3 PACKAGE 30-RCP 02: TEBAS-SINGKAWANG (SECTION-1 & 2) AND GALING- TANJUNG HARAPAN PACKAGE 30-RCP 03): SP TANJUNG-GALING (SECTION-1 & 2) AND ARUK-SP. 3 TANJUNG SAMBAS AND SINGKAWANG DISTRICT - WEST KALIMANTAN PROVINCE I. PROJECT BACKGROUND 1. The Regional Road Development Project (RRDP) in Sambas District, West Kalimantan has five subproject roads which three of them i.e. Singkawang Tebas ( ), SP3 Tj. Harapan SP3 Galing ( ), and SP3 Tanjung SP3 Aruk ( ) which will have resettlement impacts. The sub projects will pass through 2 sub districts and 2 villages within Singkawang District, i.e. Singkawang Tengah with Jawa village; Singkawang Utara with Sei Wie village. Whereas 3 sub districts with 12 villages within Sambas District consist of Pemangkat, Semparuk and Sajingan Besar, with the villages are: Pemangkat Kota, Penjajap Harapan, Prapakan, Tebas, Semparuk, Segedong, Singaraja, Tanjung Harapan, Galing, Senatap and Kaliau. The Description of subproject roads is shown in the Table The draft Land Acquisition and Resettlement Plan (LARP) for Sambas was agreed between the Government of Indonesia and ADB in July 2010 that has been updated in October 2011 due to additional road lengths as per DGH design, and in November 2012 following detailed inventory and measurement done by Team of Inventory and Negotiation for Delivering Compensation of Provincial and National Development Road of Sambas District for 2011 Fiscal Year (Tim Pendataan dan Negosiasi untuk Pemberian Uang Santunan Pembangunan Jalan Propinsi dan Jalan Nasional, Kabupaten Sambas Tahun Anggaran 2011). As stated in the previous LARP, scopes of updating are including updated number of Affected Households related to detail inventory of losses done by Land Acquisition Committee, updated width of affected asset, updated unit rate for calculation of replacement asset following new standard/new market price and implementation of LARP. The entitlement may be revised, as needed, to better respond to the need of the APs, but the standards set in the previous LARP cannot be lowered when the LARP is finalized. The Resettlement Plan prepared for Sambas District was based on initial design with total corridor-of-impact (COI) 14 meters has been used as basis for estimating the scope of resettlement impacts. The LARP is based on inventory by Team of Inventory and Negotiation for Delivering Compensation of Provincial and National Development Road of Sambas District using a corridor of impact (COI) of 14 meters. During the preparation of this document, numbers of meetings were held with potentially affected households and other stakeholders to determine potential impacts on land, non-land assets, and income of households living along the subproject roads. 4. The implementation report made for find out how far the action plan in the LARP document has been implemented in the field, and identifies constraint and problems that faced during the implementation process, as well as progress of land acquisition and resettlement or update of compensation payment. II. PURPOSES OF REPORT 5. The report was prepared to find out how far action plan in the LARP document has implemented in the field, and also identify constraint and problems that faced during the implementation process. III. NUMBER OF AFFECTED PERSONS 6. The first inventory of asset was carried out on 11 to 25 February 2010, additional inventory on February 2011, and on August 2011 with Corridor-of-Impact (COI) used for the project is 14 meters total. Estimated 284 affected persons (APs) have been identified. 7. The estimated area of land to be acquired is 4, square meter. With the exception of 39 households who are within the ROW, the 245 APs have certificated and non-certificate land. Non-certificate land (SKT/Girik) is issued by head of sub-district or head of village, and falls under customary right. These 245 APs are entitled to payment for land while the 39 Sambas and Singkawang District 4

5 households are not entitled to payment for land but are entitled to cash assistance for their affected structures (fence and shops) at replacement cost. 8. There are total of 133 businesses/shops affected at along three links. Some main structures of the 120 shop/business are partially affected. The remaining 13 shop only the terraces affected, thus there will be no relocation of shops. In addition, there is health center clinic in Harapan Village (Singkawang Tebas) which is only fence and will be partially affected. Other structures affected are concrete and wooden fences and also terraces which owned by 76 households. The unit rates below are based on information gathered from the field at the time of LARP preparation. The rates have been used for cost estimation only and will be adjusted following the conduct of replacement cost survey during the finalization of the LARP. 10. The unit rates were derived from the sub-district and households in the area. The local banks do not have information on the market value of land. Please note that these are cost estimation only and will be adjusted to reflect current market prices at the time of payment. 11. The width of affected land was measured during inventory of losses on February 2010 and February However, inventory carried out by the Team of Inventory and Negotiation Sambas District only measured affected asset, not the affected land. As informed by Public Work Agency of Sambas District, and head of Pemangkat Kota and Prapakan village that the land within ROW has already acquired by Government of Sambas. The rates were derived from Public Work Agency of Sambas District These rates are used as basis for private businesses or construction suppliers to issue their market prices. There is no depreciation applied for the structures or deduction for salvageable materials. At the time of LARP preparation the district has not established 2010 rates, therefore budgeting purposes, 2009 rates will be used. The additional assets that identified in 2011 still use 2009 rates for budget purposes. However, during LARP finalization, the rates will be adjusted to reflect current market prices at the time of compensation. NO. 7 13. There are 133 businesses that will be partially affected. It is estimated that the business/shops will be disrupted during restoration. Average net income of shop is IDR 50,000/day, thus cost estimates for assistance\temporary loss of income is IDR 31,500, There are 27 elderly households and 9 households of vulnerable households that headed by women. The district committee will give particular assistance during restoration of their affected properties, such as easy access to get materials and labor, if needed. The project staff and external monitor will ensure that all of the vulnerable households will get all of information easily and receive all of their compensation prior to clearance of land. 15. For protecting ROW land, the prohibition sign for using acquired land will be installed in several strategic points alongside the road link. Estimated cost for one prohibition sign is about IDR 500,000 and will be installed ±10 units. Total cost estimation is IDR 5,000, In summary, cost estimates for resettlement is IDR 4,215,393,563 as shown at Table 5 below. It includes cost for engaging an external monitor, contingency and administration cost. The administration cost of 15% is applied for budget purposes only. 17. Based on the Decree of Bupati Sambas No. 270 B/2011 the LG of Sambas change name of affected persons and allocation budget of uang santunan decrease become IDR 597,600,000 for replacement affected structure only. Whereas the replacement cost estimation budget need IDR 3,259,514,850 for replacement affected land and structure. A meeting between DGH and Sambas District has been carried out to address this issue. ENTITLEMENT MATRIX 18. The entitlements below are based on potential resettlement impacts and corresponding compensation and assistance to the APs, regardless of tenure status. Entitlements adopted are based on central and local decisions, ADB-funded project in Indonesia and as per policy principles of ADB Safeguard Policy Statement. It should be noted that actual impacts can only be determined based on census and detailed measurement survey. The entitlement matrix of this LARP may be revised to reflect the relevant changes but the standards set in the LARP entitlement matrix cannot be lowered when the resettlement plan is finalized. 8 19. Initially compensation payment of assets in Sambas District only based on the uang santunan, which means it doesn t meet with the entitlement matrix. Therefore during mission on December 2013, ADB requested some agreement of Sambas District and Provincial Government of West Kalimantan to comply with standards set in the LARP entitlement matrix. LG of Sambas commits to complete payment process of land acquisition and resettlement based on replacement cost, with target of completion is within next six months or will be completed on July However, the plan cannot be implemented, after a series of meetings with LG Sambas and west Kalimantan provincial government, it will be attempted to fulfill them through correspondence assistance from the Directorate General of Highways. Any utilities (eg. water meters or water pipes) that will be fully damaged and can no longer be re-installed will be compensated at replacement cost. Cash assistance based on replacement cost which is equivalent to current market value of structures and labour without application of depreciation. Owners will be allowed to take salvageable materials. As for the utilities such as water and electricity, owners will be compensated based on cost of removal and installation of said utilities. Any utilities (eg. water meters or water pipes) that will be fully damaged and can no longer be re-installed will be compensated at replacement cost. Temporary disruption of Shop owners It is estimated that 120 shops may require 2 5 days to be repaired. 1 Non-certificate land (SKT/Girik) is issued by Head of Sub District or Head of Village. It falls under "customary right. It is common practice that during land acquisition process, "non-certification land" is upgraded as "certification land", and certification cost will be shouldered by the Government. Contractors will be responsible for paying rental in cash for land outside the ROW which will be no less than the net income that would have been derived from the affected property during disruption. Restoration of land will done immediately after use. Non-land assets within the residual area of the ROW will be replaced through in-kind support while those outside of the ROW that are adversely impacted by construction activities will be compensated in-kind or cash at replacement cost by the civil works contractor. *) Of the 254 households with land and non-land certificate, 62 households have affected land without structures/fixed assets ( = 192 HHs). **) 3 HHs inside of ROW have affected structures. V. IMPLEMENTATION PROGRESS a. Establishment of Land Acquisition and Resettlement Team 21. Refers to Head of National Land Board s Regulation No.3/2007 regarding Implementation Guidelines for President Regulation No. 36/2005 and 65/2006, the Land Acquisition and Resettlement is carried out by the Land Acquisition Committee (LAC) that established by the Bupati. The Office of the Bupati will provide the main workforce in the preparation and implementation of the LARP. The Bupati will have the following functions: (i) organize the committee for resettlement by way of a Decree; (ii) issue a local regulation on the unit costs of affected assets based on replacement cost and/or market rates; (iii) issue a local regulation with regard to assistance to informal settlers on ROW or state land; (iv) manage and disburse funds for compensation, assistance and administration costs; and (v) assist in the expeditious and judicious resolution of complaints of DPs. The office of the Bupati will work closely with the PMU staff. Sambas and Singkawang District 9

10 22. As per Indonesian Government regulations on Land acquisition for the Development of Public Purposes, land acquisition was implemented by the Land Acquisition Committee (LAC) (Panitia Pengadaan Tanah Untuk Kepentingan Umum) chaired by the Bupati of Sambas District. The Head of Bappeda served as a vice chairman with 9 members from relevant institutions including Chief of Sub District and Head of. The main tasks of the LAC at the Sambas District level are to collect land property data in the affected area, conduct public meetings with local residents and the affected people, negotiate and pay compensation, and address any disputes that may arise during Project implementation. b. Socialization 23. Socialization is carried out based on the Regent's Decree on the Formation Team Socialization in February 2010 (SK Bupati Sambas). Socialization was done throughout discussion between community and the Land Acquisition Committee (LAC). In addition, dissemination leaflet of land acquisition for RRDP was conducted as well, on the socialization in Sambas District. Socialization to the APs has been done through a series of consultation meetings with the relevant local government agencies were held in February and March 2010, to gain an understanding of the land acquisition process. c. Measurement and Inventory of Losses 24. Inventory of losses survey (IOL) was conducted in combination with the socio-economic survey (SES) and covered all the affected households in the sub-project area. Replacement cost survey (RCS) was also conducted by collecting information from both secondary sources and primary sources. The methodology includes direct interviews with people in the affected area, information from local authority, and relevant national and local regulations. 25. Inventory and measurement activities was done by a team of Data Collection and Negotiations for Awarding Compensation of Provincial Roads and National Roads Improvement in Sambas District, together with or witnessed by the PAPs. The results of measurement and inventory activities will be announced at the Village Hall and/or at the local/sub-district to be clarified by the PAPs on the width and type of asset that get compensation. At this time the community may delivers a complaint to the Land Acquisition Committee either directly or in writing. Then the result of the clarification was announced back at the Village Hall and the local or sub-district or answered directly by the implementation team to the PAPs who complain. d. Compensation Payment 26. Compensation value or the assets value of PAPs is determined by the Regent's Decision based on the assessment of the Data Collection and Negotiations Team for Awarding Compensation of Provincial and National Roads Improvement. Negotiation in section of Singkawang Tebas (Section 2) has been performed, the results of have been reported in September Furthermore, the results of these negotiations are set as the santunan by the Regent of Sambas. 27. Activities of compensation payment to PAPs constitute payment to the PAPs according to the value of assets that are made directly to the eligible PAPs whose name appears in the list of results of negotiation. Compensation Values are given according to the results of negotiations without any cuts. The amount of compensation in Sambas district for land acquisition for Regional Road Development Program (RRDP) established firstly through decree number 268 in 2011, renewed with the Sambas Regency Decree number 270 B in Sambas and Singkawang District 10

11 Therefore, the compensation amount was based on the Sambas Regent Decree No. 270 B/2011. Through interviews with the Land Acquisition Committee, compensation payment activities have completed in the year 2011 and results have been reported in January However, the results of which payment has been carried out, there are several records required clarification, namely: i) there are differences in the names of APs that are listed in the document LARP with a Sambas Regency Decree, so it is necessary measures to perform validation; ii) Compensation Uang Santunan only for buildings and plants; iii) some LARP program has not been implemented as assistance to APs that loss of income and support for vulnerable groups. 29. On the basis of the above conditions, the necessary corrective actions to be consistent with the ADB provisions and as contained in the document LARP. e. Income Restoration 30. Income Restoration Program (IRP) is focused to help the severely affected AHs i.e. households who lose 10% or more of their productive lands; the household affected by the entire loss of houses or by the entire loss of kiosks, and vulnerable AHs such as the poor, improve their situation. Women will participate during the detailed measurement survey, consultation meetings, and payment delivery. The Project will ensure active participation of women during the design, implementation and monitoring, on the community development programs. Resettlement monitoring will be disaggregated by gender. 31. The Local Government of Sambas District has not discussed about allocated budget for livelihood restoration assistance to affected households. The programs are geared to restore, if not improve, the socio-economic conditions of affected households, including vulnerable households. f. Grievance and Complaints 32. Grievance mechanism and complaints redress have been informed to the AHs during socialization, and described detail in the Project Information Pamphlet that has distributed to affected households. There no grievance and complaints received by the LAC or Project, which means no grievance and complaint regarding land acquisition process or amount of compensation or any complaints and grievance could be solved in the field level. g. Internal Monitoring 33. Project Management Unit will prepare quarterly reports and submits to DGH starting from the commencement of LARP implementation. This report is part of the quarterly report which includes update on resettlement in its regular progress reports to ADB. 34. The internal monitoring and supervision will look into the following concerns: a. Compensation and other entitlements are provided as per agreed Final LARP, with no discrimination according to gender, vulnerability, or any other factor; b. Income restoration measures are designed and implemented including modifications in the programs and provision of additional cash and in-kind assistance to the participating affected households as and when necessary; c. Public information, public consultation and grievance redress procedures are followed as described in the agreed Final LARP; Sambas and Singkawang District 11

12 d. The transition between relocation or site clearing and commencement of civil works is smooth and that sites are not handed over for civil works until the affected households have been satisfactorily compensated, assisted and relocated. h. External Monitoring 35. The scope of work of the external monitoring is to provide an independent periodic review and assessment of (i) the achievement of settlement purposes; (ii) changes in income, livelihoods and standards of living; (iii) restoration and / or improvement of the economic and social base of the affected communities; (iv) the effectiveness and sustainability of rights; and (v) the need for further mitigation measures. The activity External monitoring and evaluation activities for LARP in Sambas and Singkawang District has been done in 2013 and uploaded on the ADB website. In 2014 being carried out by consultants hired by the Directorate General of Highways as the Executing Agency. 36. In order to compliance monitoring during resettlement implementation, the main activities of the external monitor will revolve around the following: (i) review existing baseline data and gather additional socio-economic information, as necessary, on sample affected households; (ii) monitor preparation and implementation of the LARP; (iii) identify any discrepancy between policy requirements and actual implementation of resettlement; (iv) monitor the resolution of complaints and grievances of affected households; (v) provide recommendations for improving resettlement preparation and implementation; and (vi) review compliance with regard to use funds for land acquisition and resettlement. VI. CORRECTIVE ACTION PLAN and FOLLOW UP ACTION 37. Based on the results of the verification as to the difference in the name of the village and AHs conducted jointly with the Government Parties and Parties Sambas District Project on November 4 to 10, The number of AHs and land area shall be compensated is as follows: No. District No. Of AHs Land Affected Area (m2) 1. Once has received fund assistance from Provincial Government, Sambas District should pay allowance revenue loss to the APs. This assistance includes also proposed to receive funding from the province of West Kalimantan. 4. Assistance vulnerable groups. to 2015 APs that require relocation/fixed of shops/ structures should be provided easier access to materials and provision of labour, as needed. Assistance may be in cash or in kind. It was discussed with LG of Sambas. This assistance includes also proposed to receive funding or from the province of West Kalimantan. Once has received fund assistance from Provincial Government, Singkawang City should pay allowance revenue loss to the AHs. This assistance includes also proposed to receive funding from the province of West Kalimantan 39. The LG of Sambas and Singkawang was expected provide fund for giving allowance of lost revenue some affected shops/kiosks. The average net income of shop per day is IDR 50,000; therefore Sambas Government should multiply the shop/kiosk affected, by the number of days of disruption which is approximately 5 days, thus amount of allowance about IDR 250,000/shop. 40. Estimated costs necessary to implement the program set forth in the table above is IDR. 8,000,000,000,- 41. In order to accelerate implementation of corrective action, was suggested to keep coordination among Directorate General of Highway and Local Government of Sambas and Singkawang District, especially regarding completion of replacement cost of affected assets, delivering allowance of lost revenue and assistance to vulnerable groups.
