1 ARLINGTON COUNTY, VIRGINIA County Board Agenda Item Meeting of May 19, 2018 DATE: May 9, 2018 SUBJECT: Deed of Easement from Alvaro Daniel Gabaldon and Rosemary O'Neill, as Grantors, to The County Board of Arlington County, Virginia, as Grantee, on a portion of the property located at 1726 North Monroe Street, Arlington, Virginia, RPC# for construction of a public sidewalk, utilities, and drainage facilities, as part of the Neighborhood Conservation public sidewalk project for North Monroe Street from 17 th Street North to 19 th Street North. C. M. RECOMMENDATIONS: 1. Approve the Deed of Easement, attached as, between Alvaro Daniel Gabaldon and Rosemary O Neill and The County Board of Arlington County, Virginia, granting to the County a permanent easement on a portion of the property located at 1726 North Monroe Street, in Arlington County, Virginia (RPC# ). 2. Authorize the Real Estate Bureau Chief, Department of Environmental Services, or his designee, to accept, on behalf of the County Board, the attached Deed of Easement, subject to approval as to form of all documents by the County Attorney. ISSUES: There are no outstanding issues as of the date of this report. SUMMARY: This is a request for the County Board s approval and authorization to accept the Deed of Easement attached hereto as. The Deed of Easement is required for a public sidewalk, utilities, and drainage facilities that will be constructed along North Monroe Street. BACKGROUND: The Deed of Easement, attached hereto as, would convey a permanent easement to the County. The permanent easement would allow the County to construct and maintain a public sidewalk along 1726 North Monroe Street to provide a continuous public sidewalk along the westerly side of North Monroe Street. The continuous public sidewalk will comply with the Americans with Disabilities Act (ADA) standards, and extend to a maximum width of five feet. The public sidewalk project also will include the County Manager: ##### County Attorney: ***** 22. Staff: Troy C. Harris, DES, Real Estate Bureau
2 construction and installation of underground utilities and drainage facilities. The project will be funded through the Neighborhood Conservation Program. DISCUSSION: The attached Deed of Easement was signed by Alvaro Daniel Gabaldon and Rosemary O Neill. The Deed would grant the County a permanent easement that would allow the County to construct a public sidewalk, utilities, and drainage facilities at 1726 North Monroe Street to provide for, and maintain, a continuous public sidewalk along the westerly side of North Monroe Street between 19 th Street North and 17 th Street North. The continuous public sidewalk will be designed and constructed, consistent with the goals of the Neighborhood Conservation Program: to provide for pedestrian and vehicular safety, accessibility, and convenience throughout the limits of the project. PUBLIC ENGAGEMENT: The attached Deed of Easement was obtained as part of a resident approved Neighborhood Conservation public sidewalk project ( Approved Project ). The Approved Project went through the Neighborhood Conservation Program public engagement process, and obtained the approval needed to become an Approved Project. A concept design was presented to affected and interested residents in the forum of a neighborhood block meeting. The Cherrydale Citizens Association has supported the Approved Project since its presentation to the neighborhood. FISCAL IMPACT: Because the Deed of Easement will be conveyed to the County Board at no cost to the County, there will be no significant fiscal impact related to the acceptance of the Deed
