2 Dysart et al Planning Public Meeting Monday, May 1, 2017 The following is a report of the Dysart Public Meeting Committee on a public meeting which was held pursuant to Section 34(12) of the Planning Act, to discuss two proposed site specific amendments to the Municipality's Comprehensive Zoning By-law. The public meeting was held in the Dysart et al Council Chambers at Municipal Office in Haliburton on Monday, May 1, 2017, commencing at 5:00 pm. The proposed by-law will change the zone on the subject lands from the RU1 and the RR zones to the RU2, RU2-x, RU2-xx and OS zones. This will recognize that the proposed lots are backlots to the waterfront lots on Pine Lake. The by-law establishes appropriate frontage and area criteria for backlots. It also recognizes that part of the westerly lot is within 500 metres of the West Guilford waste disposal site. It restricts residential uses on the lot within 500 metre of the waste disposal site. The Committee reviewed the Planning Report, dated April 26th, 2017 and discussed the proposal. Page 3 of 47

4 The Secretary briefly outlined the proposal and the notification process. She advised the Committee that the Municipality has not received any written or verbal comments on the application. The County reviewed this proposal as part of the severance application and have no concerns. The Chair asked the agent for the owner if he had any comments. Mr. Bishop answered that staff had summarized the file well and he was available to answer questions. The Chair then asked if there was anyone else in attendance who want to comment. Ms. Carol Bateman introduced herself as a neighbour and asked for clarification on the implications on the zone. In particular, she asked for assurances that the by-law would only permit one residence. The Chair confirmed that it does. The Chair then asked the Committee if they had any questions or comments about the application. They did not. At the conclusion of the Public Meeting, the Committee recommended that Council pass the proposed zoning by-law amendment. This property was formerly the site of a gym. The Church plans to renovate this building for use as the church. There is an existing dwelling on the subject lands that will become the manse. This file was discussed at the meeting of April 3rd, The file was deferred so the proponent could submit a site plan for the property. This plan has now been submitted. The Committee reviewed the Planning Report, dated April 26th, 2017 and discussed the proposal. The Secretary briefly outlined the background and status of the proposal. She summarized the comments that had been received by the Committee at the last meeting. She noted that the Municipality received four additional submissions since the last meeting, including a petition from the neighborhood. The Secretary reviewed these submissions. The Municipality also received comments from the Ministry of Transportation, requesting a traffic brief. The Director of Public Works submitted comments on the site plan noting that "he is satisfied that drainage and parking will be contained on site". The Committee received copies of all correspondence. The Chair then asked the applicant if he had any comments. Jamie McMahon, Assistant Pastor and agent for the file, noted that the site plan is complete and demonstrates that up to 50 parking spaces can be accommodated on site. This is more than the number of spaces required by the Zoning by-law for this use. The Zoning By-law requires 35 spaces. He noted that they will be modifying the driveway entrance to address the drainage issues. Page 5 of 47

6 In response to a concern that had been raised, the Chair asked Mr. McMahon if buses could be accommodated on site. Mr. McMahon noted that they will not have buses. Mr. Bishop noted that with a minor change to the site plan, buses can be accommodated on site if necessary. The Chair then asked if there was anyone else in attendance who wanted to speak. Janis Lewis, noted that she owns two properties that are adjacent to the subject lands. She asked whether any trees will be removed. She is concerned that with such a large parking lot, her property will not be properly screened from the Church. She feels that there will be more traffic than when the gym operated. She is concerned about light pollution. She is also concerned about noise from cars, increased people and noise and activity from summer camps. She noted that when the gym operated, it could get quite noisy when the doors and windows were open. She is concerned that the Church will impact her privacy. She asked whether a fence will be constructed to give her some privacy. She is concerned about the resale value of her property. She is of the opinion that the use is not in keeping with the Official Plan. Mr. McMahon confirmed that no trees will be removed. They will remove the existing rock garden, where the Millennium Gym sign was located. The Chair noted that there are trees on the 66' unopened road allowance for Pine Ave, which will screen the parking in this location. Mark Dennys noted that water drains off the property and crosses the road to the Carey property. This becomes icy in the winter. He asked about the status of the septic system. The Chair answered that this will be reviewed with the required Change of Use Permit required for the interior renovations. The Planner noted that she site inspected the property with the Director of Public Works today in the heavy rain. The ditch line carries water from all properties to the east of the subject lands. It then crosses the road, through a culvert, at the edge of the Stevens' driveway. Some water from the Steven property was running across the road, but the Director of Public Works was confident that proper ditching on the driveway will direct the water to the ditch line as appropriate. Mr. Bishop confirmed that the site plan ensures proper drainage. Olya Healy introduced herself as the neighbour to the north. She is concerned about garbage coming from the church property and asked if the owners will consider constructing a fence. She is also concerned about the extra car traffic and pedestrian safety. The speed limit of 50 km/hr is too fast. She noted that this is a quiet, residential neighbourhood. She is particularly concerned about buses for summer camps. She would like the school bus to come up Harmony Road. Mr. McMahon answered saying that they had no plans to build a fence but if necessary, will consider it. He noted that there are no garbage issues at the current location and Page 6 of 47

7 does not expect that to change. He also noted that if the number of parking spaces is a concern, they do not have to build all 50 spaces. Mike Landry spoke next. He is concerned about the intersection with Hwy 118 and asked about the status of the traffic brief. He was advised that it was in the process of being reviewed by MTO staff. Mr. McMahon noted that the visibility issue at the intersection is a problem with highway design and not because of this particular use. Mark Dennys asked how the Municipality will protect the pedestrian traffic on the "Head Lake Trail". He also expressed his concern for the storage of snow. He noted that the college loses 2/3rds of its parking lot to snow storage. He noted that he is also concerned about traffic. The Chair confirmed that no sidewalk is planned for Harmony Road. Ken Stevens, owner of the subject lands, noted that he operated the gym for several years. The gym had a membership of 100 to 150 members and was open from 6:00 a.m. to 9:00 pm. They held regular fitness classes. He noted that the church will have less impact. He confirmed that they have parking for 25 to 30 cars now and plow the parking lot. Doug Ross, Pastor for the Church, noted that his church has been in operation for 68 years. In answer to a question, he confirmed that they do not engage in fund raising events because it is contrary to their beliefs. They do have two bible study groups during the week. These groups include no more than 10 people. He doesn't think that traffic will be an issue. They do not use school buses. This is a small church. They have a congregation of about 50 people and are planning to renovate the building to accommodate a maximum of 140 people. If they outgrow the building in the future, they will look for another property. He stressed that they want to be good neighbours. Evening services are held only at Christmas and New Years. Noise will be contained inside the building. In answer to a question about why they want to re-locate into the neighbourhood, Pastor Ross answered that the size of the property suits their needs, the building exists for the church, there is a nice house and it is located in a nice pastoral neighbourhood. He noted that 90% of the time, this will be just a residential property for his family. The church will be used only 10% of the time. The swimming pool will be used by his family. It will not be open to the public and it will be properly insured. Cathy Lewis-Lloyd asked about the basement apartment. The Planner noted that, similar to all R1 properties, a duplex or semi-detached dwelling is a permitted use. Ms. Lewis-Lloyd asked what assurances will be in place to ensure that the building is not expanded. The Planner noted that a restriction on the gross floor area can be added to the by-law. Ms. Lewis-Lloyd noted that she once lived beside a church and it was quite noisy. Page 7 of 47

8 Mike Landry asked about snow removal. He noted that in the past, snow has been stored on the turn-around for Harmony Road. It builds up, gets icy and affects visibility. Pastor Ross confirmed that they will store snow on-site and not on the road allowance. Mr. Bishop added that they can amend the site plan to expand the parking area to accommodate more snow storage. In answer to questions about parking and the impact of a large parking area, the Chair asked whether the parking should be reduced to the 35 spaces required by the Zoning By-law. In answer to comments about the impact of lighting, the Planner asked Mr. McMahon what type of lighting is proposed. He confirmed that there will only be one yard light. This light exists now. It was suggested that this be fitted with a full cut-off luminaire. Lighting on the building should be minimal. The Chair then asked the Committee if they had any questions or comments about the application. Ms. Wood-Roberts noted that the Committee is responsible for considering all information presented on the application and will base their decision on planning principles. At the conclusion of the Public Meeting, the Committee passed the following resolution. The Committee will review the file once again, once the required traffic brief is available to address the questions posed by the Ministry of Transportation. (Ref. The Heart of the Highlands To: Public Meeting Committee From: Patricia Martin, Director of Planning and Development Date: May 30th, 2017 Re: Zoning By-law Amendment Application Lands of Stevens Roll No.: Lot 17, Concession 9 Geographic Township of Dysart RECOMMENDATION: To fully address the issue of compatibility, staff recommend the following addition information be provided by the applicants before a decision is made on the application: - comments from the Ministry of Transportation on the traffic brief required for the intersection of Harmony Road and Highway 118, including their requirements for improvements to the intersection; and - information from a traffic engineer to assess the impact of the Church to traffic on Harmony Road. This report is to address whether additional road improvements are required to address the traffic generated by the Church with the current membership of 50 people and the traffic generated with the anticipated membership of 140 people. STATUS: The public meeting for this file was scheduled for April 3 rd, The Public Meeting Committee deferred their decision on the file so they could review the site plan that was being prepared for the property. The file was returned to the May 1 st meeting of the Public Meeting Committee. The site plan was submitted and was available for the Committee to review. The site plan was also provided to several residents of the neighbourhood and to all those in attendance at the May 1 st public meeting. The Committee deferred their decision on the file once again for comments from MTO. MTO has provided comments but has requested that a traffic brief be prepared. Their comments are attached to this report. PLANNING REPORT: (1) Background: The owners have entered into an agreement of purchase and sale with the Lighthouse Pentecostal Church. The Church plans to renovate the former "gym" building and use it for their church. The existing dwelling will become the manse. ZBA: Stevens Page 1 of 4 Page 10 of 47

11 The agent for the file has provided the following background information for the project: - No additional buildings are planned. The existing dwelling will become the manse and the pastor and his family will live on-site. The existing accessory building (former gym) will become the church. They will renovate the inside of this building to accommodate the main meeting and fellowship room and three small rooms for Sunday school. They have spoken to the Building Department about a change of use permit. - The Church currently has a congregation of 50 people. - They will plan seating for 140 people. - They will plan a parking lot with 50 parking spaces (to accommodate the projected 140 people). There is a stop sign for cars exiting the property. Parking will not overflow onto the street. - Key traffic/activity times include: - Sunday morning: car, based upon 100 people (currently the congregation is 50 people). - Tuesday morning: 5-6 cars. - Wednesday evening: 5-6 cars. - Friday evening: 7-10 cars. - Funerals: 2 last year. - Weddings: rarely. The Director of Public Works advises that Harmony Road can accommodate the anticipated traffic volume. The most recent survey was recorded in June cars per day were noted. This is a Class 5 road. With the additional cars anticipated by this development, the status of the road is not changed. He has reviewed the site plan he advises that he does not have any concerns about the driveway or about drainage, if the driveway is constructed according to the site plan. He has requested an entrance permit. MTO has provided initial comments on the project and have requested a traffic brief for the intersection at Harmony Road. The applicant hired Greg Bishop to prepare a site plan for the property. This plan is attached to this report. (2) Site Description: Staff have visited the property. The driveway entrance rises gently to a plateau, which is occupied by the existing buildings. The portion of the property occupied by the house, the former gym building and parking area is flat. It is developed as a residential property. The property has been cleared around the existing residence, former gym and pool. (a) Lot Dimensions: Frontage: Area: 44+ m (145+ ft) 1.9+ ha (4.75+ ac) (b) Existing Development: single family dwelling (first assessed in 1980) accessory building former gym (B.P , ) a frame garage and two smaller accessory buildings. (c) Frontage: Hwy 118. (d) Access: Harmony Road. (e) Servicing: two septic systems (one servicing the dwelling and one servicing the gym) and a shared drilled well. 12 (f) Road Allowance: the Dysart Roads Department has provided comments on the site plan and has requested an entrance permit to ensure the proper construction of the driveway entrance. (3) Provincial Policy (a) Conformity: Yes, subject to the comments of MTO. (b) Applicable Policies: Policy Settlement Areas Policy Sewage, Water and Stormwater Policy 2.1 Natural Heritage (c) Comments: All buildings exist now. The existing gym will be converted to the church. MTO has requested a traffic brief and if warranted, will required the construction of a left hand turn lane at Harmony Road. (4) Dysart Official Plan: Residential Areas (a) Conformity: Generally yes, subject to the additional information required to assess traffic. (b) Applicable Policies: Section Quantities Section Promotion of Liveable Settlements Section Water Supply and Sewage Disposal Other Areas Section 4.6 Site Conditions - Lot Shape and Size Section 4.7 Road Access Section 5 Resource Protection Section 7 Residential Areas Section Non-Residential permitted Uses (c) Comments: The following sections of the Official Plan apply: Section and Section 7: The lot does not comply with the lot frontage required by Section However, it is an existing lot, which has been used for residential purposes for many years. Section 1.6.1, which gives some flexibility to the interpretation of the figures and quantities in the Plan, applies. Section recognizes places of worship as a permitted use in Residential Areas. It notes that such uses should be compatible with the surrounding residential uses. Neighbours have expressed a concern for traffic. The following applies: - The buildings exist. No new construction is proposed. - The property is separated from neighbouring residential properties on the north and east lot lines by a 66 foot municipal road allowance. Both road allowances remain in a natural state. The west lot line is Highway 118, but this part of the property is a wetland and restricted from any structural development. Access from Highway 118 is not possible. The south lot line rises steeply and is not suited to development. Development to the south (ie. on Dome Street) is approximately 100 metres away and is at a much higher elevation. It is buffered by this difference in elevation. - No additional lighting is proposed beyond the one yard light installed for the former gym and the coach lights that exist on the building. - The busy time at the church is restricted to Sunday morning. Activities at the church throughout the week are limited and the property will function as a residential use. Technical information (a traffic report) will help confirm compatibility. In order to fully assess compatibility, staff recommend that the applicants submit an analysis of the traffic generated by the Church with its current membership and the traffic ZBA: Stevens Page 3 of 4 Page 12 of 47

13 generated by the Church if it expands to the projected 140 members. This report is to be prepared by a qualified traffic engineer. (5) Zone Category: (a) Existing Zone: Rural Residential (RR) and Environmental Protection (EP) (b) Requested Zone: Residential Type 1-xx Exception (R1-xx) and Environmental Protection (EP) (c) Compliance: The subject lands will comply with the lot area, building setbacks and the permitted uses of the R1 zone. Site specific zone provisions are required to recognize the existing lot frontage, the number of accessory buildings and the parking space setback. The EP zone is not changed by the Zoning By-law. (6) Notification and Circulation: Notice of the requested zoning by-law amendment application was circulated to all persons and agencies required by regulation on March 7th, The required advertisement was placed in the local newspaper. Several people attended the April 3rd public meeting and the May 1st public meeting to express their concerns. Generally, neighbours are concerned about increased traffic, car speed, pedestrian safety and overflow parking on Harmony Road. The Director of Public Works advises that Harmony Road can accommodate the anticipated traffic volume. He reviewed the site plan and advises that as long as the terms of the site plan are implemented, he has no concerns about the drainage and the entrance. The owners must apply for an entrance permit to ensure the proper construction of the entrance. The Ministry of Transportation has submitted preliminary comments about the intersection with Harmony road. They advise that they require a traffic brief/statement to address sight lines on Highway 118 and the requirement for a left hand turn lane. The record of public comment is attached to this report. SUMMARY: The subject lands are currently zoned for rural residential purposes. The owner has an offer of purchase and sale from the Lighthouse Pentecostal Church. The zoning by-law amendment application will permit the church use. Neighbours are concerned about traffic, car speed, safety and street parking. The Director of Public Works confirms that Harmony Road can accommodate the anticipated volume of traffic. He has reviewed the site plan and advises that he has no concerns about the driveway or drainage, if constructed according to the plans. He has requested an entrance permit. MTO has requested a traffic brief to determine if improvements are necessary for the intersection of Harmony road and Highway 118. Additional traffic information, from a traffic engineer, is required to confirm the impact of the Church to the traffic on Harmony Road (both with the current membership of the church and the anticipated membership). FINANCIAL IMPLICATIONS: there are no financial implications. 14 PURPOSE AND EFFECT OF PROPOSED BY-LAW Applicant: Civic Address: Sandra and Ken Stevens 94 Harmony Road An application has been submitted by Sandra and Ken Stevens to rezone their property in Part Lot 17, Concession 9, in the geographic Township of Dysart, in the Municipality of Dysart et al. This property is located in the village of Haliburton at 94 Harmony Road. Present Zoning: Rural Residential (RR) and Environmental Protection (EP) Requested Zoning: Residential Type 1-xx (R1-xx) and Environmental Protection (EP) The proposed by-law will change the zone on part of the subject lands to R1-xx to recognize the existing residential use and permit a place of worship (a church). Site specific zone provisions are added to recognize that the lot does not comply with the current lot frontage criteria for the R1 zone. The lot is an existing lot and the dimensions are not being changed. Three accessory buildings are permitted. The EP zone is not changed by this by-law. The lands are designated Residential Areas in the Official Plan of the Municipality of Dysart et al. The proposal is consistent with Provincial Policy and conforms to the provisions of the Official Plan, subject to the requirements of the Ministry of Transportation. Page 14 of 47

15 THE CORPORATION OF THE UNITED TOWNSHIPS OF DYSART, DUDLEY, HARCOURT, GUILFORD, HARBURN, BRUTON, HAVELOCK, EYRE AND CLYDE BY-LAW NO xx BEING A BY-LAW TO AMEND ZONING BY-LAW (Lands of Stevens) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.p.13 authorizes the Council of a municipality to pass Zoning By-laws for the purpose of land use controls. AND WHEREAS the Council of the Corporation of the United Townships of Dysart et al has received a complete application to amend Zoning By-law , as amended. AND WHEREAS a public meeting was held on April 3rd, 2017 pursuant to Section 34(12) of the Planning Act, R.S.O. 1990, c.p.13. AND WHEREAS the Council of the Corporation of the United Townships of Dysart et al deems it advisable to amend By-law No , as amended. NOW THEREFORE the Council of the Corporation of the United Townships of Dysart et al enacts the following as a by-law: 1. Schedule "A", Map 1 of By-law , as amended, is hereby further amended by changing the zone symbol on Part Lot 17, Concession 9, in the geographic Township of Dysart from "RR" (the Rural Residential zone) to "R1-xx" (the Urban Residential Type 1-xx Exception zone) as shown on Schedule "A", attached hereto, and forming part of this By-law. The existing EP zone is not changed by this by-law. 2. Section to By-law , as amended, is hereby further amended by the addition of the following subsections: R1-xx Exception Zone (By-law 2017-xx) Despite any provision to the contrary of Section 5, or any other provision of this By-law, within the R1-xx Exception Zone, the following provisions shall apply: (a) Permitted uses: All uses permitted by the R1 Zone. (b) Zone Provisions: Lot frontage minimum: 44 metres Total accessory buildings per lot, maximum: 3 Parking space setback from a street line, minimum: 1 metre All zone provisions applicable to the R1 Zone. (c) All other provisions of this By-law as applicable to the R1 Zone shall apply. 2/ Page 15 of 47

16 This By-law shall come into force on the date of final passing if no notice of appeal is filed with the Clerk within 20 days of the giving of notice of passage of this By-law. If a notice is filed with the Clerk, the By-law shall only come into force according to the provisions of Section 34(30) of The Planning Act, R.S.O. 1990, Chapter P.13, as amended.
