1 RURAL MUNICIPALITY OF WOODLANDS COUNCIL MINUTES The regular meeting of Council of the Rural Municipality of Woodlands was held in the Municipal Office on Tuesday, September 27, 2011 at 4:30 p.m. D.S.T. with Reeve Don Walsh in the chair, and the following Councillors present: Ila Buchanan, Gavin Jones, Trevor King, Doug Oliver and Garry Peltz. Also present: Lynn Kauppila, Chief Administrative Officer, as recording secretary. Councillor Carl Fleury was absent with reason. Councillor Doug Oliver arrived at 4:42 p.m. with reason. Councillor Doug Oliver was excused at 7:45 p.m. with reason. 4 COUNCIL MINUTES -4- SEPTEMBER 27, 2011 In Camera Resolution No. 468/11 Peltz-Buchanan WHEREAS subsection 152(3) of The Municipal Act provides that a Council may close a meeting to the public to meet as a committee to discuss certain matters; NOW THEREFORE BE IT RESOLVED THAT Council close the meeting to the public to meet as a committee to discuss: personnel matter preliminary discussion legal matter. Out of Camera Resolution No. 469/11 Oliver-Buchanan WHEREAS section of By-law No. 2593/10 of the Rural Municipality of Woodlands provides that a member of council must keep in confidence a matter that is discussed at a meeting closed to the public under subsection 152(3) of The Municipal Act until the council passes a resolution allowing the matter to be discussed publicly; and WHEREAS subsection 152(4) of The Municipal Act provides for the Council to only pass a resolution to reopen a closed meeting to the public; THEREFORE BE IT RESOLVED THAT the Council re-open the meeting to the public. READING AND CONFIRMATION OF MINUTES Adopt Minutes Resolution No. 470/11 Peltz-Jones BE IT RESOLVED THAT the Council of the Rural Municipality of Woodlands adopt the minutes of the regular meeting held on September 13, 2011, with the following amendment to Resolution No. 456/11 by removing 10 culvert in paragraph 2 and inserting 12 culvert. BY-LAWS Resolution No. 471/11 By-law 2602/11 Jones-Peltz Est. Desig. Officer BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands gives first Position to Enforce reading to By-law No. 2602/11 to establish a Designated Officer position to enforce by- By-laws & Acts laws, The Act and any other Act the Municipality is authorized to enforce. 1 st Reading Resolution No. 472/11 By-law 2602/11 Buchanan-Oliver Est. Desig. Officer BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands gives Position to Enforce second reading to By-law No. 2602/11 to establish a Designated Officer position to

COUNCIL MINUTES -5- SEPTEMBER 27, 2011 Resolution No. 473/11 By-law 2603/11 Jones-Oliver Amend By-law WHEREAS By-law No. 2074, being a by-law to license and regulate the placing and 2074 locating of house trailers and mobile homes, provides for the establishment of license 1 st Reading fees for trailers within mobile homes parks; THEREFORE BE IT RESOLVED THAT By-law No. 2603/11, being a by-law to amend By-law No and amendments thereto, be given first reading at this meeting. Resolution No. 474/11 By-law 2603/11 Peltz-King Amend By-law WHEREAS By-law No. 2074, being a by-law to license and regulate the placing and 2074 locating of house trailers and mobile homes, provides for the establishment of license 2 nd Reading fees for trailers within mobile homes parks; THEREFORE BE IT RESOLVED THAT By-law No. 2603/11, being a by-law to amend By-law No and amendments thereto, be given second reading at this meeting. FINANCE Report of Finance Committee Resolution No. 475/11 Buchanan-Peltz BE IT RESOLVED THAT the report of the Finance Committee be received, that the following accounts be paid: General cheque numbers through in the amount of $83, and that payments made after the September 13, 2011 meeting, cheque numbers through in the amount of $852, be approved. 1 Abstained Doug Oliver Property Tax Relief Program Applications Resolution No. 476/11 Oliver-Buchanan WHEREAS the Province of Manitoba has introduced a special provincial Property Tax Relief Program recognizing the loss in value of properties significantly damaged by the 2011 record flooding; and WHEREAS the Municipality has set a budget based on receipt of the tax revenue and the Property Tax Relief Program ensures municipal revenues are maintained; and WHEREAS the Province requested the Municipality to prepare a list of properties complete with date damage occurred and submit the list to Manitoba Local Government; and WHEREAS upon receipt of the list of affected properties Manitoba Local Government will calculate the amount of relief to be received and provide the Municipality with Property Tax Relief Statements for the affected property owners and Manitoba Finance will remit the total amount of tax relief to the Municipality; THEREFORE BE IT RESOLVED THAT Council adopts the attached Schedule A

6 listing of properties with the date the damage occurred and list to be forwarded to the Province for their consideration in the administration of the Property Tax Relief Program. COUNCIL MINUTES -6- SEPTEMBER 27, 2011 Set Tax Sale Reserve Bid Resolution No. 477/11 Oliver-Peltz WHEREAS pursuant to Section 372 of the Municipal Act a municipality may set a reserve bid in the amount of the tax arrears and costs in respect of the property; THEREFORE BE IT RESOLVED THAT the Rural Municipality of Woodlands place a reserve bid in the amount of all arrears and costs in respect of the following properties: Roll Number Legal Description GENERAL Lots 21 and 22, Block 2, Plan 2493 in N 1/2 of NE 1/ W. CAO Report Resolution No. 478/11 Jones-Oliver BE IT RESOLVED THAT the Chief Administrative Officer Report dated September 27, 2011 be received by Council of the Rural Municipality of Woodlands as information; and FURTHER BE IT RESOLVED THAT the recommendations contained in the report be approved. Extend SOLE Resolution No. 479/11 Oliver-King WHEREAS the Rural Municipality of Woodlands continues to encounter serious flooding from high water levels that requires prompt action to prevent harm or damage to the safety, health or welfare of persons located within the boundaries of the Rural Municipality of Woodlands and to prevent damage to property within those boundaries; and WHEREAS it is deemed necessary to take action as required (which may include limit access or close roads, evacuate people and/or livestock, and access property without warrant) in order to limit or eliminate the threat to life, property or the environment; Extend SOLE THEREFORE BE IT RESOLVED THAT pursuant to Section 11(5) of The Emergency Measures Act, Chapter E80 of the Continuing Consolidation of the Statutes of Manitoba, the Council of the Rural Municipality of Woodlands is requesting that the declaration for state of local emergency be extended throughout all of the Rural Municipality of Woodlands from the 28 th day of September, 2011 to the 11 th day of October, Resolution No. 480/11 Buchanan-Jones WHEREAS the Rural Municipality of Woodlands continues to encounter serious flooding from high water levels that requires prompt action to prevent harm or damage to the safety, health or welfare of persons located within the boundaries of

7 the Rural Municipality of Woodlands and to prevent damage to property within those boundaries; and WHEREAS it is deemed necessary to take action as required (which may include limit access or close roads, evacuate people and/or livestock, and access property without warrant) in order to limit or eliminate the threat to life, property or the environment; COUNCIL MINUTES -7- SEPTEMBER 27, 2011 THEREFORE BE IT RESOLVED THAT pursuant to Section 11(5) of The Emergency Measures Act, Chapter E80 of the Continuing Consolidation of the Statutes of Manitoba, the Council of the Rural Municipality of Woodlands is requesting that the declaration for state of local emergency be extended throughout all of the Rural Municipality of Woodlands from the 12 th day of October, 2011 to the 25 th day of October, FINANCE Resolution No. 481/11 Community King-Buchanan Sponsorship Ad WHEREAS the Stonewall-Teulon Tribune provided a quote dated September 22, 2011 for special events and publishing dates to support them by way of Community Sponsorship Ad; THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands agrees to publish an advertisement for the Fire Prevention Week at a cost of $50.00 and Remembrance Day at a cost of $99.00 and all applicable taxes. GENERAL MBOA Fall Seminar Resolution No. 482/11 Jones-Oliver BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands authorizes the Building Inspector to attend the Manitoba Building Officials Association Fall Seminar to be held on October 26 th and 27 th, 2011 at the Canad Inns Garden City in Winnipeg; and FURTHER BE IT RESOLVED THAT all costs incurred to be shared on 1/3 basis between the Rural Municipality s of Woodlands, Cartier and St. Francois Xavier. Welders Supplies Open House PDC Annual Banquet & Awards Dinner Resolution No. 483/11 Oliver-King BE IT RESOLVED THAT Council of the R.M. of Woodlands authorizes the attendance of Council members and Public Works employees at the Welders Supplies Limited Open House in Winnipeg on September 28 th, Resolution No. 484/11 Jones-Oliver BE IT RESOLVED THAT Council of the R.M. of Woodlands authorizes Councillor Garry Peltz to attend the Prairie Dog Central Railway Annual Banquet & Awards Dinner being held on Saturday, October 15, 2011 at 5:00 p.m. at The Hitch n Post.

Support Team Conference Red River Basin Land & Water Internal Summit Conference MTS Rights-of- Way Application Road 76.5 & 1W Resolution No. 486/11 King-Jones BE IT RESOLVED THAT upon the recommendation of the Drainage Committee, Council of the R.M. of Woodlands authorize the attendance of Council members at the Brandon Emergency Support Team Conference being held at the Keystone Centre in Brandon, November 9, 2011 in the amount of $75.00 per person. Resolution No. 487/11 Buchanan-Jones BE IT RESOLVED THAT upon the recommendation of the Drainage Committee, Council of the R.M. of Woodlands authorize the attendance of Council members at the 29 th Annual Red River Basin Land & Water Internal Summit Conference being held at the Fort Garry Hotel in Winnipeg, January 24 to January 26, 2012 in the amount of $ per person. Resolution No. 488/11 Buchanan-King WHEREAS the R.M. of Woodlands is in receipt of a Municipal Rights-of-Way Application Form from MTS; and WHEREAS MTS has requested to direction push cable under Road 76.5 from NW W to SW W approximately 400 meters east of the intersection of Road 76.5 and Road 1W and place a pedestal on the South side of 76.5 on the 0.3m line of 76.5 as per File No ; and WHEREAS MTS needs to complete these works in order to replace defective cable serving Riddell s Roasters that is currently out of service/marginal; THEREFORE BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands approve the Municipal Rights-of-Way Application from MTS being File No with notification given to the Municipality 48 hours prior to the commencement of the work; and FURTHER BE IT RESOLVED THAT the Chief Administrative Officer be authorized to execute the MTS Rights-of-Way Application. Resolution No. 489/11 Agreement 353/11 Peltz-Jones Amend Schedule B WHEREAS Council of the Rural Municipality of Woodlands entered into an agreement with G & T Bobcat Services as set out in Agreement 353/11, for the removal of debris along the Twin Beach Road South within the Rural Municipality of Woodlands; and

9 WHEREAS Council of the Rural Municipality of Woodlands and G & T Bobcat Services agree to amend Schedule B Payment Rate and Terms of Agreement 353/11 to include the hourly rate for one pickup truck with 2 employees; THEREFORE BE IT RESOLVED THAT the Amended Schedule B Payment Rate and Terms replaces the original Schedule B attached to Agreement 353/11.
