Kaplan Director, Government Affairs York State REALTORS got their wish when Governor David Paterson signed the Commission Escrow Act into law on August 8, The law will go into effect on January 1, REALTORS from around New York State applaud Governor Paterson, our Prime Legislative Sponsors Assemblyman Michael Gianaris (D-Astoria) and Senator Dale Volker (R-Depew), all of our Co-sponsors in both the Senate and the Assembly and the efforts of the entire LIBOR and NYSAR membership for bringing this long overdue measure onto the law books in New York. Assemblyman Michael Gianaris especially needs to be commended on his incredible efforts in leading the charge for this bill through the Judiciary Committee. Had it not been for his belief in the merit of this legislation ˆ we would not have a law today. The Assemblyman led this bill through the Committee process in an unprecedented way despite strong opposition from the Judiciary Committee Chair! Against all-odds, the Commission Escrow Act, which was already unanimously passed by the Senate, reached the Assembly where it passed by an overwhelming majority 112 to 7. Following our consistent outreach efforts including member participation in online Calls for Action, grassroots advocacy, Lobby Day visits with the lawmakers and the hard work of the bill s sponsor, the measure moved through the Assembly s complicated committee process. Finally it made it to the floor of the Assembly for debate on the final evening of the legislative session. During the floor debate LIBOR s delegation of Assembly Members came through! Prime Sponsor Michael Gianaris led the support with Dave McDonough (R- Merrick); Bob Barra (R-Lynbrook); Joe Saladino (R-Massapequa); Mark Weprin (D-Little Neck); Phil Boyle (R-Bay Shore) and Chuck Lavine (D-Glen Cove) all speaking eloquently on this bill and why it is desperately needed. In addition special thanks go out to Carol Gallo-Turschmann, LIBOR s Commission Escrow Committee Chair and NYSAR s Commission Escrow Working Group Vice Chair, who worked tirelessly for years spearheading the efforts on both the state and local level to make sure that this bill became law! MOTTOLA NAMED TO NEW YORK STATE REAL ESTATE BOARD The Long Island Board of Realtors and Multiple Listing Service of Long Island are pleased to announce that CEO, Joseph Mottola has been appointed by Governor Paterson to serve as a member of the NYS Real Estate Board beginning in On July 26, 1995, Governor George E. Pataki signed a new law that established the New York State Board of Real Estate within the Department of State. The State Real Estate Board consists of fifteen members including: the Secretary of State; the Executive Director of the Consumer Protection Board; and thirteen appointed members. The Real Estate Board provides needed consumer and industry input within the regulatory process for licensed real estate brokers and agents in New York State. Additionally, the Board is authorized to prescribe the content of courses of study for the examination and education of real estate brokers and salespersons. Mottola's depth of industry knowledge comes from his 40 years of experience with residential real estate, 33 of which are affiliated with the Long Island Board of Realtors and the Multiple Listing Service of Long Island. Joe's qualities and capabilities are known industry-wide. LIBOR President-elect, Buddy W. Hoosein says, Joe's qualities and capabilities are known industry wide. His abilities are recognized at both NYSAR and NAR and he will be an asset to the Real Estate Board. Joe is very pleased to have this opportunity. 3 LIBOR General Membership Meeting Scheduled for Tuesday, October 21st By Tricia Chirco Marketing & Communication Director The Long Island Board of Realtors, Inc. (LIBOR) will hold its General Membership meeting on Tuesday, October 21st at the Huntington Hilton on Broadhollow Road (Rt 110) in Melville. All Realtor members who are present and in good standing may vote at this meeting. Polls open at 9:00 a.m. and close promptly at 2:00 p.m. Realtor By Tricia Chirco Marketing & Communication Director The Realtors Against Hunger (RAH) Campaign, whose objective was to help fill the sparse food pantry shelves across Long Island during difficult economic times by supporting several Long Island hunger relief organizations, was a huge success in so many ways I can t even count them all. Over seventy real estate offices, which consisted of hundreds of individual Realtors, participated in the food drive this summer resulting in a significant amount of non-perishable being collected, most of which have been picked up already and delivered to needy local food banks and food pantries across Long Island. The RAH campaign ran from August 1st through August 15th, although several offices voluntarily extended the drive through the entire month of August. The LIBOR Public Relations Committee launched the RAH campaign bringing awareness to the hunger problem that stretches across Long Island, during the July 31st Long Island Ducks Game. The RAH campaign falls under the umbrella of the We re More Than Realtors initiative that began in Realtor volunteers, together with staff from Long Island members can also vote in two additional locations including the Realtor Service Center in Jackson Heights and the Realtor Service Center in Riverhead. Directions to both these locations are available on the REALTORS ONLY website at mlsli.com. The LIBOR Nominating Committee, chaired by LIBOR s immediate Past President Linda Bonarelli, met on Monday, September 8th in West Babylon. At the meetings conclusion, the following report Cares Harry Chapin Food Bank and the Long Island Ducks organization, promoted the campaign that night and collected food items in the RAH receptacles from game attendees as they entered the stadium. Additionally, volunteers distributed handouts that provided people with a list of RAH participating offices and information on how they could help fight hunger. The RAH campaign provided numerous outreach opportunities for Long Island Realtors. Through the publicized food drive, Realtors were able to develop stronger ties within their own communities by promoting a was given: President-elect, Michael Mendicino, Queens Vice President, Moses Seuram, Nassau Vice President, Donald Scanlon, Suffolk Vice President, Mary Alice Ruppert, Treasurer, Gilbert Picard and Secretary, Mathew Horn. On a broader scale, LIBOR was able to develop greater affiliate relationships with organizations such as Long Island Harvest, Long Island Cares, the Queens Interfaith Network, and the Long Island Council of Churches, which helps to increase the perception of the real estate community as a whole, as we align ourselves with groups such as these. Perhaps the most important date in the lives as New York State Real Estate professionals is 8/8/08. It is on this date that Governor David Paterson signed the Commission Escrow Act into law. The Senate passed the bill unanimously 3/31/08 and The State Assembly passed the bill on 6/24/08 by an overwhelming majority 112 to 7. The impact of the law is very profound. It not only affects every real estate practitioner in New York, but potentially will impact 1.4 million Realtors in the country. Before I give an overview of the law, a historical perspective is called for and should be enlightening to every Realtor in New York State. In 1983, we thought of protecting the right earned commission of our brokers and agents through an instrument called the Lien Law. It took 10 years to recognize the negative impact that a lien would have on the general public. From that point on, we pursued the protection of our earned income through enforcement of the Listing Contract. For the past eleven years numerous Realtor volunteers lobbied the NY State Senate and Assembly. Numerous trips to Albany were made by an army of tireless In the aftermath of the earthquake that hit Sichuan Province, a mountainous region in Western China, the Long Island Board of Realtors announced that it has made a $5,000 donation to the Embassy of the People s Republic of China to assist in the ongoing recovery and rebuilding efforts in the region. The quake which registered more than 7.9 on the Richter scale is responsible for the deaths of nearly 70,000 people and the destruction of thousands of homes, as well as, numerous businesses and schools. As they have previously done in response to other national disasters and crises such as the September 11, 2001 terrorist attacks on the United States, the Southeast Asia 8/8/08 Governor David Paterson signed the Commission Escrow Act into law. volunteer brokers and agents. Many calls for action were instituted and responded to in order to reach out to our political representatives. I d like to extend a special thanks to the Legislative Committee Chairs and all the committee members who have been so deeply involved in the passing of the bill. The effective date of the law is January 1, Pursuant to a written or oral contract, a real estate broker may file an affidavit of entitlement to commission for completed brokerage services in the office of the recording officer of any county in which any of the real property is situated. Within five business days after filing the affidavit of entitlement, the broker shall serve a copy of such affidavit upon the seller by registered or certified mail to the address set forth in the written contract of brokerage employment. If the seller is represented by an attorney, the broker shall provide a copy of the affidavit of entitlement to the seller s attorney via mail, facsimile, e- mail or personal delivery within five business days of the filing. At the time of closing, the seller is required to either pay the agreed upon commission or deposit the broker s commission with the county clerk where the property is located. Together we have achieved yet another goal for which we have all fought since Congratulations to each and every person who was instrumental. You are all fantastic. Additionally, thanks to those people in each office that took the time to collect, and or purchase, the items that filled every bin to capacity and in many cases went way beyond the receptacles capacity and spilled over into the office space. You are all exceptional. Tsunami, the Earthquake in Pakistan, and Hurricane Katrina, Long Island Realtors are again asking What can we do? According to Joseph E. Mottola, Chief Executive Officer of LIBOR, The donation from the Long Island Board of Realtors will go toward rebuilding the areas devastated by the earthquake in the Sichuan Province of China through a Disaster Relief Account in China which has been established to oversee the receipt and distribution of donations that continue to pour in from the international business community, world governments and concerned individuals who understand the plight of those in need still living in the areas hit hard by the earthquake in May. 6 THE REALTOR September LIBOR NEWS We realize that the media seems to be more attuned to negative news than positive news and buyers and sellers are constantly exposed to a flow of statistics and data from a variety of sources. Realtors become aware of it when they notice it themselves, or when one of their customers or clients mention an article or statistic they saw. The role of the Realtor has gradually moved from the Provider of the information to the Interpreter. What Realtors have at their fingertips is timely, accurate and accessible data that the general public does not have. The intelligent use of the available data better enables Realtors representing or working with buyers, to better counsel them on making offers. Conversely, sellers representatives have the ability to better counsel their clients on pricing strategy relative to the current market. So where s the data? On the Realtors Only website! Go to the left hand side and click on Research and Data. What you ll find there are Monthly Activity Reports going back for a year which break down market data by Zone and County. That market data includes the value of the unsold inventory by average price and median price. If you look year to year, it s apparent that asking prices are dropping. It reports how close the closing prices were to the original listing price and the last posted asking price by Zone and County. You can track contract activity and show that sales are increasing in various markets, which means that pricing will eventually be affected as well. For more detailed data, we have the NAR Economic Watch Report for Queens, Nassau and Suffolk Counties broken down by zip code showing pricing changes year to year and changes in the units sold. This report is updated quarterly. There are also a number of surveys on Member Profiles; Buyer and Seller Profiles; Realtor Technology Surveys; Firm Profiles Baby Boomers Profiles; and Consumer and Realtor Expectations and Perceptions. The last one lays out some interesting discrepancies on what Realtors believe their customers and clients think and what the customer and clients actually think! The real estate professional has tools and data not available to the public and the media. That information is very valuable in correcting erroneous impressions; off setting wild guesses and reaffirming and validating that the Realtor is the best and most accurate source for market information which enable Realtors to better serve the buying and selling public. Governor Signs CEA Act Into Law (Continued from page 1) Escrow Act Committee Vice Chair Lou Gutin, who singlehandedly brought life back into this legislation which was all but dead just a few years ago. Carol and Lou contributed much to this legislative victory. For years they constantly tried to improve upon the legislation so that our chances of victory were increased. These two individuals never stopped thinking about the Commission Escrow Act during this entire process and we thank them from the bottom of our hearts! In 2006 the Commission Escrow Act passed both the Assembly and Senate. Unfortunately, then-governor George Pataki vetoed the bi-partisan legislation when it reached his desk. After careful review of Governor Pataki s veto memo, NYSAR s Duncan MacKenzie and Mike Kelly worked to get a subsequent bill introduced during the legislative session. This legislation was the product of negotiations between several interested organizations including the New York Department of State, the State Consumer Protection Board and was designed to balance the concerns of all parties involved in broker-assisted residential real estate transactions. His Board experience also includes many years involvement at the Chapter level, and he has also served on the Education, In addition, following Gov. Pataki s veto in 2006, NYSAR commissioned an independent survey, which found that 28 percent of those questioned had lost an earned sales commission in the last 24 months and 36 percent reported having lost a commission since entering the industry. These numbers clearly demonstrated that the current law was inadequate and did not serve as a deterrent to illegal non-payment of a commission. The overwhelming figures from the lost commission survey provided a strong foundation for justifying the need for this bill. NYSAR s Legal Counsel Anthony Gatto will present webinars in September explaining how the new law affects REAL- TORS in New York State. During the webinars, Gatto will cover: the proper procedures to comply with the law; how to avoid potential issues; and what liability a REAL- TOR may face if they fail to comply with the law. By the end of the webinars, attendees will have a basic understanding of the law and be aware of their rights and liabilities. Gatto will also conduct a brief Q&A session at the conclusion of the webinars. LIBOR will be instituting seminars and such to educate our members as well. Stay tuned for more details. Legislative, Professional Standards, and Public Relations Committees. In 2006, Buddy acquired the CBR, ABR and SRES Realtor designations. Buddy has been publicly recognized for his community service and has been awarded citations from the NYS 31st Assembly District, NY City Council, and the NYS Assembly District 58 Brooklyn. On July 30, 2008, President Bush signed into law a comprehensive housing bill that aims to improve the struggling housing market and strengthen mortgage finance giants Fannie Mae and Freddie Mac. H.R the Housing and Economic Recovery Act of 2008, which was previously passed by the House on July, 23, 2008 by a vote of , and the Senate on July 26, 2008 by a vote of 72-13, contains a number of victories for REALTORS and American homeowners including GSE reform, FHA reform, permanent loan limit increases, and a $7500 homeowner tax credit. There are many components of the housing bill that will help stimulate the housing market. The following is a list of several of the major provisions that the housing bill provides: GSE Reform including a strong independent regulator, and permanent conforming loan limits up to the greater of $417,000 or 115% local area median home price, capped at $625,500. The effective date for reforms is immediate upon enactment, but the loan limits will not go into effect until the expiration of the Economic Stimulus limits (December 31, 2008). The Roundtable Presentation hosted by the WCR and LIBOR's Nassau North Shore Chapter on September 5th at the Delano Mansion in Woodbury, was well received and well attended. FHA Reform including permanent FHA loan limits at the greater of $271,050 or 115% of local area median home price, capped at $625,500; streamlined processing for FHA condos; reforms to the HECM program, and reforms to the FHA manufactured housing program. The effective date for reforms is immediate upon enactment, but the loan limits will not go into effect until the expiration of the Economic Stimulus limits (December 31, 2008). Homebuyer Tax Credit a $7500 tax credit that would be would be available for any qualified purchase between April 8, 2008 and June 30, The credit is repayable over 15 years (making it, in effect, an interest free loan). FHAforeclosure rescue development of a refinance program for homebuyers with problematic sub-prime loans. Lenders would write down qualified mortgages to 85% of the current appraised value and qualified borrowers would get a new FHA 30-year fixed mortgage at 90% of appraised value. Borrowers would have to share 50% of all future appreciation with FHA. The loan limit for this program is $550,440 nationwide. CERTIFICATION BY REALTOR Designated REALTOR Members of the Board shall certify to the Board during the last quarter of the fiscal membership year, or as otherwise established by the Board of Directors on a form provided by the Board, a complete listing of all individuals licensed or certified with the Realtor s firm(s) within the state, and shall designate a primary Board for each individual. 14 THE REALTOR September MLS NEWS MLS INFO LINE By Barbara Ford, MLS President Subtle Signs That The Bottom May Have Been Reached THE MULTIPLE LISTING SERVICE OF LONG ISLAND, INC. There have been some stirrings in the marketplace that may be a sign of things to come. Although as of the writing of this article, I have not yet received the statistics for August, the information for July had some bright spots. The number of sales in contract in July, 2692, indicated that for the third straight month the number of contracts exceeded The median price for all closings in July was $421, against $415, for June and against $455, for July The number of closings for July, 2466 represented a ten percent increase over June s figure of Although the July 2008 figure is down from July 2007, the numbers show that we have been maintaining a normal seasonal trend pattern over the last several months, with more closings occurring each month. This is of course, a good sign. Although the numbers may be down, traditional patterns are still in place. Nationwide, the number of mortgage applications are up, and pricing is inching upward to the surprise of many pundits. These aren t big changes, but they do indicate small but positive steps in the right direction. In our own backyard, our members are successfully adjusting to some of the challenges we have been facing in recent months, such as dealing with short sales and REO properties. Consumer interest in and activity at the MLSLI consumer site remains strong, indicating a public that remains interested in our market. Yes, there are large numbers of consumers who are holding back, waiting for the bottom of the market, to make their move. However, when that threshold is actually reached, there will be no fireworks, no celebrations in the street, no first hand witness, and no news bulletins on the major networks, because no one will realize it has occurred until the upward climb has already begun. Perhaps in these slow yet steady trends, we are seeing the first subtle signs of the rising from the bottom, by these small yet discernable steps in the right direction. MLS Q&A Q. I have tried to find out the status on several listings and have been told by the receptionist in the listing office that I must wait for the Listing Agent for that information. Is it okay for them to do this? A. No. According to the published MLS Board of Directors interpretations: At all times someone must have current information on each listing so as to be able to accurately advise agents of the status of the listing. (The interpretations can be found in the back of the MLS Rules book.) Multiple Listing Rules (Rule 302; To be most effective, you'll want the map to open to your exact area. Normally it opens to your OFFICE location, but you may want to adjust this. For instructions on how to use the Stratus MAPS feature, visit the Stratus Info Center ; 703) require that the listing office must provide information and access to Cooperating Brokers at all times. The above policy therefore requires that information with respect to the exact status of each property be available at the office so that Cooperating Brokers can be given full accurate and complete information when they call whether or not the listing agent is then and there available. Note: An MLS Rules Book and FAQ can also be printed from Stratus Info Center. It can be found near the right of the page, under Info Center Options. Since the new Sold Property Data feature on MLSLI.com launched in early July, the section has received an average of 35,000 visits to that section each month. The weather improved as the night progressed and all were treated to Marilyn Urso, EcoBroker gave a presentation to the Passaic County Board of Realtors at their Quarterly Meeting held at the Brownstone House in Patterson on June 26th. Marilyn is among the first EcoBrokers here on Long Island and is the process of becoming certified EcoBroker Instructor for the company. LIBOR/MLS Staff Council The Commission Escrow Act Requires a Change to the Listing Agreement and Broker Compliance By now I am sure you have heard the exciting news that Gov. David Paterson has signed into law the Commission Escrow Act. The law is a giant step toward protecting brokerage commissions. Under the Commission Escrow Act, if the seller does not pay the broker the full commission at the time of closing, the owner must deposit in escrow with the county clerk a sum of money equal to the amount of the broker s unpaid commission or, if there is insufficient money from the closing proceeds, the balance of all monies after the payment of closing expenses. Therefore, brokers should be aware of how to conduct their business in a way which would allow them to receive the benefits of this law when it takes effect on January 1, In order to take advantage of this law, brokers must strictly comply with certain requirements. One such requirement necessitates a change to the listing agreement. However, there are certain legal issues which must be resolved before the listing agreement can be revised. MLS is hoping to have the new listing agreement available by the end of this year. As soon as it becomes available, MLS will notify the brokers. The revised listing agreement will satisfy that part of the law which requires that the listing agreement contain in clear and conspicuous bold face type the following language: AT THE TIME OF CLOSING, YOU MAY BE REQUIRED TO DEPOSIT THE BROKER S COMMISSION WITH THE COUNTY CLERK IN THE EVENT THAT YOU DO NOT PAY THE BROKER HIS OR HER COM- MISSION AS SET FORTH HEREIN. YOUR OBLIGATION TO DEPOSIT THE BROKER S COMMISSION WITH THE COUNTY CLERK MAY BE WAIVED BY THE BROKER. A broker should not waive his or her rights under this law without careful consideration. It is also important to mention that this law will apply only to listings taken after January 1, This law does not apply to any listing agreement entered into prior to the effective date of the law. This means that if a listing agreement was taken prior to January 1, 2009, a broker may not renegotiate that listing agreement to include the required language for the purpose of subjecting the seller to the provisions of the law. The Department of State has indicated that any broker who tries to apply this law to a listing entered into prior to January 1, 2009 may be subject to disciplinary action. Furthermore, there are additional requirements that brokers must comply with to protect their commission pursuant to the new law. These additional requirements are as follows: The listing agreement, whether an exclusive or an open listing, must be in writing and signed by the owner. Brokers who enter into oral agreements with their clients cannot qualify for escrow protection. The listing agreement should clearly state the address of the owner. The address for the property to be sold should be set forth separately even if that address is the same address as the owner s address. It is important that the address at which the owner resides is clearly identifiable simply by looking at the listing agreement. If the commission is renegotiated after the listing has been signed, it is recommended that a new listing be entered into with the owner identical in every way to the original listing except for the renegotiated commission. The Act does not provide for modification of commissions by commission agreements. In order to make sure you fully comply, it is thus recommended you modify commission arrangements by the execution of a new amended listing contract. The broker must file an Affidavit of Entitlement for Commission. Annexed to this Affidavit must be a copy of the written listing agreement. The form for such an Affidavit is presently on the Realtors Only section of MLSLI.com, under the legal section of Documents on Demand. It is suggested that you obtain a copy of that form and review it carefully. If you have any questions about how to fill out the form, contact the Legal Helpline for assistance. The Affidavit of Entitlement must be filed in the Office of the County Clerk, except in the City of New York where it is filed in the Office of the County Registrar. This Affidavit must be filed after the contract is signed and before the closing. Within 5 business days after filing the Affidavit of Entitlement, you must serve a copy of that document on the owner by registered or certified mail, return receipt requested, or by personal delivery. The service must be made to the owner s address set forth in the written listing. If the closing will occur in 5 business days or less from the filing of the Affidavit, then service must be made by personal delivery. Along with the Affidavit of (Continued on page 19) New Law Bans Sex Offenders From Holding A Real Estate License U p until recently, a person with any conviction of any type of misdemeanor, including sexrelated offenses, could obtain or hold a real estate license. However, the loophole with the old law has finally been closed. State Senator Charles J. Fuschillo, Jr. and the Long Island Board of Realtors (LIBOR) recently announced a new law that prohibits all convicted sex offenders from obtaining, or holding a real estate license in New York State. The legislation, which was just signed into law by Governor Paterson, will help prevent dangerous sex offenders from gaining access to the homes of New York families. In the past, the loophole allowed many sex offenders initially charged with felonies to plead their cases down to misdemeanors and still lawfully keep, or obtain their license. Senator Fuschillo (8th District), Chairman of the Consumer Protection Committee, who sponsored the bill is quoted as saying, No one I know would want to give a registered sex offender the key to their house. Before this law went into effect, convicted sex offenders could hold real estate licenses and gain access to the homes of numerous New Yorkers who had LIBOR is currently working to increase public voter registration throughout Nassau, Suffolk and Queens. Realtors across Long Island are being encouraged to vote and to register their friends, families, neighbors, customers, open house attendees and most of all members of the general public. The LIBOR Voter Registration Drive includes the following: distributing the actual voter registration forms to all of our members, hosting a Voter Registration Drive in each County, and distributing posters and literature to each of the 2,700 LIBOR offices throughout Nassau, Suffolk and Queens. Voter registration forms are also being made available to Realtors online by visiting the legislative section of the REALTORS ONLY website at: LIBOR will also be promoting its Register to Vote program to all legislators and the media within the tri-county region. This is a critical election year and the economy, especially its impact on property values along with the recent mortgage crisis has been having a major impact on the real estate industry throughout the country. This Voter Registration Drive is aimed at having our voices heard on a local, state and national level. There are so many their houses on the market. This new law is just a commonsense measure that adds another layer of protection for residents of New York State. The new law (S. 1531, Chapter 430) is already in effect. Previously, while the state prohibited people convicted of a felony, including felony sex crimes, from being licensed as a real estate broker or salesman, those convicted of misdemeanor sex offenses were not automatically prohibited from obtaining or holding a realtor s license. The new law makes it illegal for a convicted misdemeanor sex offender to acquire or hold a license to sell real estate. Under the state penal law, misdemeanor level sex offenses include sexual misconduct, sexual abuse in the second degree, forcible touching, unlawful imprisonment in the second degree, and hate crimes. The new law also requires persons who already hold a real estate license in New York State to report any felony or misdemeanor sexual convictions within five days of conviction. Previously, licensed real estate agents were not required to report if they were convicted of a sex crime until the next time they sought to renew their real estate license, which occurs every two years. 19 PROFESSIONAL STANDARDS ETHICS...THIS MONTH S TOPICS The Ethics case published in this issue have been chosen by the 2008 Chairperson of the Professional Standards Committee, Tony Smith. Case #15-1: Knowing or Reckless False Statements About Competitors REALTOR A operated a residential brokerage firm in a highly competitive market area. He frequently used information from the MLS as the basis for comparative ads and to keep close track of his listing and sales activity as well as his competition. One day, while reviewing MLS data and comparing it to a competitor s ad; REAL- TOR A noticed that REALTOR Z had used a diagram to demonstrate his market share, contrasting it with those of several other firms. The ad showed that REAL- TOR A had listed 10% of the properties in the MLS over the past three months. REALTOR A thought this was low. His analysis of MLS data showed his market share was 11%. REALTOR Afiled an ethics complaint against REALTOR Z citing Article 15 of the Code of Ethics in that REALTOR Z s obviously understated market share claim was a misleading statement about competitors, REALTOR A s complaint was considered by the Grievance Committee which determined that an Ethics hearing should be held. At the hearing, REALTOR Z testified he had always been truthful in his advertising and that all claims were based in fact. He produced an affidavit from the Board s MLS administrator which indicated that a programming error had resulted in miscalculations and, after careful recomputation, REALTOR A s market share over the past three months had been 10.9%. The administrator s statement noted that this was the first time that information related to REALTOR A s listing or sales had been misstated on the system. I relied on information from the MLS. It s always been accurate and I had no reason to even suspect it was wrong last month, said REALTOR Z in his defense. The Hearing Panel agreed with REAL- TOR Z s logic, noting that a REAL- TOR should be able to rely on generally accurate information from reliable sources. They reasoned that if, on the other hand, the MLS had shown REALTOR A having, for example, 1% of the market, then REALTOR Z s reliance on the information would have been reckless because REALTOR A had generally had a 10-15% market share and a reasonable conclusion would have been that the information from the MLS was seriously flawed. The Hearing Panel concluded that REAL- TOR Z s comparison with his competitors, while slightly inaccurate, was based on usually accurate and reliable information and had been made in good faith and while technically misleading, had not been knowing or reckless. REALTOR Z was found not to have violated Article 15. The Commission Escrow Act (Continued from page 18) Entitlement, you must mail or deliver to the seller a check in the amount of $25.00 payable to the clerk of the county in which the property is located (Nassau County or Suffolk County) or, if in the City of New York it must be payable to the Department of Finance of the City of New York (Kings County or Queens County). The seller is to return this check to you at the time when you are paid at closing. Make sure your file contains both a copy of the Affidavit of Entitlement and the check that you mailed to the owner, and also make sure you have a record of the date you mailed the documents and the address to which it was mailed. Photocopying the fully addressed envelope with the postage affixed to keep for your file is probably a good idea. If the seller is represented by an attorney, and you have been given contact information for that attorney prior to the time that you file the Affidavit of Entitlement, you must also send a copy of the Affidavit to the attorney. This can be done by ordinary mail, fax, e- mail attachment, or by personal delivery. This also must be done within 5 days after the filing of the Affidavit of Entitlement. If the seller has deposited monies pursuant to the law with the county clerk or registrar, the broker must commence their action or proceeding within 60 days from the time of the posting of that money by the seller in order to ensure that the money remains in escrow. If the broker fails to commence such action or proceeding within 60 days, the owner can make an application to have the money released to them. This means that the court would give the money back to the seller to hold until the dispute is resolved, instead of keeping the money in escrow. This, in effect, would nullify the benefits of the Act because the money will no longer be safeguarded in escrow. It is important to note that this provision is not a statute of limitations time period within which the broker must commence its lawsuit against the seller for the broker commission (see next bullet point). The provision simply puts the onus on the broker to file suit within 60 days if the broker wants to make sure the money remains in escrow. Where the owner has deposited monies pursuant to this law with the county clerk or registrar, the Statute of Limitations within which the broker may bring an action or proceeding for its brokerage commission is reduced to 6 months. If the broker does not commence such proceedings within 6 months, the broker shall not be able to collect said monies. Indeed, the commission is, at that point, most likely lost. If the seller fails to make the deposit required by law, a successful broker is entitled to judgment not only for its commission, but for all costs, including reasonable attorneys fees. This law affects only residential transactions (1-4 family dwellings and individual coops and condos). The Commission Escrow Act will be a topic of discussion at NYSAR s legal meeting this month.
