O TOWNSHIP MEETING DATE July 27, 2010 ORDINANCE AMENDING CHAPTER XI (TRAFFIC), SECTION (THROUGH STREETS) AND SECTION 11-9 (SPEED LIMITS) OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF FREEHOLD, COUNTY OF MONMOUTH AND STATE OF NEW JERSEY BE IT ORDAINED by the Township Committee of the Township of Freehold, County of Monmouth, State of New Jersey, as follows: I Section Through Streets, Schedule V is hereby amended by adding the following street: Kentucky Way: From County Route 537 to County Route 537 II Section 11-9 Speed Limits, Schedule VIII is hereby amended by adding the following streets: Name of Street Direction Speed Location Wemrock Road Both 35 m.p.h. From Monmouth County Route 537 to Gully Road Double Creek Both 25 m.p.h. Entire length Parkway Nomoco Road Both 40 m.p.h. Entire length III All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed.
2 IV If any section, subparagraph, sentence, clause or phrase of this Ordinance shall be held to be invalid, such decision shall not invalidate the remaining portion of this Ordinance. V This Ordinance shall take effect upon adoption and publication according to law.
3 EXPLANATORY STATEMENT: This Ordinance designates Kentucky Way as a through street and sets speed limits on Wemrock Road, Double Creek Parkway and Nomoco Road.

6 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION DISBURSING OVERPAYMENT OF TAXES AND WATER/SEWER AND CANCELLING OF TAXES R E S O L U T I O N WHEREAS, certain property owners have credit balances on their accounts; and, WHEREAS, the following Taxpayer Schedules include 2009 State Judgements, 2010 Overbills, Overpayment of Taxes, Overpayment of Water/Sewer, and 100% Disabled Veterans Allowed, creating overpayment, applicable to the blocks and lots and in the amounts set forth; and WHEREAS, the Tax Collector of the Township of Freehold has certified to the Township Committee of the Township of Freehold that the items designated with the word "REFUND" on Schedules A, B, C and D be refunded and the items with the word "CANCEL" on Schedules E and F be cancelled in the names appearing below; and NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that the refunds be made to the taxpayers appearing on Schedules A, B, C and D and the checks for the aforesaid refunds be issued by the Treasurer; BE IT FURTHER RESOLVED that the Tax Collector is hereby authorized to make corrections and notations upon the Municipal records as may be necessary to effect this Resolution; BE IT FURTHER RESOLVED by the Township Committee of the Township of Freehold that the Township Clerk is hereby authorized to forward a certified copy of the within Resolution to the Tax Collector, Treasurer/Director of Finance and Auditor. 1

11 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION CORRECTING THE TAX ASSESSMENT OF BLOCK 38.14, LOT 7 ON THE FREEHOLD TOWNSHIP TAX MAP R E S O L U T I O N WHEREAS, the Freehold Township Tax Assessor has been made aware of an error in the assessment for the property located at Block 38.14, Lot 7 on the Freehold Township tax map, known as 13 Longview Ave, by a typographical error in the calculation of the assessment indicating the wrong square footage; and WHEREAS, N.J.S.A. 54:4-99 authorizes a municipality to adjust any past due taxes (principal amounts as well as interest and/or penalties) as it shall deem equitable and just; and WHEREAS, the Township Tax Assessor has reviewed the circumstances referenced above and has concurred with the cancellation of taxes with respect to the amounts set forth below, due to the circumstances present. NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Freehold, that the taxes shown on Block 38.14, Lot 7 on the Freehold Township tax map for tax year 2010 in the total amount $ are hereby canceled, BE IT FURTHER RESOLVED that a copy of this Resolution, certified by the Township Clerk to be a true copy, be forwarded to each of the following: a. 13 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION AUTHORIZING EXTENSION OF DEVELOPER S AGREEMENT FOR BATTLEFIELD OFFICE PARK, PHASE I, SITE PLAN NO R E S O L U T I O N WHEREAS, site plan approval was granted for an office complex known as Battlefield Office Park on May 19, 2005, located on Monmouth County Route 537, Block 67, Lot 21, Site Plan No ; and WHEREAS, the Developer s Agreement entered into between the Township and the developer setting forth the developer s responsibilities and obligations for this project was recorded on August 29, 2007; and WHEREAS, due to the economic conditions and the lack of demand in the area for office space, development of the project has stalled; and WHEREAS, under the New Jersey Permit Extension Act, the approvals have been automatically extended to December 30, 2012; and WHEREAS, the Developer s Agreement does not fall under the guidelines of the New Jersey Permit Extension Act, and the developer has requested that the Township extend the Developer s Agreement to coincide with the extension date of the approvals. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that it agrees to the extension of the Developer s Agreement to December 30, 2012, subject to the following: (1) the Township reserves the right to recalculate all of the dollar amounts referenced in the Developer s Agreement for both on site and off-site, at such time as a Building Permit is requested; and (2) the issuance of that Building Permit will be contingent upon any amended amounts being posted or deposited. BE IT FURTHER RESOLVED that a copy of this Resolution, certified by the Township Clerk to be a true copy, be forwarded to: Township Engineer, Township Attorney, Township Planning Board, Township Construction Official and the developer (C/O William J. 24 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION AMENDING 2010 BUDGET (CHAPTER 159) TO INSERT MODIFICATION TO 2010 SPECIAL ITEM OF REVENUE AND APPROPRIATION FOR THE OVER THE LIMIT UNDER ARREST STATEWIDE CRACKDOWN GRANT R E S O L U T I O N WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any Special Item of Revenue in the Budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the Budget; and WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount; and WHEREAS, the Township of Freehold has been awarded $4, from the State of New Jersey, Division of Highway Traffic Safety, for the Over The Limit Under Arrest 2010 Statewide Crackdown Grant; NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold hereby requests that the Director of the Division of Local Government Services approve the insertion of an item of revenue in the Budget of the year 2010 in the sum of $4, which is now available as revenue from: MUNICIPAL REVENUE Miscellaneous Revenues - Section F: Special items of General Revenue Anticipated with prior written consent of the Director of the Division of Local Government Services Public and Private Revenues Offset with Appropriations. 30 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION TO CANCEL RECEIVABLE BALANCE FOR PUBLIC HEALTH PRIORITY FUNDING GRANT R E S O L U T I O N WHEREAS, the Township of Freehold included in its adopted 2010 Municipal Budget $14,858 for Public Health Priority Funding Grant. However, the Township of Freehold will receive $7,429 under this grant, which will result in a decrease of $7,429 in the receivable balance entitled Due from Public Health Priority Funding Grant in the Grant Fund balance sheet; and, WHEREAS, it is necessary to formally cancel the receivable balance and its offsetting appropriated reserve balance from the balance sheet; NOW, THEREFORE, BE IT RESOLVED that the following Grant receivable and appropriated reserve balance be cancelled: PUBLIC HEALTH PRIORITY FUNDING GRANT Adopted Amended Amount Cancelled REVENUE $14,858 $ 7,429 $ (7,429) APPROPRIATION 14,858 7,429 (7,429) BE IT FURTHER RESOLVED that certified copies of the Resolution be forwarded to the Chief Financial Officer/Treasurer and the Auditor. 1

32 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION TO CANCEL A SPECIAL EMERGENCY APPROPRIATION FOR THE PREPARATION OF THE REVALUATION OF REAL PROPERTY R E S O L U T I O N WHEREAS, the Township of Freehold adopted Ordinance No. O and Resolution No. R in 2006 relating to the complete program of revaluation of real property; and, WHEREAS, N.J.S.A. 40A:4-53 created the special emergency appropriation of $1,200, for the above mentioned purpose; and, WHEREAS, it has been determined that the revaluation has been completed and that the remaining funds of $379, be formally cancelled to reflect the completion of the project; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold, in the County of Monmouth, State of New Jersey, (not less than two-thirds of all the members thereof affirmatively concurring) that, in accordance with N.J.S.A. 40A: 4-55: 1. The Deferred Charge - Special Emergency and the corresponding Reserve for Revalution balance in the amount of $379, be cancelled. 2. That a certified copy of this Resolution be filed with the Director of the Division of Local Government Services. BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to the Chief Financial Officer/Treasurer and Auditor. 1

34 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: August 10, 2010 TITLE: RESOLUTION AUTHORIZING DEDICATION BY RIDER FOR ROAD & OFFSITE IMPROVEMENT ESCROWS (N.J.S.A. 40:55D-53.1) R E S O L U T I O N WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonable accurate estimates in advance; and, WHEREAS, N.J.S.A 40:55D-53.1 allows municipalities to receive contributions from applicants and these deposits shall be held in escrow; and, WHEREAS, N.J.S.A. 40A:4-39 provides that the Director of the Division of Local Government Services may approve expenditures of monies by dedication by rider; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold, County of Monmouth, State of New Jersey, as follows: 1. The Township Committee does hereby request permission from the Director of the Division of Local Government Services to pay expenditures for all improvements to water, sewer, drainage, curbs & sidewalks, detention basins, road improvements and other disbursement purposes from these escrow funds per N.J.A.C. 40:55d-53.1; and 2. The Township Clerk of the Township of Freehold is hereby directed to forward two (2) certified copies of the Resolution to the Director of the Division of Local Government Services; BE IT FURTHER RESOLVED that certified copies of the Resolution be forwarded to the Chief Financial Officer/Treasurer and the Auditor. 1
