8 1 1 PROJECT DESCRIPTION 1.1 Background The Asian Development Bank (ADB) intends to provide an investment project that will contribute to the Government s goal of providing safe water supply and improved sanitation facilities for rural households in Vietnam. The Central Region Rural Water Supply and Sanitation Sector Project (CRRWSSP) aims to improve the rural environment and enhance poverty reduction activities in six provinces of the Central Regions of Vietnam, namely, Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Nam and Binh Dinh provinces, located in the North and South Central Region. The Executing Agency (EA) for the CRRWSSP is the Ministry of Agriculture and Rural Development (MARD), with responsibility delegated to the National Centre for Water Supply and Sanitation (NCERWASS). The Implementing Agencies are the Provincial Centres for Rural Water Supply and Sanitation (PCERWASS) established in each of the 6 provinces. Six subprojects in six target provinces were selected for project preparation for Phase 1 in January 29. Phase 1 will involve provision of piped-water supply system and sanitation facilities in the following subprojects: In Thanh Hoa province, Tien Loc commune, Hau Loc district. In Nghe An province, Dien Yen commune, Dien Chau district. In Ha Tinh province, Thach Bang and Thach Kim communes, Loc Ha district. In Quang Binh province, Thanh Trach commune, Bo Trach district. In Quang Nam province, Ag Roong hamlet, A Tien commune, Tay Giang district. In Binh Dinh province, Tay Thuan and Tay Giang commune, Tay Son district. Based on ADB Social Safeguards Policy, a Land Acquisition and Resettlement Plan (LARP) shall be prepared when social impacts on land acquisition and resettlement activities are identified so that mitigation measures and compensation for loss of personal properties and assets of project-affected-persons or households will be undertaken so as not to impoverish them and make them victims of the subproject. The intial LARP for Tien Loc Commune, Hau Loc District rural water supply and sanitation subproject in Thanh Hoa province was prepared in February 212 and this was updated in November 213 after the detailed engineering design was completed and approved. This Updated Land Acquisition and Resettlement Plan is based on the following: Results of Detailed Measurement Survey (DMS) of Affected Households (Ahs); Hiring of an independent consultant to validate replacement costs based on the market price and to apply this to the Compensation and Resettlement Plan; The provincial People s Committee s approved the compensation unit prices for compensation and resettlement. After detailed engineering a DMS of affected households was carried out in November 213. There were no major changes between the basic design used as the basis for approved LARP and the approved detailed design. Therefore small updates on amount of required land area, amounts to be compensated have been made. The number of affected households has been increased from 8 AH to 81 AH.

9 2 1.2 The Thanh Hoa Subproject Description The Thanh Hoa Subproject is located in Tien Loc commune, Hau Loc district of Thanh Hoa province. Present, water sources for domestic use are surface water, groundwater, irrigation water and rain water. Except for rain water, most of the other sources of water for domestic use are unsafe because of chemical pollutants from farming and from mechanical production from recycling of junk iron and steel. Subproject area in Thanh Hoa With the construction of the new water supply project, households will have easy access to clean and safe piped-water to their houses. It is estimated that the construction will be undertaken within a period of 2 years. The long-term goal is to provide of 9,565 persons (1% of commune population) with clean and safe piped-water by 22. The water supply component of the Subproject will consists of the following:

11 4 Figure 1 Layout of Thanh Hoa Subproject Water Supply System in Tien Loc Commune. 2 SCOPE OF LAND ACQUISITION AND RESETTLEMENT 2.1 Inventory of Losses The Thanh Hoa PPMU and PPTA consultant have conducted initial survey of losses for all affected land, assets, properties and trees in the project area. The initial survey of losses was conducted in 29 to prepare feasibility study of the subproject. Since the above-mentioned survey was conducted 3 years ago and the data was out of date, a follow-up survey of losses was conducted by PPMU Thanh Hoa on Feb 13-17, 212 to validate and update the 29 data. 2.2 The Affected Land and Non-Land Assets 2.3 Loss of Land Land for borehole and water treatment plant. There is one borehole located within the treatment plant area. The water treatment plant will be located on agricultural land and presently it is used for rice farming. Area required for WTP is 2,516 m 2 and following the result of survey of PPMU Thanh Hoa there are 2 affected households by construction of water treatment plant. out of which five (5) HHs lose more than 1% of their productive land.

Land for the Water Reservoir and access road to the reservoir The water reservoir/tank will be constructed on a hill with an elevation of 4 meters above sea level, and approximately 225 meters away from the water treatment plant. The land area to be acquired for reservoir is 216 m 2 and it is public land, therefore there will be no compensation for land acquisition. However, the 21 timber trees (mainly cajuput) that will be felled/cut will be compensated. Two (2) households are affected. The land acquired for this access road to the reservoir is 482 m 2. 13 6 Land for Access Road to water treatment plant widening The access road leading to the location of the water treatment plant will be widened to allow equipment and construction materials to be transported to the worksite. It also is the road to be used for the operation and maintenance stage.

14 7 Figure 4 Access Road to the water treatment plant to be widened. The present access road s width is around 3,8 meters. It will be widened on the right side of the road for 5 meters and the affected land is agricultural land planted mostly to rice. The total length of the access road to be widened around 391m and the total affected area is 1,14 m 2 including 1,54m 2 paddy rice and 5 m 2 fishing and this fishing land also is public land, there are 43 HHs affected because of loss of farmland, in which 1 HHs will lose fishpond. Clean water distribution system pipe line Clean treated water distribution system pipeline including main pipeline, secondary and services network pipeline s total length is meters. Around 23.9 m 2 public land will be temporary acquired for construction of the distribution system pipeline. The main pipeline, with diameter 15mm, from reservoir on the hill to the intercommunes road will have a length of around 24m, will pass through rice and vegetable fields. PPMU will permanently acquire this land, with area of 59m 2 ( out of which 239m 2 is rice field and 351m 2 is peanut). Following the survey of PPMU Thanh Hoa, there are 16 households to be affected by this component.

Crops such as rice, peanuts, and various vegetables planted near by the access road to water treatment plant affecting 43 households, and main pipeline affecting 16 households (from the reservoir to inter-communal road) will be compensated.

Based on field survey, there will be no impacts to architecture, buildings, electric posts and other public utility structures for the laying of the network pipeline as well as the construction of the reservoir on the hill and water treatment plant. 17 Cultural/Aesthetic Structures Based on technical design there will be no impacts on cultural or aesthetic structures Disturbances to Livelihoods Following the design of the pipeline located on the inter-hamlet roads, service roads located on the edge of the hamlets, show that there will be no impact or loss of structures, crops as well as other assets of households during the construction of pipeline. Disturbance to businesses located along the road where the pipeline will be laid and experience temporary difficulties in terms of access, and noise and dust pollutions. To minimize temporary disturbances particularly on access to businesses, services and other activities along the road, the Contractor will provide information 2 weeks in advance, about the date, time and duration of the construction activities so that the affected households/businesses and/or institutions will be able to prepare their activities. Wooden or steel planks will be placed across excavations to provide access and ease traffic movements. Other measures and timing to minimize disturbances and impacts are: Pipelines will be put in parallel with the process of digging ditches to save time. Once the pipes have been laid, this will be immediately covered with earth/soil. It is estimated installation of pipes will be around 2 days. Wooden planks will be placed where there are excavations crossing the road to ensure continuous traffic movement. Pressure test will take about 2 days. Total time for construction of each 3-5 m about 1 week.

18 11 3 SOCIO-ECONOMIC INFORMATION AND PROFILES 3.1 Socio-economic Profile of Subproject Area Tien Loc commune belongs to Hau Loc district, about 2 km away from Thanh Hoa city to the North; 3 km away from National Road No. 1 and North - South railway route, connected with this National Road by inter-commune road; and 15 km away from the East Sea to the East. Tien Loc commune has a total natural land area of 7.67 km 2. The population of Tien Loc commune in March 212 is 8,73 people, in which 4,396 are women, accounting for 5%. The population density is 1,138 people/ km 2. There are 2,587 households in total, in which 393 are headed by women, accounting for 15.2%. Each household has an average of 3.65 people. There is no ethnic minority in Tien Loc commune, 1% of population are Kinh people. The population growth rate of 211 is 1.2%/year. The number of the poor households in Tien Loc (according to the classification of Ministry of Labour, Invalids and Social Affairs) is 341, accounting for 13.1%. Tien Loc has 5 villages, in which Sơn village and Ngọ village are engaged in blacksmith industry while Mui, Thi Trang, and Xuan Hoi village are mainly engaged in agricultural production and many people are working in other sectors outside the commune Based on the commune Socio-Economic Report of 211, Tien Loc commune is mainly dependent on agricultural production (41 billion VND in 211, accounting for 38.2%) and small scale industry and service (67 billion VND, accounting for 61.8%). Agricultural production is dominated by cultivation (31 billion VND), followed by poultry (1 billion VND) and fishery (.25 billion VND). Forestry is also a small source of revenue (1 million VND). Small scale industry is mainly manual blacksmith in villages: Son and Ngo. Besides, many people are working overseas as part of labour export policy. Economic growth rate is 14.5%, with the total revenue of 18 billion VND in 211. The average income is 12.2 million VND/capita/year. Present sources of water for domestic use are from nearby river, irrigation channel, groundwater and rain water harvesting. Rain water is used mainly for drinking purposes, however, if the stored rainwater is consumed, alternative sources for drinking water is groundwater. An irrigation main canal runs through the Subproject area is used for washing and farming. There is a public drainage system in the commune but the ditches are open, causing bad odour and attracting flies. During rainy seasons, some areas are flooded. About 5-1% of households have septic tank toilets while 1-15% do not have a private toilet and have to discharge in their neighbours or freely discharged to road or irrigation channel near their home. 3.2 Socio-economic Profile of Affected Households There are 81 households that are affected (346 people). Among them, 5 (22 people) are severely affected; the remaining 76 households (324 people) are marginally affected. All of them will lose agriculture land but not residential land and none of them will be relocated.

19 12 In total, there were 4 people surveyed, representing 4 affected households. Among them, 5 people represent all 5 severely affected households (22 people). The 35 other people, accounting for 1.8% of 324 people that are marginally affected, represent 35 households (122 people), accounting for 46.1% of 76 marginally affected households. In total, there are 144 people that are included in the survey. The results of the survey are the following. Demographic characteristics All of surveyed people are Kinh majority. Among them, 5% are female, 13.2% are older than 6 years and 79.9% are within working age. Among the households surveyed, 35% are female-headed. On average, each survey household have 3.6 people, of which, 2.9 are in working age. Education Among the people surveyed, there are 9 children within the school age. None of them drops school. Among people surveyed, there is a highest percentage of people having graduated high school (47.2%). Smaller portions have graduated secondary school (22.9%) and primary school (18.8%). Only 3.5% (5 people) have college/university degree. There are still 6.9% that are not literate. Among the heads of households surveyed, 57.5% have graduated secondary school, 37.5% have graduated primary school and only 5% have graduated high school, none has university degree. Gender equality Most of surveyed households (7%) say that in their family both husband and wife make joint decisions. Besides, 2% said that women make decisions and the rest 1% said that men make decisions. Note that in this survey, 35% of the heads of households are women. Income source and income

20 13 Among people that are within working age and over, 72.4% have stable income and 19.4% have temporary income. Among those having stable income, 69% have income from agriculture and 29.9% have income from employment by private sector. None of them have income from being the government employees. Most of those having temporary income have it from unstable employment (84.6%). The surveyed households have an average income of 8,2, VND/hh/month (equivalent to 2,228, VND/capita/month). The biggest share of income is from agriculture (38.2%), followed by small manufacturing/craft (33.3%), other unstable employment (18%) and trade/service (1.4%). Among the households surveyed, none have income level that would make them belong to the category of the poor or near poor. Majority of them (97.5%) have an average monthly income per capita of more than 1,, VND/month and only one household has an average income that is between 521, VND/month and 1,, VND/month. At the same time, the data provided by the Commune Peoples Committee says that 17.5% of the surveyed households are still under poverty line, the same figure fits to the category of near poor and 65% are not poor, not near poor. Expenditure on food accounts for the biggest share of total expenditure (78.8%). Other expenses such as education, healthcare, electricity, telephone etc. account only for few percent each. Housing and home facilities Majority of surveyed households (97.5%) are living in semi-solid houses. Only one household lives in a temporary house and none lives in solid housing. Among the households surveyed, 85% have land use right certificates while 15% don t. The percentage of households that have land use right certificates that are under the name of both husband and wife is the highest (45%), followed by those under only the husband s name (17.5%) and those under only the wife s name (15%).

Electricity is the mainly used for lighting, with 39 households being connected with the national grid and only 1 household get the power from the neighbor. Water and sanitation Among the surveyed households, 52.5% use dug wells, 45% use drilled wells and 2.5% use other sources of water. All household surveyed think that water from dug wells is good but one from drilled wells still has color. All surveyed households have private latrines, of which, 52% have dry-pit latrines, 12.5% have pour-flush latrines and the remaining 35% have septic tanks. Among them, 52.5% think that their latrines are not really clean but acceptable and the remaining 47.5% consider their latrines clean. Among the people interviewed, only 2.5% said that common water drainage exists in the locality. In the meantime, 71.8% said that wastewater from the toilet is absorbed into the ground through a dug hole. Most of domestic wastewater and also rainwater (82.1% and 74.4%, respectively) as well as about 25.6% of toilet wastewater flows freely to garden, pond etc.

There is no waste collection available in the locality. The project impact All 4 surveyed households have project impact on their land, but no one have impact on their houses. Among them, 5 households are severely impacted and 35 households not. Among 5 severely affected households, the one that is affected the least has 12.5% of their land impacted and income lost from the impacted land of 6, VND/hh/month; while the one that is affected the most has 26.7% of land affected and income lost from the impacted land of 1,6, VND. Among the 35 marginally affected households, the one that is affected the least has only.37% of their land affected and the income lost from the impacted land of 5, VND/hh/month; while the one that is affected the most has 9.38% of their land affected and the income lost from the impacted land of 1,48, VND/hh/month. It is worth to note that the average monthly income of the severely affected households is lower than the ones that are marginally affected (7.34. 24 17 4 INFORMATION DISCLOSURE AND CONSULTATION 4.1 Consultations Disclosure of information and consultations are conducted during preparation and implementation of subprojects to ensure that Affected Households and other stakeholders are timely informed about land acquisition, compensation and resettlement so that they will have opportunities to participate in and express their preferences and concerns regarding the resettlement program. Consultation meetings at the commune level with concerned stakeholders and community meetings with affected households were held on February 21, 212 to discuss on potential impacts on land and non-land properties during construction of the subproject components. Consultation and information dissemination has been an integral component of the RP preparation. During the preparation of the RP, significant information dissemination and consultation with primary stakeholders has been undertaken, through walk through the affected area, village level meetings, sample household surveys, random interviews with people in the village, and meetings with other key stakeholders. Resettlement Consultation Workshops attended by representatives from the PPMU, District and Commune authorities were conducted to present: (i) Project s components; (ii.) GOV s laws and procedures on land acquisition; ADB s policies on Involuntary Resettlement; (iii) Project s Policy Framework and Entitlements; (iv) Project Impacts and Entitlements for each type of impact ;(v.) Preparation of Resettlement Plan; Budget Costs and Tentative Implementation Schedule. The workshop allowed the participants to raise questions to clarify the resettlement policies particularly compensation and entitlements. The updated Resettlement Plan will be submitted and disseminated to the affected communities and uploaded on the ADB s website. 4.2 Information Disclosure Key information of this RP was disclosed to the Affected Households through the distribution of public information booklets in Vietnamese language on 27/11/213 (Annex 1 Minutes of Public Consultation Meeting). Disclosure was done prior to submission of updated RP to ADB. The updated LARP agreed between ADB and Government will be uploaded on the ADB website. 4.3 Project Cut-Off Date The PPMU shall announce this date because any structure constructed on lands to be acquired or affected; and trees and crops planted will not be eligible for compensation. Announcement will use all forms of media such as posters, radio, newspaper and television so that all households within the project service area will be properly informed. District and Commune authorities shall also make announcements within their constituencies. The cut-off date is defined by the last date of the DMS on November 28, 213

26 19 5 GRIEVANCE REDRESS MECHANISM Grievances related to any aspect of the Project will be handled through negotiation aimed at achieving consensus. Complaints will pass through 3 stages before they could be elevated to a court of law as a last resort. First Stage, Commune People s Committee An aggrieved affected household may bring his/her complaint before any member of the Commune People s Committee, either through the Village Chief or directly to the CPC, in writing or verbally. It is incumbent upon said member of CPC or the village chief to notify the CPC about the complaint. The CPC will meet personally with the aggrieved affected household and will have 3-45 days following the lodging of the complaint to resolve it (Note: in remote and mountainous areas, the complaint should be resolved within 45-6 days. The CPC secretariat is responsible for documenting and keeping file of all complaints that it handles. Upon issuance of decision of CPC, the household can make an appeal within 3 days. If the second decision has been issued and the household is still not satisfied with the decision, the household can elevate his/her complaint to the DPC. Second Stage, District People s Committee Upon receipt of complaint from the household, the DPC will have 3-45 days (or 45-6 days if it is in remote or mountainous areas) following the lodging of the complaint to resolve the case. The DPC is responsible for documenting and keeping file of all complaints that it handles. Upon issuance of decision of DPC, the household can make an appeal within 3 days. If the second decision has been issued and the household is still not satisfied with the decision, the household can elevate his/her complaint to the PPC. Third Stage, Province People s Committee Upon receipt of complaint from the household, the PPC will have 3-45 days (or 45-6 days if it is in remote or mountainous areas) following the lodging of the complaint to resolve the case. The PPC is responsible for documenting and keeping file of all complaints that reaches the same. Upon issuance of decision of PPC, the household can make an appeal within 3 days. If the second decision has been issued and the household is still not satisfied with the decision, the household can elevate his/her complaint to the court within 45 days. PPC will then deposit the compensation payment in an escrow account. Final Stage, the Court of Law Arbitrates Should the complainant file his/her case to the court and the court rule in favor of the complainant, then PMU-MT will have to increase the compensation at a level to be decided by the court. In case the court will rule in favor of PPC, then the amount deposited with the court is what the complainant will receive. The AHs will be provided with support and assistance by local based organizations, in case they have limited capacity in case they have questions or complaints. If efforts to resolve complaints or disputes are still unresolved and unsatisfactory following the project s grievance redress mechanism, the households have the right to send their concerns or problems directly to ADB s Operations Department, i.e., Urban Development and Water Division, Southeast Asia Department (SERD) or through ADB Viet Nam Resident Mission. If the households are still not satisfied with the responses of SERD, they can directly contact the ADB's Office of the Special Project

28 21 6 POLICY FRAMEWORK AND ENTITLEMENTS 6.1 Legal Framework The Resettlement Legal Framework and Entitlements for the Project have been built upon the laws of the Government of Viet Nam and the ADB's Involuntary policy as outlined in the RF. However, provisions and principles adopted in the Resettlement Legal Framework for the project supersede the provisions of relevant decrees currently in force in Viet Nam wherever a gap exists. The overall objective of the policy is to ensure that all people affected by the subproject are able to maintain and, preferably, improve their pre-subproject living standards and income-earning capacity from compensation and life rehabilitation assistance for the loss of movable and immovable assets. The policy is based on the laws and regulations of the Government of Viet Nam (GOV) and the ADB. The principal Vietnamese laws and regulations include: The 23 Land Law dated 26 November 23; Decree 181/24/ND-CP dated 29/1/24of the Government guiding the execution of amended land law 23; Decree 197/24/ND-CP date 3/12/24 of the Government on compensation, assistance and resettlement in the event of land recovery by the State; Decree No. 188/24/ND-CP dated November 16, 24 of the Government on methods of determining land prices and land prices framework; Circular No. 114/24/TT-BTC dated November 16, 24 of Ministry of Finance guiding the implementation of Decree No. 188/24/ND-CP of the Government; Decree No. 17/26/ND-CP dated January 27, 26 of the Government amending and supplementing some articles of the Decree guiding the implementation of the Land Law and Decree No. 187/24/ND-CP on the transfer state-owned companies into joint stock companies. 29 22 Decision No. 4137/213/QD-UBND dated 25 November 213 For Issuance of Replacement cost for implementation of Land Clearance Project: Central Region Rural Water Supply and Sanitation Sector Project, Subproject Tien Loc, Hau Loc district, Thanh Hoa province. Annexed hereto, refer to Annex Reconciliation of Government and ADB Policy on Resettlement With the promulgation of Decree 197/24/ND/CP (3/12/24) and Decree 69/29/ND-CP and relevant decrees stated above, the policies and practices of the Government have become more consistent with ADB s social safeguards policies. Nonetheless, provisions and principles adopted in this Resettlement Framework will supersede the provisions of the relevant decrees currently enforced in Viet Nam wherever a gap exists, as provided for under Decree 131/26/ND-CP (November 26), which regulates the management and use of official development assistance. It should also be noted that as per Decree 69/29, Article 23, it states "Apart from the support prescribed in Articles 18, 19, 2, 21 and 22 of this Decree, basing themselves on the local realities, the provincial-level People s Committee shall decide on other supporting measures to stabilize life and production of persons who have land recovered; special cases shall be submitted to the Prime Minister for decision, therefore, if additional gaps not mentioned below are found during RP updating, the required assistance or support will be included in the Updated RP. The differences between the Government s Laws and Decrees and ADB Policy with regard to resettlement and compensation, and how to address these gaps for this Project are shown in the table below.

31 24 Key Issues National Laws ADB Policy Project Policy from whom land is recovered has a living standard which is classifies either as a poor household according to criteria set for poor households by MOLISA, they must be assisted to overcome the poverty. The actual amount and time of assistance will be decided by the People s Committee of a province or city under Central control but it must not be less than 3 years and must not exceed 1 years counting from the day of completion of land recovery. Non-titled users Clause 2 of Article 23, Decree 69/29, the Peoples Committees of the provinces or centrally-run cities shall consider providing such support on case-by-case basis. Non-titled households, including displaced tenants, sharecroppers and squatters, are not entitled to compensation for land but are entitled to payment for non-land assets and assistance to restore their pre-project living standards. If they are poor and vulnerable, appropriate assistance must be provided to help them improve their socio-economic status. 33 26 7 ENTITLEMENTS, ASSISTANCE AND BENEFITS 7.1 Objectives The overall objectives of the resettlement policy for this RP are (i) to minimize, if not avoidable, resettlement impacts; (ii) if impacts are unavoidable, RP is prepared in a way to ensure that AHs are not worse off; rather, they should be able to at least maintain or otherwise improve their pre-project living standards and income-earning capacity. Principles adopted for this Project, irrelevant to current situation but might be relevant in the future in case there will be major changes in alignment designs, are presented below: Involuntary resettlement and impacts on land, structures and other fixed assets will be minimized where possible by exploring all alternative options. Compensation will be based on the principle of replacement cost at the time of compensation. Displaced persons without title or any recognizable legal rights to land are eligible for resettlement assistance and compensation for non-land assets at replacement cost. Residential land, residential house and agricultural land for replacement should be close to the previous places as much as possible and be suitable to displaced persons. Meaningful consultation will be carried out with the affected households and concerned groups and ensure participation from planning up to implementation. The comments and suggestions of the AHs and communities will be taken into account. The RP will be disclosed to AHs in a form and language(s) understandable to them prior to submission to ADB. Resettlement identification, planning and management will ensure that gender concerns are incorporated. Special measures will be incorporated in the resettlement plan to protect socially and economically vulnerable groups such as households headed by women, children, disabled, the elderly, landless and people living below the generally accepted poverty line. Existing cultural and religious practices will be respected and, to the maximum extent practical, preserved. Culturally appropriate and gender-sensitive social impact assessment and monitoring will be carried out in various stages of the project. Resettlement transition stage should be minimized. Restoration measures will be provided to displaced persons before the expected starting date of construction in the specific location. Budget for payment of compensation, resettlement and support will be prepared sufficiently and made available during project implementation. Sites for resettlement and restoration will be available as required. Reporting and independent monitoring (if any) should be defined clearly as part of the management system of resettlement. Independent assessment of the duration and results of the land recovery should be carried out. PPMU will not issue notice of possession to contractors until DPC has officially confirmed in writing that (i) payment has been fully disbursed to the displaced persons

34 27 and rehabilitation measures are in place as per Updated RP agreed between PPMU and ADB; (ii) already-compensated displaced persons have cleared the area in a timely manner; and (iii) the area is free from any encumbrances. No land recovery or site clearing will be done until and after the Updated RP has been agreed between PPMU and ADB and the provisions in the Updated RP have been implemented satisfactorily. 7.2 Project Entitlements The project entitlements (i.e. compensation and support) developed and presented in the entitlement matrix below corresponds to the impacts identified during the DMS carried out in November 213. Consultation with AHs and other stakeholders were carried out on 27 November 213, for details refer to section 4 Information and Disclosure and Consultations. Entitlements adopted are based on government policies and decisions and ADB policies. Entitled persons are those who satisfy the cut-offdate.

41 34 8 RESETTLEMENT BUDGET AND FINANCING PLAN 8.1 Source of Resettlement Funds All land acquisition, compensation and resettlement costs of the subproject are taken from provincial counterpart funds of Thanh Hoa province. 8.2 Replacement Cost Survey All compensations will be based on the principle of replacement cost. Replacement cost is the amount calculated before displacement which is needed to replace an affected asset without deduction for taxes and/or transaction costs. Replacement Cost Survey has been prepared to assess if the compensation rates issued by the Thanh Hoa People s Committee corresponds to replacement costs. The market rates have been determined through desk study and field survey by an independent accredited valuation company. Information about price was mainly collected through direct interviews with affected and non-affected households. Affected households were prioritized for the selection of sample for the survey. Households who have recently bought land and built structure on this land were also prioritized. In addition, information was also collected from various provincial departments and commune, district and other stakeholders. The results of this replacement cost survey are summarized in Table 1 The market prices identified by Southwest Information and Appraisal Corporation Land Thanh Hoa Branch dated 26 October 213 and was approved by Thanh Hoa PC in decision No. 4137QĐ-UBND dated 25/11/213. For details refer to Annex 5. We should note that, in addition to the PPC compensation rate, farmers will receive an allowance equivalent to 1.5 times this compensation rate for the support for job change when acquired land. The signatures of representatives of affected households for receipt of compensations are attached in Annex 6. Once the Updated LARP is acceptable to ADB, any additional compensation payment can commence. During payment, the PPMU and local authorities will require the presence of both husband and wife to receive payment and sign payment documents. Before handing over of payments to the Affected Households, breakdown of compensation will be explained in detail using local language.

44 37 9 INSTITUTIONAL ARRANGEMENTS 9.1 Thanh Hoa Provincial People s Committee s (PPC) PPC s roles will include: Review and approve the RP (and its update) prepared for the Project Direct its relevant departments such as Departments of finance, construction, agriculture and rural development, and the Provincial Project Management Unit to help in the preparation, updating, and implementation of the RP. Approve the unit rates submitted by PPMU and enable the PPMU in finalizing the compensation plan. Approve the compensation plan and overall RP budget which will be reviewed and submitted by the DOF Settle complaints and outstanding issues. 9.2 Provincial Project Management Unit (PPMU) PPMU s roles and responsibilities will include: Supervise and guide the CARB in the preparation and implementation of land acquisition, compensation and resettlement activities. Submit regular reports and updates to CPMU on progress of land acquisition and resettlement activities. Coordinate with and update CPMU and NCERWASS on land acquisition, compensation payments and other resettlement activities. Address conflicts and grievances which cannot be resolved at the CARB, District and Commune levels. Officially declare and announce the project cut-off date for land acquisition and resettlement. 9.3 District Resettlement Compensation Committee (CARB ) The CARB will be composed of the following: PPMU representative, as Chairperson DPC representative, as co-chairperson CPC representative VWU representative Representative from the Affected Persons/Households CARB will perform the following activities regarding resettlement: Prepare and update the resettlement plan of the subproject by integrating construction activities with land acquisition and resettlement and gender mainstreaming activities. Submit regular reports and updates to PPMU on progress of land acquisition and resettlement activities.

45 Conduct socio-economic survey of affected households and will conduct DMS during Detailed Design Stage Establish proper database of areas and households affected Conduct and lead public consultation meetings and document the issues and concerns raised during these meetings Participate in the payment of compensation to affected households Monitor implementation of land acquisition and compensation payments and other resettlement activities Address conflicts and grievances which cannot be resolved at the Commune level. Announce the project cut-off date for land acquisition and resettlement to the Commune and affected households. 9.4 Commune People s Committee (CPC) CPC will perform the following activities regarding resettlement: Assist the CARB /PIA in the identification of affected households, land and non-land properties Assist the CARB /PIA in conducting the socio-economic survey of affected households and certify the detailed measurement survey (DMS) with support from PPMU/PIA and DPC Assist the CARB /PIA in organizing consultation meetings with affected households to present the project and discuss the resettlement plan, particularly the compensation, mitigation measures and entitlements until an agreement has been reached on the proposed resettlement plan between the affected households and the CPC. Ensure that vulnerable persons/groups and severely affected households are properly consulted and that the concerns and grievances of these households are heard, recorded and addressed in a timely manner. Provide updates and other important information to the DPC and CARB on the implementation of the resettlement plan Assist in addressing/resolving conflicts and grievances. 9.5 Commune Vietnam Women s Union (CVWU) CVWU will perform the following activities and be responsible for the following: Certify the list of land and household affected by the project Certify if land to be acquired is public land, if free of encumbrances and not habituated. Certify that the compensation and other entitlements for the losses of the affected household has been paid by the CARB and have been received in full by the affected household Assist the CPC in identifying vulnerable persons/groups and severely affected households. 38

46 In cases where there are complaints and/or conflicts related to the project are raised by project affected households, the CVWC will help address/resolve these through the Commune People s Committee. Provide list of poor households and female-headed households. 39

48 41 11 MONITORING AND REPORTING For the subproject, PPMU and CARB will collaborate to carry out internal monitoring of resettlement planning and implementation activities. The scope of internal monitoring will cover an assessment of: Compliance with the agreement resettlement policies and procedures; The availability and efficient use of personnel, material and financial resources; and Identifies the need for remedial actions to correct any problems that arise. An external monitor will not be engaged as impacts are not significant. The CARB will prepare quarterly progress reports on the resettlement activities and submits it to PPMU. The report includes information on key monitoring indicators, namely: Affected Household and compensation: the number of AHs by category of impact; the status of delivery of compensation and other allowances. Status of rehabilitation and income restoration activities: The number of AHs severely affected by loss of productive assets (losing >1% of farmlands); the number of vulnerable AHs; the status of technical and other assistance for income restoration. Information disclosure and consultation: number and scope of public meetings and/or consultations with AHs; status of notifications to AHs; summary of AH needs, preference and concerns raised during meetings and consultations. Complaints and grievances: summary of types of complaints received; steps taken to resolve them; outcomes; and, any outstanding issues requiring further management by district or provincial authorities or ADB assistance. Financial management: the amount of funds allocated for compensation, operations and other activities; the amount of funds disbursed for each. Resettlement schedule: completed activities as per schedule; delays and deviances, including reasons; revised resettlement schedule. Coordination of resettlement activities with award of contract for civil works: status of completion of resettlement activities and projected date for award of civil works contracts. Implementation problems: problems that have arisen, reasons and proposed strategies to remedy; outstanding issues. Upon receipt of monthly reports, the PPMU consults with CARB to clarify and/or resolve any outstanding issues. On a quarterly basis, the PPMU collates the monthly progress reports for all subprojects in the province, and submits a report to the CPMU. In turn, the CPMU prepares a Project monitoring report to be submitted to ADB.

The construction norms are calculated basing on the regulations of Ministry of Construction. - In fact, the architecture have various and complex structures.
