4 I. PROJECT INTRODUCTION 1. Background 1.1. Project. 1. Ben Luc - Long Thanh Expressway Project has an overall length of 58km. It traverses through 17 communes in 7 districts of 3 provinces/cities. The project starts from My Yen commune and part of an access-road in Tan Buu commune, Ben Luc district, Long An province. Then it goes through Phuoc Ly commune, Long Thuong commune, Can Giuoc district, Long An province; Binh Chanh, Tan Quy Tay, Hung Long and Da Phuoc communes in Binh Chanh district; Nhon Duc and Long Thoi communes in Nha Be district, Binh Khanh commune in Can Gio district, Ho Chi Minh City; then goes through Phuoc Khanh,Vinh Thanh, and Phuoc An communes in Nhon Trach district, Long Phuoc and Phuoc Thai communes in Long Thanh district, Dong Nai province. 5 2. The land acquisition area along the route varies from 56m - 73m wide. 3. To minimize resettlement impacts as required by ADB s policy, the Road safety corridor provided by Decree No.11/2010/ND-CP will not be applicable for this project. 4. Vietnam Expressway Corporation (VEC) is the implementing agency for implementation of the Project. 5. The land acquisition and resettlement activity is divided into 03 subprojects by the Ministry of Transportation which have been assigned to Ho Chi Minh City, Long An and Dong Nai provinces for implementation. After that, each province continues decentralization to assign its districts to become sub-project investors for the implementation of land acquisition and resettlement General information of compensation activity in Can Giuoc, Nha Be and Can Gio. 6. During the implementation process of compensation records for affected households, the Employer for the construction portion (VEC) and the Employer for the land acquisition subprojects (DCARC of Can Giuoc, Nha Be and Can Gio districts) undertook advanced compensation payment for some households before the URP had been approved. The advanced fast compensation payment process did not follow accurately the procedure for ADBfunded project. Hence, on April 10, 2013, ADB made a written request to VEC to provide additional TOR for Due Dilligence of Resettlement, Compensation and Assistance implementation in 3 distrcits where advanced compensation payment had been made. 7. To meet the time schedule, the due deligence report will be made for each district separately. This report is made for Can Giuoc District, Long An province. 2. Scope of Impact 8. Can Giuoc Distrcit has two affected communes which are Phuoc Ly and Long Thuong Communes, with 227 affected households, 860 displaced people, and 189,756 m 2 affected land. Among which, 7 housholds are displaced; there are no poor households and vunerable households affected by the project. 9. The below Table 1 shows the resettlement impact datas as stated in the approved RP and the actual information as of September 2013 provided by DCARC. 6 Type of Impact Unit Quantity in approved RP - Agricultural land, forestry, and land for M aquaculture Actual quantity as of Sept Other type of land M Affected houses - Household - Area Source: provided by DCARC in 9/ Implementation Progress Hộ 28 M By the survey time (September 2013), the land acquisition and resettlement progress in Can Giuoc District has been done as below: - Resettlement plan was made in July Policy framework was approved by ADB and the Government of Vietnam in September The final URP is scheduled to submit to ADB in October DMS has been completed for 227 households. - Compensation plan for 227 affected households has been approved households already received compensation money. 157 HHs have to displace their houses. 106 HHs are identified to have registered for receiving compensation in cash and arranging the new living places by themselves. 51 HHs are expected to receive land in the Resettlement Site. However, there have been no HHs submitted official application form to receive the land so far. - The income restoration programs are under appoving procedures, and have not yet been implemented. II. METHODOLOGY 1. Applied Methods 11. The consultant has been using the following methods for collecting information, analyzing and reporting: (i) (ii) (iii) (iv) (v) Review DMS and compensation forms, PPC decisions and minutes of meetings to assess (a) the extent to which the records of losses and other losses (both physical and livelihood) are reflected in the inventories of losses stated in the above mentioned documents, (b) completeness of the census, and (c) the extent to which entitlements in the agreed resettlement plan have been applied to the individual decisions. Review replacement cost survey reports. Interview/meetings with AHs (individual, focused-group, public meetings) on the process, perception, satisfaction, including plans or actions already undertaken by AHs on the compensation payment received; Interview with local officials, host communities and other stakeholders to determine their awareness and participation in the planning and implementation process. Separate meetings with women and other vulnerable households.

7 (vi) (vii) Meeting with concerned local officials/organizations to assess the planned or ongoing income restoration programs, if any In the event that displacement has already taken place review existing baseline data as per agreed Resettlement plan, conduct socio-economic survey to compare the preproject situation of AHs (at least, 20% severely affected households and 100% vulnerable households per district); 2. Implemented Schedule. 12. The Consultant has been working as below schedule: - On 16 September 2013, meeting with EPMU under VEC to get necessary information and documents. - On 17 September 2013, meeting with PMU of Long An Traffic Works- Investor of the subproject - on the works relating to land acquisition and resettlement in the district. - On 25 September 2013, working with the People s Committee of Long Thuong Commune. - On 26/9/2013, working with CPC of Phuoc Ly. - On 19 September 2013, working with SIAC consultant on the procedures to make, to apply for approval of replacement unit prices. - From 25 September to 30 September 2013, consulting and interviewing affected households, relevant communes and wards officials. 13. During this process, the Consultant has interviewd 142 households (accounting for 63% of affected households), in which 114 are severely affected and relocated households. The data of the consultation and interviews appear in table 2. The list of interviewed HHs and some photos of the consultation meetings are in Annex 1. 8 III. FINDINGS 1. Consultation and information disclosure (to affected people and the Community) % of surveyed households said that they were informed about the Project infomormation. Affected households got the information on the project and on the stages of the compensation for land acquisition mainly sent to their home through local authority officials like staff of DCARC, of commune s Land management team, or head of ward (96%). Others got information through commune meetings (92%). And 88% of HHs got project information and compensation information at the documents posted at the office of communes. 15. During the process of making and updating RP, the general project information, and the main contents of RP like compensation and assistance policy, livelihood restoration programs, complaint mechanism... reached the affected households through public consutation meetings organized by PMU in collaboration with the consultant (for RP and URP). 92% of households attending the interviews and group discussions said that they had joined the consultation meeting and knew all that information. 16. Compensation unit price and assistance policies were decided specifically for each household in the land acquisition and resettlement plan. This compensation plan was posted publicly 20 days in accordance with regulation (with the minutes recording the time of posting). 96% of AHs interviewed during this time monitoring said that they already saw the posted compensation plans % of severely affected households on agricultural land said that they knew and agreed to receive the livelihood assistance in cash. The assistance fund was established in the compensation plans of each HHs % of severely affected households on agricultural land said they were consulted on the income restoration programs of the project, and they commented or selected the proposed activities in the income restoration programs. Source: Consultant team s survey in 9/ % of surveyed HHs said they did not remember, did not know or some other members in their families knew the notification before the DMS. 5% of HHs did not participate in the DMS mainly due to they were not at homes. 27% of HHs did not reply or confirm whether DMS was accurate or not % of interviewed HHs said they did not remember or did not participate in the discussion to select the compensation option (by cash or land for land, house for house ). 21. Conclusion: The consultation and information disculure to affected households have been done in accordance with the provisions specified in the approved RP. However the severely affected HHs on agricultural land should be consulted more detailed on measures to restore livelihoods and income at the stage of implementing livelihood restoration program. 2. Determining replacement unit price for compensation 22. SIAC, an independent Price Appraisal Consultant was sellected by the technical design consultant and approved by ADB/VEC to conduct the replacement cost survey, to appraise and propose the replacement unit prices. 23. The group of selected SIAC appraising team to conduct the replacement cost appraisal for Can Giuoc District has 4 members. All of them have Appraiser Certificate granted by Ministry of Finance, and have long expriences in appraising land and asset prices Unit price for land compensation. 24. SIAC carried out the survey and appraisal of prices in the early of SIAC already issued Price Appraisal Report and a Appraisal Deed No.Vc 12/07/408/BDS dated 12 July SIAC applied the comparison and collection method in order to decide the proposed replacement unit price. In which, the comparison with the actually-occured buying cases in the market was used for residential land; and the calculation of the income generated was used for productive land. The information and data used for this method are collected from : - Relating issued documents on price unit. - Survey result on actual buying cases in the area. - Other archived data of SIAC. 26. The replacement unit price for land compensation proposed by SIAC has been approved by People s Committee of Long An province in Document number 3283/UBND dated 19 October 2012, and applied for establishing the compensation plan. The replacement unit price for land compensation proposed by SIAC was appoved by People s Committee of Long An province as shown in Annex Unit price for compensation of buildings and structures 27. SIAC carried out the survey and appraisal of compensation prices in the early of SIAC already issued Price Appraisal Report and a Appraisal Deed No.Vc 12/07/419/BDS dated 25 July SIAC applied the comparison and collection method in order to decide the proposed replacement unit price. The information and data used for this method are collected from: - Survey the market information through construction companies, local suppliers or price quotations for construction work. - The archived data of SIAC

The replacement unit price for buildings, structures appraised by SIAC is in line with the unit price for houses and structures issued by People s Committee of Long An province in the document number 31/2012/QD UBND dated 13 July The unit price of several items proposed by SIAC was not stated in the Decision No. 31/2012/QD-UBND dated 13 July Then it was supplementarily approved by Long An PPC under the Decision No. 3283/QD-UBND dated 19 October The establishment of the compensation plan for AHs houses and structures, which was applied the unit price under the Decision 31/2012/QD- UBND dated 13 July 2012 and Decision No. 3283/QD-UBND dated 19 October 2012, was fitting with the SIAC appraisal resutls Unit price for plants and crops compensation 30. SIAC carried out the survey and appraisal of compensation unit prices for plants and crops in the early of SIAC already issued Price Appraisal Report and a Appraisal Deed No.Vc 12/07/419/BDS dated 25 July SIAC applied the comparison in order to decide the proposed replacement unit price. The information and data used for this method are collected from: - Survey the market information through local suppliers. - The archived data of SIAC. 32. The replacement unit price for plants and crops appraised by SIAC was fitting with the compensation price for crops and plants under the Decision No. 22/2011/QD-UBND issued by Long An PPC dated 20/7/2011. Some unit prices proposed by SIAC were not stated in Decision No. 22/2011/QD-UBND dated 20/7/2011. Then, they were supplementarily approved by Long An PPC under the Decision No. 3283/QD-UBND dated 19/10/ The establishment of the compensation plan for AHs crops and plants, which was applied the unit price under the Decision 22/2011/QD- UBND issued by Long An PPC dated 20 July 2012 and Decision No. 3283/QD-UBND dated 19 October 2012, was fitting with the SIAC appraisal resutls. 33. Conclusion: The survey of replacement unit price was done by a qualified appraiser. The applied method was suitable with the target of determining replacement unit price. The main replacement unit prices propsed by the consultant were different from the unit price enacted by PPC. It was appoved by Long An PPC to be applied for making compensation plans. 3. Provision of compensation, relocation and rehabilitation, and assistance to the poor and vulnerable households as per project policies and entitlements The compensation, assistance and ressettlement plan approved by the People s Committee of Can Giuoc District 34. The compensation, assistance and ressettlement plan was approved by the People s Committee of Can Giuoc District in the Decision No.914/QD-UBND dated 28 November 2012 for 227 affected households with total approved budget of VND Detail of cost is broken down as following table. Expenses for livelihood restoration programs: The livelihood restoration programs are waiting for approval. Estimated expense is VND Resettlement for relocated households. 36. According to statistics result of DRC of Can Giuoc district, 157 households need to be relocated. These HHs have two options (i) provide a land lot at Tan Kim Expanded Resettlement site with the price of VND 4,000,000/m2, in which AH pays VND /m2 and Investor assists VND /m2. In case the compensation money for AH is less than the value of the smallest Resettlement land lot, AHs would be assisted the variance. or (ii) receive compensation in cash, arrange new living place by themselves and they are entitled to an assistance in a range between VND and VND depending on each case. 106 HHs registered to receive compensation in cash and arrange new living places by themselves. 51 HHs informed the Land Fund Development Center (LFDC) of Can Giuoc district that they would receive land in the Resettlement Site. However, these households have not officially applied. According to LFDC of Can Giuoc district, the official implementation of providing land will be conducted after URP is approved. Conclusion: The Resettlement Site is readily prepared for needed HHs moving in to live. The two options of compensation were publicly posted. The assistances for HHs, who agreed to receive compensation in cash and arrange the new living places by themselves, were calculated appropriately following the approved regulations. 5. The effectiveness of grievance redress mechanism. 37. According to the LFDC of Can Giuoc district, there are 37 cases of HHs having complaints, not receiving compensation money. In which: i. 17 cases were settled with Decisions issued by DPC of Can Giuoc. Then, these 17 HHs submitted their complaints to PPC of Long An. The PPC of Long An issued Decisions rejecting the complaints of these 17 HHs and confirmed that the compensation plan established for these HHs are surely accurate. The contents of the complaints from these HHs are as following: - 17 HHs complained that the compensation unit price for residential land is too low, requesting higher compensation unit price.

12 - 10 HHs complained that the compensation unit price for structures is too low, requesting higher compensation unit price (these HHs also complained about land compensation price). - 6 HHs claimed for assistance of displacement (these HHs also complained about the land and structures compensation price). ii. There are 20 cases of claiming now, and they are being settled by district and provincial authorities. The LFDC of Can Giuoc district said that the contents of these claims are mainly as following: - Some HHs complained that the compensation unit price for residential land is low, requesting higher compensation unit price. - Some HHs complained that the current assistance rate (2.5) applied for training and career transition on agricultural land is too low, requesting to apply the maximum assistance rate (5 x agricultural land compensation price). - During the working period, LFDC of Can Giuoc district informed that PPC of Long An is now considering to add more to the current assistance rate (2.5) applied for training and career transition on agricultural land, so as to make up a more appropriate assistance rate. 38. Conclusion: The settlement of complaints, grievance of affected households has been done through levels in accordance with the grievance redress mechanism set up for the project in the approved RP. The HHs who was not satisfied was guided to send their complaints to higher level. LFDC of Can Giuoc district needs to gather all information of complaints and follow the progress as well as cooperate in settlement process. 6. Capability of local authority in planning and implementing 39. District Compensation, Assitant and Resettlement Council (DCARC) of Can Giuoc was set up with 15 members, in which 3 members were representatives of affected HHs (Decision No.620/QD-UBND dated 26 September 2012 of People s Committee of Can Giuoc district). Besides, People s Committee of Can Giuoc district also assigned for the LFDC of Can Giuoc district to implement the mission under the direction of DCARC LFDC of Can Giuoc district assigned 5 members to directly prepare the compensation documents. 40. Most of the human resource of DCARC and LFDC of Can Giuoc district are experienced in resettlement and compensation work in government funded projects. During the implementation process, LFDC of Can Giuoc district set up a general schedule, as well as a plan to settle the pending jobs and actually they met the set-up schedule. The settlement of complaints from affected HHs involves many relating authorites like Inspectoriat, People s committees of different levels Therefore LFDC of Can Giuoc district hasn t caught up all of the complaints. 41. The staff in charge of resettlement and compensation said that they did not have exprerience in organizing and implementing economic restoration programs. Therefore, it is necessary to have further training for concerning staff before the economic restoration program is implemented. 42. Conclusion: The current personnel to carry out resettlement and compensation work in Can Giuoc district meets the requirement for the work of the project. The further training for relating staff before implementing the economic restoration program is necessary and needs to be considered by VEC and EPMU.

13 7. Cost estimates as per RP as against the actual budget used 43. Flow of funds (VEC to local authorities) 44. The loan used for land acquisition is taken from Government budget. MOT registered the loan annually based on VEC and local authority proposals. The disbursement for LFDC of Can Giuoc district is carried out by Long An province s State Treasury based on approved registered loan. 45. According to the data from LFDC of Can Giuoc district, LFDC received an advance payment of VND from the State Treasury of Long An province, and make compensation payment to HHs in the early of Based on the approved compensation, assistance plan, on the plan of distributed fund, LFDC of Can Giuoc district would request the State Treasury of LongAn province to transfer money to LFDC s bank account openned at State Treasury of Can Giuoc district. 47. Before each time of payment of compensation, LFDC made a list of HHs receiving compensation money, and requested to transfer the fund for the list from State Treasury of Can Giuoc district to the bank account used for compensation payment at the Vietnam Bank for Agriculture and Rural Development of Can Giuoc Payment of compensation

14 48. LFDC organized the advance payment of compensation to affected HHs in the early of The Vietnam Bank for Agriculture and Rural Development of Can Giuoc directly involved in the payment to affected HHs. LFDC of Can Giuoc district has not requested AH to hand over the land to project % of 128 HHs interviewed, who already received compensation money, said that schedule for payment of compensation was informed 2-5 days in advance. The receiving of money was convinient and transparent. At the monitoring time, 191 HHs already received compensation money with total amount of VND Gender concerns and gender strategies/plans; 50. Among 227 affected households, 103 are headed by women (39 HHs of Long Thuong commune; 64 of Phuoc Ly commune). At the monitoring time, the land acquisition and site clearance for the project as well as the project construction have not yet implemented. Therefore, there has been no direct impact on affected households in general, and on women in particular. 51. However, when the land acquisition is made, there will be impacts on jobs and adverse social impacts on women. 52. Impact on jobs: According to the socio-economic Report of Phuoc Ly and Long Thuong communes, 59% of affected households are involving in agricultural production and freelance workforce, 11% are doing trade or service and women play the main role. Therefore, the acquisition of agricultural land has direct impact on the jobs of women. This also means that women of affected HHs will have to look for other jobs to gain the income. 53. Social impacts and other implicit risks: - The presence of workers from other areas in the district will pose implicit risks to local women: women/children trafficking, social evils (drug, prostitution, gambling ) ; social diseases, un-wanted pregnancy. - To minimize and prevent the above risks, it is essential to have a concrete action plan to improve the women s knowledge on solving arising problems; to create more chances for women to get new suitable jobs. The contractors need to commit with local authorities to strictly manage their workers during the implentation of the project. 10. Pre- and post socio-economic conditions of already compensated households in terms of relocation and livelihood. 54. Up to the time of checking of the consultant team, 191 HHs already received compensation, assistance. Because the project has not yet acquired land and cleared the site, those affected HHs are still living on the affected residential land, and farming on other type of affected land. 55. With HHs whose agricultural land were affected: the early receiving compensation money helped them actively invest more in production, or take career transition. My family received the compensation money. I plan to continue my investments. The project did not have bad impact on the income of my family. I satisfy with the project compensation, said a man of HH affected severely on agricultural land in Phuoc Ly commune. 56. With relocated HHs: the early receiving compensation money helped them actively undertake their family plan such as: purchasing new residential land, invest in own business, invest in their children education, etc.

15 57. When answering the indepth interview, one household header in Phuoc Ly commune said: My family received the compensation money and spent on purchasing land, building house. I supposed to spend the rest on my own business investment and pay for the children education. Our lives in the new place have no difficulties. 58. Conclusion: The early payment of compensation when affected land has not yet been acquired by project has not made much changes to the socio-economic condition of affected HHs. Most of the current changes are positive like buying more productive land, more residential land and building houses in new living place. Initially, affected HHs used the compensation, assistance money received from the project effectively in investment, in improving economic conditions of their families. 11. Monitoring of activities (site visits of VEC, local authorities, reporting and submission of reports) 59. During the compensation payment process, EPMU (under VEC) assigned 7 members and 1 Deputy Director to take part in the monitoring, coordinating of the resettlement and compensation activities. For Can Giuoc district, EPMU assigned 1 staff to directly monitor and coordinate with local authorities. Besides, 1 Deputy Director of EPMU (under VEC) was also involving in the instruction for resolving relating works. 60. According to EPMU, during the process of preparing compensation documents, staff of EPMU made site visits, and worked with local authorities averagely 4 days/week. At other timing, they worked 1-2 days/week. 61. Staffs of LFDC were also frequently present at the site to solve relating works. 62. The internal reports were mainly prepared by EPMU based on TA consultant's and LFDC's reports. The LFDC s reports were not periodically made or following any fixed format, but they were very detailed in reporting the completed works, outstanding issues, and proposing solutions. 63. Conclusion: The monitoring of site activities and coordinating to resolves problems at site were very well done. In order to support the preparing of report for the total project better, EPMU should set a fixed report format for all districts. 12. Challenges encountered by local authorities during the process of implementation 64. During the process of implementation, local authorities met some difficulties which had impact on the time schedule and on the livelihood restoration of affected HHs as followed: - The system of land management was not good; many HHs did not have necessary documents. This led to the verification jobs taking much time and causing many complaints from HHs. - As the site is near HCMC, many HHs bought land as a speculation, and did not use it. This fact made the management of land, and the verifying for people assistance very difficult. Many HHs bought land in (a period of high land price). Now the land price is going down too much and have few transactions. Hence, they are not satisfied with the land compansation price. - The compensation unit price for land and the assistance rate for training and career transition in Can Giuoc district are generally lower than that of HCMC. That led to complaints and grievances from AHs, especially HHs in Long Thuong commune bordered with Binh Chanh commune of HCMC.

16 - The livelihood restoration program following the project s target and provision is a newlyapplied process. Therefore, local authority staff does not have experience in handling it well. IV. CONCLUSION, RECOMMENDATIONS AND ACTIONS TO SOLVE OUTSTANDING ISSUES 1. Conclusion: 65. By September 2013, the DMS and preparing compensation plans for project affected HHs in Can Giuoc district are already done for 227/227 HHs. 191 AHs already received compensation and will hand over the site when being requested. Most of affected HH are satisfied with compensation policies. 66. In general, project employer has followed the resettlement procedures set out in project s RP and in Decree 69/2009/ND-CP of the Government, and other legal documents of the Government, and of Long An province. 67. The information disclosure, DMS, compensation payment processes were joined and monitored by representatives of affected HHs and other relevant authorities. However, the implementation of income restoration program is now behind schedule. 68. The preparation of resettlement land for needed HHs are undertaken, but the official registration of land to hand over to HHs is not completed. Investor and LFDC of Can Giuoc district need to accelerate the process like submitting URP for approval, consultation for AHs aspiration, distribution of land lot to HHs, etc. 69. The settlements of complaints from affected HHs have been handled by relevant authorities. However, there are 20 un-settled cases which need to be paid more attention to be settled completely. LFDC of Can Giuoc district needs to gather all information of complaints and follow the progress as well as cooperate in settlement process. 70. The internal monitoring have been done by EPMU and LFDC frequently. Monitoring reports were made with information reflecting resettlement progress, and arising issues to be solved. In order to support well the internal monitoring and the information summarising for total project, EPMU should request the local authorities to prepare Internal Monitoring Reports in fixed format. 2. Outstanding issues and recommendation to resolve. 71. The compensation, resettlement of Benluc-Longthanh expressway Project in Can Giuoc district has some outstanding issues to be resolved.
