Opening The Special Magistrate called the hearing to order and led the Pledge of Allegiance. Proof of Publication - The agenda was posted on the city's website and at City Hall on February 22, 2017 Roll Call Magistrate Present: Audrie Harris Hoehn, Esq. Staff Present: Lonnie Smith, Code Enforcement Teresa Malmberg, Administrative Coordinator 2. Approval of Minutes The minutes of the April 25, 2016, hearing were approved as submitted. 3. Public Hearing Item Number: DCV /Case #CE Property Owner: Leonard A. Michie Property Address: Palmetto Way / Parcel ID Violation: Excessive Vegetative Growth (grass over 12" in height), Sec Public Nuisances (motor vehicle), Sec. 99.5(9) Following presentations of fact and testimony by witnesses, verification of property notices given, Special Magistrate Hoehn found the property owner in violation of Ordinance Sections 99-9 and 99-5(9) Excessive Vegetative Growth and Public Nuisance Property and will enter an order for Findings of Fact and Conclusions of Law to be recorded with the Marion County Clerk of Court allowing respondents until March 15, 2017, to come into compliance, and if not in compliance by this date a daily fine as long as the violation continues to exist with a final determination at a hearing set for April 4, Public Comment: The next hearing is scheduled for April 4, 2017 at 9:30 a.m. 5.
