That Oxfod County Council authoize the disposal of County owned suplus lands at Lots 5, and 6, Concession 5, Township of Nowich, shown as ts 1, 2, 3, 4, 5, and 6 on Refeence Plan 41R-8925 and in accodance with Repot PW (CS) And futhe that, the CAO be authoized to execute all ageements and documents elated theeto. 3. And futhe, that staff be authoized to advetise the sale of this land to the public and the intention of the County to enact a bylaw to declae the land suplus. 4. And futhe, that the Teasue be authoized to tansfe any net poceeds fom these tansactions to the Facilities Reseve. 5. And futhe, that Repot No. PW (CS) be eleased, with exception of Documents 3 and 4. REPORT HIGHLIGHTS To obtain appoval to dispose of suplus County owned lands. Implementation Points Following Council appoval, Staff will follow Oxfod County Policy 6.15 Disposal of Land Policy to dispose of lands declaed suplus at Lots 5, and 6, Concession 5, Township of Nowich. ge 1 of 3

2 Financial Impact This sale of land will have a mino net positive impact on the 2013 budget as this tansaction was not included in the pojected evenue. Net Revenues will be placed in the Facilities Reseve. The Teasue has eviewed this epot and agees with the financial impact infomation. Risks/Implications The poposed sale of the lands in question will emove legal issues that the County could face in the futue. Stategic Plan County Council adopted the County of Oxfod Stategic Plan at its egula meeting held Mach 27, The initiative contained within this epot suppots the values and stategic diections as set out in the Stategic Plan as it petains to the following Stategic Diections: 3. A County that Thinks Ahead and Wisely Shapes the Futue ii) Actively pomote the esponsible use of land and natual esouces. DISCUSSION Backgound Document 1 is an aeial photogaph of this aea with popety lines added. Document 2 is Refeence Plan 41R On August 30, 1996, the County of Oxfod puchased the efeenced popety fom the Canadian National Railway (CNR) Company. One of the pacels was descibed as PIN , which is undestood to be the widening fo the oiginal CNR ailway station at Nowich, togethe with the laneway fom Nowich Road to the fome station popety. These ae the lands poposed fo sale. The County does not equie these lands fo any futue use. ge 2 of 3

The emainde of this epot can be eleased to the public afte the ecommendations have been adopted by Council. t 7 of Plan 41R-8925 is a oad widening fo County Road 18. This pacel will be dedicated as oad allowance by a bylaw in the nea futue along with othe pacels obtained fo oad widening s. Conclusions This situation is vey complicated fom a legal pespective. This poposal will dispose of suplus popeties and povide legal access fo existing popeties. Staff ecommends poceeding with the disposal of the suplus popety.
