7 Carriage Pointe Homeowners Association, Inc. LEASING REQUIREMENTS These leasing requirements have been prepared for the owners of units at Carriage Pointe Homeowners Association. Prospective tenants should be advised that these Conditions of Lease will strictly apply to all applicants for lease. No lease will become effective unless the tenant is approved by the Association. Conditions of Offer to Lease! Tenants must have a minimum credit score of 600! Unit Owner must have owned Unit for 24 months before leasing.! The Association s representative will perform a criminal background check on all tenants and proposed occupants. A felony or misdemeanor shall be a basis for rejection of an application for lease. (Minor traffic infractions will be allowed);! All applicant s must provide complete information on anyone who will occupy the residence, including but not limited to, previous rental history and a contact and telephone number for employment verification.! A past history of re-occurring late rent shall be basis for rejection of an applicant for lease; Having read the proceeding Leasing Requirements and Conditions of Offer to Lease, I hereby request that A&N Management, Inc. proceed with the credit check, employment verification, and a criminal background check. I understand that satisfying the requirements set forth above is a condition of being offered a lease. 8 AUTHORIZATION AGREEMENT FOR ASSOCIATION TO COLLECT RENT UPON DELINQUENCY IN MAINTENANCE PAYMENTS WHEREAS, (herein Owner ), is the record owner(s) of Unit located at,, Florida in Carriage Pointe, a homeowners association, recorded in the Public Records of Palm Beach County, Florida. WHEREAS, Carriage Pointe Homeowners Association, Inc. (herein Association ) is the entity charged with the operation and management of the Association; and WHEREAS, Owner desires to lease the Unit to (herein Lessee(s) ) pursuant to a lease submitted herewith; and WHEREAS, the parties desire the approval of the Association for this lease, pursuant to the Declaration for Carriage Pointe. NOW THEREFORE, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt of adequacy of which is expressly acknowledged, the parties hereto agree as follows: 1. Upon execution and delivery of this Authority Agreement, the Association shall provide the necessary approval for the lease. 2. If at any time during the pendency of the term of the lease, Owner becomes delinquent in payment of assessments to the Association, Owner and Lessee(s) agree that the Association shall have the power, right and authority to demand lease payments directly from the Lessee(s) and deduct such past due assessments, costs and attorneys fees, if any, as may be delinquent. Further, Owner and Lessee(s) agree that the Lessee(s) will pay the full rental payment due, to the Association, upon written demand. Owner expressly absolves Lessee(s) from any liability to Owner for unpaid rent under the Lease Agreement if such payment is made directly to the Association upon demand from the Association. If any funds are left over, the Association shall immediately remit the balance to Owner at the address listed in the Association s records. 3. Should Lessee(s) fail to comply with the demand of the Association within three (3) days of receipt of demand for payment hereunder, the Association is hereby granted the authority to obtain a termination of tenancy, in the name of Owner, through eviction proceedings, or to seek injunctive relief or specific performance under this Agreement. Owner and Lessee(s) further agree that, if such legal action becomes necessary, the Association shall be entitled to recover reasonable attorneys fees and costs, including appeals, from Owner. CARRIAGE POINTE SUMMARY OF RULES AND REGULATIONS The following information is intended to be a partial summary of our community guidelines and is provided for your convenience. It addresses several topics which affect every resident and is meant to serve as a quick reference only. All residents are required to follow any/all state and local statutes that pertain to these as well as any other topics. This information is not meant to replace the Carriage Pointe Homeowners Association, Inc. Documents and it is recommended that you reference them for more information, as necessary. Every resident s full cooperation will protect our wonderful community and through respect and common sense, it will assure the superior quality of life and quiet enjoyment to which all Carriage Pointe residents are entitled. 1. PETS A maximum of 2 domestic pets per unit is allowed. All pets must be walked on a leash and the person walking the pet must clean up after them. Pets cannot be tied out on the exterior of a home or in common areas. Pets are not permitted in the playground or pool areas. CATS ARE PROHIBITED FROM ROAMING FREELY AT ANY TIME. Nuisance pets shall be required to be removed from the community within 48 hours of proper notice to the owner. The back and side yard areas of our homes, as deeded to the unit owner, are private property. Please respect your fellow neighbors and walk pets in common areas only. 2. PARKING Each home has four (4) parking spaces, two in the garage and two in the driveway. Vehicles must be parked in the garage or driveway of a unit and must not be parked on or block ANY PART of the sidewalk. Vehicles must keep their wheels on paved surfaces only and must be kept off the grass and off the landscape beds. Not only does driving on or over and parking on or over unpaved surfaces kill vegetation, it damages irrigation components, as well. There are sprinklers located in the grass patches at roadside, between the road and walks, and great care must be taken to avoid driving or parking on these areas. Please share this information with all drivers in you household as well as with visitors and vendors in order to limit your liability. Parking in the driveway of any home, other then yours, without the EXPRESS written PERMISSION of the current home OWNER, is trespassing. Vehicles WILL be removed, WITHOUT FURTHER NOTICE, at the owner/operator s expense. initials 9

10 No commercial vehicles, recreational vehicles or trailers of any sort are allowed in Carriage Pointe unless they are kept inside your Garage at all times. There is to be NO PARKING ON THE STREET OVERNIGHT. The parking spots on the north and south side of the pool are for Visitors Only. If necessary, residents may park at the pool WHILE USING the pool but UNDER NO OTHER CIRCUMSTANCES should a resident s car be parked in that area. Please have your guests leave a note on the dash of their car that indicates that they are a GUEST OF UNIT #500, for example. A TOWING COMPANY is contracted to patrol the community making sure that vehicles are not parked on the grass, on the street overnight, in driveways other than that of the resident or in the visitor parking areas illegally. Failure to comply with parking guidelines will result in removal of the offending vehicle, without notice, at the owner s/operator s expense. 3. GARAGES - Garage Doors must be closed at all times except to accommodate vehicle or pedestrian access. Aside from being an eyesore, leaving them open day and/or night is an invitation to crime. No garage may be used as a living area or for COMMERCIAL USE OF ANY TYPE. 4. TRASH CONTROL Trash is picked up on Tuesday and Friday. A) TUESDAY IS TRASH ONLY. On Tuesday the city PICKS UP REFUSE WHICH IS IN THE CITY ISSUED GARBAGE CARTS ONLY. B) FRIDAY is Trash, Recycle, and Bulk Items. Corrugated cardboard boxes need to be flattened and cut to 2' x 2' sections and should be placed in, or next to, the yellow recycling container. Cardboard which is not prepared in this manner will not be picked up. If you have any questions as to whether or not items will be accepted for pickup you must call the City of Boynton Beach Public Works Department at C) Please do not place loose Styrofoam pop-corn or loose shredded paper in the garbage carts in order to prevent them from spilling when the carts are mechanically emptied. Trash should be put out NO EARLIER THAN 6PM THE EVENING BEFORE Pickup. (City of Boynton Beach Ordinance) ALL CONTAINERS MUST BE put inside the garage NO LATER THAN the. EVENING OF pickup. Containers which are left out are subject to removal. initials 5. LANDSCAPE- Personal items such as chairs, swings, statues, grills and toys etc. are not to be left on the grass areas. The lawn maintenance company schedule varies and they will not move your personal property while working in the community. 10

11 You may not add or remove any plantings or alter the landscape beds in any way. All problems such as damaged or malfunctioning sprinkler heads, dead or damaged plantings, insect mounds or weeds should be reported immediately to the property manager, A&N Management, at (561) Please be as specific as possible so the manager can have the condition addressed as quickly as possible. Residents can be held responsible for landscape and irrigation system damage caused by their misuse or neglect and/or that of their guests or invitees. 6. ENTRANCE & DRIVEWAY AREAS Since two units share the entrance areas, the Entrance MUST be kept clear and clean, except that residents may put live/healthy plants along their side of the entrance area. Garden Hoses and items which could cause someone to trip must be kept on caddies and/or in the garage. Personal items such as chairs, swings, toys, sporting equipment (e.g., basketball goals) etc. should not be left outside on the street, driveway or entryway when not in use. 7. SATELLITE DISHES The installation of a satellite dish REQUIRES the approval of the Architectural Control Committee (ACC) as well as that of the unit owner. THEY MUST BE INSTALLED IN A SPECIFIC MANNER IN THE REAR OF THE UNIT ONLY. Failure to obtain the necessary approval and/or the installation of a dish in any way other than as required can result in a fine as well as other liability. ACC applications are available through A&N Management as well as on the community web site. (forms link). 8. POOL/CABANA RULES - The hours of the pool are dawn to dusk. Residents and Guests must not play loud music and must behave in a proper manner. Children under 16 MUST be accompanied by an adult. BARBECUING, COOKING AND GLASS CONTAINERS ARE PROHIBITED AT THE POOL. Food and beverages must be kept at least four (4) feet form the pool at all times. NO PETS are allowed in the pool area. No pool parties over 15 persons are allowed and the pool area cannot be restricted for private use. All residents and guests are required to clean up after themselves. A key is required to access the rest rooms. ALL WHO ENTER THE POOL AREA MUST AGREE TO READ, UNDERSTAND AND ABIDE BY ALL POSTED RULES AND INFORMATION. Failure to do so WILL RESULT IN FINES, EJECTION AND LOSS OF USE OF ALL COMMON AREAS. 9. EXTERIOR CHANGES Are not allowed without the approval of the ACC. initials 10. RENTALS/RESALES Application must be made and approval must be obtained from the Association BEFORE a unit rental or resale may occur. Forms 11

12 are available from the Management Company and on the community web site. Units may NOT be sublet, in whole or in part, at anytime. 11. HURRICANE SHUTTERS Use of Hurricane Shutters is strongly recommended in the event that a Named Storm is announced. Shutters must be removed within 72 hours of the Passing of the storm. PERMANENT Hurricane Shutter installation (for example, Accordion shutters) must also be approved by the Architectural Control Committee. 12. GRILLING- Is allowed only in the rear area of a unit. Grills are not to be left on the lawn and should to be kept on patio when not in use. No grilling is permitted in garages, driveways or in the front of a unit. 13.
