1 BY-LAW No EXPLANATORY NOTE Purpose and Effect of e By-law The Council of e Township of Nor Dundas has initiated a house keeping amendment to rezone multiple properties in e former Township of Winchester Zoning By-law 12-93, e former Township of Mountain Zoning By-law 79-6 and e former Village of Winchester Zoning By-law as conditions of severances, as well as amend e respective by-laws to clarify definitions and harmonize e by-laws to make em consistent. This amendment will rezone multiple properties as conditions of consent. The majority of properties effected by is By-law are properties (surplus dwellings) at were severed as a result of farm consolidation under e Provincial Policy Statement and e United Counties of Stormont, Dundas and Glengarry Official Plan. This By-law will prohibit residential dwellings from being constructed on e remaining prime agricultural land. This By-law will also clarify definitions and harmonize e by-laws to make em consistent and in regard to building height, mobile homes and modular homes as well as increase minimum lot size requirements in e former Township of Mountain s Rural (RU) zone. Furermore, e By-law will address e serviced commercial area wiin e former Township of Winchester. Amendments to e former Village of Winchester s By-law will add definitions for triplex and fourplex dwelling units and clarify e Residential Type Three (R3) zone to bring it into conformity wi e former Village of Chesterville s Zoning By-law. Key maps are provided at detail e properties at are to be rezoned as a condition of consent as well as individual properties to be rezoned at are not e subject of consent. Schedules are also attached at detail e properties effected by consent, inclusive of consent file number, location and e nature of rezoning. This By-law is deemed to be in conformity wi e policies contained in e United Counties of Stormont, Dundas and Glengarry Official Plan and e Provincial Policy Statement. A majority of e properties to which is By-law applies were e subject of consent as detailed in e appropriate schedules. Township of Nor Dundas

2 THE CORPORATION OF THE TOWNSHIP OF NORTH DUNDAS BY-LAW NUMBER Being a By-law to Amend e Former Township of Winchester By-law 12-93, Former Township of Mountain By-law 79-6 and Former Village of Winchester By-law as Amended WHEREAS pursuant to e provisions of e Planning Act, R.S.O., 1990 Section 34 as amended, e Council of a Municipality may enact by-laws regulating e use of lands and e erection of buildings ereon; AND WHEREAS By-law as amended regulates e use of land and e use and erection of buildings and structures wiin e former Township of Winchester, now e Township of Nor Dundas; AND WHEREAS By-law 79-6 as amended regulates e use of land and e use and erection of buildings and structures wiin e former Township of Mountain, now e Township of Nor Dundas; AND WHEREAS By-law as amended regulates e use of land and e use and erection of buildings and structures wiin e former Village of Winchester, now e Township of Nor Dundas; AND WHEREAS e Council of The Corporation of e Township of Nor Dundas deems it expedient and advisable to amend certain requirements of By-law 12-93, By-law 79-6 and By-law as amended; insofar as ey relate to certain lands to which e said By-laws apply; AND WHEREAS e matters set out in is by-law are deemed to be in conformity wi e Official Plan of e United Counties of Stormont, Dundas and Glengarry; NOW THEREFORE e Council of The Corporation of e Township of Nor Dundas enacts as follows: FORMER TOWNSHIP OF WINCHESTER 1.0 That (e former Township of Winchester) By-law 12-93, as amended, is hereby amended as follows: 1.1 That subsection 6.1(b) Commercial Zone - Zone Requirements of By-law is hereby amended by inserting e following new subsection immediately after e contents ereof: (a) 6.1(b) Commercial Zone Requirements (iii) Fully Serviced Area (Municipal Water and Sanitary Sewer) Lot Area (minimum) 2 2,023 m 21,775 sq ft Lot Frontage (minimum) 30 m 98.4 ft Yard Requirements (minimum) Front 6 m 19.7 ft Rear Nil Except where e yard abuts a lot in a Residential or Institutional zone, e minimum yard shall be 3 m (9.84 ft) Exterior Side 6 m 19.7 ft Interior Side Nil Except where e yard abuts a lot in a Residential or Institutional zone, e minimum yard shall be 3 m (9.84 ft) Building Height (Maximum) 14 m 45.9 ft Lot Coverage (Maximum) 45% Dwelling Units Per Lot (Maximum) 1.../1

An existing dwelling on anoer lot or a new dwelling on anoer lot having an area greater an 1 ha (2.47 acres) Livestock barn or manure storage area and/or feedlot: 30 metres (100 ft) A well on a neighbouring property 1.3 That subsection 12.1(c) Agricultural Zone - Special Exception" of By-law 12-93, is hereby amended by inserting e following new subsection immediately after e contents ereof: (a) 12.1(c)(xxxvi) Agricultural Zone - Special Exception Thirty-Six (AG-36) Notwistanding e provisions of Section 12.1(a) hereof to e contrary, on lands zoned AG-36", e following residential uses shall not be permitted: a) Accessory dwelling b) Apartment, Accessory c) Rural Home Occupation d) Single Dwelling e) Mobile Home as a temporary accessory dwelling for farm employees or retiring farmer. (b) That e areas legally defined in Schedule 1 and shown on Schedule 2 shall hencefor be zoned Agricultural - Special Exception Thirty-Six (AG-36) zone and cease to be zoned Agricultural (AG). 1.4 That subsection 12.1(c) Agricultural Zone - Special Exception" of By-law 12-93, is hereby amended by inserting e following new subsection immediately after e contents ereof: (a) 12.1(c)(xxxvii) Agricultural Zone - Special Exception Thirty-Seven (AG-37) Notwistanding e provisions of Section 12.1 hereof to e contrary, on lands zoned AG-37", no more an one dwelling unit is permitted and e following uses shall not be permitted: a) Accessory Dwelling b) Mobile Home as a temporary accessory dwelling for farm employees or retiring farmer. (b) That e area legally defined as Part of Lot 1, Concession 10, former Township of Winchester, being Part 1 on RP8R4412 shall hencefor be zoned Agricultural - Special Exception Thirty Seven (AG-37) and shall cease to be zoned Agricultural (AG) zone as shown on Schedule 3..../2

(b) That e area legally defined as Part of Lot 19, Concession 4, former Township of Winchester, being Parts 1, 2 & 3 on RP8R3357 shall hencefor be zoned Agricultural - Special Exception Thirty-Eight (AG-38) and shall cease to be zoned Agricultural (AG) zone as shown on Schedule That e area legally defined as Part of Lot 20, Concession 2, former Township of Winchester, being Part 1 on Registered Plan 8R5089 shall hencefor be zoned Industrial (M) zone and shall cease to be zoned Agricultural (AG) zone, as shown on Schedule That a portion of e area legally defined as Part of Lot 3, Concession 5, former Township of Winchester, shall hencefor be zoned Industrial (M) zone and shall cease to be zoned Agricultural (AG) zone, as shown on Schedule That Schedules A and B of (e former Township of Winchester) By-law are hereby amended to comply wi e provisions of is by-law. 1.9 All oer applicable provisions of (e former Township of Winchester) By-law 12-93, as amended, shall continue to apply. FORMER TOWNSHIP OF MOUNTAIN 2.0 That (e former Township of Mountain) By-law 79-6, as amended, is hereby amended as follows: 2.1 (a) That in Section 2 Definitions e following definitions are hereby amended by deleting subsections 2.46 and 2.56a and replacing em wi e following definitions: 2.46 Height when used wi reference to a building, shall mean e vertical distance measured between finished grade and: a) e highest point of e roof surface of a flat roof; b) e mean level between eaves and ridge of any oer type of roof; and c) e deckline of a mansard roof. 2.56a Mobile Home shall mean a transportable, factory-built dwelling designed to be used as a year-round dwelling, and has been manufactured to comply wi e Canadian Standards Association (CSA) Standard No. Z240, as amended or replaced from time to time, but does not include a modular home dwelling, a park model trailer, a motor home, a mobile camper trailer, a truck camper or any oer dwelling defined by is Bylaw. For e purposes of is By-law a single section factory manufactured home shall be deemed to be a mobile home..../3

5 THE CORPORATION OF THE TOWNSHIP OF NORTH DUNDAS BY-LAW NUMBER xx-2013 (b) That in Section 2 Definitions e following definition is hereby amended by adding e following new clause; 2.56d Modular Home shall mean a single detached dwelling at is constructed by assembling, on a permanent foundation, at least two factory manufactured modular units each of which comprises at least one room or living area and has been manufactured in a Canadian Standards Association (CSA) A277 certified factory. For e purposes of is By-law a modular home dwelling shall be considered as a single detached dwelling. 2.2 That subsection 3.1(d) Accessory Uses of By-law 79-6, is hereby amended by deleting e phrase one storey or. 2.3 That subsection 10.1(b) Rural Zone - Zone Requirements - Residential of By-law 79-6, is hereby amended by changing e lot area (minimum) requirement to 4,000 square metres (1 ac) and lot frontage (minimum) requirement to 38 metres (125 ft). 2.4 That subsection 10.1(c) Rural Zone - Zone Requirements - Oer Uses of By-law 79-6, is hereby amended by changing e lot area (minimum) requirement to 2 ha (5 ac) and lot frontage (minimum) requirement to 38 metres (125 ft). 2.5 That subsection 5.1(b) Residential First Density - Zone Requirements of By-law 79-6 is hereby amended by changing e lot area (minimum) requirement to 4,000 square metres (1 ac) and lot frontage (minimum) requirement to 38 metres (125 ft). 2.6 That subsection 10.1(d) Rural Zone - Special Exception of By-law 79-6, is hereby amended by inserting e following new subsection immediately after e contents ereof: 19) Rural Zone - Exception Eighteen i) Notwistanding e provisions of Section 10.1(a) hereof to e contrary, on lands zoned RU-18", e following uses shall not be permitted: Accessory Dwelling Mobile Home Rural Home Occupation Single Family Dwelling (ii) That e areas legally defined in Schedule 7 and shown on Schedule 8 shall hencefor be zoned Rural - Exception Eighteen (RU-18) zone and cease to be zoned Rural (RU). 2.7 That subsection 10.1(d) Rural Zone - Special Exception of By-law 79-6, is hereby amended by inserting e following new subsection immediately after e contents ereof: a) 20) Rural Zone - Exception Nineteen i) Notwistanding e provisions of Section 10.1(a) hereof to e contrary, on lands zoned RU-19", only e following uses shall be permitted: Single Family Dwelling Rural Home Occupation Uses Accessory to e foregoing.../4

FORMER VILLAGE OF WINCHESTER 3.0 That (e former Village of Winchester) By-law 25-96, as amended, is hereby amended as follows: 3.1 That subsection 3.61 Definitions - Dwelling Unit is hereby amended by amending e following definition: 12. Multiple Dwelling House Multiple dwelling house means a dwelling house containing a minimum of two (2) but no more an six (6) dwelling units and not oerwise defined herein. 3.2 That subsection 3.61 Definitions - Dwelling Unit is hereby amended by adding e following definitions and renumbering e section accordingly: 9. Fourplex Fourplex means a building at is divided horizontally and/or vertically in four (4) separate dwelling units, each of which has an independent entrance eier directly from e outside or rough a common entrance, but does not include a converted dwelling or townhouse dwelling. 18. Triplex Triplex means a building at is divided horizontally into ree (3) separate dwelling units each of which has an independent entrance eier directly or rough a common vestibule. 3.3 That subsection 8.1 Residential Type 3 (R3) - Permitted Uses is hereby amended by adding triplex and fourplex to e permitted uses. 3.4 That subsection 8.2 Residential Type 3 (R3) Zone Provisions is hereby amended by adding e following zone provisions and renumbering e section accordingly: 4.
