1 ARLINGTON COUNTY, VIRGINIA County Board Agenda Item Meeting of January 28, 2017 DATE: January 19, 2017 SUBJECT: Deed of Easements, Temporary Construction Easements and Construction Agreement and Deed of Utilities Easements Granted to the Arlington County Board for Palazzo Condominium, RPC# , Related to the Columbia Pike Multi-Modal Project. C. M. RECOMMENDATIONS: 1. Approve the attached Deed of Easements, Temporary Construction Easement and Construction Agreement ( Easement ) for Palazzo Condominium, RPC# , ( Property ) and all the terms therein. 2. Approve the attached Deed of Utilities Easements ( Utilities Easement ) for the Property and all the terms therein. 3. Authorize the Real Estate Bureau Chief, Department of Environmental Services, or his designee, to accept and execute the Easement and the Utilities Easement on behalf of the County Board of Arlington County, Virginia, subject to approval of the Easement and the Utilities Easement, as to form, by the County Attorney. ISSUES: There are no known issues associated with the approval and acceptance of the Easement and the Utilities Easement. SUMMARY: The Easement and the Utilities Easement convey property interests to the County that are needed to construct the Columbia Pike Multi-Modal Utilities Undergrounding & Street Improvements: Four Mile Run to Arlington/Fairfax County Line (Segment H/I) Project ( Multi- Modal Project ). The Easement and the Utilities Easement (collectively, Easements ) are being conveyed to the County by the Property owner for no compensation. BACKGROUND: The Easements are required for the construction of the Multi-Modal Project. The Multi-Modal Project, in its entirety, is planned to transform the full length of Columbia Pike into a Complete Street, making it a safer, more accessible route for all users. In addition to the visible street improvements along Columbia Pike, which include wider sidewalks, upgraded County Manager: ##### County Attorney: ***** 26. A. 2 traffic signals, new street lights, street trees, transit stations and intersection improvements, extensive work is occurring below the roadway to replace aging and leak-prone water and sewer pipes and to bury existing overhead utilities underground. The portion of the Multi-Modal Project in front of the Property will include the undergrounding of all overhead utilities, the creation of wider sidewalks, a landscaping strip (where feasible), and a median or left turn land and installation of new street lights, street trees and a new transit station. DISCUSSION: The Unit Owners Association of the Palazzo Condominium ( Owners ) have agreed to grant and convey to the County Board, by the attached Easement, areas designated as: 1) Easement for Public Sidewalk, Utilities, Drainage, and Transit Stop/Shelter Purposes Area = 924 Sq. Ft.; 2) Easement for Storm Drainage Purposes Area = 354 Sq. Ft.; 3) Easement for Retaining Wall Purposes Area = 1,504 Sq. Ft.; ; 4) Temporary Construction Easement Area = 125 Sq. Ft.; 5) Temporary Construction Easement Area = 287 Sq. Ft. ; and 6) Temporary Construction Easement Area = 191 Sq. Ft. ; all as shown on a plat entitled Plat Showing Various Easement on The Palazzo Condominium, D.B. 2027, Pg. 1920, Arlington County, Virginia, prepared by Nathan A. Orr, Land Surveyor, Department of Environmental Services Engineering Bureau Survey Section, dated November 12, 2015 and approved by the Subdivision & Bonds Administrator on November 19, 2015 ( Plat ) attached to the Easement. In addition, the Owners have agreed to grant and convey, by the attached Utilities Easement, an area designated on the Plat as Easement for Public and Private Utilities Purposes Area = 1,374 Sq. Ft. The Easement is attached to this Board Report as Exhibit A and the Utilities Easement is attached to this Board Report as Exhibit B. FISCAL IMPACT: There will be no fiscal impact from the approval and acceptance of the Easements, as the County is obtaining the Easements without the payment of compensation
