The property is designated "Service Commercial" in the Brampton South Secondary Plan (SPA 16) and is zoned "Service Commercial". In order to permit residential uses, an amendment to the Secondary Plan and Zoning By-law is required. Once the development application has been evaluated by internal City Departments and key external agencies, staff will report back to Planning Design and Development Committee with recommendations. Recommendations: 1. THAT the report from Paul Aldunate, Development Planner, Planning and Building, dated July 31, 2014 to the Planning, Design and Development Committee Meeting of September 8, 2014, re: INFORMATION REPORT Application to Amend the Official Plan and Zoning By-Law and Proposed Draft Plan of Subdivision, CANDEVCON LIMITED - HANS HOLDINGS, Ward: 4, File: C01W be received; and, 2. THAT staff be directed to report back to Planning Design and Development Committee with the results of the Public Meeting and a staff recommendation, subsequent to the completion of the circulation of the application and a comprehensive evaluation of the proposal.

2 Background: Dfl-IA Proposal (See Map 1): The applicant is proposing to be build 16 townhouse units consisting of the following: Eight (8) conventional condominium townhouse units on 5.0 metre (16.4 feet) wide lots with single car garages facing a private road; Eight (8) dual frontage condominium townhouse units facing McMurchy Avenue on 5.75 metre (18.86 feet) wide lots with single car garage access from the private road; and, Five (5) visitor parking spaces with access from Fair Oaks Place MAPI: CONCEPT PLAN LEGEND Conventional Townhouses Dual Frontage Townhouses Existing Townhouses Fair Oaks Place C 01 > < u Existing Semi-Detached Dwellings

3 pa-2 Property Description and Surrounding Land Use: The property has the following characteristics: is located at 57 McMurchy Ave South; has a site area of hectares (0.69 acres); and, has a frontage of approximately 49 metres (161 feet) along McMurchy Avenue South The surrounding land uses are described as follows: North: East: South: West: Fair Oaks Place (private road), beyond which is existing residential townhouse units. McMurchy Avenue South, beyond which is the Brampton Curling Club located within the Old Fairgrounds Park. Existing residential composed of semi-detached and single detached residential units. 4 "D2-W Current Situation: Comments from City divisions/departments and external commenting agencies are required in order to complete a comprehensive analysis of this application. All comments received will be attached to the future planning recommendation report to the Planning, Design and Development Committee. Further details on this application can be found in Appendix 5 of this report. Corporate Implications: Financial Implications: An assessment of the financial implications associated with this application will be undertaken and discussed within the future planning Recommendation Report. Other Implications: Other technical planning and development implications associated with this application will be assessed and discussed within the planning Recommendation Report. Strategic Plan: As part of the development review process this application will be reviewed against the City's Strategic Plan with the findings brought forward as part of a future planning recommendation report. Public Meeting Notification Area: Notice of the Public Meeting was given by prepaid first class mail to all persons assessed in respect of land to which the proposal applies and within 240 metres of the area to which the proposal applies as shown on the last revised assessment roll, and by public notification in the Brampton Guardian. 10 APPENDIX 5: INFORMATION SUMMARY Official Plan: The subject lands are designated as "Residential" according to Schedule A General Land-use Designations of the Official Plan. An amendment to the Official Plan is not required. Secondary Plan: The subject lands are designated as "Service Commercial" in the Brampton South Secondary Plan (SPA 16). An amendment to the Secondary Plan is required in order to permit residential development on these lands. Zoning By-law: The subject lands are zoned "Service Commercial" (SC) according to Zoning By- Law , as amended. This zone permits a number of commercial related uses including a retail establishment having no outside storage, a service shop, bank, office, dining room restaurant or garden centre. An amendment to the Zoning By-law is required to permit residential development.
