Adopt Resolution No , entitled A Resolution of the Board of Directors of San Dieguito Water District Approving Quitclaim of Water Easement APN (Attachment 2); and 2. Authorize the General Manager to file a Quitclaim Deed of Public Water Easement (Attachment 3) SAN DIEGUITO WATER DISTRICT STRATEGIC PLAN: This item is not applicable to the Strategic Plan. FISCAL CONSIDERATIONS: There is no direct fiscal impact associated with the staff recommendation. BACKGROUND: The San Dieguito Irrigation District obtained water easements through the subject property, 2325 Cambridge Avenue in Cardiff, per a permanent easement of right of way recorded March 7, 1950 in Book 3529, Page 410 and October 20, 1950 in Book 3833, Page 79 of Official Records. The purpose of the easements was for waterline construction, operation and maintenance. In 1950, the District constructed a 30-inch transmission main within the granted easements. In May 2017, the District abandoned 1,750 LF of the 30-inch transmission main from the Cambridge Yard to the San Elijo Water Reclamation Facility located at 2695 Manchester Avenue. Kachina J. Krafchow, a married woman as her sole and separate property, is the owner of 2325 Cambridge Avenue. Whiz Builders Inc. and Champion Permits Inc., acting as agents for the owner, are requesting that the District Board of Directors quitclaim the easements if they are no longer needed by the District. With the completion of the 30-inch transmission main abandonment, the easements obtained in 1950 are no longer needed Item S8F 1 of 8
2 ANALYSIS: The District has completed the abandonment of the 30-inch transmission main. Staff has determined that the easements are not needed for any present or future use. Since the District originally acquired the easement at a minimal cost, District policy is that no fee will be charged for this quitclaim other than for staff time. A $500 fee has been paid by the owner s agent, Champion Permits Inc., to cover the cost of staff time for the quitclaim procedure. ENVIRONMENTAL CONSIDERATIONS: The action being considered by the District Board is exempt from the California Environmental Quality Act (CEQA) because it is not a "project" per Section 15378(b)(5) of the CEQA Guidelines. The action involves an organizational or administrative activity of government that will not result in the direct or indirect physical change in the environment. Krafchow, a Married Woman as her sole and separate property is the owner of the property located at 2325 Cambridge Avenue, Cardiff (APN ); and WHEREAS, said water easements were dedicated to the San Dieguito Irrigation District on March 7, 1950 in Book 3529, Page 410 and October 20, 1950 in Book 3833, Page 79 of Official Records; and WHEREAS, the San Dieguito Water District is successor in interest to the San Dieguito Irrigation District; and WHEREAS, the San Dieguito Water District has abandoned or removed said waterline in accordance with District standards within the property and the underlying property owner has accepted those facilities not removed; and WHEREAS, the easement is no longer necessary, and it is in the District s interest to quitclaim the easement to the underlying property owner; NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the San Dieguito Water District order as follows: 1. That the quitclaim deed be granted and is approved. 2. That the General Manager of the San Dieguito Water District is authorized and directed to execute the quitclaim deed on behalf of the District.
