BACKGROUD: West ason Steet between Coast Highway 0 and eptune Avenue was oiginally ceated with a 40 foot wide ight-of-way (ROW) by a 927 subdivision map. Unde the County, West ason Steet was designated as a 60 foot ROW, and late, the City of Encinitas Public Road Standads established a 56 foot wide ROW fo West ason Steet; 20 feet of tavel aea, togethe with 8 feet of paking, a 5 foot pakway and a 5 foot sidewalk on each side of the steet (see Exhibit C). As popeties along West ason Steet wee developed, evocable Offes of Dedication (OD) and dedication of ightof-way wee ganted to the County and City; Exhibit D povides details on OD and ROW dedications to date. Futhemoe, the eastely end of West ason Steet lies within the oth 0 Coido Specific Plan (see Exhibit E). The potion of West ason Steet within the oth 0 specific plan aea is designated as a 40 foot ROW; 22 feet of tavel aea, 8 feet of paking on the south side and a 5 foot wide sidewalk on both sides (see Exhibit F). The Specific Plan designation has ceated some disageement on intent elative the ROW width fo the emainde of West ason Steet and simila steets in the aea. Specifically, while the emainde of West ason Steet has neve been designated as a special case steet 40 foot ROW, some esidents believe that was Council s intent when adopting the Specific Plan. The popety known as 85 West ason Steet was subdivided into thee pacels in As pat of that subdivision, a 5 foot dedication of ight-of-way was ganted to the City on Pacel Map 9885 (see Exhibit G) along the West ason Steet fontage. M. ames Lattin, the popety owne (and subdivide), has filed a equest fo the vacation of this 5 foot dedication on the gounds that a potion

2 TEM #07 2 of West ason Steet was designated by Council to be a 40 foot ROW within the oth 0 Coido Specific Plan aea. M. Lattin assets that this designation by Council educed the ight-of-way width equiement fo all of West ason Steet. AALYSS: Staff ecommends that in conjunction with consideing the Applicant s equest fo vacation of ightof-way Council also make a detemination on an appopiate ight-of-way width and impovement standad (typical coss section) fo West ason Steet. To assist in this pocess staff has developed a vaiety of altenative typical coss sections with diffeent ROW widths fo consideation (Exhibits H though H6); each typical coss section includes a summay of the pos and cons associated with that paticula altenative. As Council is awae, ight-of-way widths and impovement standads, as well as thei elationship to setbacks, building density and community chaacte have been the subject of extensive discussion and delibeation in ou City. While peseving neighbohood aesthetic values, the West ason Steet ight-of-way should addess a vaiety of public infastuctue needs including: Vehicula and bicycle taffic safety Emegency vehicle access and lane widths that allows emegency vehicles adequate oom to set up and opeate Pedestian access fo esidents and fo beach visitos Paking fo esidents and beach visitos Pope steet dainage, stomwate pollution contol, and oadside teatment of stom unoff Designated aea fo dy utilities Sevice life and maintenance needs of the steet impovements Flexibility of the design elements to accommodate existing physical constaints n consideing these many needs, the impotance of paking in this aea, as well as locations of existing impovements, aea topogaphy and elated factos staff is ecommending that Council adopt the 50 foot wide typical coss section shown on Exhibit H. Staff believes this typical coss section, while less than the cuent Public Road Standad 56 foot typical section is the best oveall fit fo West ason Steet when consideing existing pivate impovements, and can addess all infastuctue needs fo this location. This coss section can safely and effectively tansition to the naow 40 foot ROW in the commecial zone within the specific plan aea. f Council detemines a 40 foot ROW to be appopiate, staff ecommends the coss section shown on Exhibit H5, howeve, it should be noted that maintenance costs will be highe due to dy utilities unde pedestian walkways and spot easements will be equied fo cetain above gound dy utility (cable, phone, lighting, etc) boxes and facilities. t is impotant to note that in addition to addessing infastuctue needs, ight-of-way lines ae used to establish building setbacks and can consequently affect development of adjacent popeties in a vaiety of ways. n some ae past cases Council has consideed augmenting existing ight-of-ways when equied with Pedestian Access, Dainage, and Geneal Utility Easements (PDU) instead of

3 TEM #07 3 ROW dedications, as unde the Municipal Code dedication of a PDU does not affect building setbacks; geneally a PDU povides the same function as ROW except that it can not be used fo paking o oadway. As an example, due to the poximity of cetain popeties to the specific plan aea and conflicts with the existing stuctues/impovements in the setback aeas, a modified steet section consisting of 40 feet of ight-of-way and 5 feet of Public Pedestian Access, Dainage, and Geneal Utility Easement (PDU) was conditioned on TPM as shown on Exhibit D. Geneally staff does not ecommend PDU s (except possibly to addess cone lot o simila issues) because they can t be used fo pak/oadway puposes and they ae geneally not eflected on Assesso s Pacel Maps which can ceate confusion fo popety ownes and lead to encoachments. Additionally, some may conside that they cicumvent the intent of Zoning setbacks. Howeve PDU s emain a tool available to Council. Unfotunately, if Council appoves a 50 foot wide typical coss section, it will be necessay to eithe deny the vacation equest, o appove it and etain a 5 foot PDU ove the vacated aea. Staff has included a Resolution o to summaily vacate 5 feet of the existing ight-of-way fo oad puposes along 85 West ason Steet, and to eseve a 5 foot Public Pedestian, Dainage, and Geneal Utility Easement ove the aea of vacation as Attachment with Exhibits A and B if Council wishes to gant the vacation equest and etain a PDU. FSCAL AD STAFF MPACTS: Thee ae no diect fiscal o staff impacts caused by this matte; pocessing costs have been paid by the applicant. Futue maintenance costs of West ason Steet will vay depending on the typical coss section chosen by Council and the associated facilities/constaints. RECOMMEDATO: Staff ecommends that City Council appove the typical coss section shown in Exhibit H fo West ason Steet and deny the vacation equest.
