LIBOR and MLSLI Hosted Annual Installation Gala on November 27th 2013 Leadership Gets Installed and Recognition Awards Presented By Tricia Chirco Marketing & Communication Director On Tuesday, November 27th, the Crest Hollow Country Club hosted the annual LIBOR/MLSLI Installation Gala and Dinner Dance. This event serves as the forum for installing newly elected LIBOR and MLS leadership, as well as announcing several of the Realtor Recognition Awards. Joseph E. Mottola, Chief Executive Officer for LIBOR and MLSLI, assumed the role as Master of Ceremonies for the evening, a role that he has enjoyed for many years. He opened the ceremony with a patriotic video presentation of Stripes performed by Nathan Osmond. Cathy Nolan, a Past President of both LIBOR and MLSLI, and current Board Counsel, did the honor of installing incoming 2013 LIBOR and MLSLI elected officers. Incoming 2013 LIBOR Officers installed included: Bettie Meinel, President-elect, Susan Helsinger, Nassau Vice President, David Legaz, Queens Vice President, Dianne Scalza, Suffolk Vice President, Mary Alice Ruppert, Treasurer, and Laura Copersino, Secretary. The 2013 MLSLI Officers installed were: Frank Paruolo, Suffolk Vice President, Anthony Atkinson, Nassau Vice President, John Rodriguez, Queens Vice President, Barbara Ford, Treasurer, and David Lucas, Secretary. All were on hand to take the oath of office and accept the responsibility that comes with serving in these positions. Immediately following the installation of the incoming officers, 2013 MLSLI President, Kevin Leatherman was installed into office by Michael Zapson, the Democratic Chairman of the City of Long Beach MLSLI President, Linda Bonarelli Lugo, and Kevin s partner Dennis Law, looked on as Kevin was sworn in and then gave his brief remarks afterward. Kevin s business background is extensive. He has been a licensed real estate Broker for nearly 20 years and is the Broker/Owner of Coldwell Banker Surf in Rockville Centre. He has called Long Island his home for more than forty years, and currently resides in Rockville Centre, New York. Kevin has served on the MLSLI Executive committee since He has served in the capacity of Secretary, Treasurer, and most recently, Vice President of Nassau. He has also served as a NYSAR Director since 2009 and has served on many committees and task forces that include, but are not limited to: Advertising, Budget & Finance, Bylaws, and Technology. His focus is, and will continue to be, fostering cooperation and professionalism amongst real estate agents. He is an advocate for respect amongst Realtors and is an enthusiast for equal rights for all human beings. Kevin is all about client service and communication. He is recognized as a progressive broker and has long championed the agent s role as a buyer broker. Amongst his many achievements, Kevin holds a Bachelor degree from Hofstra University in Business Administration and Banking and Finance. He has been ranked within the Top 3 of Nassau Realtors in closed units, and currently holds the ABR Pictured at the Annual Gala are (l-r) the newly installed 2013 MLSLI President Kevin Leatherman and 2013 LIBOR President Moses Seuram. and SFR NAR designations. Kevin was also named one of this year s recipients of the distinguished Tasso Award which goes to an outstanding MLSLI Director LIBOR President, Moses Seuram was then installed into office by Marian Fraker-Gutin, who served as 2005 and 1994 LIBOR President and served as the 1993 MLS President. Marian was representing her late husband Lou Gutin, who Moses regarded as a cherished mentor. Onlookers to Moses installation included his wonderful family: his wife Wendy, daughter Savannah, and son Ethan. Moses will succeed current LIBOR President Don Scanlon. Here is some background on the new Board President. Moses Seuram, who was born in Guyana, South America, and currently resides in Queens, began his real estate career in He currently works as an Associate Broker at Keystone Realty USA in Flushing, New York. Moses joined the Long Island Board of Realtors in 2001 and has actively served the Board ever since. He has chaired and served many committees at the local, State, and National level. He has served on the LIBOR Executive Committee for the past five years. He has served two terms as Queens Vice President, two terms as LIBOR Treasurer, and currently as President-elect. Moses is also the current Treasurer of the Long Island Realtors Federal Credit Union. He has a strong belief in education, knowledge and integrity. Moses holds the following real estate designation and certifications: ABR, CBR, SRES, Green, AHWD and AFR. He is proud to say that he was amongst the members of the first graduating class of the NEW York State Association of Realtors Leadership Academy that began in In 2010, Moses was named Realtor Salesperson of the Year by the Long Island Board of Realtors. He has always been involved in community service and is always volunteering to help with any of the Board sponsored outreach events. He has been a recipient of the Realtor Spirit Award and has been recognized in this community as a Man of Distinction by the Council of the City of New York for his humanitarian services. Next, Peter Caruso was called to the podium and presented the prestigious 2012 Realtor -Broker of the Year award. Peter was the recipient of the 2010 Realtor - Broker of the Year Buddy Hoosein Award and after reading an extensive and impressive list of achievements for this year s recipient, he called Buddy Hoosein (Continued on page 6)

REALTOR RELIEF EFFORTS Visit LIRealtor.com/Sandy By Tricia Chirco Marketing & Communication Director In the days right after the super storm hit the Long Island Board of REALTORS (LIBOR) was on the phone with NYSAR, who was conferencing with NAR, New Jersey and the Connecticut Boards, coordinating realtor relief efforts for our area. The NAR Realtor Relief Foundation got activated immediately and a call out for donations was placed on realtor.org. As the information became available to us, we sent it out to the field using all our communication venues including , lirealtor.com, facebook, twitter, text messaging, and phone messaging. For communication purposes with the filed we immediately set up a separate webpage for storm support information- LIRealtor.com/Sandy. This is the website where members can find all kinds of relief information, both personal and business related. We expect this site to be updated frequently over the coming weeks so please check back frequently. Immediate relief is now available to Realtor members in our area affected by the storm through the Realtor Relief Foundation. Through NAR s Realtor Relief Foundation, members displaced from their home during the storm can apply to receive up to $1500 in assistance to help with your housing costs. For those members that own their home, and do not have a mortgage, you would be eligible to receive the grant money for the DEDUCTABLE on your home owners insurance. You can download the short application on lirealtor.com/sandy and if you are not sure if you qualify for this grant, you are still encouraged to submit an application. The New York State Association of Realtors has been very supportive over the past month. NYSAR staff made a trip to our office in a van loaded with food items, cleaning supplies, and warm blankets, within a week of the storm wreaking its destruction across Long Island. Those goods got immediately distributed to a few local shelters who have made good use of them. In the days following the storm, LIBOR was activated under the SEMO program. SEMO is the State Emergency Management Office that Realtor volunteers work with in the event of an emergency that would cause people to need temporary housing. We have had a team in place since 9/11 of around two dozen realtor volunteers, that in short notice, are tasked with putting together lists of any available rentals, apartments or houses, as well as commercial space that could be converted to housing units. Available listing information is then collected from the volunteers and sent to the State. There is still a great need for available temporary housing opportunities and if you have listings to share with SEMO, please forward them to me directly via fax at In the past month there have also been an impressive long list of individual relief efforts on behalf of our members that have been brought to our attention, and whenever possible, LIBOR has supported those efforts, and will continue to do so over the coming days. The individual efforts represented all kinds of support. We have members involved in Pet Rescue efforts, members that are routinely visiting the hardest hit areas of Long Island and delivering hot food and supplies, and then we have members who are simply rallying the people in their town by pushing out resource information and positive messaging about recovering and rebuilding. All of this is equally important to our recovery. All of these initial efforts fall under Phase 1, where the main focus was on individual support. Now we are entering Phase 2, where our efforts include our commitment to your business recovery. We are in the process of collecting information and setting up resources that will help you with your business needs, We expect to have information on regarding FEMA and the SBA loan programs in early December. Additionally, the Long Island Realtor Federal Credit Union is offering for a limited time, some very affordable home improvement and auto loans so you should check that out as well. Keep checking the website for updates and all new updates will be communicated to our members through our traditional communications means including: facebook, lirealtor.com, text alerts, , the Realtor paper, etc. Phase 2 of the Realtor recovery will include community Outreach programs for our members. LIBOR believes it is important to have a presence in the areas most affected by the storm so you know that LIBOR is committed to helping you get back to business as soon as possible. On Tuesday, December 4th we plan to be in Long Beach to distribute materials to our members in need, and based upon the turn out and feedback, we will these program in other areas too. Last but not least LIBOR will be teaming up with volunteers from NYSAR in January and will take on a hands on rebuilding project with Rebuilding Together Long Island. (RTLI) We have hosted several work days with this great organization over the years and when we have a firm date and location in place, we will communicate that to the field and solicit volunteers. Insurance Plus Insurance for the Small Business & the Self-Employed PRESIDENT S MESSAGE By Don Scanlon, LIBOR President A Glance Back at the Last 12 Months How quickly 2012 has gone by, as LIBOR finished year 2 of its second 100 years. As your President, I was fortunate to have a group of Realtors who served on the Executive Committee, Board of Directors, and various committees as members, who, along with an extremely competent staff, helped me protect and support the interests of the members of our organization. As of this writing, we have seen 10 consecutive months of increased transactions over last year. Why? There is a direct relation to this and our organization. Together, we were involved with many areas of service that assist our membership and our communities. I mentioned them at the General Membership meeting in October but feel a need to share with you now as I close out my year as your President. Legislatively, we continued to focus on Co-op legislation as we all need a greater level of transparency in the process. Although faced with roadblocks to positive legislation, we continue to remain persistent and will succeed. In addition, our government affairs department continued monitoring any legislation that could adversely affect our member s ability to conduct business, and was able to work with local officials to have them modify their codes that resulted in less risk to our members. Our RPAC participation increased by more than 1000 additional investors that helped our voice be heard! There are serious Realtor issues that are on the horizon and will surface even more in 2013; issues that will have a dramatic negative impact on our business. We must be diligent, informed and aware of what is being proposed and be prepared to act as a strong Realtor community. In the area of Public Relations, we continued to be More than Realtors, through both the work of our local chapters, and at the board level. St. Mary s Children s Hospital, The Boy Scout and Girl Scouts, Habitat for Humanity, LI Cares and Island Harvest through our Realtors Against Hunger program, our newly created Realtors Veteran Scholarship program, and most recently our Realtor Relief Efforts for the victims of Sandy will be forever remembered by those who benefited from our efforts. In Education, we have continued to step up the programs and courses that will help our members. Additional Short Sales, Senior Citizen, REO, Vacation Home, and Designation courses were added to our growing array of classes offered. We also expanded our offerings further east to even better accommodate our members in the Hamptons and North Fork. As Technology continues to evolve and further impact our business, communication to our membership has had to change. No longer is it just this publication that communicates with you, E- mails, texts, Facebook, Twitter, and Social media have become a daily part of our communication efforts. In addition LIBOR has created, modified, and increased the amount of course offerings to our membership to assist them in their communication and marketing efforts. As I mentioned in the beginning, I was very fortunate to have the support of an extremely competent LIBOR staff, along with an Executive Committee, Board of Directors and committee members all who are VOLUNTEERS that assisted me. Any attempt to name them all would be futile. I hope you will look at 2013 as your year to get involved with us either through committee involvement, or at a local chapter or any of our divisions. Your 2013 leadership team is a superb group of Realtors, but they cannot do it all for you without you. 4 THE REALTOR December LIBOR NEWS The Voice for Real Estate Since 1910 FROM WHERE I SIT By Joseph E. Mottola, Chief Executive Officer SANDY...the Aftermath...review, reflection and recovery. Everyone has a story, a highly personal experience ranging from the firsthand to a family or friend. There is a tendency to second guess ourselves over the decisions we made to prepare for the storm and how we dealt with the reality. Hindsight is always 20/20 but also the reality is that most people did the best they could with the information they had at the time. At the Board and MLS, our initial concerns were Realtor safety, staff safety, our facilities and our services. We cancelled classes so as not to put Realtors on the road as conditions threatened to get worse. For the same reason, we had some staff operate from home and ultimately closed our four offices because we didn t want anyone more exposed to the dangerous conditions than necessary. We took down the Stratus system and actually covered equipment with tarps in the event we had windows blow in. Could the system have stayed up? Yes, but if there were issues that caused it to crash, it would have taken us longer to get back in business than it would with a phased shut down and orderly re-energizing the system. With almost 90% of Realtors without power, system usage would have been minimal in any event. We brought up the system first and then staff came in and began providing normal services to an abnormal marketplace. First and foremost we gathered information that would be helpful to Realtors in personal distress and prepared for the distribution of that information in as many ways as possible and as fast as possible. If Realtors are anything, they are resilient. We were the first Board to provide the information and the applications for Realtors to apply for money from the NAR Realtor Relief Fund as we worked closely with NYSAR staff. We continue to look for ways to ease the transition for those whose businesses were severely damaged and get them back to where they can resume an operational status. The market will provide a range of challenges to our members. Inventory has been reduced; properties which were on the market but sustained some damage will have to be repaired before they can be effectively marketed and closings are being delayed as properties have to be re-inspected. Homes and apartments have to found for those who find themselves without housing. We are in touch with County and Town governments about relaxing restrictions on rentals and the permitting process to expedite finding adequate shelter for those in need. We continue to keep you up to date on whatever we discover in our dealings with officials that can be helpful to you. The recovery will come...probably faster than you might think. Based on real estate industry experiences with Katrina and other damaging hurricanes in Florida, markets tend to be very active six months after the event. While we sustained some losses, the bulk of our market was spared the major ravages of the storm. If Realtors are anything, they are resilient. They know housing is a cyclical industry. We are recovering from the market s implosion brought about by the mortgage crisis and we will recover from Sandy as well. In Memory of Two Beloved and Dedicated REALTORS Lee Testa Walter Messina We regret to inform you of the recent passing of two very dear and dedicated members of the LIBOR family, Lee Testa and Walter Messina. Leo (Lee) Testa has had a 43 year career as a professional Realtor, dealing in a variety of areas. In 1973, he opened his own office, Pine Hill Properties Inc, at this time he became involved with LIBOR and MLSLI. In both organizations, he served as a Director, in various officer positions to include the Board Presidency in 1985 and He was very active with its Commercial and Industrial Division and later the LI Commercial Network and was their Member of the Year in Walter Messina was the broker and partner in Glenjay Realty in Forest Hills. He has been a Realtor for over 35 years, and a member of LIBOR since He has served in a multitude of capacities and on numerous committees in his time with LIBOR, MLSLI and on a state and national level. He is a Past President of the MLSLI, Queens Real Estate Board and Western Queens Chapter of LIBOR. Walter, a New York State Certified Appraiser, had been the President of LIBOR s Appraisal Division for the past 9 years. The Long Island Board of Realtors appreciates the many years of service that both Mr. Testa and Mr. Messina dedicated to the industry. They will be greatly missed by the real estate community. Being an avid runner/jogger who has participated in the Long Island Half Marathon, Shelter Island 10K and many other running events, he saw how popular these events were becoming. With this knowledge he proposed and completely organized a fundraising event for the Hampton Bays Lions Club in 2011, called Over the Bridge (Ponquogue Bridge), a 10K Run and 5K Run/Walk along the Ocean and Shinnecock Bay. The first year of the event was a huge success with 400 participants, and earning over $20,000 for the HB Lion s Club. The second year of the event far surpassed that with 550 participants, and over $35,000 earned. With the funds raised in 2011, the Hampton Bays Lions Club was able to supply four seeing eye dogs through the Smithtown Guide Dog Foundation to people in need, as well as make additional donations to the Hampton Bays Library, Churches, Boy and Girl Scouts, Booster club, little league baseball, the Dominican Sisters and local scholarships. The Hampton Bays Lions Club, established in 1948 has continuously helped people in need in the Hampton Bays and East Quogue community. Kaplan Director of Government Affairs The Long Island Board of REALTORS (LIBOR) is working closely with Nassau and Suffolk Counties, as well as the City of New York to try and expedite the process of getting displaced citizens from the storm into available rentals asap. LIBOR has sent a list of all available rentals from the Multiple Listing Service of Long Island, Inc. (MLSLI) to the Nassau and Suffolk County Executives, The Mayor of New York City and the Queens Borough President, all who are working closely with FEMA to try to help as many people as possible. According to LIBOR President Don Scanlon, The REALTOR community is saddened by the widespread devastation from the recent Super Storm Sandy. Our goal is to help find a suitable dwelling for those residents who were displaced. We are maintaining contact with key municipal officials in Nassau, Suffolk and Queens during this crisis. Additionally we conveyed our thoughts to all the Counties and Towns that they should temporarily relax rental restrictions on apartments for displaced people. We requested that the permit fees be dropped for Super Storm Sandy-related repairs. We were assured that these municipalities will do everything in their power to aid in the placement of those who are in dire need of housing. We are seeing cooperation between local governments at an all time high during this crisis. He was Vice President-Queens for 3 consecutive years: 2005, 2006 and His unique leadership on the county level & his dedication to the members earned him the distinct privilege of the nomination for LIBOR President-Elect in Buddy is a NYS Certified Real Estate Instructor since 1997 and earned his CBR, ABR and SRES real estate designations. On the state level, Buddy serves as a NYSAR Director since 2005 and is a member of the State Professional Standards, Education and Legislative Committees. He is also a NAR Director and serves on the Federal Housing Policy Committee. His involvement in Public Relations and the community earned him the prestigious NYS citation for district 31 in 2006, the NY City council citation in 2007, the NYS Assembly citation in 2008 and is a member of the New York State Senate Business Forum. Allen Saunders 7 December 2012 THE REALTOR This statement could not be any truer than what we have recently experienced with Hurricane Sandy. Usually you will see my article featured around what we have accomplished this year, and what we are working on to improve your businesses. Although things are progressing with our new MLS Stratus system I find it very difficult to report on that when some of our Brokers have lost not only their homes, but also their businesses. I was one of the more fortunate ones that only lost a few trees and electricity for ten days. There are many brokers, agents, homeowners, and tenants that lost so much more. As many of us are returning back to normal please remember our colleagues and Long Island communities that are still struggling. There are many ways you can help encourage landlords to rent short term to a displaced family along with the family pet, donate food, gift cards, cleaning supplies, foster a pet while the owner is rebuilding. The list can go on and on, but most importantly is to let these people know that we care and we are thinking about them. I have lived on Long Island all of my life, and I have never seen the kind of devastation that was caused by this disaster. This happens in other places but not here, or so I thought. I am thankful for all that I have, and for the many opportunities life has brought my way. The good news is that together as a Board, we had over 1,000 more members invest in RPAC then in 2011! That was an increase of 27% year over year! That is a monumental achievement which means that over 1,000 LIBOR members now GET IT that didn t before. They understand the importance of RPAC to our industry and our future. It all comes down to education and understanding exactly what RPAC does for us. Once you GET IT, you will surely make an investment in our future every year. A: When you explain what the form is all about "at the first substantive contact," which means when you meet with a buyer or seller and engage in conversation meant to lead to a real estate transaction. In other words, when a buyer comes into your office asking to see houses, when a buyer goes into your open house and wants information about the property and when you are making a listing presentation to a seller! Q: I do not think I have to give buyers agency disclosures until I have an offer. A: You think wrong! See above! Q: Do I have to give a seller an unconditional release when he asks for it? A: You never have to give an unconditional release, but if the seller wants you to stop representing him you must give him a withdrawal He may still be contractually bound to pay you a commission. LIBOR/MLS Staff Counsel Electronic Signatures are legal in New York! The Governor of New York signed a law that allows all real estate related documents to be in electronic form and to contain electronic signatures. This would apply to signatures on listing agreements, agency disclosure forms, leases, and all real estate related documents that are used by a broker in a real estate transaction. When using electronic documents, you must make sure that your client consents to using an electronic document and to signing the document electronically. If your client doesn t consent, then the client must sign the document manually. It is legal for one party to sign the document electronically and another party to sign it manually. The New York State Department of State (DOS) is accepting electronic documents with open arms! As you may know, DOS requires that a duplicate original of an executed document in real estate be given to the party who signed the document. DOS has held that electronic delivery of the electronic document would satisfy this rule. DOS also requires that certain documents be retained by the broker for a designated number of years. DOS has held that a broker would satisfy DOS s document retention requirements by retaining documents electronically for the required time periods. Being able to satisfy these DOS rules by the use of electronic documents clearly helps the broker Q: Must I have a written buyer broker agreement? A: In real estate, you never need a written hiring agreement, however, it is difficult to prove you have an agreement without a signed writing and consequently difficult to get a judge to award you a commission when the client turns on you and swears he never promised to pay you! Q: I have a listing signed by a husband in a divorce situation and just found out another agent has a listing signed by the wife! What happens now? A: The husband is bound to pay you and the wife is bound to pay the other agent if a sale occurs. But in the real world neither agent will be able to get the parties to sign the deed under these circumstances! Your best approach would be to try to work with the other agent as a co-lister so that you have a chance to bring about a transaction! Q: Can an attorney be the broker and the lawyer on a transaction and get paid a commission and a legal fee for the one deal? A: No, and if you know of any who try it, you can report the attorney to the bar association! to more easily manage the office paperwork. By using a secure electronic signature program and one that provides for the delivery and storage of electronically signed documents, a broker will be reducing the risk of doing business. For example, a broker would have immediate access to documents and would not have to rely on the affiliated licensees to bring the paperwork into the office. All of the signed documents will already be in the broker s electronic storage system because licensees of the broker could have documents electronically delivered to consumers and signed by consumers electronically and at the same time retain a copy in the broker s electronic filing system. Now that you can benefit from the use of electronic documents and signatures, there are certain best practices that you should follow: Make sure that the electronic signature program you use contains security measures to protect the authenticity of the signatures and document! You cannot compel someone to sign a document electronically! It s voluntary. If you send a document to a client electronically, you must still explain each document and page to your client. Make sure you have face time with your client! Just because you can now send your clients documents electronically you should not take the personal aspect out of the transaction! Do not have your client electronically sign all of the electronic documents in bulk. You should have the client electronically initial each page of the document so there is further proof that you went over each page with your client or that the client read each page. Government News Briefs Don t Cancel Mortgage Debt Relief A law that currently provides relief to troubled borrowers when some portion of their mortgage debt is forgiven is set to expire at the end of this year. If that happens, households who were already struggling to pay their mortgage may face tens of thousands of dollars in taxes because the IRS would count the cancelled debt as income. The current law aims to ensure that homeowners are not required to pay income tax when no cash is realized in a transaction. Although the expectation is it will be extended again this year, there are hurdles to overcome. A bill has been introduced by Congressman Charlie Rangel of New York to extend current law for 2 years and by Congressman Tom Reed of New York to extend it for one year. Senator Debbie Stabenow of Michigan introduced a bill that would extend relief for 2 years in the senate. Despite some positive signs of recovery, our nation s real estate market is still fragile. Over a quarter of all transactions still involve a distressed property. That s why you must take action now and tell Congress to extend Mortgage Forgiveness Tax Relief. Without an extension, families engaged in a loan modification, short sale, or foreclosure would face a big tax bill. Neither consumers nor the housing market need that added burden. Homeowners shouldn t be forced to pay a tax on money they ve already lost with cash they never received. To respond to this cal for action go to www. center.com/site/advocacy?pagename=h omepage&page=useraction&id=2309&a utologin=true Top Ten Things You Need to Know About the 3.8% Tax When you add up all of your income from every possible source, and that total is less than $200,000 ($250,000 on a joint tax return), you will NOT be subject to this tax. The 3.8% tax will NEVER be collected as a transfer tax on real estate of any type, so you ll NEVER pay this tax at the time that you purchase a home or other investment property. You ll NEVER pay this tax at settlement when you sell your home or investment property. Any capital gain you realize at settlement is just one component of that LIBOR LEGAL HELP LINE The LIBOR Legal Help Line is Available From 9:00 a.m. 1:00 p.m. Monday through Friday Call the LIBOR Legal Helpline at year s gross income. If you sell your principal residence, you will still receive the full benefit of the $250,000 (single tax return)/$500,000 (married filing joint tax return) exclusion on the sale of that home. If your capital gain is greater than these amounts, then you will include any gain above these amounts as income on your Form 1040 tax return. Even then, if your total income (including this taxable portion of gain on your residence) is less than the $200,000/$250,000 amounts, you will NOT pay this tax. If your total income is more than these amounts, a formula will protect some portion of your investment. The tax applies to other types of investment income, not just real estate. If your income is more than the $200,000/$250,000 amount, then the tax formula will be applied to capital gains, interest income, dividend income and net rents (i.e., rents after expenses). The tax goes into effect in If you have investment income in 2013, you won t pay the 3.8% tax until you file your 2013 Form 1040 tax return in The 3.8% tax for any later year will be paid in the following calendar year when the tax returns are filed. In any particular year, if you have NO income from capital gains, rents, interest or dividends, you ll NEVER pay this tax, even if you have millions of dollars of other types of income. The formula that determines the amount of 3.8% tax due will ALWAYS protect $200,000 ($250,000 on a joint return) of your income from any burden of the 3.8% tax. For example, if you are single and have a total of $201,000 income, the 3.8% tax would NEVER be imposed on more than $1000. It s true that investment income from rents on an investment property could be subject to the 3.8% tax. BUT: The only rental income that would be included in your gross income and therefore possibly subject to the tax is net rental income: gross rents minus expenses like depreciation, interest, property tax, maintenance and utilities. The tax was enacted along with the health care legislation in It was added to the package just hours before the final vote and without review. NAR strongly opposed the tax at the time, and remains hopeful that it will not go into effect. The tax will no doubt be debated during the upcoming tax reform debates in 2013.
