Since this submittal exceeds 30,000 square feet, per Section c, a Special Approval is required to be submitted and approved by the Board of County Commissioners prior to exceeding the additional 30,000 square feet The Southeast Guide Dog center was established in 1982 and currently comprises 57,337 square feet of administrative offices, kennels, training areas and dormitories The 22.49± acre property is within the RES-6 (Urban Fringe 6 units per acre) Future Land Use Category (FLUC). The dog training school is surrounded by roadways on three sides; I-275 (north), Ellenton- Gillette (west), 77 th Street East (south) and additional property owned by the school on the eastern perimeter. The dog training school was established in The proposed FAR (0.10) is significantly less than the FAR allowed in the RES-6 FLUC (0.23). Southeastern Guide Dog facility has been in place since 1982; for 35 years. NEGATIVE ASPECTS It is staff s opinion that there are no apparent or notable negative aspects. MITIGATING MEASURES N/A

9 Page 4 of 9 Special Approval Resolution Southeastern Guide Dogs-Residence Hall and Training Center SPECIAL APPROVAL, ANALYSES, RECOMMENDATTIONS, FINDINGS Policy c of the Manatee County Comprehensive Plan requires Special Approval from the Board of County Commissioners for any non-residential project exceeding 30,000 square feet of gross building area in the RES-6 Future Land Use Category. Request The request is to approve a Special Approval for a non-residential project, which exceeds 30,000 square feet in the RES-6 FLUC in order to construct a 30,182 square foot addition at Southeastern Guide Dogs facility located at th Street East. The facility consists of two parcels totaling approximately acres and is located at the northeast corner of 77 th Street East and Ellenton-Gillette Road. The site plan included depicts the construction of a residence hall in the form of a kennel, as well as a canopy area. The Southeast Guide Dog center was established in 1982 and has continued to grow over the years. The center currently comprises 57,337 square feet of administrative offices, kennels, training areas and dormitories for those selected for a guide dog. Within the Comprehensive Plan there is language in Policy c. of the RES-6 Future Land Use category which requires any non-residential project exceeding 30,000 square feet of gross building area to obtain a Special Approval. Special Approval requires BOCC approval and is a quasi-judicial. The policy is in place in all the RES future land use categories to protect the potential impacts of a 30,000 square foot non-residential building in a residential future lands use category. Once approved, the Southeastern Guide Dog school can proceed with their requested expansion. The last expansion was in December 2015 for a 30,867 sf student and administrative offices with a 3,797 sf canopy area. STAFF ANALYSIS AND FACTORS FOR CONSIDERATION Consistency with Comprehensive Plan The site is in the RES-6 FLU category. Within the range of potential uses within the RES-6, in part, is to provide for schools. The Southeastern Guide Dog Center is a school of special education. There are a total of 20 guide dogs schools in the United States. Arizona (1), California(3), Connecticut(1), Florida(1),Hawaii(1), Kansas(1), Michigan(1), New Jersey(1), New York (3), Ohio(1), Oregon(1), Texas(1) and Wisconsin (1). Florida only has this one school with the next closest school in San Antonio Texas. The Southeastern Guide Dog school was established in At this time, there were no residential subdivisions within close proximity of the area; only single family homes on one acre and larger. Schools are defined as a residential support use as described by definition in the LDC and permitted within the RES-6 FLU category. This proposal was reviewed for consistency with Policy of the Comprehensive Plan which requires review of all proposed development for compatibility and appropriate timing. The proposed expansion includes a kennel and canopy area to the existing guide dog school. This is to accommodate a need to fulfill increased requests by those that have lost their eye site associated with a variety of causes. The Southeastern Guide Dog center also

10 Page 5 of 9 Special Approval Resolution Southeastern Guide Dogs-Residence Hall and Training Center caters to Veterans that have PTSD (Post Traumatic Stress Syndrome), Canine Connections dogs for children that are legally blind or will become blind as an adult, service dogs, facility therapy dogs and breeder dogs. Policy Review all proposed development for compatibility and appropriate timing of development Compatibility To the south is 77 th Street East. Across 77 th Street East is Heron Run, a 45 lot residential subdivision that was approved in March of Within Zoning Ordinance PDC-14-24(P), a Notice to Buyers shall be included in the Declaration of Covenants and Restrictions, which includes language informing prospective homeowners the presence of the dog training facility and noises associated with their uses. Along the eastern property line is property owned by the Southeastern Guide Dog center. To the west is Ellenton-Gillette Road. Beyond Ellenton-Gillette Road is an orphanage. To the north is I-275. The expansion of the existing guide dog facility is consistent with the community character of the immediate neighborhood which is a combination of single-family homes on both large and small lots. In addition to the Special Approval for a non-residential use exceeding 30,000 square feet, the kennel requires Final Site Plan approval. Timing and Trends The site is zoned A-1 (Suburban Agriculture), the original zoning for the property. The request is to expand the dog kennel portion of the Southeastern Guide Dog center which was started in The area surrounding the Southeastern Guide Dog center continues to grow with both residential and non-residential development. A recently approved residential development to the south, Heron Run, was required to identify in their homeowners documents and put all residence on notice that the Southeastern Guide Dog facility is locate on the north side of 77 th Street East, just across the street from their residential subdivision. Location in Areas Subject to Flooding The project is not within an area of known flooding. The site is located in Zones X, A with no base flood elevation and AE with a Base Flood Elevation of 17.6 NAVD 1988, per FIRM Panel 12081C0159E, effective 3/17/2014. Impacts to Infrastructure The expansion project is utilizing the existing access on 77 th Street East. According to the Traffic Impact Statement prepared for the Final Site Plan, the trips generated by this project will not negatively impact the level of service for Ellenton-Gillette Road nor 77 th Street East. There is an 8 PVC water main on the north side of 77 th Street East which currently serves the guide dog facility. Environmental Sensitivity There are no wetlands on the project site. The site is not within an area of high archaeological potential. There are no known archaeological, historical, or cultural resources on this site. Finding for Special Approval The Board finds that the specific criteria for the special approval established in the Comprehensive Plan and Land Development Code are satisfied by the proposed design because the project will have no significant detrimental impacts on natural resources, adjacent land uses, or public facilities. A residence hall in the form of a kennel for the guide dogs and canopy can be found consistent and compatible with the existing guide dog campus and other development patterns in the area. Southwest Guide Dog was established in 1982 and has continued to grow to accommodate those that have physical limitations and the need for specialized training for these type of trained dogs. This analysis shall include the following: - consideration of existing development patterns, - types of land uses, - transition between land uses, - density and intensity of land uses, - natural features, - approved development in the area, - availability of adequate roadways, - adequate centralized water and sewer facilities, - other necessary infrastructure and services. - limiting urban sprawl - applicable specific area plans - (See also policies under Objs ) Implementation Mechanism(s): a) County review of all plan amendments and development proposals for consistency with this policy. b) Placement of conditions, as necessary on development orders to ensure policy compliance. Policy Policy RES-6: Establish the Residential-1 future land use category as follows: Intent: To identify, textually in the Comprehensive Plan's goals, objectives, and policies, or graphically on the Future Land Use Map, areas which are established for a low density suburban residential environment, or a clustered low density urban residential environment where appropriate, and which may be utilized for compatible agricultural activities in the short-term, while recognizing that suburban or clustered urban uses are the preferred long-term land use for these areas. Also, to provide for a complement of support uses normally utilized during the daily activities of residents of these suburban or urban areas. Net densities greater than 6 dwelling units per net acre may be considered within the WO (Evers) or CHHA Overlay Districts, pursuant to policies and , to maximize protection of natural resources and to maximize reserved open space. d) Any project containing any net density in excess of 1 dwelling unit per acre shall require special approval. e) Any nonresidential project exceeding 30,000 square feet of gross building area shall require special approval. R SPECIAL APPROVAL (RELATED TO AP-17-01) SOUTHEASTERN GUIDE DOGS RESIDENCE HALL AND TRAINING CENTER MEPS384 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MANATEE COUNTY, FLORIDA, ALLOWING FOR A NON-RESIDENTIAL PROJECT EXCEEDING 30,000 SQUARE FEET AS A COMPONENT OF AN EXISTING SCHOOL OF SPECIAL EDUCATION IN THE RES-6 (RESIDENTIAL SINGLE FAMILY, 6 DWELLING UNITS PER GROSS ACRE) FUTURE LAND USE CATEGORY LOCATED ON ±22.49 ACRES OF THE APPROXIMATELY ACRE SITE LOCATED AT TH STREET EAST, BRADENTON (MANATEE COUNTY); SUBJECT TO STIPULATIONS AS CONDITIONS OF APPROVAL; SETTING FORTH FINDINGS; PROVIDING A LEGAL DESCRIPTION; PROVIDING FOR SEVERABILITY, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Manatee County Comprehensive Plan requires any non-residential project exceeding 30,000 square feet in the RES-6 Future Land Use Category; and WHEREAS, pursuant to Table 3-4 of the Manatee County Land Development Code Special Approval requires approval of the Board of County Commissioners and may be granted by resolution following a duly noticed public hearing, separate from any other development order; and WHEREAS, Southeastern Guide Dog, LLC (the Applicant ) owns a 33.39± acre parcel of land located at th Street East, Bradenton (Manatee County) more specifically described in Exhibit A attached hereto and incorporated herein (the Property ); and WHEREAS, the Applicant has a pending application for an administrative permit AP to allow for a 30,182 square foot dormitory and canopy area; and, WHEREAS, the Applicant applied for Special Approval pursuant to the applicable provisions of the Comprehensive Plan and Land Development Code for a non-residential project exceeding 30,000 square feet component of an existing school of Special Education in the RES-6 (Residential Single-Family, 6 dwelling units per gross acre) Future Land Use Category, on the Property; and, WHEREAS, the Board, upon recommendation of staff, desires to conditionally grant Special Approval for a non residential project to exceed 30,000 square feet as a component of an existing school of Special Education in the RES-6 (Residential Single-Family, 6 dwelling units per acre) Future Land Use Category. NOW, THEREFORE, be it resolved by the Board of County Commissioners of Manatee County, Florida: Section 1. Findings of Fact. In support of this resolution, the Board hereby makes the following findings: A. The above recitals are true and correct and are hereby adopted as findings of the Board.

The Board held a public hearing on August 3, 2017, regarding the request and considered the evidence and testimony received at the hearing, including the report of the Building and Development Services Department containing an analysis and recommendation of the applicant s request. C. The Board finds that the proposed project described in Administrative Permit Application No. AP will have no significant detrimental impacts on natural resources, adjacent land uses, or public facilities. Section 2. Special Approval. The Board hereby grants the Special Approval for a non-residential project exceeding 30,000 square feet as a component of an existing school of Special Education in the RES-6 (Residential Single-Family, 6 dwelling units per gross acre) Future Land Use Category, as detailed on the Administrative Permit Application No. AP Section 3. Severability. If any section, sentence, clause, or other provision of this Resolution shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such section, sentence, clause, or other provision shall be deemed severable, and such invalidity or unconstitutionality shall not be construed as to render invalid or unconstitutional the remaining sections, sentences, clauses, or provisions of this Resolution. Section 4. State and Federal Permitting. The issuance of any local development permit by the County shall not create any liability on the part of the County in the event the applicant fails to obtain the required state or federal agency approvals or permits or fails to fulfill the obligations imposed by any state or federal agency or undertakes actions that result in a violation of state or federal law. Section 5. Effective Date. This Resolution shall be effective on the date that the Administrative Permit No. AP is approved by staff.
