1 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION AUTHORIZING CHANGE ORDER NUMBER 1, CONTRACT 06-20, GEORGIA ROAD FY 2006 MUNICIPAL AID PROGRAM PAVING PROJECT R E S O L U T I O N WHEREAS, a Contract was awarded to Earle Asphalt Company, by Resolution R on November 8, 2006, for the Georgia Road FY 2006 Municipal Aid Program Paving Project in the amount of $329,413.13; and WHEREAS, the Township Engineer, by memorandum dated November 8, 2007, recommends Change Order Number 1 in the amount of $16, due to adjusted final contract quantities needed to complete the project; and WHEREAS, the Director of Finance has certified to the Township Clerk that additional funds are available in the following Budget Account: CG0621C-8195 NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that Change Order Number 1 in the amount of $16, is hereby authorized for the aforementioned Contract, bringing the total Contract amount to $346,135.46; BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded to the Assistant Township Administrator, the Director of Finance, the Township Engineer, and Earle Asphalt Company. 1

5 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION DISBURSING OVERPAYMENTS AND CANCELING OF TAXES R E S O L U T I O N WHEREAS, certain property owners have credit balances on their accounts; and, WHEREAS, the following Taxpayer Schedules include Overpayments of Taxes, State Judgements, Veteran or Senior Citizen Deductions, or a 100% Disabled Veteran, creating verpayments of taxes, applicable to the blocks and lots and in the amounts set forth; and, WHEREAS, the Tax Collector of the Township of Freehold has certified to the Township Committee of the Township of Freehold that those items designated with the word "REFUND" on Schedules A, B, C, D, and E be refunded and those items designated with the word "CANCEL TAXES" on Schedule F be canceled to the names appearing below; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that the refunds be made to the taxpayers appearing on Schedules A, B, C, D,and E and the checks for the aforesaid refunds be issued by the Treasurer; BE IT FURTHER RESOLVED that the Tax Collector is hereby authorized to make corrections and notations upon the Municipal records as may be necessary to effect this Resolution; BE IT FURTHER RESOLVED, by the Township Committee of the Township of Freehold that the Township Clerk is hereby authorized to forward a certified copy of the within Resolution to Tax Collector, Treasurer/Director of Finance and Auditor. 1

9 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT FOR THE PURCHASE OF SUPPLIES FOR WATER AND SEWER DISTRIBUTION SYSTEM MAINTENANCE AND REPAIR R E S O L U T I O N WHEREAS, the Township of Freehold has a need to purchase supplies for water and sewer distribution system maintenance and repair; and WHEREAS, the Purchasing Agent has determined and certified in writing that the value of the acquisition will not exceed that Township's bid threshold, but will exceed $17,500 in vendor aggregation; and WHEREAS, the anticipated term of this contract is 1 year; and WHEREAS, WW Grainger can supply the required items for $3,701.91; and WHEREAS, WW Grainger has completed and submitted a Business Entity Disclosure Certification which certifies that WW Grainger has not made any reportable contributions to a political or candidate committee in the Township of Freehold, County of Monmouth, in the previous one year, and that the contract will prohibit WW Grainger from making any reportable contributions through the term of the contract; and WHEREAS, the Director of Finance has certified to the Township Clerk that additional funds are available in the following Budget accounts: NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that a contract for the purchase of supplies for water and sewer distribution system maintenance and repair is hereby authorized with WW Grainger in the amount of $3,701.91; 1

12 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT FOR 2007 LEAF RECYCLING/DISPOSAL R E S O L U T I O N WHEREAS, the Director of Public Works, by memorandum dated November 26, 2007, advises of the need for a recycling location for leaf collection services for the Township of Freehold for the 2007 Leaf Recycling Program; and, WHEREAS, in accordance with NJSA 40A:11-5,1(s), of the Local Public Contracts Law, recycling of compost materials is listed as an exception and may be negotiated and awarded by the governing body without public advertising for bids; and, WHEREAS, the Director of Public Works, by memorandum dated November 26, 2007, recommends award of a contract to Gibson Farms of Freehold, NJ for leaf recycling/disposal in the estimated amount of $55,000.00; and, WHEREAS, the Chief Financial Officer has certified funds are available in the following account: NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that it hereby approves the award of a contract for leaf recycling/disposal in the estimated amount of $55,000.00, in accordance with NJSA 40A:11-5,1(s) of the Local Public Contracts Law; BE IT FURTHER RESOLVED that certified copies of the within Resolution be forwarded to Gibson Farms, the Assistant Township Administrator, the Chief Financial Officer and the Director of Public Works. 1

16 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT TO SHAWNEE MOUNTAIN FOR THE PURCHASE OF SKI LIFT TICKETS R E S O L U T I O N WHEREAS, the Township of Freehold has a need to secure ski lift tickets within the Parks and Recreation Department pursuant to the provisions of NJSA 40A:11 and NJSA 19:44 A-20.5; and WHEREAS, the Purchasing Agent has determined and certified in writing that the value of the acquisition will not exceed that Township's bid threshold but will exceed $17,500 in vendor aggregation; and WHEREAS, the anticipated term of this contract is 1 year; and WHEREAS, Shawnee Mountain has submitted a proposal indicating they would provide the necessary tickets for the Parks and Recreation Department in the amount of $6,220.00; and, WHEREAS, Shawnee Mountain has completed and submitted a Business Entity Disclosure Cetification which certifies that Shawnee Mountain has not made any reportable contributions to a political or candidate committee in the Township of Freehold, County of Monmouth, in the previous one year, and that the contract will prohibit Shawnee Mountain from making any reportable contributions throughout the term of the contract; and, WHEREAS, the Director of Finance has certified to the Township Clerk that additional funds are available in the following Budget account: R NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold, that a contract is hereby awarded to Shawnee Mountain in the amount of $6,220.00; 1

22 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION AMENDING RESOLUTION R WHICH CONSTITUTED AN AGREEMENT WITH CERTAIN STATE CONTRACT VENDORS R E S O L U T I O N WHEREAS, the Township of Freehold, as a contracting unit, may, without advertising for bids, purchase materials, supplies or equipment under any Contract or Contracts for such materials, supplies or equipment entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury, pursuant to the provisions of NJSA 40A:11-12; and, WHEREAS, the Township Committee of the Township of Freehold wishes to evidence an agreement with the attached referenced State Contract vendors through this Resolution and a properly executed purchase order, which agreement shall be subject to all the conditions applicable to the current State Contract; and, WHEREAS, the Township Committee of the Township of Freehold wishes to authorize the Purchasing Department to purchase those certain items from an approved New Jersey State Contract vendor with the threshholds hereinafter stated; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that this Resolution, together with properly executed purchase orders, shall constitute agreements between the Township of Freehold and the attached referenced State Contract vendors, subject to all conditions applicable to the current State Contract; BE IT FURTHER RESOLVED that the Township Committee of the Township of Freehold hereby authorizes the Purchasing Department to purchase items from an approved New Jersey State Contract vendor list (Exhibit A); 1
23 BE IT FURTHER RESOLVED by the Township Committee of the Township of Freehold that, pursuant to the rules of the Local Finance Board of the State of New Jersey, funds shall not be expended prior to a certification of available funds made by the Township Director of Finance upon receipt of a properly executed purchase order. The department issuing the purchase order shall have the obligation of securing the necessary certification as to the availability of funds from the Director of Finance; BE IT FURTHER RESOLVED that the duration of this authorization shall be until December 31, 2007 or upon the expiration of the vendors' State Contract, whichever event first occurs; BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded to the Assistant Township Administrator, the Director of Finance, and the Director of Public Works. 2

27 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: December 4, 2007 TITLE: RESOLUTION AMENDING 2007 BUDGET (CHAPTER 159) TO INSERT MODIFICATION TO 2007 SPECIAL ITEM OF REVENUE AND APPROPRIATION FOR RECYCLING TONNAGE GRANT R E S O L U T I O N WHEREAS, N.J.S.A. 40A:4 87 provides that the Director of the Division of Local Government Services may approve the insertion of any Special Item of Revenue in the Budget of any county or municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the Budget; and WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount; and WHEREAS, the Township of Freehold has received primary funding from the State of New Jersey in the amount of $30,303.34; NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold hereby requests that the Director of the Division of Local Government Services approve the insertion of an item of revenue in the Budget of the year 2007 in the sum of $30, which is now available as revenue from: MUNICIPAL REVENUE Special items of General Revenue anticipated with prior written consent of the Director of the Division of Local Government Services.
