1 GLOUCESTER TOWNSHIP COUNCIL MEETING DECEMBER 14, 2009 MUNICIPAL BUILDING, CHEWS LANDING NEW JERSEY Pledge Allegiance to the Flag Rev. Margaret Sterchi of St. John s Episcopal Church gave the invocation. Statement: Mr. Bianchini read a statement setting forth the time, date and place of this meeting, that it was properly advertised, posted and filed in the Office of the Township Clerk pursuant to the Open Public Meetings Act. Services Chief Smith, Police Swearing In: The Clerk and the President of Council swore in Lieutenant Robert Stavola and Sergeant James Garber Presentation: Gloucester Township Chamber of Commerce President Jim Forte presented a check to Mainstage Center for the Arts Acting Director Joe Bretschneider. This money was raised at the Taste of Gloucester Township event. Presentation: Council President Bianchini presented Councilwoman Shelley Lovett a plaque for all her hard work and dedication to the residents of Gloucester Township. A gift will be presented to the Mayor from the Gloucester Township Council by the Clerk tomorrow, as she was not present at the meeting. Councilwoman Lovett thanked the Council for the gift and then thanked all the residents for their support over the past years. At his time, Council President Bianchini called for a brief recess. Roll call: All members present. Public Portion: Mr. Bianchini opened the public portion. Maureen Redrow of 125 Empire Avenue questioned the bids for the hockey rinks. She also questioned Resolution 341 and asked what work force housing meant. She also asked why there was not a lot of discussion concerning this issue. Director Roy Rogers explained the need for rushing this along. He stated that there is $6,000, in stimulus money available to Gloucester Township but they must have their application in by February 15, He stated that this will allow Gloucester Township to develop affordable housing. He stated that the township owns land adjacent to the Gloucester Township Community Park. He stated that they would like to build 100 units. Mr. Rogers stated that this is a great opportunity for Gloucester Township who are committed to affordable housing. Mr. Carlamere stated that it is the intent of the Housing Authority to be owner and manager of the project. He stated that they are committed. Ms. McLaughlin asked what the income eligibility amounts would be. Mr. Lechner spoke about our COAH obligations. Ms. McLaughlin also spoke about the facade program and asked that there be certain stipulations put in the contract if the business owners sold their business in the first five years. Mr. Kibelstis of 81 Shelly Street asked about the bid amounts for the hockey rinks. He asked what the current township debt is and what the township interest payments are on this money. He questioned the hockey rinks and asked if the township had done a cost analysis on the maintenance of these rinks and the life expectancy of the rinks. He asked if the township will be generating any money from the concession stands. Ray Polidoro spoke about the Neighborhood Preservation Program in the Clementona area and stated that the residents that used this program had a seven year time frame in which they would

2 have had to pay the money back to the township if they decided to move. He would like to see the facade program with the same time restraints. He also spoke about the lights on the fields at the Lakeland facility and the fact that they are on constantly. He stated that he will be airing the meeting live on the internet on gloucestertownshipnews.com. There was some discussion as to the appropriateness of this. Linda Musser of Cameron Circle spoke about the bids for the hockey rink. She asked if the ground was leased and how long the lease is. She also questioned the funds from the concession stand and if the township will be taking some of them. Mr. Bianchini stated that we have the use of the land until She asked what would stop the county from not leasing the property to the township. Mr. Bianchini stated that the Council is in the process of going back to the County for additional years at this location. Mr. Bianchini stated that the sports organizations use the funds from the concession stand for uniforms and to defer the costs to the parents. He stated that the money is put back into the organization. She also questioned the facade program resolution and stated that there should be a deed restriction included and it should be written into the grant. Mr. Carlamere stated that he will look at the guidelines to the program. It was stated that the spending of this grant money must be done in a timely fashion. Ms. Musser stated that she would like to see a re-capture clause in the resolution. Mr. Mercado stated that he thinks that the Council is only working on the concept this evening. There being no comment, the public portion was closed. Roll call vote: Mrs. Lovett stated that she is not against the project, and there is a need to build something, but these are tough times and the bids are high. She stated that the township should go out for bids again and this should be done in phases. She voted no. Mrs. Evans stated that she concurs with Mrs. Lovett. She stated that the State has had budget cuts and although she is in favor of hockey, she will also be voting no. All others voted yes Motion carried 5-2. John Custodio ) Louis Gerace Jr. - Alternate II Term expires ORDINANCES: O FIRST READING ORDINANCE REDUCING THE SPEED LIMIT ALONG WEST ACCESS ROAD, EAST ACCESS ROAD, COLLEGE ROAD, BRIDGE STREET AND COOPER ROAD IN THE TOWNSHIP OF GLOUCESTER, COUNTY OF CAMDEN, STATE OF NEW JERSEY AND AMENDING CHAPTER 81, SECTION ENTITLED, SPEED LIMITS OF THE CODE OF THE TOWNSHIP OF GLOUCESTER

3 BE IT ORDAINED by the Township Council of the Township of Gloucester, County of Camden and State of New Jersey, as follows: SECTION 1. The speed limit of 25 miles per hour be and is hereby established for both directions of traffic along entire length of West Access Road, East Access Road, College Road, Bridge Street and Cooper Road in the Township of Gloucester, County of Camden, New Jersey, said roads having recently been constructed in Block and Block This speed limit is based on the parameters used for the design of the said roads. SECTION 2. Regulatory and warning signs shall be erected and maintained to effect the above designated speed limit as authorized by the Department of Transportation. SECTION 3. Chapter 81, Section 31 of the Code of the Township of Gloucester, entitled, Speed Limits, be and is hereby amended. SECTION 4. All ordinances and provisions thereof inconsistent with the provisions of this ordinance shall ne and are hereby repealed to the extent of such inconsistency. SECTION 5. If any section, part, clause, or phrase of this ordinance shall be declared invalid by judgement of any court of competent jurisdiction, such section, subsection, part, clause, or phrase shall be deemed to be severable from the remainder of this ordinance. SECTION 6. This Ordinance shall take effect after passage and publication is provided by law and upon the approval by the Commissioner of Transportation. 7 WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-2 et seq.) requires that the resolution authorizing the award of contracts for "Professional Services" without competitive bids, must be publicly advertised, and WHEREAS, the Township Council of the Township of Gloucester does hereby designate John Stiefel, III as Actuary for the Township of Gloucester. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Gloucester, County of Camden, and State of New Jersey, as follows: l. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Gloucester that the Chief Financial Officer and/or Business Administrator is hereby authorized to refund Texas Roadhouse Holdings, LLC, the sum of $25,493.00, in accordance with the calculation of the Office of the Tax Assessor and the non-residential development claim fee form filed and the amount of refund being acceptable to the Claimant.

11 TOWNSHIP CLERK R-09: RESOLUTION AUTHORIZING COAH PAYMENT REFUND TO PIAZZA PINE HILLS, LLC WHEREAS, pursuant to the Non-residential Development Fee Act of 2008, Developers within the Township of Gloucester contributed a non-residential development fee under COAH; and WHEREAS, pursuant to Section 39D of the New Jersey Economic Stimulus act of 2009, developers within the Township of Gloucester may file a claim for a refund of the non-residential development fee paid; and WHEREAS, the Piazza Pine Hills, LLC has filed for a refund of their development fee paid in accordance with the Act; and WHEREAS, the application for fee refund has been deemed complete by the Department of Community Development and Planning; and WHEREAS, the Office of the Tax Assessor had calculated the amount of fee refundable in accordance with the COAH refund procedure. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Gloucester that the Chief Financial Officer and/or Business Administrator is hereby authorized to refund Piazza Pine Hills, LLC, the sum of $52,826.50, in accordance with the calculation of the Office of the Tax Assessor and the non-residential development claim fee form filed and the amount of refund being acceptable to the Claimant. He stated that they are following Green Acres rules and getting two appraisals for the one property so that the township could get the greatest appraised value. Mr. Cardis stated that the other block and lot originally on this resolution are not needed at this time and that is why it is coming off. The Township Council of the Township of Gloucester recognizes a need to provide decent, safe and affordable housing for citizens of the Township of Gloucester, and WHEREAS. The Township of Gloucester has an obligation under the current New Jersey Council on Affordable Housing (COAH) to provide affordable housing and to designate an Administrative Agent and Municipal Housing Liaison, and WHEREAS. The Township has previously named a Township Employee as Municipal Housing Liaison to be the primary point of contact and to the coordinate activities of affordable housing and now desires to designate an Administrative Agent, and WHEREAS. The Township Council has determined that the Gloucester Township Housing Authority is a qualified and experienced authority established under the laws of the State of New Jersey to build, renovate and manage property, including affordable housing in the Township of Gloucester, and

Motion carried R-09: RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF GLOUCESTER, CAMDEN COUNTY NEW JERSEY AUTHORIZING THE NEGOTIATING AND SIGNING OF AN INTERLOCAL SERVICE AGREEMENT WITH THE GLOUCESTER TOWNSHIP HOUSING AUTHORITY FOR DEVELOPMENT OF AFFORDABLE HOUSING AND THE LOCATION AND TRANSFER OF SUITABLE LANDS (BLOCK LOTS 1 & 2 AND BLOCK LOT 1) WITHIN THE TOWNSHIP OF GLOUCESTER FOR SAID PURPOSE WHEREAS. The Township Council and the Gloucester Township Housing Authority jointly recognize the current COAH regulated need to provide affordable housing within the Township of Gloucester, and WHEREAS. The Gloucester Township Housing Authority has determined that there is available GRANT and economic stimulus money for the acquisition and development of housing within the Township of Gloucester and WHEREAS. It is the desire of the Township Council of the Township of Gloucester to support the endeavors of the Housing Authority and jointly work towards the development of responsible affordable housing for the citizens of the Township of Gloucester. NOW THEREFORE, IT IS HEREIN RESOLVED that the Township of Gloucester shall negotiate and execute an Interlocal Service Agreement with the Gloucester Township Housing Authority for the acquisition and development

17 of premises known as Block Lots 1 & 2 and Block Lot 1, for designated affordable housing. BE IT FURTHER RESOLVED, that the Housing Authority shall have immediate access to the premises described for the purpose of a site suitability study, engineering and site plan preparation. And further that the Housing Authority has the consent of the Township of Gloucester to make application to the appropriate Planning or Zoning Board for site approvals deemed necessary to accomplish the purpose of this Interlocal Service Agreement. R-09: RESOLUTION AUTHORIZING THE GLOUCESTER TOWNSHIP TAX COLLECTOR TO PREPARE AND MAIL ESTIMATED TAX BILLS IN ACCORDANCE WITH P.L. 1994, C.72 WHEREAS, the Township of Gloucester has not adopted the Gloucester Township Municipal Budget for 2010 and the Gloucester Township Tax Collector will be unable to mail the Township s 2010 tax bills on a timely basis; WHEREAS, the Gloucester Township Tax Collector in consultation with the Gloucester Township Chief Financial Officer has computed an estimated tax levy in accordance N.J.S.A.54:4-66.4, and they have both signed a certification showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies; WHEREAS, in accordance with Chapter 72, P.L. 1994, the Township Council requests the Director of the Division of Local Government Services to approve the estimated tax levy exceeding 105% listed below. Approval will enable the Township to meet its financial obligations, maintain the tax collection rate, provide uniformity for tax payments and save the unnecessary cost of interest expenses on borrowing. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Gloucester, in the County of Camden and State of New Jersey on this 14 TH day of December, 2009 as follows: 1. The Gloucester Township Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for the Township for the third installment of taxes. The Tax Collector shall proceed upon approval from the Director and take such actions as are permitted and required by P.L. 1994, c.72 (N.J.S.A. 54: and ). 2. The Municipal estimated tax levy for is hereby set at $37,324, Therefore making the entire estimated tax levy for including County, Schools and Special Districts in $136,779, In accordance with law the third installment of taxes shall not be subject to interest until the later of February 1 or the twenty-fifth calendar day after the date the estimated tax bills were mailed. The estimated tax bills shall contain a notice specifying the date on which interest may begin to accrue.

18 TOWNSHIP CLERK, RMC Mr. Cardis explained the reason for this resolution. He stated that he spoke with Local Government Services. He stated that the Extraordinary Aid figures will probably not be in until January and then they will have to appear before the Local Finance Board. He stated that the bills must go out. It was stated that this will avert a cash flow crisis. R-09: RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF GLOUCESTER, CAMDEN COUNTY NEW JERSEY IMPLEMENTING A BLACKWOOD FAÇADE IMPROVEMENT PROGRAM FOR COMMERCIAL BUILDINGS LOCATED WITHIN THE BLACKWOOD WEST REDEVELOPMENT ZONE WHEREAS. The Township Council of the Township of Gloucester has previously adopted the Blackwood West Redevelopment Zone plan to address the blighted and deteriorated conditions existing in the designated zone, and WHEREAS. The area has been designated a New Jersey Development of Community Affairs (DCA) Neighborhood Preservation Program (NPP) target area and an Area in Need of Redevelopment, and WHEREAS. The Township Council of the Township of Gloucester has determined the advantage of establishing a program to encourage commercial building owners and tenants located in the Blackwood West neighborhood to undertake improvements to the exterior façade of their buildings, and WHEREAS. The Township Council desires this program to be part of a comprehensive program to include planned street improvements, selective demolition and or construction of new structures, business promotional efforts and the possible construction of new housing in the Neighborhood. NOW THEREFORE it is herein RESOLVED as follows, FUNDING SOURCES The Blackwood Façade Improvement Program will be funded by a Grant in the initial amount of $100, awarded from Federal and State Sources. The appropriate Township Officials are hereby directed and authorized to prepare and make the necessary Grant applications, and acceptance, to carry out the Program. The Township will administer the Program in accordance with the guidelines established by the Grant Funding Source. ELIGIBILITY Commercial Building Owners and Tenants will be approved for Grant Commitments on a First Come First Approved basis until funding has been exhausted. The Program is intended to continue as long as new funding is made available for the Program. Owners of commercial properties, and Tenants with written approval from Owners, located within the Blackwood West Neighborhood Preservation (NPP) target area will be eligible for the Program. A Program Map of the eligible target area is to be established and made a part of the Resolution. AMOUNT OF FUNDING The Township will provide a grant to an approved applicant for up to 50% of the cost of the façade improvement up to a maximum of $15, per storefront or commercial unit. Funds will be provided as reimbursement following completion (issuance of a Certificate of Occupancy) of construction. The Township Officials will work to encourage local banks to make matching façade improvement loans to property owners within the designated target area at competitive terms and interest rates.

19 WRITTEN AGREEMENT Approved applicants will enter into a Developers Agreement with the Township Council as Redevelopment Entity which redevelopment agreement shall contain a covenant that the property owner shall not significantly alter the façade improvement funded by the Program or cause the demolition of the building for a period of five (5) years from completion without the written consent of the Township Redevelopment Entity. PROGRAM PROCEDURES The Façade Improvement Program commences with an initial meeting between the property owner and or tenant and the Township Grants Office. If eligible the applicant will be provided with a Program Application, Program Guidelines and Procedures for application submission. Once the Township Grants Office determines the application is complete, the Grants Office will issue a Grant Commitment. Applicants who do not meet the Program requirements or who have not provided required information within 60 days from the date of application will be Denied. Applicants receiving a Denial letter may reapply at a future date Through the Township Redevelopment Entity, the Township, at the Township s sole option, may engage a licensed Architect to review plans submitted and make recommendation to property owners on the consistency of the proposed improvements with the Blackwood West Redevelopment Plan renovation guidelines. The Township may request the Architect to certify that the proposed improvement is consistent with the building improvement guidelines prior to a final Program approval being issued to the applicant. The building Owner or Tenant is responsible for securing all necessary and required permits, Federal, State and Local as may be applicable. PREVAILING WAGE TO WORKERS As a Program funded through the Township of Gloucester, all workers on the construction pf the Façade Improvement must be paid the applicable State and or prevailing wage for trade classification. The Township will provide the applicant s contractor the schedule of prevailing wages and the job may be monitored for the payment of required wages according to the schedule. MAINTENANCE OF THE FAÇADE IMPROVEMENT The Program commitment, as well as the Developers Agreement with the Redevelopment Entity will require the Owner and or Tenant to properly maintain the Façade Improvement and to not significantly alter, remove, or demolish the improvement or building for a period of five (5) years from completion without prior written approval by the Township. Roll call vote: Mrs. Lovett stated that the grant would improve and vitalize downtown Blackwood and she voted yes, all others voted yes. MOTIONS: RA 1241 CHOIMER TRACE VFW - POST TO RA 1242 GLOUCESTER TOWNSHIP BOYS BASKETBALL Mr. Hutchison made a motion to adopt, seconded by Mrs. Evans. Roll call vote: All in favor. PUBLIC PORTION: Mr. Bianchini opened the public portion. Mr. Kibelstis of 81 Shelly Street asked about the 27 acres near his home. It was stated that this was a foreclosed property and is now on the township ROSI list. The state required that signs be put on the properties. He also questioned Mr. Cardis on the estimated tax bills.

20 Maureen McLaughlin of Empire Avenue stated that she would like to see a street in the township named after a long time resident and educator Sarah Bass Young. She also spoke about the sewer extension for Winslow Township that was discussed at the workshop. She questioned who would get the fees. It was stated that these fees would go to the GTMUA. Mr. Bianchini stated that the pump station has room for expansion and if we have a need we could ask them to leave immediately. Mr. Bianchini stated that at this time Winslow Twp. is moving along on fixing their sewer issue. She also asked if the meeting with the insurance carriers was opened to the public. It was stated that it was unless the Council went into closed session. Joe Pauli of Erial thanked Mrs. Lovett for all her hard work and dedication to the township. He thanked Mrs. Evans for her bi-partisanship. He thanked Mr. Polidoro for putting the meetings on the internet. Toni Enoch of 228 Crestview Avenue asked about the hockey rink and why the bids came in differently from the engineers estimate. Mr. Cardis stated that the engineer tries to come as close to the price as possible. She asked what the procedure would be now that we have accepted the bids for the hockey rink. Ms. Enoch questioned the bonding options the township has. Ms. Enoch stated that Gloucester Township is going in the wrong direction. She stated that the township must check the electrical usage at the Lakeland fields. She stated that if people decide to talk at the meetings, they are part of the public meeting and can be videotaped. Frank Mellace of Hillcrest Avenue told Council to check the website that the meetings will be streamed live. He stated that there is also a public forum on this website. Rev. Sterchi of 1704 Old Black Horse Pike thanked the Council, the Police Department and the Mayor for providing a crossing guard for her church to help cross the parishioners. Mr. Polidoro stated that his website is a PILOT and has the ability to blog, but there will be no personal attacks on his website. Gabe Busa said goodbye and thank you to everyone. He thanked everyone for any part they played in Public Works success. He thanked Council for all they have done and wished Council a lot of luck. He stated that if needed he would be happy to help with the transition. There being no further comment, the public portion was closed. POLLING OF DIRECTOR S Chief Smith thanked Council for their support of the Police Department and for authorizing the promotions. Mr. Cardis thanked Mr. Bianchini for his years of service. Stavola and Sgt. Garber. She thanked the Chamber of Commerce with their presentation to Mainstage. She stated that this would be her last regular meeting. She wished everyone a Merry Christmas and Happy Hanukkah. She stated that it has been a pleasure working with the employees who have been kind and generous to her. She stated that Mr. Busa has been a good friend to her and has done a wonderful job at Public Works. She stated that his guys work hard and go beyond the call of duty. She stated that Chief Smith and his department has always been very professional. She thanked Deputy Chief Earle and stated that it was a pleasure serving with him on the Human Relations Commission. She thanked Mr. Garbowski for sitting next to her and stated that it was a pleasure serving with Council. She stated that this is not a goodbye. She stated that it is hard to be on Council especially as an African American Woman. She stated that she will miss Mrs. Lovett as they have become friends. She stated that she doesn t care what party she is. She thanked Ms. McLaughlin and her suggestion about naming a street after Sarah Bass Young. She thanked Rev. Sterchi for praying for Council.
