4 PRESIDENT S PERSPECTIVE Resale Home Prices Cooled in October STEVE FRAIOLI 2018 PRESIDENT Despite the competition in the resale home market, San Diego County saw a slowdown from rising prices in October. Single-family median home prices last month leveled off at $645,000, slightly lower than September, while prices of condominiums and townhomes (attached properties) dipped by 2.7 percent ($418,000) in October. That s not to downplay the fact that median home prices have still increased by more than 6 percent over the past year. Sales of single-family homes increased more than 2 percent month over month, but are down by nearly 17 percent from a year ago. Attached properties saw a nearly 9 percent increase home sales in October compared to September, yet are 15 percent lower than October of last year. For the year to date, sales of previously owned homes are off by 9 percent compared to The temperature of home prices seems to be cooling, which may lead to a period of calm for the rest of the year. However, the strength of the economy and the strong job market remains great news for buyers and industries related to real estate. In October, the zip codes in San Diego County with the most single-family home sales were: (Ramona) with (Oceanside North), (Poway) and (Ranch Bernardo East), each with (Santee) and (College), both with (Spring Valley) with (Fallbrook) with 37 The most expensive single-family property sold in October in San Diego County is a 13,000-square-foot Rancho Santa Fe estate on more than five acres, built in 2003, with 7 bedrooms, 11 baths, and a sale price of $13.3 million. 6 SDAR HOLIDAY HOUSE Holiday House Join the Charity Celebration on Dec. 5 The annual Holiday House is in full swing. This is the local real estate community s effort to help the families of the men and women who serve our country, so please join SDAR s Ambassadors Foundation to celebrate the joyous season of giving on Wednesday, December 5 in Carmel Valley. 7 CIPS AWARD SDAR s Ginni Field Awarded CIPS Instructor of the Year Ginni Field, an SDAR board member and certified instructor for NAR designation courses, has been awarded the National Association of REALTORS 2018 CIPS Instructor of the Year. CIPS (Certified International Property Specialist) is a focused 5-day institute, administered by the NAR Global, that incorporates the vital elements of transnational transactions. Attendees study currency and exchange rate issues, cultural exchange factors, regional market conditions, investment performance, and tax and legal issues. The institute is usually held once a year at SDAR in Kearny Mesa. Learn more at Field also teaches business development and planning; goal setting and time management; and recruiting and business management for real estate companies. She serves on the Certified Real Estate Brokerage Council Board of Directors and Professional Development Committee. She has been a real estate and life coach and mentor since Next Deadline to Complete Code of Ethics is Dec. 31 REALTORS are required to complete ethics training of not less than 2 hours, 30 minutes of instructional time within two-year cycles. The training must meet specific learning objectives and criteria established by the National Association of REALTORS. The deadline for this cycle is December 31, Training may be completed through local REALTOR associations or through another method, such as home study, correspondence, classroom courses, or online courses. To complete your training online through the official site, visit NAR's Code of Ethics, adopted in 1913, was one of the first codifications of ethical duties adopted by any business group. 8 CELEBRATE OUR INDUSTRY ON JANUARY 12 Dec. 21 is the Deadline to Apply for the Recognition of Excellence SDAR continues to collect applications for San Diego real estate s most prestigious event, the Circle of Excellence, taking place January 12, Don t hesitate and be sure to get in before the deadline, but all members are invited to attend the event at the Hilton San Diego Bayfront to celebrate our industry. RECOGNITION OF EXCELLENCE Top-producing teams and individual REALTORS who exemplify excellence in the San Diego County real estate industry will be highlighted in the Recognition of Excellence. Teams and individuals will be recognized at the Platinum, Gold, and Silver levels of achievement based on numbers of units and/or sale prices. The sales production levels are specified on the Circle of Excellence website If a team or individual qualifies for one of the levels, they may fill out an application and attach a copy of their sales production report. The production dates for qualification are November 1, 2017, through October 31 of this year. 9 LAW & ETHICS You Could Be the Fall Guy for Your Seller s Lies by Danielle Braff When Kristen Martinez and her family bought a home in the Seattle area two years ago, she specifically asked about the electrical wiring. We had been told [by the seller] when we bought the house that there was no knob-and-tube wiring, Martinez says. This older form of electrical wiring is less resistant to damage and more prone to causing fires. The issue went undetected during an inspection because the electrical work appeared to have been masked, says Martinez, who wasn t at the inspection. But as soon as the Martinez family moved into their new home, they realized they had been deceived. We had come to realize that the seller who is a house flipper and electrician did a shoddy job hiding the bad wiring and illegally connected dangerous knob-and-tube wiring with [more modern] wiring, Martinez says. About $7,000 later, the Martinez family s electrician completely rewired their home, but they still come across safety issues. It has been a terrible experience. Sellers can be held legally liable under most state laws for not disclosing property defects and material facts, such as leaky basements or knowledge of lead paint. You, too, can suffer legal consequences if you don t disclose material defects found on the property that you become aware of in the course of serving your client. But if your seller is hiding problems he or she is aware of, and you re none the wiser about them, can the finger be pointed at you? Legally, you can t be held liable for property issues you don t have knowledge of in most jurisdictions. But your reputation as an agent having even unwittingly represented a seller who lied could inadvertently take a hit. Even if you re selling a property as is, which indicates the buyer must accept the home s condition, the buyer still has the right to know what the problems are. The buyer [must have the information available to] make an educated decision about whether or not to make an offer, says Kevin Deselms, a sales associate with RE/MAX Alliance in Golden, Colo. If you suspect your client is either unaware of property issues or being less than forthcoming about them, and you want to ensure more transparency in the transaction, you could disclose your observations of the property s condition to the buyer and encourage them to seek further professional advice, says Bryan Zuetel, a real estate attorney and brokerowner of Esquire Real Estate Inc., in Irvine, Calif. For instance, an agent might smell a moldy scent in the basement and see what looks like mold, but the agent is not qualified nor required to conclude that there is mold in the basement, Zuetel says. The agent could simply disclose a moldy scent or a moldy appearance in the basement, and advise all parties to engage the proper professionals for further evaluation. Whether a seller acknowledges the issue is not relevant to the agent s duty to disclose. Cassandra Corum, managing broker at Sotheby s International Realty in Beverly Hills, Calif., takes this approach, cautioning that we can t force a seller to tell the truth, and sometimes they may not know the truth. The home could have flooded prior to their ownership, so their experience has been that the property has never flooded. Corum makes sure to get the disclosure form, including her notes about her observations of the property, to the buyer before they schedule a home inspection. That way, the buyer can make a more informed decision about how they want to proceed earlier in the transaction. This is tricky, she says, because you can t say [a problem exists where it might not], but you would hope and assume that a comment about an odor, for example, would turn on a lightbulb and move the buyer to schedule a mold inspection. Though you have no duty to search for property defects yourself, it would be wise to pay attention to the home s condition as you and your client prepare it for market. If you notice a potential problem the seller has not told you about, ask your client questions to gauge their knowledge of the issue and willingness to fix it. 10 REAL ESTATE MARKETING Use Location Intelligence to Market Your Listings by Adrian Fisher It s not uncommon for real estate professionals to find new clients from word-of-mouth referrals and networking. But with the abundance of information now available online, property buyer and seller behaviors are shifting, and real estate agents need to find new ways to market and sell their services in order to stay relevant. One of the most recent advancements helping those in the real estate industry is location intelligence. This essentially means taking large sums of data about a place and transforming it into useful insights to understand and visualize the context around where a property is located. The global location intelligence market is anticipated to reach $25.25 billion by 2025, according to market research and consulting company Grand View Research, Inc. What s more, 66 percent of enterprises currently rank location intelligence as either critical or very important to their ongoing revenue growth strategies. Of course, the idea is nothing new in real estate. Buyers agents routinely perform this task for their clients, helping them purchase property in areas with good schools, convenient public services, or nearby other developments that may positively affect the value of the property in the future. But with big data tools and advancements in locationbased technologies, agents are able to visualize a property s surroundings and target their advertising efforts like never before, helping them save time, impress clients, and ultimately, grow their businesses. Here s a look at how location intelligence is entering the real estate industry and a few of its use cases for real estate marketing. Data Visualization Location intelligence tools can help real estate agents aggregate and visualize data for better insights into a property. For example, it s possible to layer a map of a neighborhood with demographic, socioeconomic, or even local crime data to assess the opportunities and risks involved with a specific property based on its location and historical patterns. By combining data from a variety of sources, this helps buyers see what it would really be like to live in a certain area. Real estate agents can also incorporate intelligent tools in their marketing plan for listings. The Walkscore widget showcases the ease of getting around a neighborhood, such as the distance from a property to a grocery store, park, school, or public transit system. Agents can also use REALTORS Property Resource to create reports and maps that incorporate school data, flood zones, tax information and other important points of consideration for potential buyers. Geofencing Geofencing allows businesses to advertise to potential clients within a specific geographic area by constructing virtual limits around a location. Typically, geofencing uses some combination of GPS, radio frequency identifiers, Bluetooth technology, and beacons. One listing, however great it may be, is not worth an agent s license, says Vincent Averaimo, an attorney with Milford Law in Milford, Conn. Rather than get involved in deceit, it is a more prudent business decision to walk away from the deal and advise your broker immediately. Fred Glick, e-pro, a sales associate with Arrivva Inc., in Aptos, Calif., says it s best to be painfully honest with sellers about the importance of a disclosure form at the start of the business relationship. I tell them that this form can be used in court to prosecute them, he says. It could be used to prove fraud, which could be criminal. I encourage the seller to do an inspection of the property before we list and allow buyers to get their own inspections. Most buyers will do their own inspections anyway, which likely will reveal whatever issues sellers may want to hide and possibly lead to a termination of the offer or a large negotiation on the home s price, says Nancy Wallace-Laabs, SFR, co-partner at KBN Homes in Frisco, Texas. Therefore, not being upfront about property issues quite literally eats away at the seller s bottom line. The headaches that ensue with a dishonest client are not worth the price of any commission you might make on the property, Wallace-Laabs says. 14 CONTINUED FROM 10 Geofencing allows real estate agents to create virtual boundaries around areas where they want to advertise their properties. For instance, a geofence could be set up nearby certain office areas or shopping centers where target demographics are likely to spend their time. The easiest way to do this is by using a mobile app. For instance, a brokerage might work with a developer to create an app so agents can select boundaries around a specific location. As customers enter that area, the app will trigger mobile alerts. Typically, customers will need to opt into location services on their devices for the geofence to work. Building a geofencing app from scratch can cost thousands of dollars; however, services such as Reach Local and Simpl.fi offer more affordable options. A mobile app that allows customers to opt in to receive notifications is recommended, as some operating systems, such as Google s Android, have recently disabled automatic nearby notifications, typically pushed by marketers to users without making them download an app. Hyperlocal Ad Targeting Location technology can also help your ad budget go further.
