4 Planning Commission City of Rock Hill, South Carolina October 7, 2014 A regular meeting of the Planning Commission was held Tuesday, October 7, 2014, at 7:00 P.M. in City Council Chambers, City Hall, 155 Johnston Street, Rock Hill, South Carolina. Approval of minutes of the September 2, 2014, meeting. Mr. Christopher made a motion to approve the minutes from the September 2, 2014, meeting. Mr. Greene seconded and the motion passed by a vote of 4-0. BLIC HARING ITMS 2. Hold public hearing and consider a recommendation to City Council on petition M by dgar G. illiams to rezone approximately acres at 1271 South Anderson Road from Residential Development-II (RD-II) in York County to Industry General (IG) in the City of Rock Hill. This property is proposed to be annexed into the City of Rock Hill. Tax map number ric Hawkins presented the staff report. Mr. Graham referred to the western boundary and asked about the required buffers. Mr. Hawkins stated that for a fully enclosed industrial use, the buffer required would be sixty feet, and an industrial use with outdoor activity would require an eighty foot buffer. He noted that the width of the buffer could be reduced by ten feet if a six foot tall solid fence or a berm were in place. Mrs. Judy Martin, 296 Southside Road, requested clarification on the application, asking if other properties would be annexed as well. Mr. Graham explained that the annexation was only for the single property, not any of the others in the area. There were no further questions or comments from the audience. Mr. Greene presented the motion to recommend approval of the rezoning application to City Council. Mrs. Thomas seconded the motion. The recommendation passed by a vote of 4-0. N BUSINSS 3. Consideration of a request by Henson Foley, Inc. for Major Site Plan approval for Home2 Hotel. (Plan # ) Mr. Reinhardt presented the staff report. Mr. Tim Foley, Birkdale Commons Parkway, Huntersville, NC, was available to answer questions. Mr. Christopher asked about the detention pond. Mr. Foley stated that this was still under discussion but it was believed that they may be able to be part of the
5 Planning Commission Minutes October 7, 2014 Page 2 Bilwyn master pond. Mr. Christopher presented the motion to approve the Major Site Plan subject to staff comments. Mrs. Thomas seconded, and the motion carried by a vote of Other Business Draft meeting calendar for 2015 regular Planning Commission meetings. Mr. Hawkins noted that the Commission should look over the calendar and consider for adoption at the next meeting. He added that the only conflict was with National Night Out in August, so the meeting was changed to August 11. He also noted that November 3 was lection Day, but did not think there would be any conflicts that day with Council Chambers but would advise the Commission closer to the date. Boards & Commissions Dinner Mr. Hawkins asked all members attending the Boards & Commissions Dinner on October 9 to please RSVP as soon as possible. General Updates Mr. Christopher asked for an update on the Seven Oaks Apartments discussion regarding how to calculate the tree save area. Mr. Hawkins stated that he had not gotten any new information but that the applicant was continuing to work on a resolution. Mr. Christopher asked about City Council s meeting discussion regarding the Corporate Boulevard D amendments. Ms. Youngblood stated that City Council wanted to make sure that if indoor recreation uses were allowed in the D, no alcohol nor nightclub-like parties could take place within them. 5. Adjourn. Reason for Request: The property owner plans to combine the subject property with his property at 129 Oakland Ave. to support future expansion of the Microbrewery and Bar that is under construction. 7 Case No. M Rezoning Analysis-Report to Planning Commission Meeting Date: November 6, 2014 Location: 138 benezer Avenue,Tax Map # (portion) Site Area: Approximately 0.53 acres Request: Rezone property from Neighborhood Office (NO) to General Commercial (GC). Proposed Development: Microbrewery (Limited Manufacturing) and Bar Applicant: Rock Hill City Council Owner: LRB Property LLC (Legal Remedy Brewing Co.: Chad A. McGowan, sq.) Rock Hill, SC Site Description The subject property is undeveloped and is under the same ownership as the adjoining property at 129 Oakland Avenue. It is located within Old Town between Oakland Avenue (Minor Arterial, State maintained) and benezer Avenue (Local, City Maintained). Surrounding uses include professional offices and residential in commercial zoning districts. Background Chad McGowan, owner of 129 Oakland Avenue, recently received Special xception approval for a Limited Manufacturing use (Microbrewery) and Bar with outdoor seating. Mr. McGowan also recently purchased the subject property with plans to combine it with 129 Oakland in support of future expansion. In order to combine the parcels, they need to have the same zoning. Since owner-initiated applications to rezone to GC are not allowed by the zoning ordinance, such rezonings can only be initiated by the City. On rare occasions, staff has asked City Council to sponsor rezonings to GC for small properties that are adjacent to existing GC zoning and fit in with the larger zoning pattern. Staff approached City Council about rezoning the subject property at their October 13, 2014, meeting and Council sponsored it at that time. xisting Zoning District Summary Neighborhood Office (NO)- The NO district is established to provide for a mix of smallscale professional office uses together with limited service uses, single-family detached, single-family attached, townhouse, two- to four-family dwellings, and multiple family uses in close proximity to one another, subject to design and compatibility standards. Non-residential uses shall be located in buildings that are consistent with surrounding residential uses in physical design, scale, character, and shall not exceed ten thousand (10,000) square feet in area. Legally established nonconforming Retail Sales and Services uses in existence on March 1, 2006, shall be allowed to remain, recommence, and expand in accordance with Section 8-200(D)(2), Retail Sales and Services Uses in
8 Rezoning Analysis-Report to Planning Commission M Page 2 the Neighborhood Office (NO) District. Structures exceeding ten thousand (10,000) square feet in size in existence on March 1, 2006 shall be allowed to remain, but in no instance shall such structures be allowed to expand. The maximum residential density allowed is five (5) dwelling units per acre. Live/work dwellings and upper story dwellings over a street-level non-residential use may be included at densities of eight (8) units an acre. In addition, all non-residential development in the NO district shall limit its hours of operation to between the hours of 6:00 AM and 10:00 PM. Proposed Zoning District Summary General Commercial (GC)- The GC district is established as a commercial district applied to lands being used for commercial uses which do not readily fit into one of the three (3) other commercial districts. The GC district provides opportunities to integrate residential with retail and office uses, subject to design standards. It is the intent of this Ordinance the GC district be phased out over time by not allowing new owner-initiated rezonings to the GC District. INFRASTRUCTUR CONSIDRATIONS Transportation The property is proposed to be combined with the property at 129 Oakland Avenue and will be accessed from Oakland Avenue. Public Utilities All necessary utilities are available to the site. RLATIONSHIP TO BLIC PLANS Vision 2020 Comprehensive Plan The subject property is reflected on the City s Vision 2020 Land Use Map as being Urban Mixed Use as well as within the Textile Redevelopment Corridor Overlay. The Urban Mixed Use Character Area is the historic urban core of the City. Development patterns envisioned for this area include a mix of uses, pedestrian-friendly amenities, and the visual character found in Rock Hill s existing downtown areas. The area should include a wide range of commercial, residential and civic activities; while large scale retail, light industry and heavy industry (outside of business parks) should be limited. Approved Focal Point Plans should guide decisions about redevelopment and infill within this area. Projects should reinforce compatibility and context with the surrounding community. Other Planning Principles to be considered in redevelopment of this area are urban form (including compact development, walkable streets, mixed
9 Rezoning Analysis-Report to Planning Commission M Page 3 uses, transit oriented design, block and street orientation, integration of civic spaces) and historic character. Textile Corridor Master Plan The subject property is within the study area of the Textile Corridor Master Plan which was adopted in The plan envisions a pedestrian-friendly, mixed-use, urban village anchored by the Bleachery site. The Textile Corridor area is now a part of the larger Knowledge Park area that is targeted for development by knowledge-based businesses and supporting amenities. Conclusion The requested rezoning is generally consistent with the City of Rock Hill Vision 2020 Comprehensive Plan and Vision 2020 Land Use Map. BLIC INVOLVMNT Staff hereby certifies that the required public notification actions have been completed as follows: October 17: Rezoning notification signs posted on subject property. October 17: Rezoning notification postcards sent to 44 property owners within 300 of the subject property. October 18: Planning Commission public hearing advertisement published in The Herald. Public Feedback No comments received to date. RCOMMNDATIONS Staff Assessment Due to the specialized use involved, the transitional land uses in the area, and the nearby zoning pattern which is predominately GC, a rezoning to GC would likely be the most reasonable route to fulfill the applicant s plan. The proposed zoning is consistent with the Land Use Plan and compatible with the surrounding zoning. Staff Recommendation Staff recommends approval of the rezoning. Constitution Park HOA c/o Marissa Harris, Property Manager The applicant is interested in installing a gate on the back entrance to Constitution Park, near Longview Road. See attached letter from Marissa Harris on behalf of the HOA. The proposal requires Planning Commission approval as a revision to the Preliminary Plat. The D Plan and Preliminary Plat for Constitution Park were approved in hen the Zoning Ordinance was revised in 2006, it included a prohibition on gated streets to preserve access for public agencies. Staff has concerns with permitting gated streets because of service-delivery and quality of life issues for the community as a whole. hile the impact of this proposal may be small, staff is concerned that it will lead to other requests for gated streets that will cumulatively reduce the service levels of the overall road network and various community services such as garbage collection and emergency response time. Although the zoning ordinance prohibits gated streets, Constitution Park was approved prior to the adoption of this provision and therefore may be considered by the Planning Commission. If the request is approved, a plan must be submitted for staff review to ensure the design will accommodate emergency and public works vehicles. Staff Recommendation: Due to concerns with the cumulative effects of similar requests in the future, staff does not recommend approval of the request. Tryon St. Suite F211 Charlotte, NC (704) October 14, 2014 Re: Constitution Park Gate Request Dear Planning Commission, This letter is a request from Constitution Park Homeowners Association for a variance, allowing the Association to gate the back entrance of their community. The request is in response to the community attempting to control the disposal of trash at their rear entrance (off of Longview Rd.) and cut through traffic on Constitution Park Blvd. The trash issue causes thousands of dollars each year to be spent on the removal of items left by non-residents. The items left include construction debris, furniture, appliances, etc. The Association has tried several methods of controlling both of these issues including temporary cameras, offering rewards, raising the height of their speed humps and are currently paying for the trash to be removed on a regular basis. e have met with the traffic commission monthly between July - September 2014 and were provided a preliminary approval for the gate system as it will not affect the City trash service, emergency system or create traffic volume issues. The gate system will be a one armed system with code access. The City of Rock Hill and residents can be assigned codes to allow access. This will discourage the dumping of trash and cut through traffic. The Association wishes to work with the City of Rock Hill for approval of the gate system or other permanent resolution. The issue of the additional cost to the Association for the removal of trash from outside of the community and the long term impact on the community for such responsibility must be addressed. The cost of the continued removal of trash from non-residents places and undue burden on the 136 owners of the community.
