"Th rmaining points to b clard up ar not of any major consqunc, but bcaus of th lngth of tim lapsd sinc th start of th bargaining, som nw problms hav com up." Th Board of Collctiv Bargaining last wk rmovd th major obstacl in th talks by rsrving dcision on th qustion of including parity and diffrntial clauss in th contracts. t notd in its intrim dcision, howvr, that firfightrs will rciv th Sc^m pay as patrolmn undr th proposd pact and that th salaris of firmn and fir liutnants would continu at a 3.0 to 3.9 ratio. Maximum salary lvls undr th proposd contracts would b, as of nxt Jan. 1, $21,450 for fir captains, $18,590 for fir liutnants and $14,300 for firmn. Th UFOA and th UFA had brought th issu bfor th OCB, charging that th; city had rngd on a promis to hav th parity and diffrntial clauss writtn into thir contracts. Th city dnid th charg and rfusd to rduc th traditional rlationships to writing for far of bing bound in a "parity spiral" among th uniformd srvics. Th Board in ffct dclard th point moot for th duration of th contracts, both of which run from Jan. 1, 1971 to Jun 30, 1973, saying that "w hav no rason to bliv th pay rlationships thus stablishd will or should b changd during th lss than on yar that rmains of th currnt contract trms." Gimmlr said that this was th assuranc that th UFOA had wantd. Th Board has postpond dciding whthr parity clauss may b writtn into contracts "in viw of th sriousnss of th issus prsntd, th complxity of th lgal qustions involvd, and th rlvanc of th yt-to-b compltd contracts of othr intrrlatd groups." ycyjf.v-' "A ^fr.'^^yx.^ DSCUSS ATC ACT Rp. Controvrsial ssu Th right of public mploys to ngag in political activitis has long bn a controvrsial issu. As far back as 1892, in a cas known as McAuliff v. City of Nw Bdford, Justic Olivr Wndll olms, thn a judg of th Massachustts Suprm Court, ruld on a cas involving a formr polic officr who was dismissd from th forc for having ngagd in political soliciting and canvassing. n upholding th dismissal of th policman, Justic olms, in his typical plgrammatical styl, wrot that th policman "may hav a constitutional right to talk politics, but h has no constitutional right to b a policman." olms laboratd on this thsis as follows: "Thr ar fw mploymnts for hir n which th srvant dos not agr to suspnd his constitutional rights of fr spch, as wll as of idlnss, by th implid trms of his contract. Th srvant cannot complain, as h taks mploymnt on trms which ar offrd him." A numbr of rcnt judicial dcisions hav followd th olms formulation with rspct to policmn in holding that a mmbr of a polic forc is inligibl to run as a candidat for lction to a local school board, for xampl. n 1947 th Unitd Stats Suprm Court uphld th atch Act on grounds also similar to th doctrin xprssd by Justic olms. owvr, th District Court last wk took th position that th law suit bfor th court did not qustion th powr of Congrss to pass such a law, but whthr th provisions of th Act which dfind th prohibitd conduct wr clar and dfinit. By a 2-1 vot, this Court hld that th dfinition of such conduct was "ambiguous and unsatisfactory." Although th procding was startd pursuant to Articl 78 of th Civil Practic Law and Ruls, th court tratd it as an action for a dclaratory judgmnt rlying on th substanc of th cas rathr than th: form in which it was prsntd.
