1 THE CORPORATION OF THE UNITED TOWNSHIPS OF DYSART, DUDLEY, HARCOURT, GUILFORD, HARBURN BRUTON, HAVELOCK, EYRE AND CLYDE BY-LAW NO BEING A BY-LAW TO AMEND ZONING BY-LAW , AS AMENDED (General Housekeeping Amendment to Comprehensive Zoning By-law) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.p.13 authorizes the Council of a municipality to pass Zoning By-laws for the purpose of land use controls. AND WHEREAS the Council of the Corporation of the United Townships of Dysart et al now wishes to amend Comprehensive Zoning By-law , as amended, to ensure that the planning policies of the Municipality are current and address the needs of the community. AND WHEREAS a public meeting was held on March 2nd, 2015 pursuant to Section 34(12) of the Planning Act, R.S.O. 1990, c.p.13. AND WHEREAS the Council of the Corporation of the United Townships of Dysart et al deems it advisable to amend By-law No , as amended. NOW THEREFORE the Council of the Corporation of the United Townships of Dysart et al enacts as follows: 1. Section 2 Definitions, is amended as follows: (a) Subsection 2.5 Average Finished Grade: delete this subsection in its entirety and add the following: "2.5 Average Finished Grade The average level of the proposed or finished ground adjoining a building or structure on all exterior walls." (b) Subsection 2.25 Dwelling : at the end of the subsection, after the words " quonset hut " add the words " or other corrugated steel structure, a shipping container, a freight container, a transport truck trailer." (c) Subsection 2.59 High Water Mark: after the words " water body as shown on a " add the word: " current ". (d) Subsection 2.61 Home Industry: (i) after the words: " conducted within one or more accessory buildings..." add the words: "that is a gainful occupation or profession." (ii) after the words: " A home industry does not include " add the words " a bed and breakfast establishment " (e) Subsection 2.87 Marina: after the words " A marina may include a marine facility " add the words: " and a gasoline/propane retail facility." (f) Subsection Non-Complying Legal: to (a) after the words "..the lot is noncomplying " add the words: " but it complied with the applicable Zoning By-law when it was created or it was created before July 11 th, 1977". 2 2. Section 3 General Provisions, is amended as follows: (a) Subsection 3.7 Encroachments into Setbacks: (i) To (a) following the words " decks that attached to " add the word: " main ". (ii) To (a) following the words " abuts an interior side lot line " add the words: " or unless the building is less than 10 metres from a high water mark". (b) Subsection 3.19(a)(v) Non-Complying Structures and Lots: after the words " encroachment by a main building within a minimum setback area " add the words "including any deck attached to a main building " (c) Subsection 3.19(e) Alterations to Lots Causing Structures to be Non-Complying: at the end of this section, add the following subsection: "(iii) a conveyance to enable a public use or street." (d) Subsection 3.25 Quonset Hut: after the words "A quonset hut..." add the following words: " or other corrugated steel structure, which is greater than 10 sq. metres in area, " 3. Section 5 Residential Zones, is amended as follows: (a) Table 5.1 Permitted Uses: amend the permitted Residential uses as follows: - Rural Residential (RR) zone add: - duplex dwelling - semi-detached dwelling - Suburban Residential (RS) zone add: - duplex dwelling - semi-detached dwelling - Residential Type 1 (R1) zone add: - duplex dwelling - semi-detached dwelling - Residential Type 2 (R2) zone add: - duplex dwelling - semi-detached dwelling (b) Table 5.1 Permitted Uses: amend the permitted Non-residential uses as follows: - Rural Residential (RR) zone add: - hobby farm (c) Table 5.2 Zone Provisions: amend the zone provisions as follows (i) Lot area minimum. amend as follows: - Waterfront Residential 3 (WR3): delete 2785 m 2 and add 4000 m 2 - Waterfront Residential 3L (WR3L): delete 2785 m 2 and add 4000 m 2 - Waterfront Residential 4 (): delete 2785 m 2 and add 4000 m 2 - Waterfront Residential 4L (L): delete 2785 m 2 and add 4000 m 2 (ii) Total accessory buildings per lot, maximum: to the WR1, WR2, WR3, WR3L,, L, WR5, WR5L, WR6, WR6L and RR zones add a new footnote as follows: - "(aa)" - to the "Notes" add a new footnote above (a): "(aa) plus 1 one-storey building less than 10 sq. metres in area." (iii) Main building, maximum gross floor area of any storey: for the WR1, WR2, WR3, WR3L,, L, WR5, WR5L, WR6, WR6L zones: delete "280 m 2 " and add "372 m 2 ". Page 2 of 5

Section 9 Rural Zones, is amended as follows: (a) Table 9.1 Permitted Uses: amend the permitted Residential uses as follows: - Rural Type 1 () zone add: - duplex dwelling - semi-detached dwelling - Rural Type 2 (RU2) zone add: - duplex dwelling - semi-detached dwelling 5. Schedule A, Map 1 is amended by changing the zone symbol on the following properties as shown on Schedule A-1, attached hereto: (a) Part Lots 10 and 11, Concession 8, geographic Township of Dysart (Peninsula Road): zone change from WR2 to RS for the following Roll Numbers: Schedule A, Map 3 is amended by changing the zone symbol on the following properties as shown on Schedules A-2, A-3, A-4 and A-5, attached hereto: (a) Part Lots 17 and 18, Concessions 4 and 5, geographic Township of Guilford (Cranberry Lake Road): zone change from to L for the following Roll Numbers: (b) Island in Part Lots 4 and 5, Concession 12, geographic Township of Guilford (Lipsy Lake) in front of Roll Number : zone change from to OS.
