1 ARLINGTON COUNTY, VIRGINIA County Board Agenda Item Meeting of December 14, 2013 DATE: November 12, 2013 SUBJECT: Deed of Dedication, Deeds of Easement and Deeds of Temporary Easement and Construction Agreement for a Department of Environmental Services Project on Portions of Properties Located Along Old Dominion Drive in Arlington County, Virginia (RPC# & RPC# ). C. M. RECOMMENDATIONS: 1. Approve the Deed of Dedication, Deed of Easement, and Deed of Temporary Easement and Construction Agreement, attached hereto as Exhibits 1 3, from Jonathan D. Eisner, Trustee, to the County Board of Arlington County, Virginia, granting to the County portions of the property located at 4880 Old Dominion Drive, including a portion of the land fee simple for public streets and utilities, a portion of the land in permanent easement for public sidewalk, utilities, and storm drainage purposes, and a portion of the land in temporary easement for public streets, utilities, and drainage facilities purposes; 2. Approve the Deed of Easement and Deed of Temporary Easement and Construction Agreement, attached hereto as Exhibits 4 and 5, from Michael C. Lindsay and Debra L. Lindsay to the County Board of Arlington County, Virginia, granting to the County a portions of the property located at 4876 Old Dominion Drive, including a portion of the land in permanent easement for public sidewalk, utilities, and storm drainage purposes, and a portion of the land in temporary easement for public streets, utilities, and drainage facilities purposes; and 3. Authorize the Real Estate Bureau Chief, or his designee, to accept the above described deeds, including the Deed of Dedication, the Deeds of Easement, and the Deeds of Temporary Easement and Construction Agreement, attached hereto as Exhibits 1 5, on behalf of the County Board of Arlington County, Virginia, subject to approval of the deeds as to form by the County Attorney. 2 ISSUES: No issues have been identified. The Code of Virginia requires that for any conveyances of real property to the County Board to be effective, the conveyances must be accepted on behalf of the County Board. SUMMARY: This is a request for the County Board s approval and authorization to accept five (5) deeds, including a Deed of Dedication, two (2) Deeds of Easement, and two (2) Deeds of Temporary Easement and Construction Agreement, attached hereto as Exhibits 1 5, for the Department of Environmental Services public works project known as Old Dominion Drive between North Glebe Road and 38 th Street North. The project will construct public street, sidewalk, and utilities along Old Dominion Drive. BACKGROUND: The subject deeds are required for a public sidewalk and streetscape project, which encompasses Old Dominion Drive from North Glebe Road to 38 th Street North, and extends through the Rock Springs and Yorktown civic associations. The project is designed to construct public sidewalk, curb and gutter, and storm drainage improvements, and install street lights along both sides of Old Dominion Drive. The project would also construct intersection improvements, including traffic signal and turning lane upgrades. The project will provide improved roadside clearance and sight distance vision, which will promote better pedestrian, bicycle, transit, and vehicular safety. In addition to the proposed construction along Old Dominion Drive, the County plans to improve the service road east of Little Falls Road (formerly known as Creston Avenue) and the service road between Rock Springs Road and 29 th Street North. DISCUSSION: The Deed of Dedication, attached hereto as Exhibit 1, would convey 17 square feet of land in fee simple from Jonathan D. Eisner, Trustee, to Arlington County. The 17 square feet of land is presently improved with street asphalt beneath the intersection of Old Dominion Drive and Little Falls Road. Acquisition of the 17 square feet will allow the County to hold title to, control and maintain, the paved over street intersection. The Deeds of Easement, attached hereto as Exhibits 2 and 4, would convey permanent easement areas allowing for the construction and ease of maintenance of public sidewalk along the southerly side of Old Dominion Drive. The public sidewalk will be accessorized with public street lighting and a new sidewalk ramp to accommodate pedestrian crossings at the corner of Old Dominion Drive and Little Falls Road, which will meet American with Disabilities Act (ADA) standards for an ADA compliant sidewalk ramp. The Deeds of Temporary Easement and Construction Agreement, attached hereto as Exhibits 3 and 5, would convey temporary easement areas allowing for the access to and ease of use of the properties adjacent to the public sidewalk, as the public sidewalk is being constructed and installed. FISCAL IMPACT: The County and property owners have reached an agreement on compensation for the property owners loss of existing landscaping, and for the relocation of yard improvements and fixtures. The agreement allows the property owners, themselves, to remove and reinstall their electrical and irrigation systems, and to restore landscaping after the County completes its proposed sidewalk improvements. The County has agreed to pay - 2 -

3 $39, to Michael C. Lindsay and Debra L. Lindsay and $26, to Jonathan D. Eisner for this landscaping and relocation work. The total sum of $66, paid to the property owners will be in lieu of the County having to remove, transplant and/or replace trees, shrubs, and plantings, and is supported by estimates for such work obtained by the County from its landscaping contractors. Therefore, the sum of $66, paid to the property owners will add minimal costs to the overall construction costs of the project. Funding for the payment is available in the project s account: TBOD
