9 PLANNING AND DEVELOPMENT DEPARTMENT BRIEF TO PUBLIC HEARING, WEDNESDAY, MAY 21, 2008 ITEM # S632 RZ - BYLAW NOS AND Nameof Applicant and Owner: Addressof Applicant and Owner: Polygon Windsor Gate Development Ltd West Broadway, Vancouver BC V6H4C2 Legal Description of Property: Lot 4 Section ii Township 39 NWD Plan BCP Address of Property: Present Zoning Category: Requested Zoning Category: Present CWOCP Designation: Proposed CWOCP Designation: Proposed Development: 1137 Kensal Place formerly 1133 Pipeline Road RM-6 Multi-Storey High Density Apartment Residential RM-2 Three-Storey Medium Density Apartment Residential High Density Apartment Medium Density Apartment Thirty-Three-Storey Townhouse Units and Central Common Clubhouse Facility. RECOMMENDATION: 1. That Council give second and third readingstocity of Coquitlam Citywide Official Community Plan Amendment Bylaw No. 3934, 2008; 2. That Council give second and third readings to City of Coquitlam Zoning Amendment Bylaw No. 3935, ISSUES: 1. The applicant seeks to redesignate a small portion ofthe Windsor Gate site from its current High Density Apartment land use designation to Medium Density Apartment Residential to allow development on this site at a lower density than envisioned under the current High Density Apartment designation. The subject site is the proposed location of 30 townhouse units and a central common amenity clubhouse. 2. The units are organized on the site into buildings of six units each, and the units range in size from 130 square metres (1,405 square feet) to l88 square metres (2,022 square feet). 3. InordertoachievethedevelopmentoftheKensal Walk site at this time, a numberof amendments to the overall Development Agreement are required. Staff are working with the applicant to affect the required changes to the Development Agreement and these amendments will be required to be implemented prior to fourth and final readlngof these bylaws and approval ofthe overall Development Permit for the site. The overall total numberof dwelling units permitted in the Windsor Gate neighbourhood will not be affected by this application as the increase in townhouse units will be offset by a decrease in the apartment units on the site. 4. This proposed change will likely have a very limited impact on the surrounding neighbours to the north ofthe property. Due tothe natureof a townhouse design over an apartment design, impacts on views for adjacent neighbours will actually be improved with the redesignation ofthe lands. Overall, staff is satisfied that the proposed change in land use is generally consistent with other parts ofthe Windsor Gate development area and Is an appropriate development response to the overall neighbourhood and the site. BACKGROUND: The staff report dated April 25, 2008 concerning Bylaw Nos and 3935, 2008 is attached to the agenda and provides additional information on the application. On May 5, 2008, Council gave first reading to Bylaw Nos and 3935, 2008 and referred the bylaws to Public Hearing. Staff is recommending that Council give second and third and readings to Bylaw Nos and 3935, File #: / /1 Doc #; 63488l:vl
10 PLANNING AND DEVELOPMENT DEPARTMENT BRIEF TO PUBLIC HEARING, WEDNESDAY, MAY 21, 2008 ITEM # RZ - BYLAW NOS AND Nameof Applicant and Owner: Rob Cooper, RKC Investments Ltd. Address of Applicant and Owner: A Street, Maple Ridge BC V4R 2X2 Legal Description of Properties: Lots 11 and 12 Section 123 Township 39 NWD Plan Address of Properties: 3359 and 3365 Darwin Avenue Present Zoning Category: RS-2 One-Family Suburban Residential Requested Zoning Category: RTM-l Street-Oriented Village Home Residential (3365 Darwin Avenue) RS-8 Large Village Single Family Residential (3359 Darwin Avenue) Present LHCVNP Designation: Street-Oriented Village Homes (3365 Darwin Avenue) Large Village Single Family (3359 Darwin Avenue) Proposed LHCVNP Designation: Minor Boundary Adjustment Proposed Development: 3365 Darwin - l6-unlt multi-family townhouse development 3359 Darwin Avenue - six single family houses RECOMMENDATION: 1. That Council give second and third readings to City ofcoquitlam Citywide Official Community Plan Amendment Bylaw No. 3918, 2008; 2. That Council give second and third readings to City of Coquitlam Zoning Amendment Bylaw No. 3919, ISSUES: 1. The subject property is located within the Lower Hyde Creek Village Neighbourhood Plan area which currently designates the site for Street-Oriented Village Homes (3365 Darwin Avenue) and Large Village Single Family (3359 Darwin Avenue). The proposal would require that a minor adjustment to the designation boundary on Schedule "A ofthe Lower Hyde Creek Village Neighbourhood Plan be amended to reflect the proposed district boundaries to accommodate the proposed development and land use. 2. Located along the northsideof Darwin Avenue is a roadside ditch, which drains eastward and conveys water under Coast Meridian Road and ultimately into Watkins Creek, a fish bearing watercourse. Given the site constraints resulting from the required Riparian Areas Regulation setbacks for this drainage channel, staff has worked with the applicant and their qualified environmental professional to find a site planning solution which allows the ditch to remain while still allowing for the required widening of Darwin Avenue to occur with the development proposal. The site planning solution arrived at with the proponent involves a minor variance to the Darwin Avenue road standards which eliminates the sidewalk on the north side and incorporating a relocated drainage swale within the boulevard. Both City and Fisheries and Oceans Canada staff support this approach to maintain the environmental value ofthe open drainage channel. BACKGROUND: The April 11, 2008 staff report to Council concerning Bylaw Nos and 3919, 2008 is attached to the agenda and provides additional information on the application. On April 21, 2008, Council gave first reading to Bylaw Nos and 3919, 2008 and referred the bylaws to Public Hearing. 11 PLANNING AND DEVELOPMENT DEPARTMENT BRIEF TO PUBLIC HEARING, WEDNESDAY, MAY 21, 2008 ITEM # RZ - BYLAW NO. 3924, 2008 Name of Applicant and Owner: Justco Holdings Ltd., Ron Fox Address of Applicant and Owner: 1288 Coast Meridian Road, Coquitlam BC V3B 7M9 Legal Description of Property: Lot 2 Section 12 Township 39 NWD Plan Address of Property: 1288 Coast Meridian Road Present Zoning Category: Requested Zoning Category: Present CWOCP Designation: Proposed CWOCP Designation: Proposed Development: RS-2 One-Family Suburban Residential RS-8 Large Village Single Family Residential and P-5 Special Park Large Village Single Family and Environmentally Sensitive Areas No change Approximately twelve single family residential lots and streamside protection areas. RECOMMENDATION: 1. That Council give second and third readings to City of Coquitlam Zoning Amendment Bylaw No. 3924, 2008; 2. That Council give fourth and final readings to City of Coquitlam Zoning Amendment Bylaw No. 3924, ISSUES: 1. This application relates to a proposal to rezone 0.80 hectares (2.0 acres) of land located on the west side of Coast Meridian Road, just north of Mason Avenue In Northeast Coquitlam. The rezoning would facilitate development of approximately twelve large village single family residential lots and streamside protection areas. The application conforms to guidelines of the Lower Hyde Creek Village Neighbourhood Plan. 2. The development proposal, envisions an interior road constructed to a narrow street standard (lo. 0 metre wide) which connects to Coast Meridian Road and provides the necessary access for eight lots located between East and West Watkins Creeks. In addition a 6.25 metre widening of Hollybrook Street on the west side ofthe property will provide access to the remaining four lots that will front this street. 3. East Watkins Creek crosses the eastern portion ofthe lot adjacent to Coast Meridian Road and Is considered to be a non-permanent, non-fish bearing watercourse. West Watkins Creek, a permanent, fish bearing watercourse, is also located on the lands. To ensure long-term physical protection of both watercourses and their associated riparian areas, the applicant will provide a ten metre Streamside Protection and Enhancement Area from the high water mark of these creeks. 4. Contingent upon Council's approval ofthe rezoning of the subject lands, staff is recommending that the five per cent provision ofthe parkland relating to the subdivision application be comprised of cash-in-lieu, as no active park is envisioned for this site. It Is noted that funds so received, will facilitate the purchase of active parkland on nearby development parcels within the neighbourhood. BACKGROUND: The April 25, 2008 staff report to Council concerning Bylaw No. 3924, 2008 is attached to the agenda and provides additional information on the application. On May 5, 2008, Council gave first reading to Bylaw No. 3924, 2008 and referred the bylaw to Public Hearing. 13 PLANNING AND DEVELOPMENT DEPARTMENT BRIEF TO PUBLIC HEARING, WEDNESDAY, MAY 21, 2008 ITEM #4 - cont'd/ ISSUES cont'd/ 2. The applicant worked closely with staff on a design of a public naturetrail which respects the integrity ofthe Hyde Creek SPEA, while trying to maximize the separation ofthe trail and the rear yards ofthe proposed single family residential homes and not negatively impacting the proposed lot yield. Staff support the application and recommend that the City acquire ownership ofthe area adjacent to Hyde Creek to be consistent with previous applications for subdivision along the Hyde Creek corridor. 3. As discussed at the May 5, 2008 Council meeting, clarification was given with respect to provision of parkland arisingfrom the proposed subdivision applications pursuant to Section 941 of the Local Government Act. Staff Is recommending that the five percent dedication be provided by the owners ofthe three subdivision proposals adjacent to the Hyde Creek ravine (3342 David Avenue, 3345 and 3361 Mason Avenue) to accommodate the proposed pedestrian access trail consistent with the Lower HydeCreek Village Neighbourhood Plan. It is recognized that the amount of land for the trail exceeds the five percent amount; the remaining lands for trail use will be purchased using DCC parkland acquisition funds. Staff is recommending that the five percent cash-in-lieu provision for the subdivision proposal at 3354 and 3364 David Avenue be utilized noting that parkland is not envisioned on these lands. The remaining subdivision proposal at 3366 David Avenue only creates two additional lots and therefore does not trigger the five percent parkland provisions. 4. The owners ofthe properties at 3342 David Avenue and 3345 Mason are proposing to transferthe balance of the HydeCreek ravine lands (approximately 1.69 hectares or 4.18 acres of non-developable area) to the City, in exchange for a federal income tax credit (established at market value) ofthe lands to be donated. Staff support the owners'offer to provide additional lands as proposed. BACKGROUND: The April 25, 2008 staff report to Council concerning Bylaw No. 3925,2008 is attached tothe agenda and provides additional information on the application. On May 5, 2008, Council gave first reading to Bylaw No , 2008 and referred the bylaw to Public Hearing. Staff is recommendingthatcouncil give second, third and fourth readings to Bylaw No. 3925,2008.
