The parcel was originally planned for a comprehensive R-3 development. It was later subdivided into 4 parcels with the subject lane provided as access to accommodate street-oriented attached dwelling product. The developer now feels that the site would be more appropriately developed as a comprehensive site with a private road network, and therefore wishes to consolidate the subdivided parcels and lane back into the original single lot. 4. MINUTES OF REGULAR MEETING APRIL 7, P-023 Approval of Minutes April 7, 2016 Regular Meeting D. Oneil moved that the Airdrie Municipal Planning Commission adopt the minutes of the regular meeting of April 7, 2016 as presented." PUBLIC INPUT SESSION CARRIED There were no questions from the public. BUSINESS ARISING Development Permit Neighbourhood Commercial Buildings in Midtown Location: 1 Midtown BV SW Staff Contact: Karl Mielke Chris Joslin has applied on behalf of North Lumina Developments JV Inc. for a Development Permit to construct a neighbourhood commercial complex at 1 Midtown BV SW. K. Mielke reviewed the application. Concern was raised about noise from the car wash. K. Mielke will confirm that the car wash hours meet the noise requirements under the Land Use Bylaw. 1

3 Regular Meeting of Airdrie Municipal Planning Commission April 21, 2016 Page 2 Concern was raised that residences across Midtown Blvd face the back of the buildings and that residents will have to walk around the buildings to access the individual businesses P-024 DP Midtown BV SW M. Steffler moved that the Airdrie Municipal Planning Commission approve Development Permit with the following variances, conditions and notations: 1. This development is classified as a neighbourhood commercial centre with the following land uses: Health Services; Retail Liquor Sales; Retail Sales; Personal Services; Day Care Facility; Restaurant, Major; and Restaurant, Minor, which are Discretionary Uses in the Neighbourhood Commercial District (C-1), on the lands legally described as Lot 1, Block 8, Plan This development is approved with a variance of 42.8% to the maximum site area requirements of Section 5-5(6)(a) of Land Use Bylaw B-09/2005, as may be amended from time to time, to allow for consistency with the site size provided for in the Midtown Neighbourhood Structure Plan. 3. All development, including the location, orientation, capacity and use of buildings and any landscaping and site improvements, shall be completed as per the approved plans and in accordance with the requirements of the City of Airdrie s Land Use Bylaw and Engineering Standards, to the satisfaction of the City of Airdrie, notwithstanding any variances granted by the Development Authority. 4. Ninety-five (95) parking stalls shall be provided for this development in accordance with the requirements of Land Use Bylaw B-09/2005 and as shown on the approved plans. All parking stalls shall be hard surfaced with asphalt pavement, concrete or other similar paving material to the satisfaction of the Development Authority prior to occupancy. 5. The parking stalls required for this development shall include 6 stalls designated as barrier-free for disabled persons. All stalls for disabled persons are to be marked with permanent, all-weather signage to the satisfaction of the Development Authority. 6. Prior to Development Permit issuance, a detailed cost estimate for the landscaping, including all site work and irrigation work, will be required and must be provided for review and approval. Following approval of this cost estimate, a Letter of Credit will be required in the amount of 150% of the established/accepted costs of the landscaping and site work. 7. Prior to Development Permit issuance, the developer/owner shall enter into a Development Agreement with the City of Airdrie pursuant to the City of Airdrie Land Use Bylaw B-09/2005 and Section 650(1) of the Municipal Government Act. 8. Prior to Development Permit issuance, the developer/owner shall submit copies of the following plans to the satisfaction of the City of Airdrie Engineering Services Department: a. Site servicing plan; b. Site grading/drainage plan; 2

The area around the construction site shall be kept clear of equipment and debris, and construction materials, including garbage, shall be stored so as not to create a nuisance to neighbouring properties. 10. Prior to Development Completion Certificate (DCC) issuance, the developer/owner shall provide the City of Airdrie with a letter from an Engineer registered and certified to practice in the Province of Alberta confirming that the site servicing and grading/drainage has been constructed according to the approved plans. 11. Prior to Development Completion Certificate (DCC) issuance, digital and hard copy as built drawings of the site servicing and grading/drainage shall be submitted to the satisfaction of the City of Airdrie Engineering Services Department. Legal Notations Any signage in addition to that shown on the approved plans will require a separate sign permit application. Any and all required traffic/vehicle signage shall be the responsibility of the developer, to the satisfaction of the Development Officer. All site accesses and sidewalks are to be designed and constructed to the satisfaction of the City of Airdrie. Prior to the commencement of any work on or within a City street, right-ofway or other City owned property, application must be made to and approved by the City of Airdrie Engineering Services Department. All necessary permits and inspections are the responsibility of the applicant including, but not limited to, Building Permits and Fire Approval, and shall be submitted to the City as required. This permit is approved with the understanding that there are no offsite effects. Compliance shall be maintained with the Municipal Government Act (Alberta) and the City of Airdrie Land Use Bylaw No. B-09/2005 (copy available at City office), site and elevation plans, and this permit. This permit is subject to all relevant environmental legislation and the Environmental Protection and Enhancement Act (Alberta). The City of Airdrie Engineering Services Department requires the following with respect to service ties to City infrastructure: 1) A Transportation Accommodation Strategy a minimum of 3 days prior to road closures/detours; 2) A minimum of 48 hours notice for service ties to street; and 3) Street rehabilitation to an asphalt standard for service. It is the owner s responsibility to determine whether the use approved by this Development Permit is, in fact, achievable or whether such use may 3

5 Regular Meeting of Airdrie Municipal Planning Commission April 21, 2016 Page 4 be constrained or precluded by site conditions, including constraints on use resulting from environmental conditions or legislation, or both. The developer/owner is responsible for coordinating and making all necessary arrangements with relevant utility providers. CARRIED by a vote of 6 in favour, 1 opposed Opposed: K. 6 MUNICIPAL PLANNING COMMISSION AGENDA REPORT Meeting Date: 5 May 2016 Subject: Bylaw No. B Boards Routed Through: n/a Date: 18 April 2016 Issue: Maidment Land Surveys Ltd. has applied on behalf of Westmark Holdings Ltd. to close and dispose of an unnamed lane on Plan , located within Cooper s Crossing Phase 22. The parcel was originally planned for a comprehensive R-3 development. It was later subdivided into 4 parcels with the subject lane provided as access to accommodate streetoriented attached dwelling product. The developer now feels that the site would be more appropriately developed as a comprehensive site with a private road network, and therefore wishes to consolidate the subdivided parcels and lane back into the original single lot. Background: Subject Lane: The subject laneway lands were originally subdivided as part of Coopers Crossing Phase 22B in July 2013, along with four fee simple Residential Low Density Multi-Dwelling District (R-3) lots. The developer has since determined that the site would be better suited to a 5

7 comprehensive development rather than fee simple product. This would allow for private roadways to access the residential lots within the site, rather than a public lane owned and maintained by the City. This proposal would dispose of the laneway lands, allowing the developer to consolidate the site back to its original single lot. The parcels to be consolidated, including the subject lane, are listed in the diagram and table below: The entire area provided as lane ROW is only 0.06 acres, and would not be conducive to development as it is currently configured. The value of the land as it stands would be 6

8 negligible and would negatively impact any proposed future development of the remaining R-3 parcel if it was left in its current form. As the parcel was contributed by the developer with the intention to provide access to their fee simple lots, and has no other value to the City or the Developer as it currently stands, and because the Developer is not able to cancel the subdivision plan without disposal of the roadway as per the Municipal Government Act, it would be logical to dispose of the lands and return them to the Developer for consolidation at no cost. This would both allow the development to proceed, and allow the City to ensure that development of the site unfolds in a more logical and desirable fashion. Alignment with AirdrieONE: This application has little relevance to, and is neither consistent nor inconsistent with, the direction of AirdrieONE. Boards Routed Through: N/A Alternatives/Implications: MPC has three alternatives with respect to the proposed bylaw: Alternative One: To recommend that Council adopts Bylaw No. B-06/2016. By choosing this alternative, MPC generally accepts the road closure proposal in the manner described in this report and recommends that Council gives Final Readings in favour of the proposal. Alternative Two: To recommend that Council tables Bylaw No. No. B-06/2016. By choosing this alternative, MPC encourages Council to delay a decision on the proposal until further information can be provided by staff. Alternative Three: To recommend that Council defeats Bylaw No. No. B-06/2016. By choosing this alternative, MPC rejects the lane closure and disposal described in this report and recommends that Council defeat the application. Communications Plan: A 60-day appeal period for the proposed lane closure and disposal was advertised in Airdrie City View on the following dates: February 4 th, 2016 February 11 th, 2016 February 18 th,

9 The appeal period closed on April 18 th, Following Municipal Planning Commission s recommendation and prior to the public hearing, the proposed lane closure will be advertised in Airdrie City View for a period of 14 days. Recommendation: That Municipal Planning Commission recommend that Council adopt Bylaw No. B-06/2016 as presented.
