6 In accodance with povisions of Sections and C.27 of the Los Angeles Municipal Code (LAMC), the Advisoy Agency appoved Vesting Tentative Tact No SL, located at 4321 and 4323 West Buns Avenue fo a maximum of six (6) lots, pusuant to the Small Lot Subdivision Odinance No. 176,354, as shown on evised map stamp-dated July 13, 2017 in the Hollywood Community Plan and Subaea A (Neighbohood Consevation) of the Vemont/Westen Station Neighbohood Aea Plan (SNAP) Specific Plan. This unit density is based on the RD1.5 Zone. (The subdivide is heeby advised that the LAMC may not pemit this maximum appoved density. Theefoe, veification should be obtained fom the Depatment of Building and Safety which will legally intepet the Zoning Code as it applies to this paticula popety.) The Advisoy Agency s appoval is subject to the following conditions: NOTE on cleaing conditions: When two o moe agencies must clea a condition, subdivide should follow the sequence indicated in the condition. That pio to ecodation of the final map, the Depatment of Building and Safety, Zoning Division shall cetify that no Building o Zoning Code violations exist on the subject site. LOS ANGELES UNIFIED SCHOOL DISTRICT (LAUSD) 8. That pio to the issuance of any demolition o gading pemit o any othe pemit allowing site pepaation and/o constuction activities on the site, satisfactoy aangements shall be made with the Los Angeles Unified School Distict. The poject site is located on the pedestian and bus outes fo students attending Lockwood Elementay School. Theefoe, the applicant shall make timely contact fo coodination to safeguad pedestians/motoists with the LAUSD Tanspotation Banch, phone no , and the pincipals o designees of Lockwood Elementay. (This condition may be cleaed by a witten communication fom the LAUSD Tanspotation Banch attesting to the equied coodination and/o the pincipals of the above efeenced schools and to the satisfaction of the Advisoy Agency.) DEPARTMENT OF WATER AND POWER 9. Satisfactoy aangements shall be made with the Los Angeles Depatment of Wate and

Upon compliance with these conditions and equiements, LADWP s Wate Sevices Oganization will fowad the necessay cleaances to the Bueau of Engineeing. (This condition shall be deemed cleaed at the time the City Enginee cleas Condition No. S-1 (c).) BUREAU OF SANITATION 10. Wastewate Collection Systems Division of the Bueau of Sanitation has inspected the sewe/stom dain lines seving the subject tact and found no potential poblems to thei stuctue o potential maintenance poblem, as stated in the memo dated Decembe 22, Upon compliance with its conditions and equiements, the Bueau of Sanitation, Wastewate Collection Systems Division will fowad the necessay cleaances to the Bueau of Engineeing. (This condition shall be deemed cleaed at the time the City Enginee cleas Condition No. S-1 (d).) INFORMATION TECHNOLOGY AGENCY 11. To assue that cable television facilities will be installed in the same manne as othe equied impovements, please cabletv.ita@lacity.og that povides an automated esponse with the instuctions on how to obtain the Cable TV cleaance. The automated esponse also povides the addess of thee people in case the applicant/owne has any additional questions. DEPARTMENT OF RECREATION AND PARKS 12. That the Quimby fee be based on the RD1.5 Zone. DEPARTMENT OF CITY PLANNING - SITE SPECIFIC CONDITIONS 13. Pio to the ecodation of the final map, the subdivide shall pepae and execute a Covenant and Ageement (Planning Depatment Geneal Fom CP-6770) in a manne satisfactoy to the Planning Depatment, binding the subdivide and all successos to the following: a. Limit the subdivision to a maximum of six (6) lots. b. Povide two (2) paking spaces in each dwelling unit fo a total of 12 automobile paking spaces fo six (6) dwelling units, and one (1) guest paking space that is accessible by guests of all units. The final tact map shall be evised to show the equied numbe of paking spaces, including guest paking. c. The height of the building shall be limited to feet. d. Note to City Zoning Enginee and Plan Check. The Advisoy Agency has eviewed and appoved the location(s) of the following item(s) as it applies to this subdivision and the poposed development on the site. i. The poject is pemitted a educed 18-foot common access stip open to the sky, all the way to the public steet.

A Community Maintenance Ageement shall be pepaed, composed of all popety ownes, to maintain all common aeas such as tees, landscaping, tash, paking, community diveway, walkways, monthly sevice fo pivate fie hydant (if equied), etc. Each owne and futue popety ownes shall automatically become paty to the ageement and shall be subject to a popotionate shae of the maintenance. The Community Maintenance Ageement shall be ecoded as a Covenant and Ageement to un with the land. The subdivide shall submit a copy of this Ageement, once ecoded, to the Planning Depatment fo placement in the tact file. Copies of all ecoded Covenant and Ageement(s) fo all ecipocal pivate easements shall be submitted to the Planning Depatment fo placement in the tact file. INDEMNIFICATION AND REIMBURSEMENT OF LITIGATION COSTS. Applicant shall do all of the following: (i) Defend, indemnify and hold hamless the City fom any and all actions against the City elating to o aising out of, in whole o in pat, the City s pocessing and appoval of this entitlement, including but not limited to, an action to attack, challenge, set aside, void o othewise modify o annul the appoval of the entitlement, the envionmental eview of the entitlement, o the appoval of subsequent pemit decisions, o to claim pesonal popety damage, including fom invese condemnation o any othe constitutional

(ii) (iii) (iv) (v) Reimbuse the City fo any and all costs incued in defense of an action elated to o aising out of, in whole o in pat, the City s pocessing and appoval of the entitlement, including but not limited to payment of all cout costs and attoney s fees, costs of any judgments o awads against the City (including an awad of attoney s fees), damages, and/o settlement costs. Submit an initial deposit fo the City s litigation costs to the City within 10 days notice of the City tendeing defense to the Applicant and equesting a deposit. The initial deposit shall be in an amount set by the City Attoney s Office, in its sole discetion, based on the natue and scope of action, but in no event shall the initial deposit be less than $50,000. The City s failue to notice o collect the deposit does not elieve the Applicant fom esponsibility to eimbuse the City pusuant to the equiement in paagaph ii. Submit supplemental deposits upon notice by the City. Supplemental deposits may be equied in an inceased amount fom the initial deposit if found necessay by the City to potect the City s inteests. The City s failue to notice o collect the deposit does not elieve the Applicant fom esponsibility to eimbuse the City pusuant to the equiement in paagaph ii. If the City detemines it necessay to potect the City s inteest, execute an indemnity and eimbusement ageement with the City unde tems consistent with the equiements of this condition. The City shall notify the applicant within a easonable peiod of time of its eceipt of any action and the City shall coopeate in the defense. If the City fails to notify the applicant of any claim, action, o poceeding in a easonable time, of if the City fails to easonably coopeate in the defense, the applicant shall not theeafte be esponsible to defend, indemnify o hold hamless the City. The City shall have the sole ight to choose its counsel, including the City Attoney s office o outside counsel. At its sole discetion, the City may paticipate at its own expense in the defense of any action, but such paticipation shall not elieve the applicant of any obligation imposed by this condition. In the event the Applicant fails to comply with this condition, in whole o in pat, the City may withdaw its defense of the action, void its appoval of the entitlement, o take any othe action. The City etains the ight to make all decisions with espect to its epesentations in any legal poceeding, including its inheent ight to abandon o settle litigation. Fo puposes of this condition, the following definitions apply: "City shall be defined to include the City, its agents, offices, boads, commissions, committees, employees, and voluntees. Action shall be defined to include suits, poceedings (including those held

13 VTT SL-1A C-8 unde altenative dispute esolution pocedues), claims, o lawsuits. Action includes actions, as defined heein, alleging failue to comply with any fedeal, state o local law. Nothing in the definitions included in this paagaph ae intended to limit the ights of the City o the obligations of the Applicant othewise ceated by this condition. 14. That the subdivide shall ecod and execute a Covenant and Ageement (Planning Depatment Geneal Fom CP-6974) that a Cetificate of Occupancy (tempoay o final) fo the building(s) shall not be issued until the final map has been ecoded. 15. That pio to the issuance of the building pemit o the ecodation of the final map, a copy of the DIR SPP-SPPA shall be submitted to the satisfaction of the Advisoy Agency. In the event that DIR SPP-SPPA is not appoved, the subdivide shall submit a tact modification. 16. Pio to the issuance of a building pemit, gading pemit and the ecodation of the final tact map, he subdivide shall ecod and execute a Covenant and Ageement to comply with the Vemont/Westen Station Neighbohood Aea Plan (SNAP) Specific Plan and Case No. DIR SPP-SPPA. Tenant Relocation Conditions 17. Within 10 days afte the expiation of the appeal peiod (and final action theeon), the applicant shall execute and ecod a Covenant and Ageement (Planning Depatment Geneal Fom CP-6770) in a fom satisfactoy to the Advisoy Agency binding the applicant and any successo in inteest to povide tenant elocation assistance and establish a elocation pogam in a manne consistent with Section of the Los Angeles Municipal Code elating to demolition. The applicant shall povide a copy of the Covenant and Ageement to each eligible tenant within five (5) days of ecodation of the Covenant and Ageement. 18. Within 10 days afte the time to appeal has expied, the applicant shall execute and ecod a Covenant and Ageement (Planning Depatment Geneal Fom CP-6770) in a fom satisfactoy to the Advisoy Agency binding the applicant and any successo in inteest to the affimative duty to abide by all povisions of the Ellis Act (Govenment Code 7060, et seq.) and of the Los Angeles Municipal Code. DEPARTMENT OF CITY PLANNING - STANDARD SINGLE-FAMILY CONDITIONS SF-1. That appoval of this tact constitutes appoval of model home uses, including a sales office and off-steet paking. If models ae constucted unde this tact appoval, the following conditions shall apply: 1. Pio to ecodation of the final map, the subdivide shall submit a plot plan fo appoval by the Development Sevices Cente of the Depatment of City Planning showing the location of the model dwellings, sales office and off-steet paking. The sales office must be within one of the model buildings. 2. All othe conditions applying to Model Dwellings unde Section A.10 and 11

The subdivide must make aangements fo the undegound installation of all new utility lines in confomance with Section N of the Los Angeles Municipal Code (LAMC). As pat of the Total Enegy Management Pogam of the Depatment of Wate and Powe, this nocost consultation sevice will be povided to the subdivide upon his equest.

18 FINDINGS As amended by the Aea Planning Commission on Apil 24, 2018 FINDINGS OF FACT (CEQA) The Deputy Advisoy detemined, based on the whole of the administative ecod, that the Poject is exempt fom CeQa pusuant to State CEQA Statutes and Guidelines, Section (Class 32) and thee is no substantial evidence demonstating that an exception to a categoical exemption pusuant to CEQA Guidelines, Section applies. Class 32 consists of pojects chaacteized as in-fill development meeting the following citeia: a. The poject is consistent with the applicable geneal plan designation and all applicable geneal plan policies as well as with the applicable zoning designation and egulations; b. The poposed development occus within city limits on a poject site of no moe than five aces substantially suounded by uban uses; c. The poject site has no value as habitat fo endangeed, ae o theatened species; d. Appoval of the poject would not esult in any significant effects elating to taffic, noise, ai quality, o wate quality; and e. The site can be adequately seved by all equied utilities and public sevices. The applicant is equesting a Vesting Tentative Tact Map fo the subdivision of one (1) pacel into six (6) small lots to constuct a thee-stoy, foot tall single-family dwelling with an attached two-ca gaage on each lot. The subject site is elatively level, 9,602 squae feet, o 0.22 aces, in size and wholly within the City of Los Angeles. The site is zoned RD1.5-1XL and has a Geneal Plan Land Use Designation of Low Medium II Residential. The site is also located within Subaea A (Neighbohood Consevation) of the Vemont/Westen Station Neighbohood Aea Plan (SNAP). As shown in the case file, the poject is consistent with applicable Hollywood Community Plan designation and policies, all applicable zoning designations and egulations, and Specific Plan povisions. The RD1.5 Zone allows 1,500 squae feet of lot aea pe each dwelling unit, which pemits a maximum of six (6) units on the site. The poject site is located in an ubanized aea, and all of the suounding popeties ae developed with single- and multi-family esidential developments, offices, commecial and etail stoes, suface paking lots, light industial buildings, and an elementay school. The site is cuently impoved with a duplex and has no value as a habitat fo endangeed, ae o theatened species. Thee ae five (5) non-potected tees on the site, which will be emoved as pat of the poposed poject. The poject will be subject to Regulatoy Compliance Measues (RCMs), which equie compliance with the City of Los Angeles Noise Odinance; pollutant dischage, dewateing, stomwate mitigations; and Best Management Pactices fo stomwate unoff. These RCMs will ensue the poject will not have significant impacts on noise and wate. The poject is beneath the theshold citeia established by LADOT fo pepaing a taffic study. Theefoe, the poject will

19 VTT SL-1A F-2 not have any significant impacts to taffic. The poject will not esult in significant impacts elated to ai quality because it falls below inteim ai theshold that wee developed by DCP staff based on CalEEMod model uns elying on easonable assumptions, consulting with AQMD staff, and suveying published ai quality studies fo which citeia ai pollutants did not exceed the established SCAQMD constuction and opeational thesholds. The poject site will be adequately seved by all public utilities and sevices given that the constuction of the poposed poject will be on a site which has been peviously developed and is consistent with the geneal plan. Theefoe, based on the facts heein, it can be found that the poject meets the qualifications of the Class 32 Categoical Exemption. Thee ae five (5) Exceptions which must be consideed in ode to find a poject exempt unde Class and 15332: (a) Cumulative Impacts; (b) Significant Effect; (c) Scenic Highways; (d) Hazadous Waste Sites; and (e) Histoical Resouces. Thee is not a succession of known pojects of the same type and in the same place as the subject poject. As mentioned, the poject poposes six (6) esidential units in an aea zoned and designated fo such development. The poposed poject is not unusual fo the vicinity of the subject site, and is simila in scope to othe existing low- and medium-density esidential developments in the aea. Thus, thee ae no unusual cicumstances which may lead to a significant effect on the envionment. The only state designated scenic highway in the City of Los Angeles is a potion of State Route 27 (Topanga Canyon Boulevad), which is located in the Canoga Pak, West Hills, Winnetka, and Woodland Hills aea, and theefoe the subject site is not designated as a state scenic highway, no ae thee any designated state scenic highways located nea the poject site. Futhemoe, accoding to Enviosto, the State of Califonia s database of Hazadous Waste Sites, neithe the subject site, no any site in the vicinity, is identified as a hazadous waste site. The applicant submitted a Histoic Resouce Repot, pepaed by Kaplan Chen Kaplan and dated Septembe 11, 2017, which has been eviewed by the Depatment of City Planning, Office of Histoic Resouces. The Repot veified that the existing building does not meet the citeia fo listing in the National Registe of Histoic Places, the Califonia Registe of Histoical Resouces o as a City of Los Angeles Histoic-Cultual Monument o as a contibuting building to any potential histoic distict. The subject building is not found to be a potential histoic esouce based on the City s HistoicPlacesLA website o SuveyLA, the citywide suvey of Los Angeles. Finally, the City does not choose to teat the site as a histoic esouce. Based on this, the poject will not esult in a substantial advese change to the significance of a histoic esouce and this exception does not apply. FINDINGS OF FACT (SUBDIVISION MAP ACT) In connection with the appoval of Vesting Tentative Tact No SL, the Advisoy Agency of the City of Los Angeles, pusuant to Sections , ,.61 and.63 of the State of Califonia Govenment Code (the Subdivision Map Act), makes the pescibed findings as follows: (a) THE PROPOSED MAP IS CONSISTENT WITH APPLICABLE GENERAL AND SPECIFIC PLANS. The adopted Hollywood Community Plan designates the subject popety fo Low Medium II Residential land uses with the coesponding zones of RD1.5 and R2. The Famewok Element encouages stability and enhancement of multi-family esidential neighbohoods

The subject popety is zoned RD1.5-1XL and is appoximately 9,602 squae feet in size. The applicant poposes a six-unit small lot subdivision on the site that is pemitted a maximum density of six (6) dwelling units in an aea that is chaacteized by mix of lowand medium-density esidential uses. The poject site is bound by Buns Avenue to the south, which is designated as a Local Steet by the Mobility Plan 2035, with a ight-of-way width of 60 feet, and oadway with of 36 feet. BOE is not equiing any steet dedication. The subject popety is also subject to Subaea A (Neighbohood Consevation) povisions in the Vemont/Westen Station Neighbohood Aea Plan (SNAP). The applicant filed a concuent case (DIR SPP-SPPA) fo the demolition of an existing duplex and the constuction of a six-unit esidential development. The appoval of the Vesting Tentative Tact Map is subject to the appoval of the concuent DIR Case, and the applicant is equied pe Conditions of Appoval to submit a copy of the Lette of Detemination fo the DIR Case pio to the issuance of the building pemit o the ecodation of the final map. In the event that the DIR case is not appoved, the applicant is equied to submit a tact modification. As such, the poposed six-unit small lot subdivision is substantially consistent with the applicable Geneal Plan and the SNAP Specific Plan, subject to the appoval of the Poject Pemit Compliance. (b) THE DESIGN OR IMPROVEMENT OF THE PROPOSED SUBDIVISION IS CONSISTENT WITH APPLICABLE GENERAL AND SPECIFIC PLANS. Pusuant to Section of the Subdivision Map Act, "design of a map efes to steet alignments, gades and widths; dainage and sanitay facilities and utilities, including alignments and gades theeof; location and size of all equied easements and ights-ofway; fie oads and fiebeaks; lot size and configuation; taffic access; gading; land to be dedicated fo pak and eceational puposes; and othe such specific physical equiements in the plan and configuation of the entie subdivision as may be necessay to ensue consistency with, o implementation of, the geneal plan o any applicable specific plan. The subject popety will be seved by an existing sanitay sewe adjoining the pacel. The applicant is equied to constuct necessay mainline and house connection sewes to seve the tact. The Bueau of Sanitation, Wastewate Collection System Division found no potential poblems to thei sewe and stom dain lines seving the subject aea. Additionally, no steet lighting impovements if no steet widening is equied pe BOE impovement conditions. Othewise, the applicant is equied to emove and einstall existing conduit behind new cub and gutte on Buns Avenue. The Bueau of Engineeing (BOE) has eviewed the poposed Vesting Tentative Tact Map and is equiing the applicant to emove and econstuct the entie sidewalk adjoining the tact including the landscaping aea with a five-foot concete sidewalk and landscaping of the pakway, and constuct the necessay on-site mainline sewes. The applicant is equied to submit a plot plan, showing applicable fie lanes, fie hydant, and distance fom the edge of the oadway o appoved fie lane to dwelling unit entances, to the Los Angeles Fie Depatment fo appoval.

Additionally, the poject is equied to povide and dimension the ecipocal pivate easement fo pedestian and diveway egess and ingess in the final map and povide necessay public access to the on-site easements. Futhemoe, the Los Angeles Depatment of Wate and Powe commented that this tact can be supplied with wate fom the municipal system and all equied wate mains have been installed. Theefoe, as conditioned, the design and impovement of the poposed subdivision ae consistent with the intent and pupose of the applicable Geneal Plan. (c) THE SITE IS PHYSICALLY SUITABLE FOR THE TYPE OF DEVELOPMENT. The poject site cuently consists of one pacel with a lot aea of 9,602 squae feet. The site is zoned RD1.5-1XL within the Hollywood Community Plan, which designates the site fo Low Medium II Residential land uses. The poject site is not located in any hazadous o geologically sensitive aeas, including Hillside Aea, Vey High Fie Hazad Seveity Zone, Flood Zone, Hazadous Waste/Bode Zone, Methane Hazad Site, Alquist-Piolo Fault Zone, Landslide Aea, Liquefaction Aea, Peliminay Fault Ruptue Study Aea, and Tsunami Inundation Zone. Additionally, although the poject site is located within the BOE Special Gading Aea, LADBS Gading Division eviewed the poposed poject and detemined that geology/soils epots ae not equied and the poject does not equie any gading o constuction of an engineeed etaining stuctue to emove potential geologic hazads. The suounding popeties ae developed with a mix of low- and lowmedium esidential uses. The poposed development of six (6) small lot homes is an allowed use on the site that is consistent with the geneal chaacte in the neighbohood. As such, the poject site is physically suitable fo the poposed type of development. (d) THE SITE IS PHYSICALLY SUITABLE FOR THE PROPOSED DENSITY OF DEVELOPMENT. The poject site is zoned RD1.5-1XL and designated fo Low Medium II Residential land uses, coesponding to the RD1.5 and RD2 Zones pe the Hollywood Community Plan Land Use Map. The RD1.5 Zone allows 1,500 squae feet of lot aea pe each dwelling unit, pemitting a maximum of six (6) units on the 9,602-squae-foot site. The applicant poposes a six-unit small lot subdivision, which is within the maximum allowable density. As peviously mentioned, the poject site is not located in any hazadous o geologically sensitive aeas, including Hillside Aea, Vey High Fie Hazad Seveity Zone, Flood Zone, Hazadous Waste/Bode Zone, Methane Hazad Site, Alquist-Piolo Fault Zone, Landslide Aea, Liquefaction Aea, Peliminay Fault Ruptue Study Aea, and Tsunami Inundation Zone. Additionally, although the poject site is located within the BOE Special Gading Aea, LADBS Gading Division eviewed the poposed poject and detemined that geology/soils epots ae not equied and the poject does not equie any gading o constuction of an engineeed etaining stuctue to emove potential geologic hazads. The poposed subdivision and subsequent impovements ae subject to the povisions of the Los Angeles Municipal Code (e.g., the Fie Code, Planning and Zoning Code, Health and Safety Code) and the Building Code. Othe health and safety elated equiements, as mandated by law, would apply whee applicable to ensue the public health and welfae (e.g., asbestos abatement, seismic safety, flood hazad management). The poject site is not located on a hazadous mateials site, floo hazad Thee ae no appaent health poblems that might be caused by the design o constuction of the poposed condominium units. The Bueau of Engineeing has epoted that existing sanitay sewe is available unde Buns Avenue adjoining the subdivision. This development is equied to be connected to the City s sewe system whee the sewage will be diected to the LA Hypeion Teatment Plant, which has been upgaded to meet State-wide ocean dischage standads. (g) THE DESIGN OF THE SUBDIVISION OR THE TYPE OF IMPROVEMENTS WILL NOT CONFLICT WITH EASEMENTS, ACQUIRED BY THE PUBLIC AT LARGE, FOR ACCESS THROUGH OR USE OF PROPERTY WITHIN THE PROPOSED SUBDIVISION. The poject site is a legally ecoded lot that is suounded by pivate popeties that adjoin impoved public steets and sidewalks designed and impoved fo the specific pupose of poviding public access thoughout the aea. The poject site does not adjoin o povide access to a public esouce, natual habitat, pak o any officially ecognized public aea that equies access though o within the poposed subdivision, and no such easements ae known to exist. Necessay public access fo oads and utilities will be acquied by the City pio to ecodation of the poposed map. Theefoe, the design of the subdivision and the poposed impovements would not conflict with easements acquied by the City pio to ecodation of the poposed map. (h) THE DESIGN OF THE PROPOSED SUBDIVISION SHALL PROVIDE, TO THE EXTENT FEASIBLE, FOR FUTURE PASSIVE OR NATURAL HEATING OR COOLING OPPORTUNITIES IN THE SUBDIVISION. (REF.
