8 REZONNG APPLCANT'S RESPONSE STANDARDS GOVERNNG THE EXERCSE OF THE ZONNG POWER (A) (B) (C) (D) (E) (F) Yes, approval of the proposed development will permit a use that is suitable in view of the use and development of adjacent and nearby property. The Property is near or adjacent to land zoned R-1 00 Modified, R-ZT, R-75 Modified, R-60, and R-TH. No, the proposed development will not adversely affect the existing use or usability of any of the nearby properties. Due to the size, location, layout and di1nensions of the subject property, the Applicant sub1nits that the property does not have reasonable economic use as currently zoned. No, the proposed rezoning will not result in an excessive or burdensome use of the infrastructure syste1ns. The Prope1iy has convenient access to Buford Drive (State Route 20) via Gravel Springs Road and will have even more convenient access to nterstate 85 once the proposed Gravel Springs interchange is completed. Yes, the proposed Rezoning Application is in conformity with the policy and intent of the Gwinnett County Land Use Plan. The Property is designated as within the Existing/E1nerging Suburban Character Area which encourages residential infill developn1ent at densities and character compatible with surrounding property including, single-family detached and townhouse developtnents, specifically. Lee Tucker, Jr. *Of Counsel LETTER OF NTENT FOR REZONNG APPLCATON Mahaffey Pickens Tucker, LLP submits this Letter of ntent and attached rezoning application (the "Application") for the purpose of requesting the rezoning of an approximately acre tract (the "Property") located on vy Creek Road between Gravel Springs Road (State Route 324) and Camp Branch Road in northern Gwinnett County. The Property is currently splitzoned R-75 Modified and R-1 00 Modified. The Applicant requests the rezoning of the Property in order to pennit its develop1nent as a high-quality single-fan1ily residential community pursuant to the Traditional Neighborhood Development District (TND) as set fm1h in the Gwinnett County Unified Development Ordinance (the "UDO"). The proposed development would include 295 homes with a variety of lot sizes, home styles and architectural designs and would be served by two entrances on vy Creek Road. Si1nilar to recent development just west of the Property, the proposed homes would be constructed by Chafin Com1nunities who is hoping to continue their success at the Villages at vy Creek cmnn1unity. The proposed develop1nent would include a variety of home types including single-fan1ily attached townhomes as well as traditional single-family detached hmnes on large, medium, and small lots as required under the TND zoning classification. 10 wide and a total of 145 townhomes. The proposed style of townhomes would further diversify and expand housing options in the area by including a mix of front and rear entry-style homes. All proposed homes would include two-car garages as well as attractive architectural elements that are compatible with the surrounding area. Homes built on the proposed 62-foot-wide lots would include at least 2,400 square feet for single-story homes and 2,800 square feet for twostory h01nes. Facades of these homes would primarily include brick and/or stacked stone on three sides. Homes built on the 47-foot lots would be at least 2,400 square feet in area and the townhomes would include at least 1,600 square feet. The townhomes and detached homes on 47- foot lots are proposed to be constructed primarily with brick and/or stacked stone on the front fac;ade with sides and rears of the same or fiber cement siding with a masonry water table. The larger of the proposed detached homes would be located along the rear portions of the Property where adjacent to the Hedgerows subdivision. Medium-sized lots are proposed along the northeasterly po1iions of the Property and are separated from the adjacent Hedgerows subdivision by at least 150 feet of streatn buffers and impervious setbacks. n spots, this natural buffering in combination with proposed open space provides vegetated separation between the Property and the Hedgerows subdivision of over 300 feet. The proposed townhomes are located on internal portions of the Property off of vy Creek Road and away from the Hedgerows subdivision with convenient pedestrian access to open space. The combination of front and rearentry home styles improves aesthetics of the proposed community by creating visual diversity along internal roadways. The proposed development also utilizes existing stream buffers and utility easements to provide two large, interconnected areas of open space in the center of the Property. 11 of 4-foot-wide sidewalks on both sides of the street promoting a healthy lifestyle by providing a pedestrian-friendly community. n additional to pedestrian-friendly sidewalks, the proposed con1n1unity would include attractive street trees planted in landscape strips adjacent to all streets. n total, the proposed development provides approximately 18 acres of c01nmon and open area for the use and enjoyment of residents, which is 23.2% of the Property' s gross acreage. Additional amenities for residents would include a pool, cabana/bath house, and mail kiosk constructed to match the aesthetics and architectural style of homes in the community. According to the Gwinnett County 2030 Unified Plan (the "2030 Plan"), the Property is located within the Existing/Emerging Suburban Character Area. Within that character area, the 2030 Plan specifically encourages "single family detached and townhouse developments at low to tnoderate densities" and "residential in-fill development at densities and architectural character compatible with existing development." The Villages at vy Creek includes singlefan1ily detached homes similar to what the Applicant is proposing to construct on the Property. n fact, the Villages at vy Creek is adjacent to the Townes of Avondale, a high-end townhome development similar to the attached townhomes that are proposed in this application. Moreover, the Property is adjacent to a large tract of land zoned R-TH on vy Creek Road. The proposed development is therefore consistent and compatible with existing development patterns on Gravel Springs Road and vy Creek Road. Further, the 2030 Plan provides that "promoting a variety of housing options for Gwinnett County residents" is one of the County's major policy goals for future growth. The proposed development furthers this stated goal by providing a variety of housing options in a planned, cohesive, residential mixed-use development that is both compatible with the zoning classifications of adjacent property and in-line with established development patterns in the area. \
