2 Terms and Provisions: The owners and lessees of each patio home in the general plan of development shall abide by each and every term and provision of the Declaration of Covenants and Restrictions, the Articles of Incorporation, and By-Laws of the Sun Terrace at the Oaks Homeowners Association, Inc. ( STATO ), as well as those of The Oaks Property Owners Association, Inc. ( OPOA ). The definitions contained in the Declaration of Covenants and Restrictions for STATO are incorporated herein as part of these Rules and Regulations. Purpose of STATO and OPOA: The purpose of STATO and OPOA is to engage as a non-profit organization in protecting the value of the property of the Members of the Association, to exercise all the powers and privileges, and to perform all of the duties and obligations of the Associations as set forth in the Declarations which are recorded in the public records of Palm Beach County, Florida, including, without limitation, the establishment and enforcement of the payment of assessments and other charges contained therein, and to engage in such other lawful activities as may be to the mutual benefit of the Members and their property. 1. Revocation of Consent: Any consent or approval given under these Rules and Regulations by the Association may be revocable at any time by the Board. 2. Enforcement Action: Should the Association be forced to take action for violation of any provisions in the Declaration of Covenants or the adopted Rules and Regulations, the Board, at its sole discretion, may impose fines, after written notice and an opportunity for hearing has been given, for the offense, not to exceed $ per day up to a maximum of $1, for each offense or infraction committed. Initial Initial Vehicles are subject to tow at the owner s expense. Initial Initial a. Should the Association be required to seek enforcement of any provision of the Declaration of Covenants or the Rules and Regulations and prevail in such action, then the offending patio homeowner (himself or for his family, guests, invitees, or lessees) shall be liable to the Association for all costs incurred in the enforcement action, including reasonable attorney s fees, whether incurred in trial or appellate procedures or otherwise. 3. Animals and Pets: Initial Initial a. Notwithstanding anything to the contrary, no pets shall exceed a maturity weight of twenty five (25) pounds. Written authorization is required from a licensed professional, and must be in accordance with all Federal, State and County laws, if the pet exceeds the maturity weight of twenty five (25) pounds. All pets shall be registered with the Association and a pet registration form, along with a copy of vaccinations, county license and a picture, must be submitted to the Association for record within thirty (30) days of obtaining the pet. Registration of one s pet must include the animal s date of birth as well as the date that the owner obtained the pet. Owners are responsible for ensuring that all documentation is submitted if their tenant has a pet. b. The weight limit restriction set forth in 3(a) shall only apply to pets obtained by an owner or tenant after the date of adopting these Rules and Regulations. All current pet owners/tenants, including owners/tenants who already have pets exceeding the weight limit restriction, as of the date of adopting these Rules and Regulations, are required to register their pets within thirty (30) days of receipt of these Rules and Regulations, and any owner s/tenant s failure to register their pet shall result in fines and/or legal action to remove the pet from the development. If an owner/tenant currently has a pet that exceeds the weight limit restriction, then they are entitled to keep the pet at the development until the pet dies or is otherwise permanently removed, but it can be replaced only in accordance with the weight limit restriction set forth in 3(a). c. No animal(s) shall be raised, kept, or bred in any patio home for any commercial purposes. d. No dog or dogs evidencing a mean or violent temperament are permitted to be kept or maintained in a patio home. If a dog, or any other animal, becomes obnoxious to other patio residents by excessive barking or otherwise creates a nuisance, the owner, his / her family member, his/her guest, or his /her lessee, shall remedy the problem upon written notice from the Association, within 15 days from the date of the notice, or he /she will be required to remove the pet and/or legal action may be taken by the Association. e. All dogs and cats outside of patio enclosure must be on a leash and are prohibited from roaming freely and each pet owner is required to pick up after his/ her pet. 2

3 4. Common Areas : Initial Initial a. Broadcast devices: All antennas and aerials (including parabolic antennas) for Residential Property must be concealed inside attic space or locations approved by the Association and applicable FCC rules. The Association shall be notified of an owner s intent to install an antenna. The installation of satellite dishes as protected by federal law shall not be subject to approval by the architectural control committee. Dish installation locations: 1) On the inside of patio. 2) In Attic b. Damages: Any damage to the common elements, property, or equipment of the Association caused by any patio homeowner, his family member, guest, invitee or lessee shall be repaired or replaced at the expense of such patio homeowner by way of an approved vendor the Association has selected. c. Recreational Facilities: Conduct at the Recreation Center shall be governed in accordance with the Rules posted at the Pool. Violators can be ejected. Vandalism will be prosecuted to the full extent of the law. d. Signs: No political, sales and lease, or yard signs are permitted on common area, outside unit or in windows of any unit. e. Landscaping: Patio Owners, his / her family member, guest, invitee or lessee are prohibited from planting any flowers, shrubs or trees outside the patio enclosure. Pottery, decorative flags, banners, lattice trim, statues, bird feeders/baths and other garden items are also prohibited outside the patio enclosure. f. Lakes and Water Bodies: All lakes, ponds, and streams within the properties shall be aesthetic amenities only, and no other use thereof (including, without limitation, fishing, boating, swimming, playing, or use of personal flotation devices) shall be permitted. The Association shall not be responsible for any loss, damages, or injury to any person or property arising out of the authorized or unauthorized use of the lakes, ponds, or streams within the Association common areas. It is further prohibited to feed any of the wild animals (including ducks, squirrels, etc.) on Association property. Any feeding of wildlife is subject to fines and strictly prohibited. 5. Sales and Leases: Initial Initial a. The patio owner must inform the Association and Management, in writing, thirty days (30) in advance, of his/ her intention of selling or leasing their unit. A copy of the contract or lease must accompany the Association s application and all fees associated with the application must be paid for prior to the issuance of the certificate of approval. If an application was completed online and approved, then the information sheet and copy of valid vehicle registrations must be submitted to the Association s or Management s office. The voter s registration form and copy of warranty deed is required to be submitted within ten (10) days from the date of sale. b. All violations must be cured, all dues must be current and the patio owner must be a member in good standing, unless other arrangements have been made between the owner and the Association and submitted in writing accompanying the sales or lease package. c. No unit shall be leased more than once per year or for less than a four (4) month term. d. Moving In/Out - No boxed moving vans are allowed overnight. Moving storage units must not be left onsite more than two (2) days. All moving vans and moving storage units are prohibited from parking on the grass and must be parked in the assigned parking space for that unit. Garage/Estate/Moving sales are prohibited. 6. Vehicles/Parking Permits and Spaces: Initial Initial a. No advertising logos or for sale signs are permitted on any vehicle parked overnight in the community. Covers for vehicles must have a window for license plate and the vehicle cover form is required to be on record with the Association and Management s office. Vehicle license plates should be visible at all times while parked in the community. No commercial vehicles, motorcycles, or motor homes are permitted. Vehicle(s) will exhibit a wellpainted exterior free of offensive markings. An applicant must agree that vehicle in which a permit is sought will be well maintained, and will display no body rust or other deterioration. All vehicles must have a current registration, insurance and operable at all times. b. No owner, tenant, invitee, or guest shall do anything that shall be a nuisance or disturb, annoy or interfere with the rights, comfort or convenience of the other residents. 3

4 c. Each resident is permitted two (2) parking decals. The decal must be affixed to the lower left-hand side of the rear window or if the applicant cannot affix the permit, it may be affixed to a piece of clear plastic and placed on the dashboard where it will be clearly visible from outside the vehicle. d. Each resident will use only the parking spaces assigned to him/her, and will not park or position his vehicle so as to prevent access to another homeowner s parking space. Residents are prohibited from parking in a guest space without prior consent of the Board. Handicapped parking spaces are strictly for vehicles with a state issued permit. e. No resident shall do or permit any assembling or disassembling of motor vehicles except for ordinary maintenance, such as the changing of a battery or a tire. f. No equipment, objects, or materials are permitted to protrude from any vehicles or the bed of a truck. No gas pumps, chemicals, or other hazardous or harmful substances are allowed to remain in the bed of any truck. No item stored in the bed of a truck may exceed the height of the bed of the truck. g. Patio owners and lessees are responsible for keeping parking spaces clean and free of oil and other stains. h. The patio homeowners, their families, guests, invitees, and lessees will obey the posted parking and traffic regulations for the safety, convenience, and welfare of all residents. A guest pass can be acquired at the Association s office if your second space is occupied. A guest pass cannot be issued for more than ten (10) days without approval from at least two Board Members. i. Two-axle vans, jeeps, (including similar 4-wheel drive vehicles) and trucks (excluding campers), not in excess of 6,000 lbs. gross vehicle weight, used solely for family or personal transportation may be permitted within the general plan of development by the Board if appropriate documents have been provided for the Board s review. 7. Patios: Initial Initial a. Homeowners are responsible for maintaining patio surface, lights, screening, and plants. All patios must be maintained, clean and free of excessive debris, trash and mildew. b. Lattice: No latticework on the outside of the patio structure may be erected on any patio home. Lattice on the inside of the patio may not exceed forty-eight inches in height. The Lattice must be white and must be in good condition and shall be removed or replaced if deteriorating. 8. Shutters: All new installations of hurricane shutters must be compliant with city code, installed by a licensed professional and a permit acquired. The shutters must be white, in good condition and shall be removed or replaced if deteriorating. Decorative shutters and storage lockers must be white in color and all must be approved by the architectural control committee. 9. Screens: Privacy screens may not be hung on screening areas. 10. Lighting: Except for holiday decorative lights, which may be displayed between the Monday prior to Thanksgiving and January 10 th only, all exterior lighting must be approved by the architectural control committee. 11. Waste Management: Initial Initial a. No material other than household garbage shall be placed in the trash corrals. The responsibility for removing all materials (Wood, Tile, Sheetrock, Paint, Etc.) related to remodeling, repairs, or other work is that of the homeowner and the contractor involved (if any). It is the homeowner s responsibility to ensure that their contractor(s) are aware of and follow this rule. All boxes should be emptied and flattened. Any fines associated with the improper use of the trash corrals will be assessed to the owner of the responsible unit. j. Items that qualify for bulk pickup per SWA are acceptable in the corrals. The homeowner must call to notify SWA of the need for bulk pickup. Items are not to be placed in the corrals without making the proper notification. Doing so may result in fines to the homeowner. c. All garbage and refuse shall be in plastic bags and be securely tied before depositing in the garbage corrals intended for such purposes. d. No littering shall be done or permitted on Association property. e. No refuse shall be placed out before 6:00 p.m. the night before garbage pickup. Trash/garbage containers must be removed from trash pick-up areas no later than 9:00 a.m. on the day after the trash pick-up day. If the containers are not removed in the time specified above, the Association will have the container(s) removed and discarded. 4

5 f. No hazardous waste shall be put out for pickup or in recycle bins. (i.e. propane containers, paint cans, bulbs, batteries etc.). Homeowners must make arrangements for these to be delivered to Waste Management s hazardous material drop-off sites. g. All hazardous items must be dropped off at Solid Waste Authority located north of Donald Ross Rd on Military. (You may also check with the local hardware companies in the area.) By Resolution of the Board of Directors of Sun Terrace at the Oaks Homeowners Association, Inc. January 27, 2016 and adopted on February 4 th, 2016 I, hereby acknowledge that I have received and read the aforementioned rules and regulations totaling five (5) pages, for Sun Terrace at the Oaks, HOA, Inc.
