CARRIED PUBLIC MEETING HELD PURSUANT TO THE PLANNING ACT 6:30 p.m. APPLICATION FOR ZONING BY-LAW AMENDMENT The purpose of this public meeting is to provide general information and a recommendation regarding an application for Zoning By-Law Amendment submitted by the Real Estate and Land Development Department on behalf of the property owner for the property at 9 Morton Way. The subject property has a total area of approximately 2020 square metres and contains a single family dwelling. The application proposes to address the non-conforming status of the property that resulted from the recent municipal closure of Morton Street, which was an unimproved public street now renamed as Morton Way. The application is consistent with the Provincial Policy Statement and the policies of the City of Kingston Official Plan. No concerns were raised by other departments or external agencies. File No. D Morton Way Application for Zoning By-Law Amendment Applicant: Philip J. Brown Family Trust Agent: City Of Kingston Councillor Paterson, Chair, called the public meeting regarding the application for a Zoning By-Law Amendment for 9 Morton Way to order at 6:37 p.m. Mr. Peter Huigenbos, Manager of Real Estate and Land Development and Ms. Cynthia Beach, Commissioner of Corporate and Strategic Initiatives spoke to the details of the application. Ms. Lindsay Lambert, Senior Planner, advised that no pieces of correspondence had been received and that the comprehensive report would be coming forward at this meeting later tonight. Pursuant to the requirements of the Planning Act, a notice of the statutory Public Meeting was provided by advertisement in the form of a sign posted on the subject site 20 days in advance of the Public Meeting. A Notice of Public Meeting regarding these applications was also sent by pre-paid first class mail to all property owners within 120 metres of the

In addition, a courtesy notice was published in The Kingston Whig-Standard. There were no questions or comments from Committee. There were no questions or comments from the members of the public. The public meeting regarding the application for a Zoning By-Law Amendment for 9 Morton Way adjourned at 6:39 p.m. PUBLIC MEETING HELD PURSUANT TO THE PLANNING ACT 6:30 p.m. APPLICATION FOR ZONING BY-LAW AMENDMENT The purpose of this public meeting is to provide general information regarding a Zoning By-Law Amendment application for the property municipally known as 7 Pine Street. The subject property has a lot area of approximately 276 square metres. The property currently contains a two-storey four-bedroom house. The applicant is proposing to demolish the existing structure to construct a building containing two two-bedroom dwelling units. The applicant is requesting zoning relief from minimum lot area requirements, front and side yard setbacks, and to request that habitable space be permitted in a cellar. The property is designated Residential in the City of Kingston Official Plan. The subject lands are presently in a One-Family Dwelling and Two-Family Dwelling (A) zone in Zoning By-Law No. 8499, as amended. Application for Zoning By-Law Amendment 7 Pine Street File No. D Applicant Zane Whitfield Councillor Paterson, Chair, called the public meeting regarding the application for a Zoning By-Law Amendment for 7 Pine Street order at 6:38 p.m. Mr. Zane Whitfield, Applicant spoke to the details of the application. Pursuant to the requirements of the Planning Act, a notice of the statutory Public Meeting was provided by advertisement in the form of a sign posted on the subject site 20 days in advance of the Public Meeting. In addition, prepaid first class mail was sent to approximately 113 property owners (according to the latest Assessment Rolls) within 120

In response, to a question from Councillor Berg, Mr. Whitfield advised that the rear access will be at grade. He noted that the new space is designed to be more accessible, but would not be deemed accessible. He advised that the ground floor unit is intended for his parents, and advised that in future they may have mobility concerns, therefore accessibility considerations have been incorporated into the design. Councillor Berg questioned how far from the property line would the new foundation be placed. In addition, Councillor Berg enquired if Mr. Whitfield has spoken to his neighbours about his proposed plans for the property. Mr. Whitfield noted that he has consulted with a structural engineer and spoken to the neighbour. He noted that the foundation would be close to the property line, and that every precaution would be taken to ensure it is done correctly, and not disrupt the neighbour. Councillor Paterson opened the floor for questions and comments from members of the public. Mr. Frank Dixon, noted that the subject neighbourhood is currently under improvement and renewal. He enquired if the historical aspects of the building had been taken into consideration. Mr. Whitfield advised that he currently lives next door to the subject property in a two storey red brick home which is approximately 130 years old. The house on the subject property is not as old and was built with minimum building standards. He noted that for the home to be repaired it would be cost prohibitive, and indicated that there had also been additions made to the building that were not sympathetic to the way that people live today. In response to a question from Councillor Neill, Mr. Calvin Chan, Senior Planner explained that the application is before the Committee because the applicant is building a new building that is beyond the existing foot print and increasing the height, and therefore the applicant had to apply through the rezoning process. This report describes the purpose and effect of the requested Zoning By-Law Amendment and includes an overview of the relevant policies and regulations that apply to the subject property. The subject property has a total area of approximately 74 hectares. This is an existing licensed quarry. The applicant is requesting to add an asphalt and/or a concrete batching plant as a permitted use within the Extractive Industrial (MX) zone on the subject property. The additional uses will require an Environmental Compliance Approval (ECA) from the Ministry of the Environment and an Amended Site Plan Approval from the Ministry of Natural Resources. The applicant is requesting that a holding ( H) symbol be applied to the proposed site-specific Extractive Industrial (MX-X) zone in Zoning By-Law No , as amended. The applicant can apply to remove the H provision from the property once provincial approvals have been received. The property is designated Mineral Resource Area (Q Quarry) in the City of Kingston Official Plan. The subject lands are presently in an Extractive Industrial (MX) zone in Zoning By-Law No , as amended. Application for Zoning By-Law Amendment 3893 Highway 15 File No. D Applicant: G. Tackaberry and Sons Construction Co. Ltd. Agent: FoTenn Consultants Inc. Councillor Paterson, Chair, called the public meeting regarding the application for a Zoning By-Law Amendment for 3893 Highway 15 to order at 6:58 p.m. Mr. Keene Fotenn Consulting, agent for the applicant spoke to the details of the application. A copy of the PowerPoint presentation is attached to the original agenda located in the City Clerk s Department. Mr. Chan noted that two pieces of correspondence regarding the application had been received and has been included as an appendix to the report. Pursuant to the requirements of the Planning Act, a notice of the statutory Public Meeting was provided by advertisement in the form of a sign posted on the subject site 20 days in advance of the Public Meeting. In addition, prepaid first class mail was sent to approximately 16 property owners (according to the latest Assessment Rolls) within 120 metres (400 ft.) of the subject property and a courtesy notice was placed in The Kingston Whig-Standard.

6 April 17, 2014 at 6:30 p.m. in Council Chamber, City Hall Page 6 Councillor Scott referred to a map in the agent s presentation and noted that there is very little of the frontage on Hwy 15, but there is a portion of heavily treed frontage, and questioned if the land was owned by Tackaberry, or if it owns just the existing driveway. In response to Councillor Scott, Mr. Keene advised that the treed property is owned by the City. Councillor Scott asked if the company had other operations in this area, and that why was an asphalt or concrete plant proposed on this property when there are other sites that could be used. Mr. Keene advised that the company does have several operations in the area, and that the company has made the decision to use this property. He noted that to truck items from Athens to the Kingston does not make sense. He noted that current provincial requirements suggest that aggregates be as close to markets as possible. Mr. Keene advised that despite one other site, the proposed site will be the closest site that could provide a concrete or asphalt to the City. He noted that this site was also chosen as it is currently used as a quarry. He noted that there is an extensive process to create a new quarry, and spoke to the provincial and municipal regulations regarding creating accessory uses on an existing quarry. Councillor Scott advised that there are quarries off of Unity and Westbrook Roads and that although they are a long way off you can still hear and smell them. He noted that the proposed site is close to a hamlet and an institution and expressed concern on the impact it will have on the people. Mr. Keene noted that there are strategies in place to help mitigate the effects of noise and smells. He also indicated that there are new technologies that can be placed on the machines in order for the machines to emit less noise and smells. He noted that they have to receive ministry approvals, and listed some of the items that must be approved by the Province and the City. Councillor Scott had advised that the property is large and close to a hamlet he enquired if the property could be partially rezoned and that the accessory uses could be put towards the back of the site, so that the neighbouring landowners would not feel like the development is right on their back yard. Mr. Keene noted that limiting accessory through the site plan stage is more appropriate than during the rezoning process. He noted that Tackaberry is a company that is concerned with neighbourhood relations and plan to place the accessory uses as far from the residents as possible The Chair opened up the floor to receive questions and comments from members of the public.

7 April 17, 2014 at 6:30 p.m. in Council Chamber, City Hall Page 7 Mr. Running noted of the current conditions of an asphalt site in Joyceville. He noted that his wife has respiratory health issues, and noted that these types of accessory uses bring much more noise than what the applicant has described, or proposed. Mr. France, expressed disappointment that the Planning Department did not inform residents beyond the minimum range about this development. He noted that this development will affect all residents of the hamlet, and possibly more upwind. He spoke to the various provincial approvals, and noted that the proposed accessory uses is turning the property into industrial which will use dangerous chemicals in order to make asphalt and concrete on site. He noted that the Tackaberry has been a good neighbour, however this development may negatively affect the neighbourhood. He noted that he has been in communication with Councillor Scott, who has shared his experiences living near an asphalt site, and relayed his concerns with the smell. Mr. France spoke to the operations of Tackaberry, and suggested that they put their asphalt, and concrete production businesses at their Westport quarry. Mr. Frank Dixon, described the new pipeline extension in Exhibit B and asked if the pipeline will be used to transport Ninth Line petroleum products. He asked if the expanding quarry uses will affect the safety of all pipelines running through the property, or if it is an investigation that staff should pursue. Mr. Cunningham, noted the proximity of his property to the quarry. He expressed concern with respect to the well water quality, noting of the current amount of water softener required to treat his water. He spoke about his current respiratory ailments and noted that the possible effect more accessory uses may have. In response to the questions and comments made by members of the public, Mr. Keene noted that with respect to the nature of the comments, he will need to further consult with Tackaberry. He will also ask his client about the current pipelines that run through the property, and will issue a response to the Senior Planner, Ms. Lambert. He noted that the need to justify the accessory uses has been removed by the Province, as there is a need to have aggregates as close to the markets as possible. Mr. Keene pointed out that most zones do not limit accessory uses within quarries. The public meeting regarding the Application for a Zoning By-Law Amendment for 3893 Highway 15, ended at 7:30 p.m.

8 April 17, 2014 at 6:30 p.m. in Council Chamber, City Hall Page 8 PUBLIC MEETING HELD PURSUANT TO THE PLANNING ACT 6:30 p.m. APPLICATION FOR ZONING BY-LAW AMENDMENT The purpose of this public meeting is to provide general information regarding a Zoning By-Law Amendment application for the properties municipally known as 165, 167 and Wellington Street filed by Gerry Shoalts of Shoalts and Zaback Architects Limited on behalf of BPE Development. This report describes the purpose and effect of the requested Zoning By-Law Amendment and includes an overview of the relevant policies and regulations that apply to the subject property. On August 13, 2013, the proponent received approval from Council for a Zoning By-Law Amendment (By-Law No ) for one of the subject properties, located at 165 Wellington Street. This previously approved amendment established a site-specific Heritage Commercial C1-30 zone for 165 Wellington Street. The proponent has since acquired two additional abutting properties located at 167 and Wellington Street and is now proposing a Zoning By-Law Amendment to the site specific Heritage Commercial C1-30 zone in Zoning By-Law No The impetus of the requested amendment is the consolidation of the three adjoining properties and a series of building renovations and enlargements which will ultimately support 26 dwelling units and a supply of 639 square metres of commercial floor area. The application requests to amend the C1-30 zone in Zoning By-Law to include the additional properties located at 167 Wellington Street and Wellington Street, reduce the minimum requirement for residential parking, remove the requirement for equipped children s play space, reduce the amenity space requirement, increase the density and to permit an encroachment into the angular plane. In response to a question from Councillor Scott regarding amenity space, Mr. Newman advised that there are a number of open amenity spaces that are located in the downtown core. He noted the difference in amenity situation between the downtown core and in the suburbs. The Chair opened up the floor to receive questions and comments from members of the public. Mr. Dixon, advised that he is impressed by the ambitious nature of the project, especially the re-creation of the clock tower. He expressed several concerns with respect to structural engineering during the phases of construction, noting that there is a substantial vertical expansion. He noted that he was also concerned about possible street closures that will be required due to development. Councillor Neill asked about the roof top amenity space. He noted that with some proposals the roof top amenity area has specific hours of use, and is locked after 10 p.m. and there are additional rules regarding amplified noise. He also mentioned a current City review of downtown parking, and enquired about the status of that study. In response to the questions and comments from members of the public, Mr. Newman noted that the proposal has been reviewed by the engineer for construction. He advised that road closures due to development will be dealt with at the site plan stage. Ms. Marnie Venditti, Senior Manager, Client Relations & Development Services, responded to Councillor Neill s enquiry on roof top amenity space, and advised that with respect to previous approvals, she is not certain that restrictions had been put in place. She advised that staff can review and come back to Committee. Ms. Venditti advised that the parking review includes all the downtown, the lands contained in Zoning By-law , and a draft should be completed by May. This report describes the purpose and effect of the requested Zoning By-Law Amendment and includes an overview of the relevant policies and regulations that apply to the subject property. The applicant, Ontario Ltd., is requesting permission to rezone the subject property to permit the redevelopment of the property (existing Super 8 motel) to a four storey mixed-use commercial and residential building, containing 64 dwelling units.the property is designated Main Street Commercial in the City of Kingston Official Plan and zoned Williamsville Main Street Commercial C4-H Zone in Zoning By-Law No The proposed use is permitted in the existing C4 zone, however, amendments are requested to the Zoning By-Law including a reduction in the minimum street wall height; a reduction in the angular plane from the rear property line; a reduction in the minimum ground floor height; a reduction in the minimum building frontage built to the front property line; a reduction in the minimum rear yard; a reduction in the required parking spaces; a reduction in the required barrier free parking spaces; a reduction in the dimensions of a parking space; a reduction in the required loading spaces; a reduction in the required amenity area; and permission for parking in a yard abutting a streetline. Agent IBI Group Councillor Paterson, Chair, called the public meeting regarding the application for an Official Plan Amendment 720 Princess Street to order at 7:58 p.m. Mr. Mark Touw, IBI Group, agent for the applicant spoke to the details of the application. A copy of the PowerPoint presentation is attached to the original agenda located in the City Clerk s Department. Ms. Julie Salter-Keane, Manager of Development Approvals noted that two pieces of correspondence regarding the application had been received and has been distributed as part of the agenda and addendum.

11 April 17, 2014 at 6:30 p.m. in Council Chamber, City Hall Page 11 Pursuant to the requirements of the Planning Act, a notice of the statutory Public Meeting was provided by advertisement in the form of a sign posted on the subject site 20 days in advance of the Public Meeting. In addition, prepaid first class mail was sent to approximately 97 property owners (according to the latest Assessment Rolls) within 120 metres (400 ft.) of the subject property and a courtesy notice was placed in The Kingston Whig-Standard. In response to a question from Councillor Berg regarding accessible units, Mr. David Kay, Options for Homes advised that there will be some barrier free units; however they will not be fully accessible. Councillor Berg referenced the letter that was provided to Committee through the addendum. She noted that the letter expressed concerns about the proximity of the building to the property line, and overlooking windows onto the abutting property. In response, Mr. Touw advised that with the second floor windows there is little that could be done in terms of planting or landscaping and the overlooking windows. He indicated that the addition to the building there could be a number of ways to address the issue of overlooking windows and suggested using various screening, or even having transom windows, or glazed windows, that would allow for light into the units without allowing someone to necessary look out. He showed Committee a rendering of the third and fourth level units where transom windows were displayed. He noted that using step backs, or looking at massing in the addition could also be used to resolve this issue. He noted that the applicant will work with staff to ensure that a design that is sensitive to the abutting neighbours is produced. Councillor Berg enquired about proposed storm water management for the site, and noted that there have been surface flooding issues and issues with storm water management with the building and has affected its neighbours. Mr. Touw advised that with respect to the draining issues this is the first that they have heard about it, and noted the need to review the current situation. He noted that there will be various studies that will be done to examine this issue, such a servicing study and storm water brief. He noted that the new roof, through phase 2 of construction will be equipped to handle storm water for the site. In response to a question from Councillor Osanic with respect to offsite parking arrangements, Mr. Touw advised that there will be offsite parking available to the residents. He noted that the applicant owns nearby parcels of lands that can be made available for parking, and that there have been discussions with other nearby land owners to secure more parking. Councillor Osanic enquired about the time between construction of Phase 1 and Phase 2. In response Mr. Kay, advised that there would be 12 to 36 month gap between Phase 1 and Phase 2 construction, and that the site will be a contained site. Councillor Paterson opened up the floor for questions from members of the public.

12 April 17, 2014 at 6:30 p.m. in Council Chamber, City Hall Page 12 Mr. Fletcher, advised that he owns the Auto Max, and that the noise levels may be an issue. He noted that currently with the hotel guests come and go and are usually gone during the day. He expressed issues about noise from his garage being affected by a bounce back affect with the new taller buildings being built. Mr. Fletcher noted that he has a business sign on Princess Street and expressed concern that a building built close to the property line may block his sign. Mr. Patry, expressed support for the proposed development. He pointed out that the development might be using siding and suggested the use of another finish should be considered. He noted that the proposed onsite parking should be adequate, even ample. Mr. Dixon, advised that he lives close to the proposed development, and that he welcomes development in Williamsville. Mr. Dixon noted that the second phase will be built on the existing structure, which was built during a time when there may have been different building standards. He noted that he had concerns about the structural integrity of the existing building. He pointed out that a proposal for snow removal was not outlined in the report. He enquired about the proposed construction materials that will be used on the building. He noted that the nature of how people live on the property will change, and asked whether fire evacuation plan had been taken into consideration. He noted that the development will be close to the property line, and asked whether a planting or buffering could be considered. He concluded by noting that the location map appears to be off by 100 numbers (civics) and noted that this may cause confusion with the general public. Councillor Neill expressed concern about the proposed offsite parking arrangements, as these are not guaranteed and may be an issue in the future. He applauded the developer having 65 bike parking spaces and enquired if it would be covered or protected bike parking. He noted that if there is a roof top amenity space would there be rules with respect to its usage. Councillor Neill noted that the proposed building will be using the existing footprint of the building, with the exception of the commercial area and enquired about the proposed plans for that space. In response to the questions and comments from members of the public Mr. Touw advised that a noise study and a snow clearing plan will be done. Mr. Touw addressed the concern about the Automax business sign as the building will be set back 3 metres from the sidewalk, and that it should not block the sign. He advised that with respect to proposed materials for the building it will be consistent with the Williamsville design study. He advised that the issue of underground parking may be considered. He advised that most of Mr. Dixons comments and questions will be dealt with at the building permit or site plan stage. Mr. Touws advised that the bike parking would be covered, but not enclosed. Mr. Touw provided a general overview of the proposed commercial portion of the proposal. This application is a result of an application for consent to sever for the purpose of a lot addition (Application No. D ). The consent application is to sever a square metre parcel of vacant land with 22.2 metres of road frontage on Thompson Crescent from 1658 Battersea Road and have it merge on title with an abutting parcel municipally addressed as 924 Thompson Crescent. The retained lot will have a lot area of 8,876.3 square metres and 144 metres of road frontage on Battersea Road and metres of road frontage on Thompson Crescent. Pursuant to the requirements of the Planning Act, a notice of the statutory Public Meeting was provided by advertisement in the form of a sign posted on the subject site 20 days in advance of the Public Meeting. In addition, prepaid first class mail was sent to approximately 19 property owners (according to the latest Assessment Rolls) within 120 metres (400 ft.) of the subject property and a courtesy notice was placed in The Kingston Whig-Standard. CONFIRMATION OF MINUTES CARRIED Councillor Scott advised of some amendments to the unconfirmed minutes for Meeting , held on March 20, In particular, page 4, that the sentence be amended to read as follows; He advised that there are several grocery stores not nearby and provided information about a potential school site located on the other side of Bayridge Drive. He also requested that the following sentence be inserted Councillor Scott commented that he was concerned that this property would have 1,100 residents yet it would be on the other side of Centennial Drive which would isolate the property from the neighborhood amenities. Moved by Councilor Berg Seconded by Councillor Osanic a) THAT the minutes of the Planning Committee Meeting No held on Thursday, March 20, 2014, and the Planning Committee Meeting No held on Thursday, April 3, 2014 be approved as amended. 17 April 17, 2014 at 6:30 p.m. in Council Chamber, City Hall Page Map 19 of Schedule A, as amended, is hereby further amended by changing the zone symbol of the subject site from One-Family Dwelling and Two-Family Dwelling Zone A5 to Special One-Family Dwelling and Two-Family Dwelling Zone A5.442, as shown on Schedule A attached to and forming part of By- Law No That the By-Law be amended by the addition of the following section to PART VIII EXCEPTIONS TO THE VARIOUS ZONE CLASSIFICATIONS: & 14 Kingscourt Avenue Notwithstanding the provisions of Section 5 and Section 11 hereof to the contrary, the lands designated A5.442 on Schedule A hereto, the following regulations shall apply: a) DEFINITIONS: For the purpose of the A5.442 zone, the following definition shall apply: BEDROOM shall mean any room within a residential unit that is suitable to be used as a sleeping room under the Ontario Building Code, and which for greater certainty does not include: (i) Common areas open to all occupants of the unit; (ii) Areas used for sanitary (such as washroom) or cooking purposes (such as a kitchen); and (iii) Areas occupied by mechanical equipment, such as furnaces, hot water heaters and laundry equipment. b) For the purposes of the A5.442 zone the subject lands shall be considered as one lot c) MAXIMUM NUMBER OF DWELLING UNITS: (i) Maximum Number of Dwelling Units: 4 (ii) No more than 2 dwelling units shall be permitted on each side of a common party wall. d) MAXIMUM AGGREGATE NUMBER OF BEDROOMS ON EACH SIDE OF THE COMMON PARTY WALL: 5 e) MAXIMUM PERMITTED PARKING AREA: A maximum area of 25 square metres shall be permitted as an uncovered parking area in the rear yard of each side of a semi-detached dwelling unit. f) PARKING SPACE DIMENSIONS: Minimum size of a parking space in the rear yard of a semi-detached building shall be 2.7 metres wide and 5.6 metres long.

Notwithstanding the foregoing, for the purposes of this definition, a bachelor, bachelorette or studio unit shall be calculated to contain one bedroom. d) The minimum width of a drive aisle adjacent to a parking space shall be 3.25 metres. e) MINIMUM AMENITY SPACE AREA: 260 square metres f) No minimum play area shall be required. g) DEEMED TO COMPLY: The multiple family dwelling existing as of the date of the passing of this By-Law shall be deemed to comply with the minimum front yard and minimum side yard of this Zoning By-Law. In the event that the existing building on the site is removed, any new development shall be subject to the regulations of Section 13 of this By-Law. ; and THATthe Amending By-Law be presented to City Council for all three readings. e) 2014 Livable City Design Awards There was no discussion on this item.
