1 AGENDA ITEM #5 February 11,2014 Action MEMORANDUM February 7, 2014 TO: County Council, ~ FROM: SUBJECT: Marlene Michaelso~enior Legislative Analyst Action: Glenmont Sectional Map Amendment (G-959) Attached on 1 to 13 are the application and Planning Department staff memorandum for a Sectional Map Amendment (SMA) to implement the recommendations of the recently Approved and Adopted Glenmont Sector Plan. The SMA application covers approximately 711 acres, of which approximately 68.5 acres are proposed for change in zoning classification. The remaining acreage is to be reconfirmed as currently zoned. The Council approved the Glenmont Sector Plan on November 5, Attached is an opinion approving the Glenmont Sectional Map Amendment (SMA) ( 14 to 18), with the technical staff report and application for the SMA submitted by the Planning Board ( 1 to 13). The SMA implements recommendations of the recently Approved and Adopted Glenmont Sector Plan by putting into effect zoning changes recommended in the Plan. The Planning Board submitted the SMA for the Glenmont Sector Plan on December 20, 2013 and the technical staff report on January 17. Because one property has split zoning, the Opinion and technical staff report indicate the boundaries ofthe zoning with a detailed metes and bounds description. The Council held a public hearing on the SMA for the Glenmont Sector Plan on January 28, 2014; no testimony was received, nor were any issues noted. Since there was no testimony, the Planning, Housing, and Economic Development (PHED) Committee did not meet to discuss the SMA. Staff recommends approval of the attached resolution. Councilmembers should remember that consideration of an SMA is subject to the ex parte rule and, therefore, the Council may only consider information that is part of the public record. Staff recommends against allowing any member of the audience, other than Staff, to participate in the worksession discussion, since their comments would not be a part of the official record. The Maryland-National Capital Park and Planning Commission makes application with the County Couneil, sitting as the District Council, for a portion of the Maryland-Washington Regional District within Montgomery County, for a Sectional Map Amendment to implement the Approved and Adopted Glenmont Sector Plan. Summary The Proposed Sectional Map Amendment follows the approval and adoption of the Glenmont Sector Plan and will implement, through the Sectional Map Amendment process, the Plan's zoning recommendations for creating a transit-oriented, mixed-use center. The proposed SMA was filed on December 20, 2013, and the District Council Public Hearing is scheduled for January 28, Background On November 5,2013, the District Council approved the Glenmont Sector Plan, by Resolution On December 18,2013, the Maryland-National Capital Park and Planning Commission adopted the approved plan, by Resolution On December 20, 2013, the Montgomery County Planning Board filed Sectional Map Amendment G-959 with the County Council, sitting as the District Council, to implement the zoning changes recommended by the Approved and Adopted Glenmont Sector Plan. The Glenmont Sector Plan area encompasses approximately 711 acres around the Glenmont Metro Station. This SMA proposes reclassification for about 68.5 acres and confirmation of existing zones for the remainder. The reclassified area includes 65.9 acres for the CR mixed-use zones and 2.51 acres for the CRN mixed-use zones. There are no pending zoning cases within the boundaries of the Sector Plan. Contents of the Sectional Map Amendment The SMA book includes an index map indicating the boundaries of the Glenmont Sector Plan. Each SMA book, which includes six zoning maps at 200-foot scale, also delineates the existing and requested zoning boundaries. The affected pages of the zoning maps are: 216NW02, 216NW03, 217NW02, and 217NW03.
5 Recommended Rezoning The Glenmont Sector Plan proposes the creation of a transit-oriented, pedestrian-friendly community by integrating mixed land uses into the area surrounding the Metro Station. The CR zone proposed for the Glenmont Shopping Center will permit a mixed-use town center with urban amenities such as a central open space, restaurants, and professional offices to achieve a dense urban node. The CR zones proposed for Glenmont Metrocenter and Metro Station/Layhill Triangle Block will permit residential development at densities higher than currently allowed with some retail and commercial uses in appropriate locations. The CRN zone proposed for the WMATA Triangle will permit the Department of Housing and Community Affairs to pursue the development of senior affordable housing in close proximity to the Metro entrance. The recommended CRN zone on the WMATA Triangle parcel will split it into two zoning classifications: the new CRN-1.5 C-O.25 R-1.5 H-65 and the existing RT The boundaries of the proposed CRN zone on this property were created to include approximately 2.31 acres of land currently under contract-topurchase by the County. Each CR and CRN zone includes four components: an overall maximum floor area ratio (FAR); a maximum commercial FAR (C); a maximum residential FAR (R); and a maximum building height (H). All four components are shown on the proposed zoning sheets for each zone proposed. The following table lists the SMA's proposed reclassifications. The index map accompanying this memorandum shows the location of each area. The SMA application covers approximately 711 acres, of which approximately 68.5 acres are proposed for change in zoning classification. The remaining acreage is to be reconfirmed as currently zoned. The District Council approved the Glenmont Sector Plan on November 5,2013. The Sector Plan sets forth the specific land use and zoning objectives for the development ofthe Glenmont Sector Plan area and was subject to extensive and detailed review by the District Council. The District Council held a public hearing on July 30, 2013 wherein testimony was received from interested parties. The County Executive transmitted to the County Council his fiscal impact analysis for the Glenmont Sector Plan on September 10,2013. Sectional Map Amendment (SMA) G-959 was filed on December 20, 2013 by the Montgomery County Planning Board to implement the specific zoning recommendations of the Glenmont Sector Plan. The Council held a public hearing on the SMA for the Glenmont Sector Plan on January 28,2014; no testimony was received, nor were any issues noted. The table listed in the Action section below shows the proposed rezonings by area. The evidence of record for Sectional Map Amendment G-959 consists of all record materials compiled in connection with the County Council public hearing on the Planning Board Draft of the Glenmont Sector Plan, dated July 30, 2013, and all record materials compiled in connection with the public hearing held by the Council on January 28,2014 on Sectional Map Amendment G-959. For these reasons, and because to grant this application will aid in the accomplishment of a coordinated, comprehensive, adjusted and systematic development of the Maryland-Washington Regional District, this application will be GRANTED. Action The County Council for Montgomery County, Maryland, sitting as the District Council for that portion of the Maryland-Washington Regional District in Montgomery County, Maryland approves the following resolution: 1. Application No. G-959, Maryland-National Capital Park and Planning Commission, Applicants for the Sectional Map Amendment covering the area of the Glenmont Sector Plan consisting of approximately 711 acres, more or less, is GRANTED. Approximately 68.5 acres are rezoned as a result of this action. The remaining acreage is to be reconfirmed as currently zoned. 2.
