Howell, NJ Mailing Address: PO Box 580 Howell, NJ Dear Investor: Enclosed please find the Tax Sale Bidder Packet for our upcoming lien sale in Howell Township to be held on October 18, Please complete and return the Bidder questionnaire, Bidder Information Sheet and W-9 forms (available from the IRS please use Dec 2014 version) as soon as possible, so that we may pre-register you for our Lien Sale. This will assist in the registration process on Lien Sale day. You will still be responsible for signing in by 9:30 am! Our Lien sale is scheduled to begin at 10:00am in the Main Meeting room in the Howell Township Administration Building 2nd floor, straight ahead off the elevators. All participants and non-participating visitors must be signed in by 9:30am in order to obtain access to the conference room. During the sale, if a lien holder announces that they have a prior lien on a property; it does not preclude anyone from bidding against them. This is a public auction and everyone registered is welcome to bid. The prior lien holder does however, have the option of paying the open balance as a subsequent payment prior to the start of bidding or requesting redemption of the new lien after the sale. 2 Elements of Tax Sales in New Jersey New Jersey law requires all 566 municipalities to hold at least one tax sale per year, if the municipality has delinquent property taxes and/or municipal charges. You can obtain information on upcoming tax sales by contacting the tax collector in the municipality in question, or from the web site of the Tax Collectors & Treasurers Association of New Jersey: More detailed information on the tax sale process in New Jersey can be found at In New Jersey, property taxes are a continuous lien on the real estate. Property taxes are due in four installments during the year: February 1, May 1, August 1, and November 1. Delinquency on a property may accrue interest at up to 8 per cent for the first $1,500 due, and 18 per cent for any amount over $1,500. If the amount of delinquency on a property exceeds $10,000 at the end of the municipal fiscal year, the municipality may charge up to a 6 per cent yearend penalty. At the tax sale, title to the delinquent property itself is not sold. What is sold is a tax sale certificate, a lien on the property. Tax sale certificates can earn interest of up to 18 per cent, depending on the winning percentage bid at the auction. At the auction, bidders bid down the interest rate that will be paid by the owner for continuing interest on the certificate amount. If the interest is bid down to one per cent, then a premium, is bid starting at $0 to whenever the bidding stops to obtain the tax sale certificate. The premium is kept on deposit with the municipality for up to five years. If the tax sale certificate is not redeemed, or the property foreclosed upon within the five year period, then the premium escheats to the municipality. No interest accrues on the premium to the benefit of the buyer of the tax sale certificate. The winning bidder is the one who bids the lowest percentage of interest or bids the highest premium. Bidders are urged to contact the Tax Collector for local payment restrictions before the sale) At the close of the sale, the winning bidder must immediately pay (pursuant to the local restrictions) the municipality the taxes and interest to date; in exchange the municipality will provide the bidder the tax sale certificate. In order for the winning lien holder to protect their interest in the tax sale certificate, it should be recorded in the Deed Room at the County Clerk s Office within 90 days of the sale. Taxes continue to accrue on the property after the sale of the certificate. Bidders have the option to pay these subsequent taxes; if they are not paid, a tax sale certificate will be sold at the next tax sale. Any subsequent certificate issued will be paramount to any prior certificate. Subsequent taxes paid by the lien holder earn interest at the rate set by the municipality. If the certificate is redeemed by the property owner prior to foreclosure, the certificate earns a redemption penalty at the rate of 2, 4, or 6 percent, depending on the amount of the original tax sale certificate, in addition to any interest rate on the certificate. After two years, a lien holder can begin proceedings in Superior Court to foreclose on the property. If foreclosure is perfected, then the name on the deed is changed to that of the lien holder who can then take possession of the property. 3 IMPORTANT INFORMATION FROM THE OFFICE OF THE TAX COLLECTOR TAX SALE INFORMATION - ITEMS REQUIRED BY NJSA 54:5-1 ET SEQ BIDDING Tax Sale Bidding starts at a maximum of 18% rate of redemption in downward increments in whole percentages. Bidding of a Premium for a Tax Sale Certificate begins at 0. Premiums are to be bid in whole dollar amounts in minimum increments of $ or more. If there are no bidders the item may be reopened at the end of the bidding by request only. If there is no request the properties remaining will be struck off to the Township of Howell at 18%. PAYING AFTER THE SALE All items must be paid at the tax office windows with CASH, CERTIFIED CHECK OR PRE-APPROVED WIRE TRANSFERS. Separate payments must be made for Sewer, Taxes and Premium. Payments are to be completed within two hours of the end of bidding or 3:00pm, whichever occurs first. All items must be paid before the sale shall be deemed closed. YOUR RESPONIBILITIES AS A TAX SALE CERTIFICATE HOLDER After the sale certain responsibilities become the obligation of the holder of Tax Sale Certificates under the Tax Sale Law NJSA 54:5-60 thru You must file affidavits for all of your disbursements and expenses as holder of the tax sale certificates. Please review the tax sale laws 2. Record your tax sale certificates within 90 days of the date of this sale. Record the certificate at the Monmouth County Clerk s recording office in Freehold. Current fee is $20.00 per certificate. NOTE: You must file a copy of the recorded certificate with this office showing Book/Page, Date and Cost of recording the certificate in accordance with 2010 amendments to the Tax Sale Laws. Blank affidavits are contained in this packet as well as at the Tax Collectors office. 3. Current year taxes are not included in the Lien Sale. If you wish to make subsequent payments, please utilize the delinquent notices forwarded to you by this office. Subsequent payments will be accepted after the Lien Sale Certificates have been issued. 4. All actions and expenses by the Holder of the Tax Sale Certificate are normally recovered by the filing in the Tax office of affidavits setting forth those expenses. The limits recoverable are set forth in the Tax Sale Law. By becoming familiar with the Tax Sale Laws you may save money that you may not otherwise be able to recover. 5. You may request redemption figures on subsequent liens twice in a calendar year for free. Subsequent requests will be $50.00 each occurrence. 6. A request for figures on your lien will be charged $50.00 for each request in accordance with NJ Tax Sale Law and Howell Township Ordinance :5-79. When title void; exception: The title of a purchaser at a sale shall cease and determine and the certificate of sale except as otherwise provided in this section shall be void at the expiration of 20 years from the date of the sale, unless the purchaser, his heirs or assigns shall, before the expiration of that term, foreclose the right to redeem it by notice or by a civil action in the nature of a proceeding in equity and record the evidence thereof, as provided in this chapter; provided, however, that this act shall not apply to titles acquired by a municipality under certificates of tax sales purchased and held by it at tax sales conducted therein which titles so acquired and certificates of tax sales are hereby expressly exempted from said limitation period of 20 years. The limitation period of 20 years of this section shall not apply to a title and the certificate of tax sale acquired by a purchaser, his heirs or assigns when that purchaser, his heirs or assigns establish that all property taxes have been paid by him, his heirs or assigns in each year since the purchase of the certificate.
