1 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION APPROVING CONSOLIDATED BILLS LIST R E S O L U T I O N BE IT RESOLVED by the Township Committee of the Township of Freehold that the vouchers listed on the Consolidated Bill List, in the amount of $2,565, dated May 8, 2007, as presented by the Township Treasurer/Chief Financial Officer, be paid from existing appropriations. 1

3 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION AUTHORIZING PERSON TO PERSON TRANSFER OF LIQUOR LICENSE NO (FREEHOLD HOTEL ASSOCIATES, L.L.C. TO GIBSON PLACE HOTEL, L.L.C.) R E S O L U T I O N WHEREAS, an application has been filed for a Person-to-Person Transfer of Plenary Retail Consumption License Number , heretofore issued to Freehold Hotel Associates, L.L.C., for premises located at Route 537 and Gibson Place, Freehold Township, New Jersey; and WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term; and WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, the regulations promulgated thereunder as well as the pertinent local Ordinances and conditions consistent with Title 33; and WHEREAS, the applicant has disclosed and the issuing authority has reviewed the source of all funds used in the purchase of the license and the licensed business and all additional financing obtained in connection with the licensed business. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold does hereby approve, effective May 22, 2007, the transfer of the aforesaid Plenary Retail Consumption License to Gibson Place Hotel, L.L.C., and does hereby direct the Township Clerk/A.B.C. Board Secretary to endorse the license certificate to the new ownership as follows: This license, subject to all its terms and conditions is hereby transferred to Gibson Place Hotel, L.L.C., effective May 22, BE IT FURTHER RESOLVED that a copy of this Resolution certified by the Township Clerk, to be a true copy be forwarded to each of the following: 1

6 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR ON- SITE CATERING SERVICES FOR PARKS AND RECREATION R E S O L U T I O N WHEREAS, bids were accepted by the Township Purchasing Agent for On-Site Catering Services for Parks and Recreation on Wednesday, April 11, 2007 at 11:00AM; and, WHEREAS, the following vendors submitted bids: Szechuan Star Restaurant The Cutting Board Restaurant & Caterers 3338 Route Route 9 South Barclay Square #4 Manalapan, NJ Freehold, NJ WHEREAS, the Superintendent of Parks and Recreation, by memorandum dated May 2, 2007 recommends that Contracts be awarded to the following firms in accordance with the attached bid tabulations: Section(s) Estimated Awarded Cost (2007) Szechuan Star Restaurant 3338 Route 9 C $2, Barclay Square #4 Freehold, NJ The Cutting Board Restaurant & Caterers 349 Route 9 South A, B, D, E, G $49, Manalapan, NJ The following items did not receive bids and will be considered for rebid at a future date: F and H 1

7 WHEREAS, the Director of Finance has certified to the Township Clerk that funds are available in the following budget accounts, contingent upon the necessary funds being appropriated by the Governing Body in the 2007 Municipal Budgets, inclusive of temporary budget amounts appropriated: R RS RS RS7772L RS8772L RS RS R R RS7772L RS8772L-4218 NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold hereby that contracts for On-Site Catering be awarded to the aforementioned bidders for the corresponding items, in the estimated amounts noted on the attached bid tabulations; and, BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded to, the Assistant Township Administrator, the Director of Finance, Superintendent of Parks and Recreation, and the successful bidders. 2

9 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR A DIESEL POWERED WOOD CHIPPER R E S O L U T I O N WHEREAS, bids were advertised and received by the Township Purchasing Agent for diesel powered wood chipper on April 17, 2007 at 11:00AM; and WHEREAS, the following bids were received: Harter Equipment 615 Highway 33 $37, Englishtown, NJ Seely Equipment and Supply 1325 Highway 34 $40, Farmingdale, NJ Vermeer North Atlantic 7 Maple Ave. $48, Lumberton, NJ WHEREAS, the wood chipper proposed by the low bidder, Harter Equipment, has significant exceptions to the unit outlined in the bid specifications, which do not meet the Township's minimum requirements; and WHEREAS, the Director of Public Works, by memorandum dated May 1, 2007, recommends award of a contract to the second low bidder, Seely Equipment and Supply, whose bid sumbission meets or exceed the Township's minimum requirements, in the amount of $40,407.00; and WHEREAS, the Director of Finance has certified to the Township Clerk that funds are available in the following account:

10 CG0621B-8125 NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that a contract for a diesel powered wood chipper be awarded to Seely Equipment and Supply in accordance with the bid specifications; and BE IT FURTHER RESOLVED that certified copies of the within resolution be forwarded to the Township Administrator, Assistant Township Administrator, Director of Finance, Director of Public Works, and Seely Equipment and Supply.

12 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION AUTHORIZING THE SALE OF BLOCK 19, LOT 87.02, 158 ROBERTSVILLE ROAD R E S O L U T I O N WHEREAS, bids were accepted by the Township Purchasing Agent for the sale of Block 19, Lot 87.02, 158 Robertsville Road on Wednesday, April 25, 2007 at 11:00AM; and, WHEREAS, the property was advertised for public sale pursuant to all requirements and procedures set forth in the Local Lands and Buildings Law (NJSA 4A:12-1 et seq.) on April 4, 2007; and, WHEREAS, the following bids were received: Glenn and Jill Guy $526, Pierce Capell $525, NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold hereby authorizes the sale of Block 19, Lot 87.02, 158 Robertsville Road, to Glenn and Jill Guy, 12 Harding Road, Freehold, New Jersey, in the amount of $526,000.00; BE IT FURTHER RESOLVED that the Township Clerk and all other appropriate municipal officials are hereby authorized to execute such papers and to perform such acts as necessary to effectuate the purpose of the Resolution; BE IT FURTHER RESOLVED that a copy of this Resolution, certified to be a true copy by the Township Clerk, be forwarded to the Assistant Township Administrator, the Chief Financial Officer, the Township Attorney, the Township Tax Collector, Township Tax Assessor and Glenn and Jill Guy.

14 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION AWARDING A CONTRACT FOR WESTERN MONMOUTH PURCHASING GROUP FOR FURNISHING AND DELIVERY OF GASOLINE AND DIESEL FUEL R E S O L U T I O N WHEREAS, the Borough Administrator of the Borough of Freehold accepted bids as Lead Agency Representative of the Western Monmouth Purchasing Group for the Furnishing and Delivery of Gasoline and Diesel Fuel on Thursday, April 26, 2007 at 11:00 AM: and, WHEREAS, bids were received from the following vendors: Vendor Total Fuel Year 1 Total Fuel Year 2 Allied Oil, LLC $664, $664, Old Champlain Road Hillsborough, NJ John Duffy Fuel Co. $642, $642, Mulberry Street P.O. Box 5610, Newark, NJ Riggins, Inc. $644, $645, P.O. Box 150 Millville, NJ Majestic Oil Co. Inc. $656, $656, Fairfax Avenue Cherry Hill NJ

15 WHEREAS, the Director of Public Works, in a memorandum dated May 3, 2007, recommends that a contract for the WMPG Furnishing and Delivery of Gasoline and Diesel Fuel be awarded to John Duffy Fuel Co.; and, WHEREAS, the Director of Finance has certified to the Township Clerk that funds are available for this Contract in the following budget accounts: NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Freehold hereby awards a two year contract for the Western Monmouth Purchasing Group Furnishing and Delivery of Gasoline and Diesel Fuel in the estimated amount of $642, for contract year one and $645, contract year two for an estimated two-year total of $1,285,700.00; and, BE IT FURTHER RESOLVED that a certified copy of the within Resolution be forwarded to the Assistant Township Administrator, the Director of Finance, the Director of Public Works, the Director of Finance, Freehold Borough, and all bidders.

17 Resolution of the Township of Freehold Monmouth County, New Jersey No: R Date of Adoption: May 8, 2007 TITLE: RESOLUTION AUTHORIZING DEFENSE OF LITIGATION NEW JERSEY HOUSING AND MORTGAGE FINANCE AGENCY VS. TOWNSHIP OF FREEHOLD, ET AL R E S O L U T I O N WHEREAS, New Jersey Housing and Mortgage Finance Agency instituted suit against the Township of Freehold in the Superior Court of New Jersey, Monmouth County, Chancery Division, bearing Docket No. F ; and WHEREAS, the Township Committee is of the opinion that there are meritorious defenses to the litigation. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that the Township Attorney is hereby authorized to defend the Township in this litigation and to take such action as he deems reasonable in the defense of the litigation. BE IT FURTHER RESOLVED that a copy of this Resolution certified by the Township Clerk to be a true copy be forwarded to the Township Attorney. 1

BE IT FURTHER RESOLVED that a copy of this Resolution certified by the Township Clerk to be a true copy be forwarded to Nancy Arnavas, Affordable Housing Alliance and to the Township Attorney. 1

(LONGHORN STEAKHOUSE) SITE PLAN NO. SP R E S O L U T I O N WHEREAS, on February 15, 2007 the Freehold Township Planning Board granted final site plan approval to Rare Hospitality International, Inc. (Longhorn Steakhouse), Site Plan No , Block 70, Lot located on Monmouth County Route 537; and WHEREAS, in accordance with its Planning Board approval, the Developer is required to enter into a Developer s Agreement with the Township of Freehold; and WHEREAS, the Township Attorney has prepared a Developer s Agreement for this site plan. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Committee of the Township of Freehold that the Mayor is hereby authorized to execute and the Township Clerk to attest the Developer s Agreement between the Township of Freehold and the Developer in accordance with the approval granted by the Freehold Township Planning Board.
