Bylaw 2015/01 Land Use Amendment (NE W4) An application was received from Milt and Victoria Landsiedel to reclassify a 2.14 ha portion of the NE W4, from Agriculture IDP District 1 A-1 IDP to Limited Country Residential IDP District CR-IDP" for the purposes of creating a separate title for the existing farm residence. Bylaw 2015/02 Land Use Amendment (SW W4) An application was received from WSP Surveys Limited Partnership on behalf of Art and Geraldine Aasman to reclassify a 4.01 ha portion of the SW W4 from Agriculture District 2 A-2 General Agriculture to Country Residential District 2 CR-2 for the purposes of creating a separate title for an existing farm residence. A public hearing was held prior to the meeting at which Council discussed the postponement of Bylaw 2015/02 at the recommendation of the Planner to allow for an adjustment to the proposed subdivision boundary to allow for better access to the remnant agriculture title. Resolution No. 2015/59 Councillor Lentz moved to postpose Bylaw 2015/02 to a future Council meeting to allow for the preparation and submission of a layout design that includes an amendment to the proposed south subdivision boundary to better accommodate access to the remainder of the agricultural title onto Range Road 63. Carried. NEW BUSINESS: Bylaw 2015/08 Land Use Amendment (SE W4) An application was received from Bernie Smyth on behalf of Anthony F. Bylaw 2015/09 Land Use Amendment (SW W4) An application was received from Bernie Smyth on behalf of Anthony F. Jeraj Professional Corporation to re-classify a portion of the SW W4 from Agricultural District 2 A- 2 General Agriculture to Country Residential District 2 CR- 2. Resolution No. 2015/61 Councillor Squire moved 1 st reading of Bylaw 2015/10. Carried. Bylaw 2015/10 Land Use Amendment (SW W4) An application was received from Norman Wittevrongel, to re-classify a portion of the SW W4 from Agricultural District 2 A-2 General Agriculture to Country Residential District 2 CR-2. Resolution No. 2015/62 Councillor Squire moved 1 st reading of Bylaw 2015/10. Carried Fire Agreement With the City of Medicine Hat The City of Medicine Hat provides coverage to the Hamlets of Veinerville, Dunmore, and Desert Blume as well as a designated rural area east, south, and southwest of the City. The City also provides support to County volunteer departments and has done so for many years. The City is Page 5 of 45

6 Council February 17 th, 2015 Page 4 willing to enter into an agreement to provide Firefighting services to the County as per the terms and conditions set out in the agreement. Resolution No. 2015/63 Councillor Vossler moved to enter into the two year agreement with the City of Medicine Hat as presented. Carried. Reduce Speed Limit Rge Rd 61A A request was made to Administration to look into the possibilities of reducing the speed limit on a section of Rge Rd 61A which runs along the east side of Desert Blume. Staff did research on the matter which included speaking to the Peace Officer to see if there were speeding infractions and there is no knowledge of any. Resolution No. 2015/64 Councillor Lentz moved to receive for information. Carried. Bylaw 2015/04 Emergency Management Staff have been working on developing a new Municipal Emergency Management Plan (MEMP). In conjunction with the MEMP, the Emergency Management Bylaw brings into being the components of the Emergency Management Act that will put the County into compliance with the Act. Jason Storch and Dennis Mann made a presentation to Council out-lining the roles and responsibilities of the MEMP. Resolution No.2015/65 Councillor Vossler moved 1 st reading of Bylaw 2015/04. DELEGATION: Scott & Theresa Reesor Scott and Theresa Reesor made a presentation to Council discussing the access to their property and re-establishing it as a public road which on some documents is known a Twp Rd 84A. PURPOSE: To discuss and receive public comment on Land Use Amendment Bylaws 2015/01 and 2015/02. INTRODUCTION: Bylaw 2015/01 Land Use Amendment (NE W4) An application has been received from Milt and Victoria Landsiedel to reclassify a 2.14 ha portion of A-1 IDP land to CR-IDP" for the purposes of creating a separate title for the existing farm residence. Jeffrey Dowling explained this application is intended to reclassify a 2.14 ha (5.28 acres) parcel for the purpose of subdividing the existing farmyard out of an unsubdivided quarter section in order to create a separate title for both the yard, and the remaining agricultural land. The owners would like to retain the yard site and continue to reside at this location for retirement purposes. They would like to sell the remainder of the agricultural title, which contains an irrigation pivot. Both the proposed subdivision parcel and the remainder of the agricultural title have existing access Page 10 of 45

11 Public Hearing February 17 th, 2015 Page 2 approaches that provide direct and immediate access to Range Road 65. There is an existing ravine/drainage course that flows through the irrigated land from the north, and continues to run to the east along the north side of the yard, and flows across Range Road 65 through a culvert. The Planner recommends approval, as the proposal complies with Section 2.6.2, Potential Growth Area Policy if the Tri-Area Intermunicipal Development Plan, and Section 3.4 (n) Country Residences, of the Municipal Development Plan. SPEAKERS FOR THE APPLICATION: SUPPORT OF THE APPLICATION: The applicants, Victoria and Milt Landsiedel, agree with the Planner s comments. None. OPPOSITION TO THE APPLICATION: None. COMMENTS/ QUESTIONS: Deputy Reeve Geigle inquired why the proposed area did not follow the pivot line. Mrs. Landsiedel stated that there are trees that run along the pivot which explains the slight diversion of the boundary line. INTRODUCTION: Bylaw 2015/02 Land Use Amendment (NE W4) An application was received from WSP Surveys Limited Partnership on behalf of Art and Geraldine Aasman to reclassify a 4.01 ha portion of A-2 General Agriculture land to CR-2" for the purposes of creating a separate title for an existing farm residence. Jeffrey Dowling explained this application is intended to reclassify a 4.01 ha (9.90 acres) parcel in order to subdivide an existing residence and yard site from a previously subdivided quarter section for the purposes of creating a Page 11 of 45

An ha subdivision, immediately to the south of the proposed subdivision area, and adjacent to Range Road 63, was previously subdivided from the quarter section over forty years ago. There is an existing irrigation pivot on the remainder of the agricultural land that is on the east side of the quarter section and at a higher elevation than the yard site. The proposed subdivision area also includes some small hills which are to the east of the residence. There is an existing access that provides immediate and direct access to the yard site from Range Road 63. Suitable access to the remainder of the agricultural land, from Range Road 63, will be accomplished by the placement of the south boundary of the proposed subdivision. The Planner recommends postponement of a decision to a future Council meeting to allow for the preparation and submission of a layout design that includes an amendment to the proposed south subdivision boundary to better accommodate access to the remainder of the agricultural title onto Range Road 63. In addition, this will allow the Planning Department to determine the most appropriate land use district for re-classification purposes as a result of the amended subdivision boundary, and possible parcel size adjustment. SPEAKERS FOR THE APPLICATION: SUPPORT OF THE APPLICATION: The applicant, Art Aasman, agrees with the Planner s comments. None. OPPOSITION TO THE APPLICATION: None. COMMENTS/ QUESTIONS: Deputy Reeve Geigle inquired where the water supply will come from for the proposed subdivision. Mr. Aasman said the Westside Water Co-op supplies the water to the parcel. Councillor Hamilton inquired as to how long the residence has been on the property. Mr. Aasman stated that they had moved a residence on the property in 1998, and before that the original residence had been there since the early 1900 s. Page 12 of 45

Council discussed postponement of Bylaw 2015/02 at the recommendation of the Planner to allow for an adjustment to the proposed subdivision boundary to allow for better access to the remnant agriculture title. 16 PUBLIC HEARING CYPRESS COUNTY LAND USE AMENDMENT REPORT By-law No.: 2014/40 Land Use Application: 14/A17 TYPE OF AMENDMENT: From Agricultural District 2 A-2 General Agriculture to Country Residential Farmstead Separation District CR-FS Legal Description: PN SE W4 Location: Adjacent to Range Road 60 Proposal: To reclassify a 2.54 ha portion of A-2 General Agriculture land to CR-FS" for the purposes of creating a separate title for the existing farm residence. Owner: Mark and Ann Rodermond Applicant: Mark Rodermond Previous Applications: None BACKGROUND INFORMATION: (February 26, 2015) This application is intended to re-classify a 2.54 ha (6.27 acres) parcel for the purpose of subdividing the existing farmyard out of an unsubdivided quarter section in order to create a separate title for both the yard, and the remaining agricultural land. The owners would like to sell the yard, and retain the agricultural land which contains an irrigation pivot. Both the proposed subdivision parcel and the remainder of the agricultural title have direct and immediate access to Range Road 60. The house is currently serviced with various utilities including a water connection to the Westside Water Co-op. There is a separate irrigation turnout in the field for the irrigation pivot. The existing residence is beyond 100 metres from the gas well to the south on the adjacent quarter section. There are no other separate titles, or residences within the quarter section. This land use amendment received first reading of the Bylaw on October 21 st, After 1 st reading was passed by Council, the land owner requested that the public hearing be delayed until later on in 2015 to re-evaluate their intentions. CONSIDERATIONS: (February 26, 2015) 1. The Municipal Development Plan directs Council as follows; Section 2. 2 Objectives (b) to minimize the fragmentation of agricultural land; (f) to locate country residential development where appropriate; Section 3.3 Farmstead Separations (a) A farmstead separation may be approved if: Page 16 of 45

17 ii) iii) iv) Agricultural titles may be permitted to subdivide out an existing country residence as a farmstead separation provided that there are not more than two existing titles which have been previously subdivided from the quarter section, nor more than two existing residences within the quarter section. Only one residence will be permitted within a farmstead separation proposal, and the residence must be in existence on the County s tax assessment records for a minimum of five years, Legal and physical access must be available to the remnant and proposed parcel, The proposed parcel will not restrict the agricultural use of the balance of the quarter section, v) The size of the proposed parcel does not exceed the area utilized for the building site unless there are physical boundaries or significant infrastructure and/or utilities which define a larger parcel. (b) The property cannot be further subdivided without Council first re-classifying the proposed subdivided area to a different Country Residential District. Section 3.4 Country Residences (n) a maximum of two residential titles will be permitted to be subdivided per quarter section within an agricultural district outside of the Tri-Area IDP boundary. Council may allow for one vacant single country residential title, and/or one farmstead separation title, and no more than two residential titles are to be subdivided per quarter section. Any previously subdivided country residential subdivisions and/or agricultural titles will be counted towards the eligibility of any further subdivision proposals per quarter section. 2. At the time of writing this report, there were no written objections or comments received from any of the adjacent land owners. 18 CYPRESS COUNTY BYLAW 2014/40 A Bylaw of Cypress County in the Province of Alberta to amend Bylaw 2011/04 being the Land Use Bylaw. PURSUANT TO the provisions of the Municipal Government Act, being Chapter M-26 of the Revised Statutes of Alberta, 2000, and amendments thereto, the Council of Cypress County, in the Province of Alberta, duly assembled, ENACTS AS FOLLOWS: 1. Having received an application (14/A17) from Mark Rodermond to re-classify a portion of the SE W4, as shown on the attached Schedule A, from Agricultural District 2 A-2 General Agriculture to Country Residential Farmstead Separation District CR-FS. 2. Having held a public hearing on the matter, Land Use Bylaw 2011/04, as amended, is hereby amended to change that portion of the SE W4, as shown on the attached Schedule A, from Agricultural District 2 A-2 General Agriculture to Country Residential Farmstead Separation District CR-FS. 3. This bylaw shall take effect upon final registration of the subdivision plan. 4. If no subdivision plan is registered within 2 years of the final reading of the Bylaw, the Bylaw shall be null and void. 21 PUBLIC HEARING CYPRESS COUNTY LAND USE AMENDMENT REPORT By-law No.: 2015/03 Land Use Application: 14/A15 TYPE OF AMENDMENT: From Agricultural District 2 A-2 General Agriculture to Country Residential District 2 CR-2 Legal Description: PN SE W4 Location: Adjacent to Range Road 64 Proposal: To reclassify a 2.27 ha portion of A-2 General Agriculture land to CR-2" for the purposes of creating a separate title for the existing residence. Owner: David Cota & Sharon Cranston Applicant: David Cota & Sharon Cranston Previous Applications: 89SE86 Refused BACKGROUND INFORMATION: (February 26, 2015) This application is intended to re-classify a 2.27 ha (5.60 acres) parcel for the purpose of subdividing the existing residence out of a previously subdivided quarter section in order to create a separate title for both the yard, and the remaining agricultural land. The current agricultural title is ha (64.6 acres). The railway tracks run diagonally through the quarter section. As a result, the quarter section was subdivided into two separate titles on either side of the railway right of way. A 10.9 metre (36 foot) wide access easement ( ) was registered with Alberta Land Titles to allow for access across the neighbor s subdivided parcel, which is located on the NE W4, in order to get to Range Road 64. The applicants are proposing an additional 20 metre wide access easement, across the remainder of the agricultural title, utilizing the existing private driveway to the residence, in order to connect to the existing registered access easement further to the East. Therefore, the applicants are requesting that access to the proposed parcel continue to be provided through the use of registered easements rather than purchase that portion of the neighboring land, and construct a public road to the proposed subdivision parcel, as well as to the remainder of the agricultural title. A very similar subdivision application was proposed in 1989, and it was turned down by the Municipal Planning Commission because of a lack of satisfactory physical access to the remainder of the agricultural title, and because of its proximity to an established hog operation within the same quarter section and situated to the south. The neighbor s hog barn, located to the south, appears to be no longer in operation. There is an old irrigation canal right of way, Plan 7441 HX, that has been put back into the rest of the agricultural title. The irrigation canal has been replaced with a buried pipeline which has been registered as an easement ( ). The proposed subdivision parcel would be considered to be the third title to be created within the quarter Page 21 of 45

22 section. There are two existing residences, one of which is included in the proposed parcel, within the quarter section. CONSIDERATIONS: (February 26, 2015) 1. (o) quarter sections which have been subdivided as a result of an involuntary severance, due to a permanent physical barrier, will be considered as a whole quarter section in determining the eligibility of subdividing an additional single country residential parcel under subsection (n). 2. At the time of writing this report, there were no written objections or comments received from any of the adjacent land owners. Planner s Recommendation: Refusal, as the proposal does not comply with Section 3.4 (n) Country Residences, of the Municipal Development Plan, as the proposed parcel does not have direct or immediate access to an established public road, and the applicant does not appear to be willing to acquire the land to develop a new road to the proposed subdivision parcel at their costs to provide direct and immediate access. 26 CYPRESS COUNTY BYLAW 2015/11 A Bylaw of Cypress County in the Province of Alberta to amend Bylaw 2011/04 being the Land Use Bylaw. 32 Signage Identifying Black and White Trail A request was received to improve signs identifying the Black & White Trial at the intersection on Twp Rd 120. There are signs in both directions indicating an important intersection ahead when approaching the Black and White Trail. There are sign posts at the intersection indicating the Black and White Trail. The Eagle Butte Rd is identified in the same fashion. Recommendations 1. Council move to receive for information. 2. 33 Curves on Rge Rd 60 Councillor Vossler asked Administration to place this curve on a future agenda. Following is the information concerning the curve on the south end of Rge Rd 60 just north of Twp Rd 120. This road was previously oiled and was paved in the spring/early summer of Dating back to June of 2013 there have been five accidents on Rge Rd 60. June 6, 2013, July 11, 2013, November 12, 2014 (fatality), February 16, 2015 and most recently February 25, Along the road there is a checker board sign and four two way Chevron signs at the curve in question. There are also delineator posts at the curves. Signage with arrows indicating curve ahead coming from both the north and south, and the speed limit is reduced to 50 km/h then further reduced to 25km/h. According to WSP Canada Inc. the firm who engineered the road, the signs meet the standards required by Alberta Transportation. Prior to the road being built the engineers tried to lessen the degree of the curve but the adjacent landowners refused to sell land to the County for this purpose. At the time expropriation was not considered. Page 33 of 45

34 Ratification of ASB Policy Updates At the October 28 ASB meeting the board reviewed and made revisions to the following policies. ASB P3.1 Rat and Skunk Control ASB P4.1 Grasshopper Spraying on Public Land ASB P5.1 Dutch Elm Disease Control Program As an advisory board to Council, the ASB wishes for Council to review and accept the policies as presented. Recommendations: 1. Council move to accept the policies as presented. 2. Council move to accept the policies as amended. 3. Council move to direct the ASB to re evaluate the policies, taking Council Direction into account, and bring them back to Council for review at a later date. 4. PROCEDURE: 1. Cypress County shall enter into the Alberta Municipal Rat and Rabies Control Agreement with the Province. The Provincial-Municipal Alberta Rat and Rabies Control Agreement This agreement forms part of this policy. 2. Under this agreement the County shall: In brief, the Agreement states that: a) Employ and supervise a Pest Control Inspector the County must employ a Pest Control Inspector to conduct a rat and rabies control program in the first 2 ranges of the County, b) Inspect all inspection sites for rats and signs of their activity within a control zone of three ranges, west from the Saskatchewan border. inspections must be carried out once each year at abandoned building sites and twice each year at occupied yards, c) Inspect sites in Range 1 at least two times per year and sites in Ranges 2 and 3 at least once per year. conduct a general depopulation of skunks within 5 km of any rabid animal and in Ranges 1-4 if rabies threatens to spread from Saskatchewan, d) Exterminate rat infestations when found, including those outside the control zone. e) Be willing to assist adjoining municipalities with rat infestation control efforts, when requested. f) Participate in a rabies vector inspection program. At the time of the inspections in the control zone rate payers will be provided rat bait free of charge. Rat bait will be available at the County office year round distributed, free of charge, to County residents within ranges 1 to 3. Only 12 bags will be provided per farm over the front counter. Residents wanting more bait must schedule a time for pick up with the Agricultural Fieldman or Pest Control Inspector. 4. Reported rat sighting are to be given a high priority for a response, and shall be investigated The Pest Control Inspector will only deal with skunk control requests if rabies is a possibility. Skunk traps will be loaned to County residents from the County office according to the fees set in the Master Rates bylaw. The Pest Control Inspector will only deal with skunk control requests if rabies is a possibility. Confirmed cases of rabies must be reported to the Provincial Chief Public Health Vet Rat and skunk control by the County in Saskatchewan will only be done by our the Cypress County PCO Pest Control Inspector if requested in writing by the adjoining R.M. All Saskatchewan Agriculture policies would be strictly adhered to All relevant parts of the Agricultural Pest Control Act and Regulations and product label requirements will be considered part of this policy. PROCEDURES: 1. The Agricultural Service Board will systematically reinventory the elm population in the County and encourage residents to prune or remove trees as necessary. 12. The ASB Municipal staff will cooperate assist with the placement of DED pheromone traps to monitor the movement of beetles in the area. 2. To emphasize the importance of control in ditches before the grasshoppers move into the fields. PROCEDURE: 1. The ASB will not spray any roadsides in Cypress County for the control of grasshoppers. 2. The ASB chooses not to implement roadside grasshopper spraying due to the increase in personnel and equipment that would be necessary. 3. The ASB encourages adjacent landowners to control grasshoppers on Cypress County roadsides. 4. The ASB will not subsidize roadside grasshopper spraying in any way. Page 38 of 45

39 Paving of Old TransCanada Hwy West of Redcliff The road base was built to pavement standards in July The distance prepared for paving is roughly 2 km between Rge Rd 70 and Rge Rd 71. In 2013 and 2014 the County has spent $135,000 on various dust control products. The traffic count between January 20, 2015 and February 02, 2015 was 1,410 vehicles; of which 56% were tractor trailers. The estimate to pave this section is $1,227,600 including engineering costs. 41 CAO Report March 3 Attended the Brownlee LLP seminar. It was time well spent. With the knowledge learned future changes will be made to our pre employment drug screening protocol. It is apparently illegal to pre screen in our current situation but our post incident and just cause testing are okay. Good food for thought regarding off site levies also gained. Application has been sent to province for water transfer. It is possible we can swap the location on the pile with our Hilda Schuler application. Administration was told this is one of the areas that are not front line staff for the province and thus they are shorthanded. Attended and completed ICS 200. 42 Assistant CAO Report The land purchase from Ellen Wise at the end of 2 nd Avenue for the Dunmore booster pumps has now been completed. Letters were recently sent out to adjacent landowners along the former CPR line from Schuler to Pivot, inviting them to purchase the land from the County. Some landowners replied stating that the price is too high. Six parcels are being subdivided to complement existing road widening plans. Recreation Grant funding applications have been sent to local community groups with a submission deadline of March 16. Depending on completeness of information received, the Recreation Board meeting can be scheduled for either April 7 th or 21 st. Irvine Library is beginning the process to become a full member of the Shortgrass Library System (SLS). Ideally, the recon (addition of Irvine materials into SLS catalogue) would happen over the summer. This should allow for full library services, including access to digital materials to commence by September Irvine Library will also need to make a full commitment to Resource Sharing with other libraries Page 42 of 45
