(Bockes) Commissioner Stafford motioned that the Planning & Zoning Commission approve the minutes from the March 7, 2017 P&Z meeting as presented; motion seconded by Commissioner Meek. Motion passed with a vote of Conduct a public hearing, consider and act upon a request for a replat of Lot 11 of the Emerald Sound at Lake Lewisville Addition, Section Four, consisting of approximately 5 acres generally located at the northeast corner of Crystal Cove and Amber Lane in the City of Oak Point s Extraterritorial Jurisdiction. (Olson) Luke Olson discussed the agenda item stating that it was a replat of a 5 acre lot that is outside of the City limits, but subject to the subdivision ordinance and platting. 4 divide the lot into two lots, one 2.75 acre lot and one 2.25 acre lot. After review of the application and plat by the City Planner, City staff recommended that the Planning & Zoning Commission conduct the public hearing and recommend that the City Council approve the request for replat. Public hearing notices were mailed to property owners on March 14, 2017 as well as the public notice being posted on the City s website and in the Little Elm Journal. As of Friday, March 31 st the City had not received any reply forms back. The replat met all the requirements and therefore approval was required. Chairperson Almond opened the public hearing at 6:03 p.m. The applicants were present and answered questions as needed. Karen Salter, Crystal Cove, spoke in regards to the request and was not opposed but wanted to make sure that the lot could not be subdivided even further in the future. David Temple, Crystal Cove, spoke in regards to the request and had concerns about current AG exemptions. City staff noted that the tax exemptions were done through the County and the City did not have jurisdiction over exemptions, specifically in the ETJ. Concerns were raised about the HOA s CCR s and how those would be enforced. City staff noted that the City s ordinances and regulations supersede the CCR s of an HOA and it would be up to the HOA to handle any violations. However, there was nothing in the CCR s that prevented a 5 acre tract from being subdivided. Chairperson Almond closed the public hearing at 6:13 p.m. Vice Chairperson Collins motioned that the Planning & Zoning Commission vote to recommend that the City Council approve a request for a replat of Lot 11 of the Emerald Sound at Lake Lewisville Addition, Section Four, consisting of approximately 5 acres generally located at the northeast corner of Crystal Cove and Amber Lane in the City of Oak Point s Extraterritorial Jurisdiction; motion seconded by Commissioner Buttermark. Motion passed with a vote of 4-2. Ayes: Almond, Buttermark, Collins, and Meek. Nos: Burke and Stafford. 5. Consider and act upon a final plat of Wildridge Phase 3A consisting of 26 single-family lots and one HOA common area/open space lot located on approximately acres on the north side of Shahan Prairie Road approximately 3,275 feet east of F.M. 720/Oak Grove Parkway. (Olson) The final plat for Wildridge Phase 3A was submitted and reviewed by the City engineer and City Planner. The plat is in line with the development agreement and all applicable ordinances. City staff recommended that the Planning & Zoning Commission approve a final plat for Wildridge, subject to final submittal of any requirements based on the City Engineers reviews of the civil construction plans and approval from Mustang. All lots within this final plat are located in the City s extraterritorial jurisdiction. (Olson) The preliminary plat for Wildridge Phases 3D, 4B, & 4C have been reviewed by the City Planner and City staff and conform to the ordinances and development agreement. The civil engineering plans were still being reviewed by the City Engineer and recommended approval was subject to the comments from the engineer and approval from Mustang. The property consists of 221 single-family residential lots with 217 being within the City limits, the remaining lots are located in the ETJ. Commissioner Meek motioned that the Planning & Zoning Commission vote to recommend that the City Council approve a preliminary plat for Wildridge Phases 3D, 4B, & 4C consisting of 221 singlefamily residential lots and 2 HOA lots located on approximately acres in the William McNeil Survey, Abstract No. 814 and the E.A. Shahan Survey, Abstract No in the City of Oak Point and the Oak Point extraterritorial jurisdiction, Denton County; motion seconded by Commissioner Buttermark. Motion passed with a vote of Consider and act upon a final plat of Shahan Lakeview, Phase 2 consisting of 191 single-family residential lots located on approximately acres in the Lawson Clark Abstract No. 311, the E.A. Shahan Abstract No and No in the City of Oak Point s Extraterritorial Jurisdiction (ETJ). (Olson) The final plat for Shahan Lakeview Phase 2 was submitted and reviewed by the City engineer and City Planner. The plat is in line with the development agreement and all applicable ordinances. City staff recommended that the Planning & Zoning Commission approve a final plat for Shahan Lakeview, Phase 2, subject to final submittal of any requirements based on the City Engineers reviews of the civil construction plans and approval from Mustang. Olson, City Manager Re: Replat of Lot 1, Block A, Wellington Trace, Phase 1 Date: May 2, 2017 Agenda tem: Conduct a public hearing, consider and act upon a request for a replat of Lot 1, Block A of Wellington Trace, Phase 1 Addition consisting of 0.3 acres generally located at the northwest corner of Wellington Drive and Hill Lane in the City of Oak Point s Extraterritorial Jurisdiction (ETJ). Description of Agenda tem: The purpose of the replat is to remove a 20 foot easement from the lot and create a separate HOA lot for the easement. The replat would still allow for the minimum front, back and sideyard setbacks on the original lot of 20 feet in the front and back and 5 feet on the side. The HOA would maintain the easement lot. Both the Subdivision Ordinance and the Local Government Code state that A replat of a subdivision or part of a subdivision may be recorded and is controlling over the preceding plat without vacation of that plat if the replat: is signed and acknowledged by the owners of the property being replatted; is approved, after a public hearing on the matter at which parties in interest and citizens have an opportunity to be heard, by the municipal authority responsible for approving plats; and does not attempt to amend or remove any covenants or restrictions. Budget mpact: There are no budget impacts to the City since the subject property is located within the City s Extraterritorial Jurisdiction. 8 A notice of the public hearing was published in the Little Elm Journal on April 7, 2017 and 15 notices mailed to property owners within 500 feet of the subject property on April 6, As of Friday, April 28, 2017 no reply forms have been received by the City. The Planning & Zoning Commission and City Council have an obligation to approve plats that conform to the City s zoning and subdivision regulations under Section of the Texas Local Government Code. Olson, City Manager Re: Planning & Zoning Meeting May 2, 2017 Date: April 28, 2017 Agenda tem: Consider and act upon a final plat of Wildridge, Phase 3B, being a acre tract of land that is part of the E.A. Shahan Survey, Abstract No in the Oak Point ETJ, Denton County, Texas containing 74 single family residential lots and 3 HOA lots. Description of Agenda tem: The subject property is located just outside of the City limits in the City s extraterritorial jurisdiction (ETJ) and is part of a larger 213-acre tract of land owned by CR-TD, LLC (Crescent Communities). The ETJ is the unincorporated area within a certain distance of a city s boundary (generally ½ mile in Oak Point s case) that is not within the city limits or ETJ of another city. While properties located in a city s ETJ are anticipated to be annexed into the associated city at some time in the future, a city may exercise only limited control over properties within their ETJ. Generally, only a city s subdivision regulations and sign regulations may be extended to their ETJ. Under certain conditions, a city may annex the property in its ETJ. However, as a general law city (less than 5,000 in population), the City of Oak Point is unable to involuntarily annex properties. The City is the authority responsible for regulating the subdivision of property and acting upon plats for properties located within the City and the City s ETJ. Typically, only a city s subdivision and sign regulations are applicable to a property located within its ETJ. However, the City entered into a Development Agreement with Crescent Communities. The Agreement significantly increased the City s regulation over the development of the property by establishing a variety of development standards and a number of obligations for the developer that would normally not be required of a development within the ETJ. These standards establish a maximum number of lots that may be developed on the property and set forth requirements for minimum lot areas, setbacks, and architectural design of homes. Obligations include a requirement to reconstruct Shahan Prairie Road, to process building permits and inspections through the City of Oak Point, and to preserve trees on the amenity and open space lots. 14 n preparing to develop a single-family subdivision on the property, Crescent Communities had submitted a preliminary plat and preliminary utility plans for the project to the City which was approved in June Lot Size Minimum lot sizes are specified by the City s zoning regulations. Zoning regulations do not apply to properties located within the City s ETJ. Therefore, the City is generally unable to regulate the size of the lots contained within residential subdivisions within the ETJ. However, the above referenced Agreement established a maximum number of lots and minimum lot sizes. The Agreement states that a maximum of 680 single-family lots may be developed on the property. Of the 680 lots, 30% of the lots must have a minimum lot area of 7,200 square feet. The minimum lot area for the remaining lots is 6,000 square feet. The final plat for Wildridge Phase 3B contains 74 residential lots and 3 HOA Lots. Building Standards While Denton County typically regulates the construction of the homes located outside of the City limits, the above referenced Agreement requires the homes to be permitted and inspected by the City. Per the Agreement, the requirements of the 2006 series of the nternational Building Code and the City s local amendments will be applicable to construction on the property. n addition, the Agreement contains other construction requirements that would normally not apply to properties within the ETJ. Examples of these requirements include masonry, roof slope, and various other architectural standards. Access Generally, each lot, with the exception of lots on a cul-de-sac, within a proposed subdivision should have two means of access to and from the property to facilitate emergency response to homes and for purposes of traffic distribution. Phase 1 has access from two streets extending from Shahan Prairie Road. Access to lots within Phase 2 is provided through Phase 1. A third street extension from Shahan Prairie Road will be constructed with Phase 3. n some instances, a street easement containing a temporary cul-de-sac constructed of asphalt per the City Engineer s specifications or concrete will need to be provided at the end of a street to provide emergency and solid waste trucks the ability to turnaround until the street is extended with the development of a subsequent phase or with the development of the adjacent property. The temporary street easement can be abandoned and the temporary culde-sac can be removed once the streets are extended. Shahan Prairie Road The Agreement includes a requirement to reconstruct Shahan Prairie Road from FM 720 to the eastern boundary of the property. Per this obligation, Shahan Prairie Road will be constructed Agenda tem No. 5 Page 2 of 4

15 as a concrete road from FM 720 to the westernmost entry street in Phase 1 (which aligns with the easternmost driveway of the Oak Point Elementary School) and as an asphalt road from the westernmost entry street in Phase 1 to the eastern boundary of Phase 3. At its intersection with FM 720, the road will be constructed as a four-lane median divided section with turn lanes before transitioning to a two-lane road. The two-lane road will be located so that it will serve as the westbound lanes of a future four-lane divided road when the eastbound lanes are constructed in the future. The Agreement requires the construction of the concrete road improvements to be complete prior to the issuance of the 100 th building permit for the property. The asphalt road improvements must be constructed concurrently with the development of any property that is served by a road intersecting with Shahan Prairie Road. The majority of the Shahan Prairie Road project has been completed with the exception of the intersection at FM 720 due to the delay in the expansion project. Landscaping, Open Space, and Tree Preservation City requirements for landscaping, open space, and tree preservation also do not generally apply to properties located within the ETJ. However, the Agreement requires landscape buffers with a minimum width of at 20 feet to be provided along Shahan Prairie Road. Within the landscape buffer, at least one tree and two crepe myrtles must be plated per every 30 linear feet of landscape buffer. n addition to the perimeter landscaping requirements, at least two trees must be planted on each single-family lot. The Agreement also requires a minimum of 30 of the 213 acres to be dedicated as open space and existing, healthy trees of three-inch caliper or greater in the open space areas must be preserved. The final plat for Phase 3B includes 3 HOA/Open Space lots. Amenity Center, Parks, and Trails An amenity center and several other private parks are planned within the Wildridge project. The amenity center located near the main entry on Block X, Lot 1 was developed with Phase 1. The Agreement also requires six-foot hike and bike trails to be constructed to provide linkages between the amenity center, open space areas, and private parks. The preliminary plats that were approved in November 2013 depicted the location of the trails. Utility Plans Water, sewer, and drainage plans were submitted and are being reviewed by the City Engineer. Water and wastewater service will be provided by the Mustang Special Utility District. Because the review of the utility plans is not complete, approval of the plat should be contingent upon the approval of the utility plans by the City Engineer and Mustang Special Utility District. Budget mpact: Approval of the plat will ultimately lead to the development of 74 additional homes in the City s ETJ. Besides increasing the number of rooftops in Oak Point s retail trade area, sales tax generated by utilities and home businesses will be paid to the City of Oak Point and the Oak Point Municipal Development District. Also, Denton County will compensate the City for responding to any future fire calls within the proposed subdivision. Per the Agreement, the City Agenda tem No. 5 Page 3 of 4

16 will provide DPS services to the property in exchange for a monthly fee. City staff has no budgetary concerns related to the approval of the plat. Legal Obligations and Review: While the approval of zoning is discretionary, the approval of plats is ministerial. Therefore, if a property owner submits a plat that meets or exceeds the minimum development standards and requirements, the Planning & Zoning Commission and City Council have an obligation to approve the plat. The Phase 3B final plat is consistent with the previously approved preliminary plat and concept plan for the Wildridge development. Based on City staff s review of the plat, it appears that the plat is also compliant with the City s subdivision regulations and the above referenced Agreement. Attached Documents: 1.
