operating landfill. Plan No JK is approximately 8.2 hectares of land that features a grain processing plant. The plant services the surrounding area by providing seed cleaning services. The development is currently under a long term lease. Plan : Expansion of an intersection between West Railway Street and 17 Ave. Portion south of an extension of the north boundary of 17 Avenue to the west boundary of Plan 6690 BM: That portion of this road plan that forms part of 17 th Avenue. Note: A graphic of the roadways is provided as a highlight to the map showing the subject lands. Pt. CR Rail R/W That portion of Railway Plan No. that lies south of the north boundary of 17 th Avenue to the south boundary of NE ) LAND USE CONSIDERATIONS It is the intent of the Town of Bowden to not cause any land use action that would impair the ability of the improvements on the subject lands to continue into the future. This includes: Maintaining the same road standards as Red Deer County has had in the past. This includes a continuation of the practice of not placing weight limits on haulers during the spring months. Ability of the W.A. Grain facility to continue under its current lease with the Town of Bowden. No changes to the current operating arrangement that the Town of Bowden has with Mountain View Water Services Commission and South Red Deer Regional Waste Water Commission. 17 Town of Bowden / red deer county 4) OWNERSHIP AND REGISTRATIONS Each of the properties within the subject lands are currently owned by the Town of Bowden or a utility commission. NW Pt. The above certificates of title include the following registrations: Foothills Natural Gas Co-op Limited Red Deer County Central Alberta Rural Electrification Association Mountain View Regional Water Services Alberta Government Telephones Fortis 5) ANNEXATION REASONING The Town of Bowden provides the following reasons in support of annexation of the subject lands: The primary access to the subject properties is from the Town of Bowden off Highway No. 2A and the Town of Bowden. An alternative access is available to the northwest from the Bowden Lake area. Each of the subject properties is owned by the Town of Bowden. 18 Town of Bowden / red deer county Improvements on two of the properties include a sewage lift station and a sewage lagoon which are part of the Town of Bowden s infrastructure. Waste water lines on the subject properties are an extension of infrastructure from the Town of Bowden. The Town does not have an agreement with Red Deer County for the extension of Town utilities into the County. 6) METHODOLOGY AND ACTION PLAN The Town of Bowden has conducted a number of discussions informally and in formal meetings at the Administrative level. Providing support services to the Town of Bowden, North Star Planning also pursued formal discussions with both municipalities and the major stakeholders on the subject lands prior to the issuance of a Notice of Intent To Annex. The intention was to identify and address any issues prior to initiating the public process through the Notice of Intent to Annex. This has been done through a combination of in-person and telephone interviews. After consideration by the Town of Bowden and an update to Red Deer County, the decision was made to prepare and issue a Notice of Intent to Annex on March 24, The Notice of Intent was issued to both municipalities, the Municipal Government Board, stakeholders within an interest on the subject lands, and regional authorities such as: Red Deer County Alberta Health Chinook Edge School Division Red Deer Catholic Regional Division South Red Deer Regional Mountain View Regional Waste Water Commission Water Services Commission Alberta Transportation Fortis Alberta Infrastructure AltaLink Management Atco Gas Atco Pipelines Alberta Energy Regulator Crossroads Gas Co-op Canadian Pacific Railway Central Alberta Rural Electrification Association Limited Annexation report P a g e 4 Town of Bowden Annexation Background Report consideration... 19 Town of Bowden / red deer county A public meeting was held on May 3 rd at the Town of Bowden Council Chambers. A meeting summary is attached to this submission. 7) ASSESSMENT AND TAXATION COMPARISON The subject properties are all owned by the Town of Bowden. W.A. Grain is currently the only assessable property within the proposed annexation area. o The property is currently assessed by Red Deer County (2015) as a combination of Residential and Commercial for a total assessment of $984,270. The tax bill was $9, o For comparison purposes, the Town of Bowden s classification for the property would be Industrial. Using 2015 Mill Rates the property would have been subject to a tax bill of $12,736. 8) CONSULTATION ACTIVITIES The following is a summary of the consultation responses that were received: Discussions with both the Town and County on January 28, These discussions were used to identify stakeholders, municipal and landowner issues. Discussions over telephone were held with the Municipal Government Board (January 30-31) on process and application requirements. Discussions over telephone were held with the following stakeholders on February 1, 2017: o W.A. Grain: Mr. Cory Leppa The only concern appears to be with the subject of taxation. 20 Town of Bowden / red deer county On the assumption that current service agreements and understandings would be maintained there are no objections to the proposed annexation. o South Red Deer Regional Waste Water Commission: Mr. Robert Jenkins The lagoon is currently part of a regional system and is used for emergency storage purposes and equalization of waste water storage through the region. o Letters of no objection were received from: o Alberta Transportation o Alberta Health 9) MUNICIPAL GOVERNMENT ACT REQUIREMENTS This proposal for annexation has been prepared in accordance with the requirements of Part 17 of the Municipal Government Act, R.S.A., ) PROVINCIAL LAND USE POLICY COMPLIANCE The document encourages municipalities to work together and cooperate on matters of mutual interest. The proposed annexation does not conflict with the Minister s Land Use Policies, circa The Town of Bowden has complied with Policy 2.0 which requires public engagement and to allow participation by stakeholders, landowners, residents, utility and transportation providers. Engagement opportunities and efforts are detailed throughout this document. The Town of Bowden has complied with Policy 3.0 which encourages cooperation and coordination between municipalities in addressing planning issues. As described in this document, an Intermunicipal Development Plan is in place and direct communication has been undertaken on a regular basis between the two municipalities. 21 Town of Bowden / red deer county 11) MUNICIPAL GOVERNMENT BOARD REQUIREMENTS This proposal has been prepared in accordance with the requirements put forth by the Municipal Government Board through its web-site, written correspondence and verbal communication. Historically, these requirements include the following applicable principles: o Intermunicipal Cooperation: The subject land is within the geographic boundary of the Town of Bowden Intermunicipal Development Plan. The plan contains policies regarding land use within the subject property and with respect to annexation. These policies are discussed further in this document. o Accommodating Urban & Rural Growth: The proposed annexation will not adversely impact Red Deer County or its opportunities for growth. The proposed annexation would not impact the Alberta Environment imposed land use buffers from the working area of a waste water; hence the ability to develop lands adjoining the subject parcel will not be impaired by this proposed annexation. Though the subject parcel would add a significant amount of land to the Town s corporate boundary, much of the land has little development potential. In terms of land area, the subject parcel is insignificant in terms of the its impact on the land base of Red Deer County. o Maintaining Local Autonomy: The proposed annexation will enhance local autonomy and responsibility for the Town of Bowden and Red Deer County. It is important to note that the lift station, non-operating landfill, lagoon and municipal utility infrastructure located within the Parcel is properly assigned to the Town of Bowden. It would be of benefit to both municipalities to have this infrastructure located within the municipality that has direct responsibility for its care and maintenance. o Cost Effective, Efficient and Coordinated Services: The property is currently serviced through a roadway, franchise utilities, a lift station, lagoon and a Town of Bowden sewer line. As the parcel has very limited development potential, the development of additional utilities (potable water) will be subject to a cost-benefit analysis. 22 Town of Bowden / red deer county time to extend existing services from the parcel to adjoining County lands. It is also noted that approval of this annexation proposal will address the issue of having services (waste water infrastructure) from the Town being provided in the County without a servicing agreement. o Supporting Plans: An Intermunicipal Development Plan is in place for the subject lands. The Intermunicipal Development Plan Intermunicipal Committee has been an important part of the consultation process for this proposal. Policies of the Plan are described in detail further in this document. o Inter-Agency Consultation: All local authorities have been notified of this proposal, as described within this document. o Assessment & Taxation Impacts: It has been noted that all lands within the subject parcel are owned by either the Town or a regional utility. The sole assessable property of note within the parcel is on a property owned by the Town under a landowner/tenant relationship. The Town, County and the tenant (W.A. Grain) have discussed outstanding issues and have reached an agreement as put forward in Section 17 of this Document. It is the position of both the Town and County that this proposed annexation is not a tax initiative. Further, the sole taxable business of any significance within the parcel has indicated a desire to be within the corporate boundary of the Town of Bowden. o Effective Public Communications: The Town submits that it has exceeded the minimum requirements for effective consultation. o Revenue Sharing: The Town and County have addressed this issue and determined that there is no need for a revenue sharing agreement. 23 Town of Bowden / red deer county 12) STATUTORY PLANS AND BYLAW CONSIDERATIONS o Red Deer County and Town of Bowden Intermunicipal Development Plan Policy Area 8.4 of the Plan describes the jointly agreed to policy directions and objectives for annexation by the Town of Bowden. Specifically: o 8.4.1: The subject land is contained within the urban expansion area described on Map 1 of the Plan, o 8.4.2: This annexation proposal is more than 5 years since the land time the Town of Bowden has submitted an annexation proposal for consideration. o 8.4.3: The annexation will not impact the range of development that may take place adjoining County lands. (note that there is no objective 8.4.4) o 8.4.5: It is unknown at this time whether or not a potable water service will be extended to the parcel, though it has been established that the service will not be extended unless it is economical to do so. It should be noted that except for an expansion of the W.A.Grain site, it is not anticipated that any additional water users will be locating on the property in the near to medium future. o 8.4.6: This annexation proposal has been initiated by the Town of Bowden. o 8.4.7: Affected landowners were notified in advance of the general public. W.A. Grain, a tenant, was also notified by the Town in advance of the general public. o 8.4.8: This policy is not applicable as the annexation is not proposed by a landowner. o 8.4.9: The Intermunicipal Committee, as required, reviewed the proposal on June 21. 24 Town of Bowden / red deer county o : As required, this annexation proposal was discussed at a joint Council (IDP Committee) meeting held on June 21, o : It is submitted that the proposed annexation will have no impact on projected growth rates as none of the subject lands are identified or suitable for residential growth, The subject property may not require any additional municipal services, however, should potable water service be required, it will be provided in a manner that is economical and efficient, The property is already serviced for industrial traffic, All landowners are in support of the proposal, The Town, County and W.A. Grain have developed a transitional agreement in principle to put forward to the Municipal Government Board for consideration, and This proposal does not conflict with any Statutory Plans. o Town of Bowden Municipal Development Plan: The Municipal Development Plan has identified industrial as the best use for the undeveloped portion of the subject property. The best use for the lagoon site is to maintain its current status as part of a regional network. The Plan defers to the Intermunicipal Development Plan on any matters related to annexation. 13) INTENDED LAND USE FOR SUBJECT LANDS Much of the land, due to the presence of a waste water lagoon and a non-operating landfill, is undevelopable. 25 Town of Bowden / red deer county a grain handling facility owned and operated by W.A. Grain under a landowner tenant relationship with the Town of Bowden. With respect to the lagoon and non-operating landfill lands, the range of land uses on those properties is significantly restricted by Alberta Environment and Alberta Health. Though it would likely be a matter dealt with as part of a future area structure plan process, it is anticipated that these lands would be restricted to open space and recreational use, or commercial/industrial use that does not include any components that are in non-compliance with provincial restrictions. The W.A. Grain site could be expanded should that entity decide to do so. It is anticipated that an expansion of the development would use the remainder of the parcel (Plan 2369 JK, Lot OT within SW23) It is not anticipated that any of the lands would be suitable or desirable for residential, retail commercial or places of assembly such as community halls, places of worship or school sites. 14) SERVICING CONSIDERATIONS As mentioned previously, the land is fully serviced with roads, franchise utilities and a piped waste water service. The sole water user on the parcel, W.A. Grain, uses a truck haul/cistern arrangement for water supply. Should the W.A. Grain development expand and it becomes necessary and feasible to extend a piped potable water service to the property, the Town will be able to consider an extension of the piped water services to the site. The Town is prevented at this time from extending a water line to the site as there is currently no intermunicipal servicing agreement in place for the extension of water from the Town into the County. 15) CONSENT TO ANNEXATION As the applicant, the Town of Bowden consents to this application for annexation. The South Red Deer Waste Water Commission also consents to the application (letter attached). Red Deer County consents to this application as described in Council Motion/Resolution No. (attached). Alberta Transportation submitted a letter dated April 10, The letter offered advice on requirements that may be applicable should the land be developed in the future. (letter attached) Alberta Health issued a letter of no objection dated April 11. South Red Deer Regional Wastewater Commission issued a letter of no objection dated June ) TRANSITION REQUEST(S) After reviewing the standard transition clauses that were provided by the Municipal Government Board, Town of Bowden and Red Deer County have jointly recommended that the Standard Conditions for Annexation as provided by the Alberta Municipal Government Board Annexation Bulletin no be applied with a 10 year transition period. 1) For taxation year (2018) and subsequent years, up to an including (2028), the annexed land and the assessable improvements to it: a. Shall be assessed by the Town on the same basis as if they had remained in the County, and b. Shall be taxed by the Town in respect of each assessment class that applies to the annexed land and the assessable improvements to it using the tax rate established by the County. 2) Where in any taxation year, a portion of the annexed land a. The reasons for the proposed annexation focused primarily on ownership (the Town of Bowden currently owns the majority of the lands described) and a development that s currently located on a portion of the property which may require water services as part of it expansion plans. Both parties were in support of the proposed annexation. It was also mentioned that an IDP amendment will be required in order to recognize the expansion of the Town boundary should the annexation application be approved. The IDP amendment application could be run concurrent with the annexation application. Next Steps Going forward The Town of Bowden stated that they will be looking to hire a consultant to assist them in the application process. A request was made for more information about the history of the lagoon and why soil was hauled off the property when the lagoon was constructed. o This matter pre-dated the knowledge of almost everyone in the room. There was not a lot of information that could be added to the history of the construction of the lagoon. A statement was made by W.A. Grain representatives that the organization would like to support the Bowden Community with its tax payment. The proximity of the railway line as well as the types and numbers of vehicles accessing the proposed annexed area to/from Highway 2A (20th Street) should be taken into consideration with respect to proposed intersections into the plan area. Approval from the rail line may be required to intensify the use of the existing 17th Avenue railway crossing. Any requirements necessary for pedestrian accommodation would be the responsibility of the Town of Bowden. As development proceeds, drainage impact on the provincial highway system should also be considered. Proposed flows into the provincial highway system are to be at or below predevelopment levels at the specified level (1:100 year, governing storm duration) as per Alberta Transportation s Design Bulletin 16, Drainage Guidelines for Highways Under Provincial Jurisdiction in Urban Areas, and meet Alberta Environment and Parks requirements, including water quality. The company allows us to provide insurance (at a reasonable rate) to non-profit organizations that work within the County to provide various municipally-based services to our residents. This policy is to establish guidelines for accepting additional named insured on to Red Deer County insurance policies. GUIDELINES/SCOPE 1. All enquiries and applications for additional named insurance (ANI) are to be approved by Council. 2. All requests with completed application forms must be forwarded to Council at least thirty (30) days in advance of the commencement of any approved coverage. 3. The Land Use Bylaw defines the purpose of this district is to provide for a diversity of commercial, recreational and tourist type uses for the public travelling along highways. Currently the Highway Commercial District does not have provisions for Office as a permitted or a discretionary use. The intent of this amendment is to include Office as a permitted use in order to accommodate businesses that may want to be located within close proximity of a highway. The definition of Office is defined as follows: Office means development primarily for the provision of professional, management, administrative, consulting, or financial services in an office setting. Typical uses include, but are not limited to, the offices of lawyers, accountants, travel agents, real estate and insurance firms, planners and other consultants, dentists, doctors, clerical services and secretarial agencies. 85 Date: July 4, 2017 July 4, Report No. 7.2 ADMINISTRATION REPORT Memo To: County Council From: Subject: Planning & Development Services Land Use Bylaw 2006/6; Business Service Airport District (BSA)/ Text Amendment 1.0 PURPOSE To consider granting first reading to a Bylaw to amend Red Deer County Land Use Bylaw 2006/6, Business Service Airport District (BSA) as follows: Amend Section 118.3, by adding Campground Minor as a Discretionary Use. and To set the public hearing date for August 15, SUMMARY The Applicant is proposing an amendment to the Red Deer County Land Use Bylaw 2006/6, Business Service Airport District, to add Campground Minor as a discretionary use. A Campground Minor means a development of planned campsites for the seasonal short term use of recreational vehicles, campers, and tents and similar recreational vehicles where there are 20 defined camping sites or less within the development area of the land and is not used as year round storage or accommodation for residential use. A campground minor may include a potable water supply or sewage disposal facilities. The intention of the campground is not for the travelling public but rather to accommodate local and other members of aeronautical group members of gliding, skydiving and flying clubs. The Big Bend Airport is home to the Central Alberta Gliding Club, Skydive Big Sky and the Innisfail Flying Club. The Applicants are proposing a 0.87 hectare (2.16 acre), 20-site campground along the east boundary of the subject lands. The minimum camping stall shall be 6.0 meters (20 feet) in width and 18 meters (59 feet) in depth with a minimum separation distance between campsites of 3.0 meters (10 feet). The campsites will be clearly marked and will provide setbacks of 3.0 meters (10 feet) from all site boundaries. The proposed site will be south of the farmstead and screened by a large farm building. Access into the site is via Highway 54 and shared by the farming operation. Topsoil will be graded and bermed to improve site drainage. The grounds will be seeded with grass outside the campsite and the existing trees and shrubs will be retained. 86 The Applicants have designed the campground to include 20 recreational vehicle parking stalls, a designated campfire area, water source and 4 portable lavatories. Solid waste will be collected in refuse and recycling bins and disposed offsite as per County standards. Signage will be provided for users and emergency vehicles. The campground site plan provides one two-way internal road. At the Development Permit stage, the Applicant will be required to have and pass a Fire Inspection. This inspection will ensure the use meets the minimum requirements of the Fire Code. The closest residences to the site are approximately 900 meters to the northeast and 1.5 kilometers away in other directions. This application was referred to both internal and external agencies as well as adjacent landowners.
