PRELIMINARY STAFF PLANNING REPORT TO THE WALWORTH COUNTY ZONING AGENCY TYPE OF PETITION X REZONE CONDITIONAL USE NAME: Robert A. Pearce Farms (Robert Pearce Applicant) LOCATION: The property of concern is located in the NE ¼ of Section 3 of Walworth Township and is identified as part of Tax Parcel E W-3-1. TOWN RESPONSE: Approved: X Denied: No Action: Tabled: ZONING: The present zoning is A-1 Prime Agricultural District The requested zoning is A-4 Agriculturally Related Manufacturing, Warehousing and Marketing District. (The rezone is accompanied by a conditional use request for expansion of uses and activities on an existing farm market). PROJECT DESCRIPTION: The application indicates: The property owner is requesting to rezone approximately 4.82 acres from A-1 to A-4 and to add the newly rezoned area to an existing farm market already zoned A-4. The additional A-4 area would allow for addition of a 50 by 70 building proposed to be used as a seasonal haunted house in the fall around the Halloween season. In addition, the owner is requesting conditional use approval for a petting zoo and a helicopter landing pad. The landing pad would be used to allow for farmer s market costumer rides to attach people to the market facility. An existing 60 by 200 farm shed would also be incorporated into the farm market for use as cold storage for supplies for the market, future expansion of the haunted house or an indoor play area during rainy weather. A small stage is proposed for giving farm orientated presentations and non-paid music entertainment. A large portion of the proposed A-4 area is to provide overflow parking the busy season. CONFORMANCE WITH COUNTY LAND USE PLAN: The County 2035 Land Use Plan identifies this area as the Prime Agricultural Land Use Category. COMPATIBILITY WITH SURROUNDING LAND USES: To the north and west are lands zoned A-1. To the east are lands zoned A-1 and A-4. To the south is land zoned A-1, P-2 and the ETZ of the Village of Williams Bay. SITE CHARACTERISTICS: The following soils are found on the site % of Site DdA Class I Dodge Silt Loam, 0 to 2% slopes 95%
2 KlA Class II Kendall silt loam, 1 to 3 percent slopes 5% The rezone area contains 100% prime farm soils. IMPACT ON ROADS AND TRAFFIC: The site is served by Hwy F to the east and North Walworth Road to the south. Costumers for the farmers market would use the access off of Hwy F. OTHER RELEVANT DATA RECOMMENDATIONS: APPLICATION STATUS: X COMPLETE INCOMPLETE FINDINGS FOR REZONING: Please confirm that the rezoning was approved only after findings of all of the following as required by s (1) Wisconsin Statutes: [ ] The land is better suited for a use not allowed in the farmland preservation zoning district. [ ] The rezoning is consistent with any applicable comprehensive plan. [ ] The rezoning is substantially consistent with the County certified farmland preservation plan. [ ] The rezoning will not substantially impair or limit current or future agricultural use of surrounding parcels of land that are zoned for or legally restricted to agricultural use. The County Land Use Plan allows A-4 zoning is the Prime Agricultural Land Use Category area for farm marketing purposes.
