Box 900 Lake Charles, LA Planning and Zoning Commission Monday, December 10, :30 PM Council Chambers OPEN MEETNG ROLL CALL MNUTES OF PREVOUS MEETNG SPECAL ANNOUNCEMENTS COMMSSON BUSNESS MCU LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: HYATT GROUP, LLC SUBJECT: Applicant is requesting a Minor Conditional Use Permit in order to construct a retail convenience store with fueling area, within a Mixed Use Zoning District. Location of the request is the Northwest corner of Lake Holly Street. STAFF FNDNGS: The applicant is requesting to construct a retail store with fueling center. Staff s review revealed the complex is bordered on the south, north, and east by office uses/mixed Use development tracts and residential uses to the west. Staff s review revealed that the proposal would meet the minimum development standards for parking, as well as building setbacks, and would be considered a compatible land use for the area. We are requesting the applicant adjust the submitted site plan to include the 10 landscape buffer abutting Lake and Hollly Street, and reconfigure the driveway access points to meet the distance requirements from the street intersection. f the site plan adjustments cannot be made the applicant will be required to make application for variances regarding curb cut access and landscape requirements. Staff recommends approval on the following conditions: 1) landscape according to Sec (attached); 2) screen all waste disposal areas from public view; and 3) adhere to any recommendations set forth by Planning Commission for variance requests (if required). RES LAKE CHARLES SUBDVSON REGULATONS APPLCANT: DONALD MOSELEY (BAGGETT SUBDVSON) SUBJECT: Applicant is requesting Preliminary and Final Subdivision approval (Section 2.3 & 2.4), in order to subdivide a 6.5-acre tract of land into three (3) business development tracts, within a Business Zoning District. Location of the request is the Eastside Contraband Parkway. STAFF FNDNGS: The on-site and site plan reviews revealed that the proposed re-platting of a 6.5 acre tract of land meets the minimum lot size and configuration set forth for a Business Zoning District. Staff recommends approval of the application on the condition applicants adhere to any recommendations by the Department of Engineering and Public Works. Location of the request is the Southside 2100 Blk. E. McNeese Street. STAFF FNDNGS: The on-site and site plan reviews revealed that the proposed re-platting of a acre tract of land meets the minimum lot size and configuration set forth for a Mixed Use Zoning District. Staff recommends approval of the application on the condition applicants adhere to any recommendations by the Department of Engineering and Public Works. Location of the request is the Northside 3200 Blk. E. McNeese Street. STAFF FNDNGS: The on-site and site plan reviews revealed that the proposed re-subdivision to be used for single family home dwelling units meets the minimum lot size and configuration set forth for the Morgan Field Master Planned Community. Staff recommends approval of the application on the condition applicants adhere to any recommendations by the Department of Engineering and Public Works related to water and sewer availability for the area and submit stamped engineered construction drawings within 90 days of planning commission approvals. RES-VAR LAKE CHARLES SUBDVSON REGULATONS APPLCANT: TERRE SANTE, LLC (TERRE SANTE RE-SUBDVSON PART 3) SUBJECT: Applicant is requesting Preliminary and Final Subdivision approval (Section 2.3 and 2.4) in order to subdivide a 2-acre tract of land into 18 townhome development tracts with a lot size variance, within a Residential Zoning District. Location of the request is the Southside 1200 Blk. W. Sallier Street. STAFF FNDNGS: The on-site and site plan reviews revealed the proposed re-subdivision to be used for single-family attached residential townhome uses fails to meet the minimum lot size of 6,000s.f. (requesting 2750s.f.) for a Residential Zoning District. This is consistent with the previously approved lot size and layout for Phase of the development. SUBJECT: Applicant is requesting Preliminary and Final Subdivision approval (Section 2.3 and 2.4), in order to re-subdivide a 3.23-acre tract of land into three (3) residential development tracts, within a Residential Zoning District. Location of the request is the Southside 1100 Blk. Shell Beach Drive. STAFF FNDNGS: The on-site and site plan reviews revealed that the proposed re-platting of a 3.23 acre tract of land for residential development meets the minimum lot size and configuration set forth for a Residential Zoning District. Staff recommends approval of the application on the condition applicants adhere to any recommendations by the Department of Engineering and Public Works. MAJ-VAR LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: JOSH FONTENOT SUBJECT: Applicant is requesting a Major Conditional Use Permit in conjunction with a neighborhood commercial use (Sec 5-30(3)(B)()) in order to construct two free standing professional office buildings with a bufferyard reduction and curb cut deviation, within a Neighborhood Zoning District. Location of the request is the Northeast section of Lake W. Sallier Street. STAFF FNDNGS: The applicant is requesting to construct a professional office facility within a Neighborhood Zoning District. The development meets the appropriate parking ratios, landscape setback requirements, and design standards for a neighborhood commercial use. The applicants are requesting a adjustment in the Lake Street curb cut location and a reduction of the 15 bufferyard to 10 along the north property line abutting a residential use. Similar commercial uses are established to the south and vacant mixed use property to the west. This corner is considered somewhat transitional for the immediate area therefore staff feels this request falls reasonable. MAJ LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: KNGSLEY S BULDNG SOLUTONS SUBJECT: Applicant is requesting a Major Conditional Use Permit (Sec 5-302(3)(A)) in order to construct a duplex dwelling unit, within a Neighborhood Zoning District. Location of the request is 2133 Cline Street. STAFF FNDNGS: The on-site and site plan reviews reveal the applicant is requesting to construct a duplex dwelling unit (two units) which falls within the allowable density for Major Use Permit within a neighborhood zoning district. This proposal is bordered by neighborhood zoning tracts to the west, and east. The application meets all the development standards for a Major Conditional Use Permit. VAR LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: H. CURTS VNCENT SUBJECT: Applicant is requesting a Variance (Section 4-205) in order to construct a restaurant kitchen addition 3 from the north side property line, within a Business Zoning District. Location of the request is 3716 Ryan Street. STAFF FNDNGS: The on-site and site plan reviews revealed the construction of a side addition for a new commercial restaurant kitchen fails to meet the requirement of 5 from the side property line in a Business Use Zoning District. Although this is a minimal impact on the abutting property and there are existing non-conforming setback structures in the immediate area, staff could find no evidence of hardship involved, therefore cannot forward a position of support. 4 Planning and Zoning Commission Meeting Agenda December 10, 2018 VAR LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: MORGANFELD PARTNERS, LLC SUBJECT: Applicant is requesting a Variance (Section 4-205) in order to construct single family homes with a street side setback of 5 vs 15 from the street side property line for lots 102 and 103 of Lakes at Morganfield Phase 1, within a Residential Zoning District. Location of the request is the Northside 3200 Blk. E. McNeese Street (Lakes at Morganfield Subdivision). STAFF FNDNGS: The on-site and site plan reviews revealed the proposed development site (corner lot) is abutting a significantly larger (non-typical) residential ROW compared to a traditional 50 ROW. The proposed residential homes will have a significant setback from the street edge. Therefore, staff feels the request falls reasonable. VAR LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: THND ENTERPRSES LLC SUBJECT: Applicant is requesting a Variance (Section 4-205) in order to construct a traditional convenience retail store with deviations from the T-4 design standards including but not limited to setbacks, pump placement, height, ingress and egress, façade standards, for the district. Location of the request is the Southeast corner of Ryan Belden Street. STAFF FNDNGS: The Downtown Development Authority will be forwarding a recommendation for the proposed development site and design standards. VAR LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: TERRE SANTE, LLC SUBJECT: Applicant is requesting a Variance (Section 4-205) in order to construct attached townhome residential units with zero lots lines per the submitted site plan, within a Residential Zoning District. Location of the request is the Southside 1200 Blk. W. Sallier Street. (Terre Sainte Sub.) STAFF FNDNGS: The on-site and site plan reviews revealed the applicant for the construction of single-family attached townhome structures within the existing Terre Sainte Subdivision development is requesting a zero lot line development. This application is consistent with the previously approved townhome component of the Terre Sainte Development. This variance would apply to all lots within this phase of the development. VAR LAKE CHARLES ZONNG ORDNANCE NO APPLCANT: JARED KENNSON SUBJECT: Applicant is requesting a Variance (Section 4-205) in order to construct an accessory parking lot 8 from the rear property line vs the 15 bufferyard abutting a Business Zoning District with an establish townhome development. Location of the request is 4212 Lake Street. STAFF FNDNGS: The on-site and site plan reviews revealed the construction of an employee parking lot fails to meet the bufferyard requirement abutting a single family townhome development to the west. The townhome properties are located within a Business Zoning District therefore staff feels this variance request falls reasonable. 24 EXPLANATON OF AND FOR THE REQUESTED VARANCES The following variances are being requested for the proposed development. 1. Corner driveway access less than 150-ft from roadway ROW. 2. Reduction in required bufferyard separating proposed commercial development and existing residential properties within a neighborhood district. The following explanations are being provided regarding the above stated variances being requested. 1. The existing property proposed for development is primarily located within flood zone AE with the remaining portions located in Zone X. The proposed site plan has been developed in an effort to maintain the construction of the office buildings outside of the areas delineated as flood Zone AE, to the furthest extent possible, and locate them within those areas delineated as Zone x. ln an effort to achieve this maximum avoidance of developing with in flood zone AE the above stated variances are being requested and explained further herein. (See attached flood map) 2. The 150-ft distance for the access drive cannot be accommodated due to the depth of the property (151.5-ft) therefore approximately 60-ft is being provided in the proposed site plan for the Lake 5t. access drive. 3. ln an effort to construct the buildings outside of flood zone AE, to the furthest extent possible, a bufferyard of 10-ft is being requested in lieu of the 15-ft required. The following concessions are being made on the part ofthe applicant to help mitigate any encumbrances which could be considered regarding the requested variances. 1. The entrance/exit drive located on Lake 5t. will be restricted to ONLY right turns into and out of the driveway. There will be no left turns allowed entering or leaving the proposed development onto neither Lake St. nor Sallier St. This concession is being offered in an effort to mitigate any potential traffic concerns which may be considered on the basis of the proximity of the Lake St. drive to the Sallier Rd. intersection. 2. The existing la ndsca p ing/vegetatio n growth located within the 10-ft buffer zone will be maintained, to the further extent possible, to buffer/hide the proposed building construction from the view of the adjacent residential properties which the project will abut. 3. The proposed buildings, which will be located adjacent to the 10-ft buffer zone, will be constructed in an Acadian style architecture in an effort to match the aesthetics and feel of the neighborhood. The look ofthe buildings will appearto be residential, from an exterior standpoint, so as to not cause any adverse effects to the neighborhood feel of the area.

The proposed development will be constructed on the northeast quadra nt of the Lake Street a nd Sallier Street intersection. The development will be constructed on three (3) parcels that will be combined to support the proposed development. Two (2) of the existing parcels (760 Sallier St and 1925 Lake St) are currently under contract by the applicant (buy/sell agreement attached). The third parcel is currently owned by the City of Lake Charles and has been determined to be surplus property. The applicant has submitted the appropriate documentation to the city of Lake Charles to initiate the buy/sell negotiations of this property. lf the project is approved the applicant will request a single property address from the City of Lake Charles. The development will generally consist of a parking lot and two (2) professional office buildings as identified on the proposed site plan. The office buildings and parking lot may be constructed in phases depending upon market conditions at the time of construction. The applicant reserves the right to construct a single building within the proposed site plan if the need/desire arises, however currently the intent is to construct two free standing buildings. The initial building construction will be built to accommodate the offices of a local engineering firm. The additional office building will be built to lease to for a similar professional office space use.
