INTRODUCTION 1.1 Distribution Efficiency Project - DEP The proposed development objective of the project is to improve efficiency, availability and reliability of power supply and as well the efficiency of its utilization. This would be achieved through the implementation of three components (i) System Expansion and Reinforcement which will cover the construction and reinforcement of 110 kv, medium voltage (MV) and low voltage (LV) networks (including substations); (ii) Introduction of Smart Grid Technologies in Distribution (focus on the automation of distribution network operations and introduction of advanced metering systems; and (iii) Technical Assistance and Capacity Building. The three components will be implemented by the five Power Corporations (PCs)1, and Component 3 also by the MoIT. To maximize initial impact, Component 2 will start by focusing in key distribution substations and the larger electricity customers. CTF co-financing has been proposed for this component, and CTF Committee has endorsed the proposed project. PCs under CTF co-financing will be selected based on their willingness and capacity to prepare and implement advanced smart grid projects. At this stage, three PCs are under consideration namely, NPC, HCMPC and HNPC. To implement subprojects components, land acquisition will be required. However, rehabilitating and increasing the capacity of existing distribution lines and substations would not cause large scale of land acquisition and resettlement. In this project, land acquisition is required mainly under subprojects in component 1. Subprojects in 15 southern provinces shall be carried out by Southern Power Corporation which concentrate on rehabilitation and expansion for power distribution systems not more than 110kV, included transmission lines, substation with level of voltage such as 110kV, 35kV, 22kV and 0,4kV. For the ownership and implementation arrangements, separate Resettlement Plans (RPs) will be prepared prior to the appraisal one for each participating PC. Abbreviation Resettlement Plan of Binh Son 110kV Substation and Tee-off subproject has been prepared in compliance with the Resettlement Policy Framework (RPF) of the DEP. 1.2 Binh Son 110kV Substation and Tee-off Subproject The proposed Binh Son 110kV and Branch Line is constructed to supply power for Long Thanh district. The subproject is aimed to: i) meet the increasing power demand in the region; ii) supply power 22kV for Binh Son, Loc An, Long An Communes and surrounding areas within Long Thanh District; iii) create an 110kV substation and 110kV brach line to connect with existing 110kV substation to supply power for Long Thanh District to increase reliability of power supply and reduce of power loss in the regional distribution power network; iv) reduce power load from existing 110 kv substations; and v) to enhance providing power for Loc An Binh Son Industrial zone and a part of Long Thanh International Airport in the in the future. Substation Construction and installation of Binh Son 110kV Substation Capacity Voltage level Location 1x40MVA (provision up to 2x40MVA in the future) 110/ 22kV Loc An Commune, Long Thanh District, Dong Nai Province Area 4,750m 2 Branch line: :Total length of the line is approximately 4.9 km with the following characteristics - The start point :110kV distribution system of 110kV Binh Son substation - The end point : the connecting tower of 110kV T/L connection between T.81 and T.82 of 110kV Phu My Long Thanh transmission line - Rated voltages : 110kV - Numbers of circuit : double circuits - Conductor : ACSR-400/51 - Overhead ground wire: GSW-70 - Optical ground wire : OPGW-70 (24 fibres; type single mode) - Insulator : Polymer (types 70kN and 160kN) - Tower : double-circuit tower, which made in using zinc-galvanized steel - Foundation : using on the spot casting reinforced concrete foundation - Right of way : 15m 1.3 Objective of the Report According to the World Bank s safeguard policy, total number of subproject DPs is less than 200 people, thus, only an abbreviated resettlement plan (ARP) is required - 2 -
6 and contents of this ARP is followed as requirements in the project abbreviated resettlement plan. The overall objective of the Abbreviated Resettlement Plan is defining resettlement and compensation programs for the project in such a way as to limit as much as possible the number of project displaced Person and their affected properties and to ensure that all DPs shall be compensated for their losses at replacement cost and will be provided with rehabilitation measures to assist them to improve, or at least maintain, their pre-project living standards and income earning capacity. The ARP preparation has been carried out by consultation and participation of DPs and local authorities in the project areas

LEVEL OF IMPACTS OF BINH SON 110kV SUBSTATION & BRANCH LINE SUBPROJECT 2.1 Determining Affects of the Subproject Determining Affected Area of the Subproject The subproject will affect on Loc An and Long An communes of Long Thanh District, Dong Nai Province. Affected areas of the subproject include: - Proposed substation area (4.560m 2 ) and proposed tower foundation areas (3.050m 2 ) - The ROW area (with a 15-meter avarage wide); and surrounding area of proposed tower foundations during construction phase, and temporary land acquisition due to wire works which may be impacted from 1 to 2 months. Temporary land acquisition for construction road is not necessary because exiting road systems and ROW shall be used during construction phase Determining Displaced Persons of the Subproject According to survey result, there are 34 households/enterprise (approxiametely 198 people) will be affected by the subproject, in which households have loss from 1.27% to 9.95% of total land holding consist of the following people - People who has agricultural land which are partically affected (temporary or permanent) - People who have perennial trees and/or harvest crops which are partially damaged (temporary or permanent). There is no impacted household of subproject belongs to vulnerable groups. FRAMEWORK AND ENTITLEMENT Abbreviation Resettlement Plan of Binh Son 110kV Substation and Tee-off subproject has been prepared in compliance with the Resettlement Policy Framework (RPF) of the DEP. Laws and policies which are applied for compensation and resettlement implementation include (i) policies of WB; (ii) existing compensation, allowance and resettlement policies of Vietnamese Government; and (iii) compensation, allowance and resettlement procedure of Dong Nai Province. Regarding to WB s policies, the Involuntary Resettlement (OP 4.12) shall be applied. Main principles of OP 4.12 are described clearly in Resettlement Policy Framework of the DEP. The following are regulations of Vietnamese Government on compensation, allowance and resettlement which are applied in ARP implementation of this subproject. The Constitution of Vietnam, 1992 confirms the right of citizens to own a house and to protect the ownership of the house. The Land Law 2003 issued on December 10, Decree 181/2004/ND-CP issued on October 29, 2004 guiding the implementation of the Land Law revised Circular 01/2005/TT-BTNMT issued on April 13, 2005 guiding the implementation of the Government s decree 181/2004/ND-CP. Decree 197/2004/ND-CP issued on December 3, 2004 on compensation, support and resettlement when land is recovered by the state. Decree 188/2004/ND-CP issued on November 16, 2004 on methods to determine land prices and assorted land price brackets. Circular 145/2007/TT-BTC issued on November 26, 2007 guiding the implementation of the Government s decree No 188/2004/ND-CP Decree 17/2006/ND-CP dated January 27, 2006 on revision and supplementation of some regulations in decrees guiding the implementation of the Land Law. Decree 84/2007/ND-CP dated May 25, 2007 on revision of issuing LURC, land acquisition, implementation of land use right, procedure for compensation, resettlement when land acquired by State and grievance redress. Decree No.69/2009/ND-CP, effective October 01, 2009; an amendment to Decree No.197/2004/ND-CP; supplementary regulations on land use planning, land prices, land acquisition, compensation, support and resettlement. Circular 14/TT-BTNMT dated October 01, 2009 providing detailed regulations on compensation, assistances, relocation and process and procedures for land acquisition, land hand-over and land lease. Circular 57/2010/TT-BTC issued on April 16, 2010 prescribing the estimation, use and settlement of funds for compensation, support and resettlement upon recovery by the State
11 Decree 106/2005/ND-CP dated on August 17, 2005, guiding the implementation of a number of articles under the Electricity Law regarding safety protection of high-voltage power grid. Decree 81/2009/ND-CP dated on October 12, 2009, amending or supplementing a number of articles of the government s decree No.106/205/ND-CP of August 17, 2005 which details and guide a number of articles of the electricity law regarding the safe protection of high-voltage power grid works. Circular 03/2010/TT-BCT dated on January 22, 2010 of Ministry of Industry and Trade, regulating a number of articles under decrees 106/2005/ND-CP and decree 81/2009/ND-CP. Circular 03/2010/TT-BCT issued on January 22, 2010 of Ministry of Industry and Trade providing a number of contents on safety protection of high-voltage power grid works The following are current regulations on compensation, allowance, and resettlement of Dong Nai Province would be applied in ARP of this subproject: Decision 72/2011/QD-UBND issued on December 22, 2011 stipulate compensation unit price for land in Decision 13/2011/QD-UBND issued on February 14, 2011 stipulated compensation and support when the State withdraws land in Dong Nai Province. Decision 20/2010/QD-UBND issued on April 05, 2010 stipulated allowance policies, and standards and procedures for resettlement examination when the State withdraws land in Dong Nai Province. Compatibility of the Government and the WB Approaches and Require Wavers The current laws, decrees and regulations make policies and practical resettlement of the Governement of Vietnam adequate to meet resettlement policies of WB more and more. Difference between laws and decrees of the Government of Vietnam from WB which related to compensation, resettlement and solving methods are described in Annex 1 Resettlement Policy Framework of DEP. Since there are differences between the WB s policy and the Vietnamese s, the policy framwork of WB will fully apply in all cases. This is in accordance with Decree No. 131/2006/ND-CP promulgating the regulation on management and use of Official Development Assistance. Compensation Principles for the Subproject The principles outlined in the WB OP4.12 have been adopted in preparing the Policy Framework. In this regard, the following principles and objectives will be applied. (a) Acquisition of land and other assests, and resettlement of people shall be minimized as much as possible. (b) All DP s residing, working, doing business or cultivating land in ROW of T/Ls, surrounding areas of tower foundations, the substation area, in the service roads under the project as of the date of the baseline surveys are entitled to be provided with rehabilitation measures sufficient to assist them to improve or at least maintain their pre-project living standards, income earning capactity and production levels. Lack of legal rights to the assest lost do not bar the DP from entitilement to such rehabilitation measures. (c) The rehabilitation measures to be provided are: (i) compensation areplacement cost, without deduction for depreciation or salvage materials for houses and - 8 -
12 other structures; (ii) agricultural land for land of equal productive capacity acceptable to the DPs or in cash at replacement cost according to DP s choice; (iii) replacement of residential/ premise land of equal size acceptable to the DP or in cash at replacement cost according to DP s choice; and (iv) transfer and subsistence allowances (d) Pay specially attention to households which belongs to vulnerable groups. Detail allowance methods for these households are included in ARP. (e) Replacement residential and agricultural land will be as nearby as possible to the land that was lost, and acceptable to the DPs. (f) The resettlement transition period will be minimized and the rehabilitation means will be provided to the DPs earlier than the expected start-up date of civil works in the respective subproject sites. (g) Plans for acquisition of land and other assests and provision of rehabilitation measures will be carried out in consultation with the DPs, to ensure minimal disturbance. Entitlements will be provided to DPs no latter than one month prior to expected start-up of civil works in the respective subproject sites (h) The previous level of services and community resources will be maintained or improved. (i) Financial and physical resources for resettlement and rehabilitation will be made available and as where and when required. (j) Civil works contractors will not be issued a notice of possession or a notice to proceed for any sub-project unless the Government has (a) Completed, satisfactorily and in accordance with the approved RP for that sub-project, compensation payments, and (b) ensured rehabilitation assistance is in place prior to starting civil work. Entitlements will be provided to DPs no later than one month prior to expected start-up of civil works at the respective project site. (k) Institutional arrangements will ensure effective and timely design, planning, consultation and implementation of DPs; and (l) Effective and timely supervision, monitoring and evaluation of the implementation of RPs will be carried out. Besides the direct compensation for the losses, DPs also will be entitled to additional assistance (subsidies/allowances) as stipulated in the Decree N o.197/2004/nd-cp, Decree N o.69/2009/nd-cp, and Decree N o.81/2009/nd-cp These subsidies/ allowances are as below a) Allowance for land within ROW Regarding to residential land and other lands which are located at the same parcel within the ROW but not require acquisition, these areas as the case may be shall be compensated and allowed not more than 80% of compensation of land acquisition in the ROW. b) Allowance for houses in ROW Houses, auxiliary structures which have partially or fully area within the ROW, these objects as the case may be shall be compensated not more than 70% of their values due to limitation and effect on life activities of landholdings. c) Other Rehabilitation Measures - 9 -
13 In addition to aforementioned information, any DP exposed to any impact other than those considered to be minor, will have a range of programs to support their full livelihood restoration and assure asset compensation at replacement values either consider each structure separately or if they consider structures by types to consider the most expensive structure in that group as bench mark. COMPENSATION AND ALLOWANCE 4.1 Compensation Surveying replacement costs To ensure that the applicable unit costs for compensation are at the replacement costs, during the impact survey, had carried out the survey on unit prices in Dong Nai province and compare them with the unit costs approved by the Dong Nai PPC. Construction prices given by contractors for recently structures are similar to construction price applied in this ARP. In this subproject, loss or damaged consist of land, perennial trees, paddy and crops. Survey results shown that proposed substaion and branch line will be built at rural areas where people mostly cultivate perennial trees and crops for living and stable land unit price. By reference viewpoint of the local authorities (Loc An and Long An Communes), it is said that compensation unit prices for land, trees and crops will be applied approved unit prices by the PPC. Compensation unit prices were proclaimed in public consultation meetings and received acceptance of DPs. Decision 72/2011/QD-UBND issued on December 22, 2011 stipulate compensation unit price for land in Decision 13/2011/QD-UBND issued on February 14, 2011 stipulated compensation and support when the State withdraws land in Dong Nai Province. It is noted that the RP s cost given in this RP is an estimate only. This rate will be considered by local authories and independent monitoring at the initial stage and amended by provincial People s Committee (if necessary) and used to estimate entitlement for DPs to ensure that all DPs will be compensated for their all loss or damage at replacement costs Defining compensation prices Compensation unit prices for land Chapter II of Decree No.188/2004/ND-CP - Methods of Defining Land price, which is elaborated in Chapter I of Circular No.145/2007/TT-BTC (i.e. Art.1 : the direct comparison method and Art. 2 : the income method ) ensure the adjustment of unit cost to meet replacement value at the time of issuance of unit cost. These unit prices are based on the replacement costs for land, house, trees and market prices for crops. However, the compensation unit prices will be reviewed by local authorities and Independent External Monitoring Agency at the initial stage of ARP implementation and the amendment will be done by the provincial People s Committee (if required and to be used for calculation the entitlements of DPs) to ensure that DPs will be compensated at the replacement costs for land, house, trees and market prices for crops according to this ARP policy. Direct comparison method and/or Income method (Chapter I of Circular 145/2007/TT-BTC dated 06 Dec., 2007) of defining land price shall be applied for the adjustment of unit cost to meet the replacement value by the time of issuance of unit cost. The contingency component would cover such differences by the time of actual ARP implementation. The newly issued Decree No.81/2009/ND-CP dated 12 Oct is also applied to estimate allowance for land value depreciation of land (due to change of land use purpose) Compensation Unit Prices for Trees and Crops According to Circular 14/2009/TT-BTNMT of MoNRE, compensation for fruit trees is determined based on the remaining harvests, perennial trees to be compensated at the replacement cost and annual crops to be compensated at the average yields of three latest years. PUBLIC CONSULTATION AND DISCLOSURE 5.1 Public Consultation During the subproject preparation (along with ARP preparation), SPPMB and the Consultant have held community meetings at offices of Loc An and Long An Commune People s Committee of Long Thanh District, Dong Nai Province with the participation of DPs and representatives of these CPC where the subproject related issues such as target of the subproject, substation s location, route alternate, investment financial resources, subproject components and compensation policies, minimized measures, etc. were presented and explained by the Consultant. Public consultant were carried out by sending summary document of the subproject and surveying by Questionaire to 100% of subproject affected households and organized community meetings. This summary document was described subproject s components, resettlemnet policy, frequently asked questions of DPs, prevented methods for risk of shock and protect measures for the ROW, potential impacts and minimized methods, etc. In the community meetings, DPs queries on ARP related issues such as entitlement, compensation, etc. were answered and recored by representatives of the Consultant. (Please see Annex 6- Minutes of public consultant meetings and photos). has carried out field survey in November, 2010 and socio-economic surveys by direct interviews and fill-in the Questionnaires for 100% of DPs in the project areas during December, 2011 and March, 2012 (Please see detail in Annex 3 Inventory of loss of of project affected people). Information dissemination to, consultation with and participation of the Displaced people and involved agencies (i) reduce the potential for conflicts, (ii) minimize the risk of project delays, and (iii) enable the project to design the resettlement and rehabilitation program as a comprehensive development program to fit the needs and priorities of the displaced Person, thereby maximizing the economic and social benefits of the project investment. The objectives of the Public Information Campaign and DPs Consultation Program are as follows: To share fully information on the proposed project areas, its components and its activities with the Displaced Persons. To obtain information about the needs and priorities of the effected people as well as information about their reactions/feedback to proposed policies and activities. To obtain the cooperation and participation of the displaced Person and communities required to be undertaken for resettlement planning and implementation. To ensure transparency in all activities related to land acquisition, resettlement and rehabilitation. Participant components who invited to the public consultantation meeting consist of representatives of subproject affected households, local authorities, other related agencies, and commune NGOs (Women Union, Farmers Associations, etc.) (Please see more detail in Annex 6). Such ARP report in both Vietnamese and English versions shall be established at Vietnam Development Information Center (VDIC, 63 Ly Thai To St., Hanoi City) for relevant organizations to read, inquire and give their opinions about the report. Also, the ARP in English version shall be sent to WB s head office in Washington DC to proclaim

SUPERVISION, MONITORING and VALUATION Implementation of RPs will be periodically supervised and monitored by the respective PC/its PMB in a close coordination with the respective Peoples' Committees at different administrative units and independent monitoring agencies. The findings will be recorded in quarterly reports to be furnished to EVN, PCs, Project Provincial Powers, and World Bank. 6.1 Internal monitoring and supervision Internal monitoring and supervision will: (a) Verify that the baseline information of all DP s has been carried out and that the valuation of assets lost or damaged, and the provision of compensation, resettlement and other rehabilitation entitlements has been carried out in accordance with the provisions of this Policy Framework and the respective RP. (b) Oversee that the RPs are implemented as designed and approved. (c) Verify that funds for implementing the RPs are provided to the respective PMBs in a timely manner and in amounts sufficient for their purposes, and that such funds are used by the respective PMB s in accordance with the provisions of the RP and policy framework. (d) Record all grievances and their resolution and ensure that complaints are dealt with in a timely manner. The independent agencies will be academic or research institutions, non-governmental Organizations (NGO) or independent consulting firms, all with qualified and experienced staff and terms of reference acceptable to the World Bank. Regular independent monitoring begins about the same time as implementation activities and continues until the end of project/subproject. Scope of work, implementing methods and other related issues will be stipulated in its Term of Reference. 6.3 Reporting Condition Internal monitoring will make report quaterly with detail schedule of ARP implementattion. These reports will be sent to EVNSPC, Dong Nai Power Company, WB and Independent monitoring organization. IMPLEMENTATION SCHEDULE 7.1 Implementation Responsibility Electricity Vietnam (EVN): EVN is the owner of the project and is responsible for managing and organizing of investigation, design, budget arrangement, funding and supervision for ARP implementation. Trade and Rural Power Deparment of EVN was appointed as direct management unit of DEP. Southern Power Corporation (EVNSPC) EVNSPC is responsible for hiring qualified consultant to prepare ARP; appointing qualified social safeguard staff at EVNSPC and SPPMB and Compensation and Resettlement Committees at provincial and district levels. Southern Power Project Management Board (SPPMB) SPPMB is responsible for management day-to-day activities include making plans, programs, sources of financing, and ensuring the overall coordination and association for monitoring of resettlement compensation, designing, implementation, monitoring, evaluation; and coordinate with EVN and WB. Dong Nai Provincial People s Committees (PPC) PPC is responsible for clearly direct/ demarcate the responsibilities for their relevant institutions in implementing RP. Approve the compensation unit prices, allowances and establishing compensation committees at all different administrative levels and approve lands for compensation. Recording and redress complaints and grievances. ARP Related Provincial Departments The Provincial Department of Finance (DOF) is responsible for studying and issuing unit prices of compensation and submitting to PPC for approval. Right from the initial stage of the RP implementation, the DOF will closely co-ordinate with Department of Construction, Department of Nature and Resources Environment, Long Thanh District People s Committees and independent external monitoring agency in order to evaluate the applicable unit prices in RP and propose to PPC for approval and ensuring the compensation unit prices to be at the replacement value at the time of compensation payment. Provincial Compensation and Resettlement Committee (CRC) The Provincial CRC is responsible for implementing RP according to the approved Schedule. The Provincial CRC will be headed by the Vice Chairmen of the Provincial People s Committee. The Provincial CRC is responsible for: Assisting SPPMB and District CRC in preparing detailed plans for compensation and resettlement. Checking all inventory of impacts and detailed implementation plans submitted by District CRC. Approving the implementation plans submitted by the District CRC. Solving complaints if the redressal is fail at the district level. The Provincial CRC will consist the representatives of:
24 Department of Finance Department of Construction Department of Natural Resources and Environment Chairmen of People s Committees of related district Representative of SPPMB. Long Thanh Districts People s Committees The District People s Committee is responsible for guiding the compensation and resettlement activities in their respective district areas: Direct the relevant institutions for carrying out impact survey; public consultation, information dissemination on the resettlement policy and RP implementation. Establishment of District CRC. Identify jurisdition conditions of land use right or property right any other real estate Solving complaints of DPs at the district level. Long Thanh District Compensation/Resettlement Committees The District CRC is principal institutions responsible for the implementation of RP in their respective district areas. The District CRC recruit experienced personnel for gathering of base-line information and inventory. The District CRC is responsible for: Organizing the survey team to carry out Detailed Measurement Survey (DMS) for affected houses and assets; finalizing DMS and Entitlement forms for each DP. Checking the unit prices of compensation as applied in RP, suggesting for the adjustment of the unit prices in conformation with market prices/replacement costs (if required). In co-ordination with SPPMB, organizing the meetings with DPs and local authorities to disseminate the RIB, DMS and resettlement log to DPs. Based on the policy and approved process in RP, preparing the detailed implementation plan (quarterly, semi-annual, annual plans) and the together with SPPMB pay entitlements to DPs in a timely manner. Settling the complaints and grievances of DPs, solving any difficulties during the implementation period. The District CRC will be headed by the Vice Chairmen of the District People s Committee. The District CRC will consist of the following representatives: Department of Finance of DPC Department Natural Resources and Environment of DPC Department of Industry of DPC SPPMB Affected communes DPs Long An & Loc An Commune People s Committees
25 People s Committees of communes will be responsible for: Contributing to census and inventory surveys. In co-ordination with District CRC for public meetings, information dissemination, compensation/allowance payment to DPs. Transferring all feedback by DPs to District CRC and settle the complaints at the communal level. Suggesting the solutions for the outstanding issues (if any). Assisting local people in overcoming the difficulties during the construction period, assist DPs in repairing of affected houses. Arranging land in the case DPs require compensation by land for land. Displaced Persons (DPs) DPs are ready with their necessary RP related papers i.e. LURC, ownership of other assets. DPs are responsible for carefully checking on their lost assets and respective entitlements and clear land in a timely manner once DPs receive full entitlements. Independent Monitoring An independent agency is responsible to supervise and evaluate implementation of ARP for the subproject. COSTS AND BUDGETS Source of financing for ARP implementation is from distribution of EVN/SPC. - SPPMB will transfer such budget to Dong Nai Provincial CRC. - Provincial CRC will transfer such budget to Long Thanh District CRC. - Long Thanh District CRC is responsible for : Payment of compensation and all entitled allowances directly to DPs, and Payment to cover costs of overall ARP activities. The rates of compensation and cash entitlements for rehabilitation and allowances payable to the DPs shall be reviewed and, if necessary, adjusted at the actual time of ARP implementation based on the actual annual inflation rate upon request of the CRCs. 30 ANNEX 1 FRAMEWORK Key Issues National Laws World Bank Policy Project Policy Non-titled users Decree 69/2009, Article 14 (replacing Decree 197/2004, Article 8), the Peoples Committees of the provinces or centrally-run cities shall consider providing such support on case-by-case basis. The absence of formal legal title to land by some affected persons should not prevent compensation. All project-affected people, irrespective of tenure status, social or economic standing, will be entitled to be compensated or assisted for their lost assets, incomes, and businesses, at full replacement cost and provided with rehabilitation measures sufficient to assist them to improve or at least restore their pre-project living standards, income levels and productive capacity. Compensation of land at replacement cost Decree 123/2007 (amending Decree 188/2004), sets price limits of land and authorizes Provincial Peoples Committees to set local land prices by establishing ranges for all categories of land and land prices in each category. The price limit would not be allowed to exceed a benchmark price by more than 20 per cent nor undercut the benchmark price by more than 20 per cent. However, in remote, isolated areas, or an area with socio economically difficult conditions, poor infrastructure, when the actual price of land in the market is lower than minimum price limit in the Decree, the PPC will adjust the specific price to be applied locally and report it to the Ministry of Finance. Article 11 of Decree 69/2009ND-CP stipulates that, If at the time of land recovery, the land price specified by the PPC is different to the actual market price under normal conditions, the PPC shall Compensate or assist all affected persons, including those without title to land, for all their losses at replacement rates. Replacement cost surveys have to be carried out to ensure that project compensation rates for all categories of loss will be equivalent to replacement cost to be updated at the time of resettlement implementation
31 Key Issues National Laws World Bank Policy Project Policy determine the land price again so that it is specific and suitable. Non-registered business Decree 187/2004, Articles 26-28: Only registered businesses are eligible for assistance. For non-land assets, all eligible affected people, whether titled, legalizable, or nontitled, need to be compensated at replacement cost, through cash or replacement assets. Included among these DPs are renters of buildings, tenants and employees of affected businesses. Non-registered businesses will be eligible for cash or inkind assistance, this includes renters of structures, tenants and employees Provision of rehabilitation assistance Decree 69/2009, Article 20 & 22: DPs losing 30% or more of productive land will be entitled to living stabilization and training/job creation assistance. Decree 17/2006 strengthens this provision and provides for longterm assistance to poor households. As per the WB policy, minor impacts are considered if affected people are not displaced and less than 10% of their productive assets are lost. The project will provide additional support and income rehabilitation assistance/ allowances to all DPs with land based livelihoods who are affected by the loss of more than 20% of total productive land (and 10% applicable for the poor and vulnerable group)

Land loss equal or more than 20% of their total landholdings, and 10% or more for the poor and vulnerable group: DP can opt for the followings: i) Land for land with the same area and productive of impacted area if the remaining plots are still economic viable and for the whole impacted plots if the remaining plots are not economic viable ii) Cash for land at the replacement cost. - Compensation for trees and affected fruit trees at the replacement cost. - Rehabilitation assistances. For DP losing Residential and garden land: With respect to garden land or ponds which are attached to the affected residential land, and the affected agricultural land which is located within the residential/settlement area, the Project will provide an assistance of 50% of price of the neighboring residential land in addition to compensation at Implementation Issues payment. - Replacement land, and resettlement sites development. - DPs receiving compensation will demolish the impacted areas and reconstruct/or improve their houses themselves. - Full compensation for trees and fruit trees to DPs at least 01 month before land clearance. If DP is requested for cutting affected trees, PMB will pay money for this work. DP has right for using salvageable trees. - Full compensation for impacted house and allowances to DPs at least 05 months before land clearance. - No award civil work contract before completion of compensation and reorganizing houses or relocation. - Payment to DPs will be delivered by PCs and DRCs - Finance/ land available for compensation/ rehabilitation and well information disclose/ disseminate. - PCs and local authorities will consult with DP who are eligible to restoration for their options and prepare proposal for restoration programs in the period of RAP implementation. - DPs will be granted with Land Use Right Certificate without payment of administrative fees
37 Binh Son 110kV Substation and Branch Line Abbrievated Resettlement Plan No Type of loss Application Definition of entitled DPs 7 DP impacted on business or other services 8 Public Work All DPs impacted on business and other services -do- Compensation Policy replacement cost for agricultural land as regulated by the laws. With respect to residential land, DP will be entitled to: - If remaining land is sufficient for reorganizing (not less than 60 m2): Cash compensation for lost area and assets associated with land. - If remaining land is not sufficient for reorganizing: DP can opt for i) cash compensation at replacement cost for land and assets on land, or ii) land for land compensation for the whole residential area which DP occupied (not only for the impacted areas) and properties associated with occupied land. For affected house and building, the same entitlement to DP of categories 3 or 4 or 5 (a) Temporary impact on business or other services. Compensation for income lost in the affected time (b) Permanent impact on business or other services. Rehabilitation assistance. Implementation Issues - Full compensation for incomes lost to DPs at least 01 month before land clearance. - PCs and local authorities will consult with DP who are eligible to rehabilitation for their options and prepare proposal for rehabilitation programs in the period of RAP implementation.
