1 MANATEE COUNTY ZONING ORDINANCE PDR-01-16(Z)(P) - DANIEL DEVELOPMENT/KEW GARDENS II AN ORDINANCE OF THE COUNTY OF MANATEE, FLORIDA, AMENDING THE OFFICIAL ZONING ATLAS OF MANATEE COUNTY, ORDINANCE NO (THE MANATEE COUNTY LAND DEVELOPMENT CODE) RELATING TO ZONING WITHIN THE UNINCORPORATED AREA OF MANATEE COUNTY; PROVIDING FOR THE REZONING OF CERTAIN LAND FROM RSF-1 (RESIDENTIAL SINGLE-FAMILY, 1 DWELLING UNIT PER ACRE) TO PDR (PLANNED DEVELOPMENT RESIDENTIAL); PROVIDING AN EFFECTIVE DATE; AND APPROVAL OF A PRELIMINARY SITE PLAN TO ALLOW A 48 LOT SUBDIVISION FOR SINGLE-FAMILY DETACHED HOMES AT A DENSITY OF 1.36 DWELLING UNITS PER ACRE, AND GRANTING SPECIAL APPROVAL FOR 1) A PROJECT TRANSFERRING DENSITY FROM ONSITE WETLANDS TO UPLAND PORTIONS OF THE SITE, AND 2) A PROJECT EXCEEDING GROSS RESIDENTIAL DENSITY OF 1 DWELLING UNIT PER ACRE IN THE UF-3 FUTURE LAND USE CATEGORY. MANATEE COUNTY, FLORIDA: BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF Section 1. FINDINGS OF FACT. The Board of County Commissioners of said County, after considering the testimony, evidence, documentation, application for amendment of the Official Zoning Atlas, the recommendation and findings of the Planning Commission of said County, as well as all other matters presented to said Board at the public hearing hereinafter referenced, hereby makes the following findings of fact: A. The Board of County Commissioners has received and considered the report of the Q GC OLD ag ocg ccco SOD B cr> te \fl CO Oi5 X: «t QS o0 <"» ffl "x. o% i Manatee County Planning Commission concerning the application for Official Zoning Atlas Amendment as it relates to the real property described in Section 4 of this Ordinance from RSF-1 (Residential Single-Family, 1 dwelling unit per acre) to PDR (Planned Development Residential). The Board of County Commissioners held a public hearing on December 18, 2001 regarding said proposed Official Zoning Atlas Amendment described herein in accordance with the requirements of Manatee County Ordinance No , the Manatee County Land Development Code, and has further considered the information received at said public hearing. c. The proposed amendment to the Official Zoning Atlas regarding the property described in Section 4 herein is found to be consistent with the requirements of Manatee County Ordinance No , the Manatee County Comprehensive Plan. Section 2. The Preliminary Site Plan is hereby APPROVED to allow a 48 lot subdivision for singlefamily detached homes at a density of 1.36 dwelling units per acre, and granting Special Approval for 1) a project transferring density from onsite wetlands to upland portions of the sie, an82) a project exceeding gross residential density of 1 dwelling unit per acre in the UF-3 Futore'LarUse,.,., Category, with the following stipulations: : m l Si 5> T«Cft - (Y> - -,;=-» ooi. cr>,, s? - HI o ;0 U3

2 Page 2 - PDR-01-16(Z)(P) - Daniel DevelopmenVKew Gardens II STIPULATIONS 1. Lots 1-32 (exterior lots) shall have a minimum lot width of 75'. Lots (interior lots) may have a minimum lot width of 70 feet. 2. Minimum setbacks shall be 25' front, 10' side, 15' rear. 3. The neighborhood focal point will provide commercial grade play equipment, benches, and picnic tables. The details of the type of equipment and layout shall be shown on the Final Site Plan. 4. Plan indicates seventy-six (76) 5" caliper replacement trees are required. Wherever possible, these trees will be planted in the perimeter buffer or other common open space areas within the project. 5. The design and shielding of any on-site lighting shall comply with Section In addition, pole mounted lights shall be limited to 20' in height and directed to the interior of the development using horizontal cut-off fixtures. 6. The Notice to Buyer and Final Site Plan shall include a notice to inform homeowners of the presence of neighboring agricultural uses, which may possibly include pesticides and herbicides and may have odors and noises associated with such uses. 7. Boundaries of the wetland buffers shall be marked with signage that indicates a wetland protection area. The number and placement shall be approved by EMD with Final Site Plan approval. 8. A minimum fifteen foot building setback shall be provided between the upland edge of the wetland buffer and any adjacent structures in accordance with Section of the LDC, unless otherwise approved by EMD. 9. Prior to Final Site Plan approval, a completed application for Fugitive Particulate Abatement must be submitted to the Environmental Management Department. 10. Drawings, details, or notes for Sedimentation and Erosion Control shall be submitted to the EMD for review and approval, prior to Final Site Plan approval. 11. Prior to Final Site Plan approval, the entire site shall be evaluated for potential hazardous material locations (e.g., historical cattle dipping vats, underground/aboveground storage tanks, or buried drums), by a qualified environmental consultant. Should evidence of contamination be discovered, further investigation will be required to determine the level of contamination and appropriate remediation/mitigative measures.

The Notice to Buyer and Final Site Plan shall include notice to inform homeowners of the presence of an interneighborhood tie to the property to the west. Traffic from that property, when developed, may use the roads within this development. 13. Prior to Final Plat approval, the applicant shall post a sign at the interneighborhood tie to inform prospective purchasers and residents of the future interneighborhood tie. The size, placement, and materials for this sign shall be determined with the Final Site Plan. 14. The applicant and their heirs, assigns, or transferees, are hereby notified that a payment of an impact fee for school purposes shall be required if such impact fee is adopted by the School Board of Manatee County or the Board of County Commissioners. 15. The lowest quality water possible shall be used for irrigation. In-ground irrigation using Manatee County public potable water supply shall be prohibited, including on individual lots. 16. The interneighborhood tie shown along the west property line shall be moved to the southwest to insure that a future connection can be made without impacting a wetland on the adjacent property to the west. 17. The intersection of 63rd Avenue East and Erie Road shall be shown on the Final Site Plan. 18. The Final Site Plan shall demonstrate and the Developer shall provide adequate intersection sight distance for 63rd Avenue East at Erie Road in agreement with AASHTO Green Book guidelines. Depict the sight distance on the plan. 19. At the intersection of 63rd Avenue East and Erie Road, the Developer shall extend the eastbound right-turn lane and depict the extended eastbound right-turn land on the Final Site Plan. The length of the extended right-turn land shall be determined prior to Final Site Plan approval. 20. In the event that any additional state or federally-listed species are discovered on-site during project development, the developer shall immediately notify the Florida Fish and Wildlife Conservation Commission and Manatee County EMD and implement the appropriate measures for species conservation as recommended by the Florida Fish and Wildlife Conservation Commission. 21. If this project drains to an area of known flooding, the stormwater management system shall be designed on the Final Site Plan to provide a reduction of 50% of the allowable pre- development flow from the 25 year/24hour storm event discharge. Section 3. AMENDMENT OF THE OFFICIAL ZONING ATLAS. The Official Zoning Atlas of Manatee County, Ordinance No , the Manatee County Land Development Code, is hereby amended by changing the zoning district classification of the property identified in Section 4 herein from RSF-1 (Residential Single-Family, 1 dwelling unit per acre) to PDR (Planned Development Residential), and the Clerk of the Circuit Court, as Clerk to the Board of County Commissioners, as well as the Planning Department, are hereby instructed to cause such amendment to the said Official Zoning Atlas.
