4 EXECUTIVE SUMMARY This Resettlement Action Plan has been prepared for Comprehensive Water Supply Service Improvement to Vizianagaram Municipality taken up under APMDP with World Bank assistance. Main objective of this RAP is to mitigate the negative impacts due to this Sub- Project. This RAP covers project information and its impacts, R&R Policy frame work, Stakeholder s meeting details, R&R entitlements, implementation arrangements, budget, Grievance Redressal Mechanism and synchronization of R&R and civil works. Comprehensive Water Supply Service Improvement to Vizianagaram Municipality is formulated to augment water supply by construction of infiltration galleries at Madhupada on river Gosthani and strengthening of distribution system by construction of ELSRs and remodeling of distribution system. In order to ensure participation of citizens in project preparation, to improve public awareness of development objectives of the projects and to promote project acceptability and transparency, Stakeholders meeting was conducted on where details of the project were explained and suggestions of participants were sought for wider acceptability of the proposal. The components of this sub-project have been so finalized that negative impacts are avoided as far as possible. The negative impacts are limited to 1.54 acres of land acquisition from 40 land owners for laying of approach road to infiltration wells at Madhupada. No other negative impacts due to this sub-project have been assessed. This project will follow consent award and if this fails, normal course of land acquisition under LA Act, 1894 will be followed. Implementation of RAP will be done by the Commissioner, Vizianagaram Municipality. The RAP along with the budget for the same will be approved by Vizianagaram Municipality. The R&R implementation schedule has been synchronized with construction schedule. It will be ensured that compensation for the farmers is paid before the commencement of respective civil work. The concurrent monitoring will be done by NGO. The tentative budget for this RAP works out to Rs. 37 lakhs. The budget provides for land acquisition and other necessary activities for implementing the RAP. 4

5 INTRODUCTION 1.1 Andhra Pradesh Municipal Development Project (APMDP) is a US$ 350 MILLION project being implemented by Government of Andhra Pradesh (GoAP) with support from World Bank. The Project is aimed at improving urban services in select ULBs mainly in water supply and sewerage sectors. The project will also support improvements in the financial, technical, and management capacities of all ULBs of Andhra Pradesh through technical assistance to sustain the infrastructures being created. 1.2 This sub-project for Vizianagaram Municipality is one of the water supply service improvement projects taken up under Andhra Pradesh municipal Development Project (APMDP). This sub-project is formulated to improve water supply service by augmenting the water supply through infiltration galleries and strengthening of distribution system. This Sub-project is divided in to the following 3 Packages. Package I: Salient components of this package are: Replacement of Centrifugal Pump sets Replacement of Submersible Pump sets Construction of Pump House at Nellimarla head water works. Supply, Delivery & Erection of Generators. Construction of Water Bound Macadam (WBM) service road from Ramatheerthalu Water Works to Master Pump House for a length of 2.20 Km. Construction of Infiltration well with 6 m Dia in Gostani River at Madhupada Head Water works - 1 No. Construction of Infiltration galleries of 60 m length in Gostani River at Madhupada Head Water works - 5 Nos Repairs to Infiltration Wells 2, 3, 5, 6 &8 in Gosthani River (5No.s) Construction of Water Bound Macadam (WBM) service road approach to Madhupada Head Water Works for a length of 0.70 Km. Construction of Water Bound Macadam (WBM) service road near infiltration wells for a length of 2.00 Km at Madhupada 5

6 Package II(a): Remodeling of Distribution System in the Town. Salient components of this package are: Construction of 500 KL capacity ELSR at Vyasanarayanametta in Zone I. Construction / completion of balance work above existing columns of uncompleted ELSR of 500 KL capacity at Phoolbagh (Uncompleted) in Zone I. Remodelling of Existing Distribution network In Zones I to IV (4 Zones) Providing DI-K7 Pumping main from Phoolbagh junction to Vyasanarayanametta ELSR Package II(b): Installation and maintenance of water meters. This package comprises of procurement of bulk meters and domestic meters and fixing at suitable locations and maintenance for specified period. OBJECTIVES OF THE RAP: 1.3 Minimisation of negative social impacts has been considered while finalising the components of this sub-project which resulted in avoiding any impacts within the town. However, acquisition of 1.15 acres of private land and 0.39 acres of D-patta land at Madhupada Head Works from 40 land owners is required for construction of approach road. Mitigation of the adverse social impacts due to land acquisition needs assessment of the impacts, estimation of the compensation, methodology and schedule for payment of compensation and establishment of institutional mechanism for grievance redressal. This RAP is prepared to propose and implement these mitigation measures. The objectives of this RAP are summarised as follows: Assessment of impacts of the sub -project Identification of PAPs by type and extent of loss. Establish baseline data of the PAPs. Propose compensation as per the policy frame work. Estimation of compensation and R & R assistance for the PAPs. Outline Institutional Mechanism for implementation and Grievance Redressal. 6

7 STAKEHOLDERS CONSULTATION: 1.4 In order to ensure participation of citizens in project preparation, to improve public awareness of development objectives of the projects and to promote project acceptability and transparency, Stakeholders meeting was conducted on where details of the project were explained and suggestions of participants were sought for wider acceptability of the proposal. Proceedings of the meeting are provided as Annexure- I. The suggestions received during the meeting and the replies are summarized below. Suggestion/Opinion It is suggested that the project shall be designed keeping in view of raid growth of population in Vizianagaram Municipality. Gosthani and other sources need to be revaluated at every 2 years for source reliability. Existing HSC are very less and more houses need to be provided with HSCs. New ELSR shall be provided for Kotha Agraharam. Reply/Integration in DPR The decadal population growth is considered for arriving at the projected prospective and ultimate populations. This aspect which is not in the scope of this DPR need to be taken up by the ULB. New HSCs are provided in the sub-project. Storage requirements of Kotha Agraharam are considered as Zone II in DPR. Policy Legal And Administrative Framework: 1.5 Project will be governed by, R&R Policy of Andhra Pradesh (Irrigation Sector), 2005 National R&R Policy 2007 World Bank Operational Policy 4.12 on Involuntary Resettlement 7

8 SOCIAL IMPACT ASSESSMENT Assessment Of Impacts: 2.1 While formulating the subproject, various efforts have been made to minimize resettlement. During planning and designing, attempt has been made to restrict the construction works within the vacant ULB lands and RoW of Government/ ULB land. Due to these efforts, impacts are limited to acquisition of 1.54 acres of land at Madhupada Head Works from 40 farmers. 2.2 The impacts are ascertained for each component of the project based on the proposed site of construction /alignment. Necessity of land acquisition, Impacts on public/ private properties, necessity for temporary relocation of roadside kiosks on RoW and disturbance to business have been ascertained for each component of the sub-project. The details of proposed investment components and the potential impacts of those components are described below. 11 Positive Benefits Due to The Sub-Project: 2.4 Not withstanding of the few above mentioned advese imapcts,the prosoed proejct will have positive impacts in the form of : reduction in water shortage increased access to potable water reduction in waterborne diseases time saving for the residents job opportunity in the Project scope for improving quality of life exposure to awareness programmes and hence updating knowledge. Summary of Impacts: 2.5 The tentative number of affected persons under the assessed categories of impacts are summarized below. The extent of land acquired in most of the cases is either 0.01 acres or 0.02 acres out of their total land holding. Hence the impact is very minimal. 12 Entltlements: 2.6 The only assessed impact due to the sub- project is acquisition of 1.54 acres of land from 40 land owners. The entitlements are as follows. These amounts shall be 10% at the beginning of each financial year. 1 Compensation for D-Patta land will be paid as per the relevant Government Orders in force. (As per G.O. Ms. No.1307, Dt , the assignees will not be entitled for interest or additional market value under the land Acquisition Act.) Note: The Government land in the alignment of proposed road is free from encumbrances. However, some adjoining farmers have extended their plantation in to the Government land along the border. Compensation for these orchards will be paid as per the valuation of Horticulture/ forest Department. Compensation for trees and standing crops will be paid as per the methodology prescribed in relevant Government Orders (G.O. Ms. No 357, Dt , Revenue-LA Dept.) For short duration crops, farmer can harvest the standing crop and deliver the vacant land. 12

13 LAND ACQUISITION PROCEDURE 3.1 The proposed approach road at Madhupada head water works passes through the private land belonging to 45 persons at Madhupada head water works. The list of land owners and the extent of land acquisition from each owner are provided as Annexure II. As could be seen from the table, the extent of land required from each land owner is very small ranging from 0.01 to 0.09 Acres. A total of 1.54 acres of land will be acquired. LAND ACQUISITION PROCESS PLAN 3.2 Land acquisition process plan for the proposed project has been prepared with the help of revenue maps and alignment plan of the proposed road. Steps followed in the preparation of LA plan are Collect photocopies of Village Revenue Maps from the Revenue Department Collect alignment plan of the proposed road Superimpose alignment plan of the proposed road on Village Revenue Maps Verify each plot under question in the field Delineate and estimate the exact area to be acquired where LA is proposed Delineate the road boundary with coordinates of land-record maps in the field Collect land ownership details from the concerned Mandal Office Joint inspection of the land by LAO and representative of the ULB. Preparation of LA Plan up to the requirement of 6(1) notification under LA Act, Submission of LA Plan to LAO. CONSENT AWARD 3.3 In order to meet replacement value of lost land and assets, consent award process will be followed as per AP negotiation rules Consent award not only ensures market value at replacement cost (mutually agreed price), but also it reduces expeditious steps of LA and number of court cases. The negotiation committee begins negotiation with a base price (market value along with solatium and interest ). If the market values are more than one year old at the time of negotiations, these will be updated for inflation to bring the price to the current level. If rate offered by the committee is not acceptable to PAPs, the collector can enhance the rate by 50% and State Government by any percentage (generally up to 100% of offered rate). If consent award fails, normal course of LA will be followed. Consent award will be considered failed only when the land owners do not agree even for enhancement of offered rate by 50 %. 13

14 STATUS OF LAND ACQUISITION 3.4 The exact extent of land to be acquired from each land owner has been identified with respective survey numbers. Accordingly LA plans are prepared and LA proposals have been submitted to LAO. The 4(1) notification will be published by 30 th April, Similarly declaration under section 6(1) is expected to be published in August, Payment of compensation is expected to be completed by October,2013. (Table 3.1).The normal land acquisition process will be followed and the use of urgency/emergency clause on section 17 (1) will be avoided to enable the land owners to submit their concerns and seek clarifications under section 5-A enquiry, before proceeding with land acquisition process and fixing of compensation. October, CONSULTATIONS WITH THE AFFECTED FARMERS: 3.5 A consultation meeting with the farmers was held on at Madhupada village in the presence of Revenue, Forest and Horticulture officials. The farmers were explained about the sub-project and necessity of land acquisition for the proposed approach road. Officials have explained about the compensation for land and trees in the identified stretch of land. Villagers have expressed their opinions and suggestions and have stated that they have no objection for laying the proposed road. The proceedings of the meeting are provided as Annexure III. The Grievances expressed by the villagers and replies for the same are summarized below. 14

15 Replies to the Suggestions/ Grievances of the villagers: Suggestion/ Grievance. Laying of road through Polamma Temple to 10 th well and to allow access to public for the road without obstructions. Provision of permanent reservoir or at least one pipeline to their village. Name of the village shall be written on the reservoir. Reply. There is no objection to the Municipality to allow public of the village to use the road. However, the access of the road is at the discretion of the Municipal Commissioner as per the prevailing conditions. There is protected water supply scheme being maintained by RWS Department. One tap is connected from HWW connecting main to the village for general usage. However, another Public Stand post will be given at the other end of the village as per the request of villagers. Name of the village i.e. Madhupada was already written on the building of Head Water Works as per the request of the villagers. 15

16 IMPLEMENTATION ARRANGEMENTS AND BUDGET Implementation Of RAP: 4.1 The RAP with necessary budget for implementation will be approved by the ULB and will be implemented by the ULB in coordination with Revenue Department. Following steps will be taken for effective implementation of RAP. The exact land to be acquired will be identified as per the alignment of the proposed road. List of affected land owners at Madhupada will be prepared by ULB in consultation with Revenue Department. Joint inspection of the land by LAO and representative of the ULB. Preparation of LA Plan up to the requirement of 6(1) notification under LA Act, Submission of LA Plan to LAO. Consultative meeting with the farmers. Land acquisition process will be carried out in co-ordination with Revenue Department in consent award method. Valuation of trees will be done by the Forest and Horticulture Department. Payment of compensation to the land owners The payment of land acquisition compensation will be certified by the Municipal Commissioner. The land will be handed over for construction of road only after payment of compensation. Necessary provisions will be made in the agreement to ensure this. Additional Impacts During the Implementation of Sub-Project: 4.2 During the implementation, if any additional impacts are encountered in addition to those described in this RAP, they will be promptly addressed through additional measures in line with the policy provisions. The contractor will communicate promptly to bring to the notice of S&E officer about any additional impacts that he may encounter during the execution of works and these will be mitigated promptly. The S&E Officer of the ULB is responsible for initiating the process for addressing the additional impacts and the supplementary plans will be processed in a similar manner by which this RAP is prepared and approved. The S&E officer will provide a confirmation to MSU, APMDP once in 16

17 quarter during the construction period about the details of new impacts encounter and measures taken to deal with those impacts or confirm that no impacts were encountered. Synchronization of R&R and Construction Schedule: 4.3 Synchronization of Construction schedule and the corresponding R&R activities will be as follows. Construction Schedule R&R Activities Award of / signing the contract Handing over of site for the proposed road at Madhupada to the contractor. Approval and Disclosure of RAP and setting up of Grievance Redressal Mechanism. Payment of compensation to affected land owners. Grievance Redressal Mechanism: 4.4 The grievances can be registered at the complaint cell established at the ULB. The Complaint Cell would forward the grievance to the S&E officer who will forward the grievance to the Revenue Officer and the NGO/ Community representative in the ESMC ( Environmental and Social Management Committee) for redressal. The Complaint Cell will also act as a Public Information Centre, where the grievances of the community will be registered and other information with regard to the project, the sub-projects, social and environmental safeguards will be provided. The grievances can pertain to any social and/or environmental issues triggered by sub-projects under the APMD Project. A District Urban Grievance Redress Body will be established for redressing the grievances that couldnot be solved by Grievance Redress Officer at ULB level This body will consist of 4 to 5 eminent citizens in the District and are from diverse backgrounds such as, education, health and sanitation, urban infrastructure, civic affairs, etc. In an advisory capacity, it will facilitate and suggest suitable action to redress the grievances of the community/public. At the State level a State Urban Grievance Redressal Body will be established along similar lines. If the grivance redress officer cannot redress the grievance within a specified time period, the grievance would be forwarded to the ESMC and further to the District Urban Grievance Redressal Body constituted at the District level. The grievances that cannot be redressed at the District level would be referred to the State Urban Grievance Redressal Body. Each of these authorities can be approached directly for grievance redress by the aggrieved person/party. 17

18 Public Disclosure: 4.5 The RAP in English and Summary in Telugu will be placed at public places and gthe web sites of Munciplaity and CDMA for the benefit of all concerned. The public disclosure places, at the minimum, include the following: Offices and libraries of the project area (Commissioner office and Municipal libraries) District Collectorate Departmental websites. Monitoring and Reporting: 4.6 A report on payment of assistance will be sent to MSU- APMDP once the payments are completed along with the certification of payments. In addition, quarterly Confirmation Note will be sent indicating the details of additional impacts or otherwise, throughout the construction period Tentative Budget estimate for RAP: 4.7 The Budget is indicative of outlays for different expenditure categories. The costs may be up dated due to change in the project designs/alignment and additional impacts. Any additional funds required for implementation of RAP will be provided by the ULB. STAKE HOLDERS MEETING ON COMPREHENSIVE PLANNING OF WATER SUPPLY SERVICE IMPROVEMENTS IN VIZIANAGARAM MUNICIPALITY Date: December 31 st,2011 Time:4.00 P.M Venue: Municipal Council Hall, Vizianagaram Hon`ble M.P Mrs. Bothsa Jhanshi Lakshmi, Mr. Gopalkrishna Reddy, S.E PH Visakhapatnam Municipal Corporation and Mr.S.Govindhaswamy, Municipal Commissioner Vizianagaram & inaugurated and chaired the session and he has given a brief introduction to the present project of Comprehensive Planning of Water Supply Service Improvements in Vizianagaram. Mr, P.Venugopal Rao, E.E, Vizianagaram in his opening remarks mentioned that this project is funded by World Bank in the proportion of 70% as grant, 10% as ULB share and 20% as Loan born by ULB. He also expressed that Existing scenario of water supply system and this scheme is taken up to met the water requirement of Vizianagaram city for the year 2041 Mr.T. Bhaskara Rao, Principal Adviser, Voyants Solutions Pvt. Ltd presented the detailed project and concept plan to the members attended to the consultation meeting. He gave a power point presentation on immediate term & medium term interventions to be taken up under the present water supply improvement scheme in Vizianagaram Discussions & suggestions called for: 19

20 Hon `ble. MP. Botsa Jhansi Lakshmi expressed that this scheme is taken up to met the water requirement of Vizianagaram city for the year A Tunnel of 1 KM has to be dug which needed Archeological survey of India`s clearance. The clearance will be given as t-it has to be dug 300 mts away from the Archeological site where there are some monuments nearby. She suggested this project to be design keeping view of rapid growth of population in Vizianagaram by using modern technology and mentioned that this project is funded by World Bank in the proportion of 70% as grant, 10% as ULB share and 20% as Loan born by ULB. Sri B. Babji,member, Loksatta party expressed that the Hydrology report was furnished only in the morning at 11 AM and not earlier for his comments. He stated that 1995 report states, that Gosthani and other sources need to be reevaluated at every 2 years for source reliability. Mr. Reddy Sankara Rao, CPM Party member expressed that there are only Houses are connected with Service connections whereas households are not connected, there is no supply connections to poor people. They should also be connected. Mr. Lenka Ram Mohan Rao, Ex. Vice Chair Person expressed that it is a good initiative to take up project like 20

21 water supply improvement in the Vizianagaram and he added water deficit at Kotha Agharam suggested to propose new ELSR. Mr. L.Shiva Rama Rao, Member, Loksatta Party expressed project should be design keeping view of Rainfall and existing ground water level. Mr.B.Shiva Prasad Rao, B.J.P expressed that facing the problem with thotapalli due to improper construction. Hence the present project should properly designed. Mr. R. Gopal Krishna Reddy, S.E, PH clarified that quality will be enforced through Third party Quality Assurance Agency. and also internal departmental Quality control unit. 21

39 ANNEXURE II Consultation Meeting with the Farmers at Madhupada held on at Madhupada. The Municipal Commissioner, Vizianagaram Municipality has explained about land acquisition for formation of road at Madhupada Head water works and also explained about the compensation payable to farmers, which the amount had to be sanctioned from Government as per norms.
