C. M. RECOMMENDATION: 1. Approve the attached License Agreement between the County Board of Arlington County, Virginia, as Licensor, and the County chool Board of Arlington County, Virginia, as Licensee, on Portions of County-Owned Property known as the Barcroft Parking Garage located at Four Mile Run Drive, Arlington, Virginia (RPC# ). 2. Authorize the Real Estate Bureau Chief, Department of Environmental ervices, or his designee, to execute on behalf of the County Board, the License Agreement, subject to approval as to form by the County Attorney. IUE: There are no outstanding issues related to this Board item as of the date of this report. UMMARY: The County Board is requested to approve the attached License Agreement ( Agreement ) between the County and Arlington Public chools ( AP ), for the temporary use by AP of a portion of the parking garage adjacent to Barcroft Park and Barcroft ports & Fitness Center for AP bus driver parking of personal vehicles on the top level of the garage. The Agreement sets forth the terms, operation and use of the parking facilities by AP bus drivers and employees. Following County Board and chool Board approval and execution of the Agreement, the Agreement will permit AP bus drivers and employees to use a portion of the parking garage for the parking of their personal vehicles on weekdays during the hours of 5 a.m. to 5 p.m. beginning July 1, 2018 for a term of five years, unless sooner terminated or extended as provided in the Agreement. 2 BACKGROUND: The Barcroft parking garage is located at Four Mile Run Drive and serves as one of the parking areas for Barcroft ports & Fitness Center and Barcroft Park, including several ballfields (see Vicinity Maps attached hereto as Attachments 1, 2 and 3). In addition to the parking garage and a surface parking lot, there is also an additional parking lot adjacent to Tucker Field, located further south on Four Mile Run Drive, and on-street parking along Four Mile Run Drive. DICUION: The Barcroft Parking Garage is located at Four Mile Run Drive and is part of the Barcroft ports & Fitness Center and Barcroft Park complex. The amenities at the facility include playgrounds, lighted soccer and baseball fields, restrooms and open park space. The ports & Fitness Center and Park are programmed and maintained by the County s Department of Parks and Recreation. The License Agreement was necessitated by insufficient parking available for bus drivers and AP Transportation staff at the Trades Center/Facilities and Operations parking lot. In order to provide the necessary parking for its employees, AP has requested temporary use of the upper level of the parking garage (approximately 60 spaces) during weekdays from 5 a.m. to 5 p.m. for off-street parking of personal vehicles by its school bus drivers and AP Transportation staff employees. The proposed Agreement, attached hereto as Exhibit A, sets forth the terms regarding the use by AP of the parking facility at Barcroft ports & Fitness Center and Park. The Agreement also provides AP with the right of access, ingress and egress to and from the upper level of the garage. The permissible hours of use for parking by AP bus drivers will be limited to weekdays between the hours of 5 a.m. to 5 p.m., when the garage is underutilized by the public for parking for recreational activities. The upper level of the garage will be signed to indicate that the area is reserved for AP use during these days and hours. After 5 p.m. on weekdays and all weekends, the entire parking garage will be open and available for public parking. Under the terms of the Agreement, AP employees are prohibited from parking on lower levels of the parking garage or in other surface parking lots. AP will also be responsible for any damages that may be caused by it during its use. In order to transport its employees to the Trade Center, AP will run a shuttle vehicle between the parking garage at Barcroft Park and the Trade Center, approximately one mile away, where the school buses are currently being parked and stored overnight. If approved, and executed by both parties, the term of the Agreement will commence on July 1, 2018 for a period of five years, unless sooner terminated by either party upon notice in writing to the other party. The Agreement also provides that the term will be automatically extended for additional one-year terms, unless terminated upon at least 180 days prior written notice provided by one party to the other party. There is no compensation being charged by the County to AP. The chool Board has agreed to the terms of the License Agreement. PUBLIC ENGAGEMENT: Public notice of the proposed License Agreement was given in accordance with the Code of Virginia by publication at least once five days prior to the scheduled County Board Meeting in a newspaper with general circulation in the County. 3 was placed in the April 24, 2018 and May 1, 2018 issues of The Washington Times for the County Board Meeting of May 19, There is no other public engagement process necessary for a temporary License Agreement on County property. FICAL IMPACT: There will be no fiscal impact to the County resulting from the execution of the Agreement with AP for use of parking garage on County property in order to accommodate AP need for daytime bus driver parking
