4 PRESIDENT S PERSPECTIVE Single-Family Median Home Price Hits $650,000 in May - A Record Level STEVE FRAIOLI 2018 PRESIDENT Single-family home prices in San Diego County hit a record high in May, reaching $650,000. Attached properties (condominiums and townhomes) settled at a median price of $421,000 last month, just under their record price set in April. Overall, home prices have seen a year-over-year increase of 6.5 percent for all resale properties. Single-family home sales in May increased by 5 percent over April, while sales of condos and townhomes rose by just over 2 percent. For the year to date 2018, however, sales of existing homes are down nearly 8 percent over last year. San Diego homes continue to be scooped up soon after they go on the market. In May, single-family homes were closing escrow in an average of only 26 days, while attached properties were closing in only 21 days. Prospective home buyers should expect a competitive housing market throughout the summer. Fortunately, the low inventory of homes for sale doesn t seem to be dampening their demand. In May, the zip codes in San Diego County with the most single-family home sales were: (Oceanside North) with (Carmel Valley) with (Escondido North) with (Fallbrook) with (Rancho Bernardo East) with 49 The most expensive single-family property sold in San Diego County in May was a half-acre oceanfront home in the Beach Colony neighborhood of Del Mar, built in 1982, with more than 4,600 square feet, 4 bedrooms, 5 baths, a guest cottage, and a sale price of $16.5 million. The REALTORS Political Action Committee (RPAC) a national bipartisan grassroots-based political advocacy organization that supports homeowners and the real estate industry released its 2017 RPAC Hall of Fame inductees list in May during the 2018 REALTORS Legislative Meetings & Trade Expo in Washington, D.C. The Hall of Fame recognizes dedicated REALTORS whose RPAC investments total an aggregate of at least $25,000. Members are recognized with a lapel pin, an inscription of their name on a plaque on the NAR Washington, D.C., building rooftop and a plaque commemorating their support. RPAC is a voluntary political action committee whose membership consists of Realtors and affiliates interested in actively and effectively protecting the real estate industry and the dream of homeownership by participating in government affairs at the local, state and federal levels. RPAC doesn't back political parties and isn't involved in presidential politics; instead, it backs congressional candidates who have strong records supporting homeownership and private property rights. 6 CIPS DESIGNATION Become an International Property Specialist Earn the Designation (The five-day Certified International Property Specialist institute is coming to SDAR s Kearny Mesa Service Center in mid-july. Details at the end of the article.) International real estate opportunities are everywhere. New people move to the U.S. from other countries every day and foreign-born individuals residing in the U.S. move to new markets. Americans in your current market invest in property overseas. 7 REBUILDING TOGETHER Rehab Project Benefits Deserving Southcrest Neighbor The home of a grandmother who cares for five grandchildren, four days a week, received the Rebuilding Together treatment on June 1, thanks nearly 40 volunteers including SDAR REALTORS, the Housing Opportunities Committee, and the Ambassadors Foundation. Stella and Sergio Hernandez s Southcrest home on Beta Street was spruced up with a full paint job and landscaping that created a pride of ownership for this deserving family, and a fresh look for the neighborhood. On hand to thank the volunteers was Greg Cox, San Diego County Supervisor. SDAR is proud to have been a founding member of the Rebuilding Together s San Diego chapter since 1995 in support of its mission financially and with volunteers to revitalizing San Diego and supporting affordable housing. Thank you to everyone who stepped forward to revitalize our community and continue to prove that San Diego is America s Finest City. Rebuilding Together San Diego provides critical repairs and renovations for low-income homeowners across San Diego County. Participants apply through the organization s website, and a project selection committee determines which sites will be selected based upon a number of factors, including need of the homeowner and the number of available sponsors. 8 RISK MANAGEMENT Digital Editing Providing a True Picture in Advertising By Jeremy Sine Digital editing of pictures has been around for years. Many of us use professional photographers, and we all know their pictures look beautiful. Excellent lighting, compelling composition and professional post-processing techniques make photographers professionals in their own right. I think it s safe to say most people accept these types of basic digital enhancements. The public at large knows their hamburger is not going to look exactly like it does in the commercial. Turning an overcast sky into a sunny day. Wide angle lenses. Changing image saturation, brightness, contrast or color balance. It s like a filter on your Instagram account. Our pictures are a marketing tool, and high-quality, attractive photographs generate interest and create a competitive advantage for our clients. With the practice of digital enhancement becoming common practice, as REALTORS we must be conscientious of our Code of Ethics. Article 12 states REALTORS shall be honest and truthful in their real estate communications and shall present a true picture in their advertising, marketing, and other representations. When talking about truth in advertising the term that keeps coming up is material misrepresentation; as in you don t want to materially misrepresent your new listing. A common example of material misrepresentation would be removing power lines from a picture. Removing permanent objects like power lines, telephone poles, neighboring homes etc. are commonly considered materially misrepresenting the property because they hide undesirable permanent property features. Go ahead and turn that overcast sky into a sunny day. That's not materially misrepresented the property because you are not altering a permanent object. This is San Diego and there are plenty of sunny days. But what about removing temporary objects like trash cans? Or a car in the driveway? As long as you are not altering a permanent fixture, you should be ok. You could always just move the trash cans or car and get the same picture. As technology has improved, so too have our options for editing pictures. Nowadays we can bypass the professional photographers altogether. With just the camera on your phone, websites like BoxBrownie.com and Fiver will let you upload pictures to have them professionally edited and even staged. Websites like VisualStager.com let you digitally stage your own pictures. With so many options and websites to choose from it s more important than ever for REALTORS to pay attention to the photos they have edited. Take a look at the picture below. 1 At first glance it seems like a nicely staged room. Did you notice the new light fixtures? You can move furniture around, but you can t move a light fixture around. Light fixtures can be a material aspect of a house and to show a fixture of any kind where none actually exist can be a material misrepresentation. Unless you are paying attention something like this can be easily overlooked. Landscaping is another tricky area. If the grass is dead are you following the Code of Ethics and presenting a true picture when the edited picture shows green grass? Probably not. In fact, there is a C.A.R. case interpretation 2 wherein a REALTOR was found in violation due to his use of the phrase charmingly landscaped site when it was actually densely overgrown in weeds. What do you think about this picture? 3 This edited picture took away piles of empty pots and replaced them with nice patio furniture and plenty of new trees and plants. It certainly looks better but is this accurately representing the property? We start to enter a grey area when CONTINUED ON 9 8 THE SAN DIEGO REALTOR JUNE 2018

9 CONTINUED FROM 8 more and more changes are made. On one hand the patio could look like this if you staged it with real furniture and plants. On the other hand, you are covering up undesirable items. I don t think it s a big deal when we are talking about pots, but what about kitchen cabinets. If you digitally edit undesirable kitchen cabinets with something that looks new and move-in ready, you are certainly not adhering to truth in advertising. Not only would you be in violations of the Code of Ethics, but you probably have some upset buyers after they realize the nice-looking kitchen in the pictures doesn't exist. Our property pictures are intended for marketing purposes and as in all marketing we want to present the property in the very best way possible. Image enhancements that do not materially change permanent physical characteristics of the house or surrounding environment are typically considered acceptable. Permanent physical features should not be edited or modified. This goes for fixtures inside the house like ceiling lights, as well as for items outside the house like landscaping and other materials aspects of a property like power lines, antenna, and neighboring homes and buildings. REALTORS should take care when working with third parties to edit and stage their pictures. Always double-check to make certain your pictures and marketing always fairly represent the property and provides a true picture in your advertising. 10 AFFILIATE SPOTLIGHT EMPOWER VETERANS, PROTECT THE ENVIRONMENT, SERVE THE COMMUNITY I had a phone call the other day with a media organization that is going to help us showcase the work that JDog Junk Removal has done here in San Diego. The press release rep made a comment that the call should only take minutes. After an hour of conversing and going back and forth with the accomplishments we have been able to achieve, she commented about our length of time here in San Diego. The public relations officer asked how long we have been in operation for, and then quickly answered her own question with, At least two years, right? Then, we protect the environment by sorting through plastic, recyclable materials, and lastly trash. SERVING THE COMMUNITY JDog serves the community by bringing paper goods, writing and coloring utensils, and other items that might be used in a classroom to schools that serve children in need. We want to provide not only a valuable education to the future of our nation but provide them with the tools they need to grow. We serve the community by providing countless wearable goods, such as clothing for interviews or the daily work force, to the service member that is starting a new life as a civilian or to a homeless organization that provides transportation to their loved ones across the nation; everyone needs clothes that they can feel proud of. We serve the community by recognizing that the household goods that we remove can be placed into a newly transitioned soldier s home, or the home of a rehabilitated homeless person. We ve all moved and have had stuff break, followed by an unexpected bill. JDog helps to alleviate that worry with the goods that you have allowed us to remove from homes. 12 TECHNOLOGY TOOLS 5 Technologies That are Revolutionizing Real Estate By Dominic Kawaja Selling real estate has always been a person-to-person type of business. The most successful agents are those who can bond with anybody on a moment's notice. While there will always be a place for friendly faces in the real estate industry, new real estate technology is rapidly overturning the established way of doing business. In the short run, this is undoubtedly making life a lot easier for agents everywhere. Those who strongly embrace the maturing technological tools are certainly reaping the benefits of being ahead of the pack. In general, there are five basic categories of new technology that most agents should be conversant with. More Bandwidth = More Video Both traditional video tours and the more recent innovation of drone footage benefit from yet another improvement in the real estate technology landscape. If not for a revolution in the speed at which data can be delivered over the Internet, neither one of these technologies would be available to the mass market. This has made it possible for people in every region of the country to view video footage in real time. Even this would not be enough if a complimentary revolution in data management had not taken place at the same time. File storage has become virtually free and accessible to anyone anywhere. Without affordable data storage to hold those massive video files, all the bandwidth in the world would still be of no use to the customer. DRONE VIDEO Building upon this new emphasis on video, drone footage is increasingly in vogue. Adding drone views to your listing produces two very useful psychological reactions among those who view it. First off, it makes the property seem much larger than it appears in any other form of presentation. Secondly, since most people do not understand how simple and affordable drone footage can be, it makes it seem like this is a very special listing, worth extra expenditures on the part of the listing agent. Properties that have been droned almost certainly create a more favorable first impression than those which are presented only through more prosaic means. One distinct caveat about drone video is that one can go a little too far with it. You don't want to use so much that it becomes tiresome or disconcerting, but you also don't want to use such a brief snippet that the viewers are unable to orient themselves in relation to what they are seeing. For many drone videographers, it is something they love to do. This means they can sometimes get carried away by putting too much of their hobby into the business of selling real estate. Keep this revolutionary new presentation tool firmly under control. Otherwise, it might turn off prospective customers. MOBILE APPS The real estate professional of today has also witnessed the maturation of Zillow and other nationwide selling platforms. For the first time, local sellers have an effective way to access interested buyers everywhere. Never before has there been such an advantageous way of expanding the pool of interested parties. With this ever-growing segment of buyers available at virtually no cost, and through practically no effort of their own, many agents have elected to concentrate their energies on garnering the maximum possible number of new listings. Many offices have always preferred this as a strategy, but the impetus of innovation is pushing this phenomenon ever harder. This represents a large change from the time when the hard copy MLS book was a jealously guarded trade secret. That hoary old collection of relevant data was not shared with any actual customers except under very limited circumstances. In today's marketplace, the current troves of 12 THE SAN DIEGO REALTOR JUNE 2018

13 data are found online everywhere. Buyers are, in effect, now capable of selling themselves. Ergo, there is a decreasing need to put a lot of effort into closing the deal on the buyer's side of the transaction. 3D VIRTUAL TOURS One of the biggest and most popular real estate innovations is the increasing use of virtual 3D tours of properties being offered for sale. While pictures and video have been around for a long time, huge changes in both the quality and cost of superior video technology places Hollywood-level image quality at the disposal of practically anyone willing to take the time to buy a camera and learn how to use it. When this superlative new picture quality is mated with extremely affordable and easy-to-use editing systems, the 3D tour of a property becomes a lot more than just a dry list of the property's features. It permits an artistic-minded agent to make a real statement that serves as a great substitute for actually showing a listing in person. After all, that is what a 3D tour is all about. It eliminates the expensive practice of showing listings to countless parties, many of whom are not actually interested or qualified. E-SIGNING A word also needs to be added about the adoption of virtual contracts and signatures. Quite obviously, these tools have vastly decreased the amount of grit floating inside the wheels of progress. Contracts can be drafted and submitted at any time of the day or night. They can be signed easily. No more of that old Notary Public rigmarole. In truth, it is now possible to undertake a real estate transaction without either meeting in person or conversing by phone until the actual date of closing. Can the day be far off when even this last pro forma type of personal appearance becomes an amusing artifact of the past? THE PROMISE & PERIL In short, new real estate technology has cut out a lot of the delay and drudgery that was once an inherent part of the real estate business. New tools and legal procedures have greatly streamlined the process. New methods of disseminating information have vastly increased the potential pool of buyers. They have been transformed into what is an almost self-generating part of the transaction. Still, this does not mean that all is rosy in the field of real estate. Realtors may celebrate the wide array of new tools in their hands. They may rejoice at the amazing technology that is making it easier to list, easier to show, and easier to close on a property than has even been possible before. However, a cautionary analogy may be found in the fate of local stock brokers. The rise of gigantic online trading firms practically extinguished them as a species. Technology eventually diffused down into the hands of the end users. This made it possible to dispense with the services of a oncenecessary professional advisory class. Many technological innovations have made various types of professional careers easier to do than ever before. This often proves to be no more than just a passing phase. Once these innovations became accessible to the general population at a ridiculously low price, the previous class of professionals loses their ways of making a living. In truth, technology is only a short-term friend of the well-compensated professional intermediary. Eventually, it becomes his replacement. Great leaps forward, such as Zillow and the e-signing of contracts, certainly make life easier for the modern real estate agent. However, the ultimate outcome of these new technological shortcuts may not be to serve as a tool of a well-equipped firm of today. Tomorrow, it might become its successor. 20 WIRE FRAUD Wire Fraud Scams and the Liability of the REALTOR By Dave Tuckman According to FBI data, nearly $1 billion was diverted or attempted to be diverted from real estate purchase transactions, and wired to criminally controlled accounts in fiscal year That figure is up exponentially from 2016, when the FBI counted $19 million in wire transfer frauds affecting home buyers. As staggering as these numbers are, they don t count how devastating this fraud can be to the home buyers involved. The problem is serious and is happening within our local communities. Here are some recent news articles covering the topic: Hackers dupe San Diego family out of $66,000 towards the down payment on their first home : Targeting-Homebuyers-in- -Scam html FBI Warns of Scam Targeting San Diego Businesses, Residents : WHAT IS THE RISK? When a real estate transaction occurs, multiple parties are involved, each with their own degree of risk and responsibility. The transaction includes financial institutions, title companies, insurance providers and many other 3rd parties; but it s the REALTOR that sits in the center of the transaction, making CONTINUED ON THE SAN DIEGO REALTOR JUNE 2018

21 CONTINUED FROM 20 their risk (and liability) fundamentally larger than many of the parties involved. REALTOR S must be aware of these risks, and act responsibility on behalf of their clients best interests. REALTORS must be knowledgeable on how to navigate through the transaction process in a safe and secure manner. Without that knowledge, the risk of wire fraud activities will increase, along with their liability. The information below is designed to give you an overview understanding of how the scam works, and how you can reduce everyone s risk. HOW IT WORKS Imagine everything in your real estate transaction is going smoothly and you are ready to send your money to escrow. Just a few steps in the transactions and you will have your dream house. Even the day before closing you get an from your real estate agent. They send you wiring instructions and request that you send in $200,000 from your bank account to the bank and include the routing number. The might have appeared legitimate but it was all part of a sophisticated hacking scam that targets REALTORS. Hackers will find REALTORS s online. They will then target them with s that contain harmful links. If the REALTORS opens the link accidentally, it will install malware on their computer which gives the hackers full access to their computer. The hackers will then monitor the agent s s and look for homes that are about to close. Right before the home closes, the hacker sends an (from the REALTORS ) to the buyer instructing them to send a wire transfer to a fraudulent account. WHAT REALTORS NEED TO KNOW The National Association of REALTORS (NAR) recommends the following: Immediately contact all parties to all of your upcoming transactions and inform them of the possibility of this fraud. Attorneys, escrow agents, buyers, sellers, real estate agents, and title agents have all been targeted in these scams. You can also download and distribute NAR s online fraud prevention handout, accessible here. If possible, do not send sensitive information via . If you must use to send sensitive information, use encrypted . Immediately prior to wiring any money, the person sending the money must call the intended recipient to verify the wiring instructions. Only use a verified telephone number to make this call. Do not trust contact information in unverified s. The hackers will recreate legitimate-looking signature blocks with their own telephone number. In addition, fraudsters will include links to fake websites to further convince victims of their legitimacy. Never click on any links in an unverified . In addition to leading you to fake websites, these links can contain viruses and other malicious spyware that can make your computer and your transactions vulnerable to attack. Never conduct business over unsecured WiFi. Trust your instincts. Tell clients that if an or a telephone call ever seems suspicious or off, that they should refrain from taking any action until the communication has been independently verified as legitimate. Clean out your account on a regular basis. Your s may establish patterns in your business practice over time that hackers can use against you. In addition, a longstanding backlog of s may contain sensitive information from months or years past. You can always save important s in a secure location on your internal system or hard drive. Change your usernames and passwords on a regular basis, and make sure your employees and licensees do the same. Never use usernames or passwords that are easy to guess. Never, ever use the password password. Make sure to implement the most up-to-date firewall and anti-virus technologies in your business.
