The following items must be completed and/or submitted to the FirstService Residential office at the time of application. All maintenance assessments, fees, and fines must be paid in full. Rental Application to be completed in full and signed. Background Authorization Form. Copy of the signed lease. Lease Addendum must be completed, initialed, and signed. Pet Application must be completed and signed if applicable. Acknowledgement of Covenants & Deed Restrictions must be reviewed and signed. Clubhouse, Pool, and Fitness Room Rules and Hours must be reviewed and initialed. Vehicle Information Form completed in full and signed (Decals will be issued upon approval) Clear copy of current Driver s License and Vehicle Registration for all tenants Application fees: $ for first two applicants. $40.00 for each additional. Refundable Security Deposit of $ Checks should be made payable to Heritage Oaks at Tradition HOA. Security Deposit will not be deposited until approval is granted by the Board of Directors. A separate check must be submitted with application for the issue of entry cards and barcodes. Proximity cards will be issued for entry to the clubhouse area with a maximum of two for each property. Barcodes will also be issued for front and rear gate entry. Cost is $12.00 each. A separate $ RUSH Application fee may be submitted for 2-3 business day processing. Rush fee is payable to FirstService Residential. The Association requires all tenants to have a face-to-face orientation with the Orientation Committee. FirstService Residential will call the new tenant within 48 hours of approval of the application to set up an orientation. The tenant is not permitted to move into the unit until the orientation has been completed. All tenants & adult co-occupants must submit to a background check & personal screening. If a tenant moves in prior to approval, the owner will be in violation of the Association s covenants and be subject to a fine or other enforcement remedies. Additionally, the tenant will be subject to eviction. Note: All applications must be submitted in full or will be rejected; and this will delay the approval process. Applications take a minimum of 15 days and up to 30 days for processing. Please submit your application to us in a timely manner to avoid any delay. Any misrepresentation or falsification of information will result in an automatic rejection. The terms Lessee and tenant are used interchangeably and are meant to mean the same thing. Background check fees are non-refundable if application is disapproved.

Any misrepresentation or falsification of information on these Forms will result in the automatic rejection of this application. Occupancy prior to Board approval is prohibited. I hereby authorize FirstService Residential to obtain a consumer report, and any other information it deems necessary, for the purpose of evaluating my application. I understand that such information may include, but is not limited to, credit history, civil and criminal information, records of arrest, rental history, employment/salary details, vehicle records, licensing records and any other necessary information. I understand that subsequent consumer reports may be obtained and utilized under this authorization in connection with an update, renewal, extension or collection with respect or in connection with the rental or lease of a residence, for which this application was made. Those pets which in the sole discretion of the Association endanger the health, make objectionable noise, are aggressive in nature, or constitute a nuisance or inconvenience to the Owners of other Units or the Owner of any property located adjacent to the properties may be expelled and removed from the properties by the Board. Pit bull or pit bull mixes are not allowed. Pets are not permitted in the Clubhouse, Gym, or Pool area. Dogs shall be confined to a leash whenever they are outside a Unit. No more than two (2) pets may be kept. It shall be the pet owners obligation to remove the pet s waste material from all property maintained by the Association. A photograph of all pets described above must be provided. All domestic pets must be licensed and have a current rabies vaccination per Port Saint Lucie Code. If applicant is a current PSL resident they must provide written proof to the Association that the pet has a license. Non PSL residents have thirty (30) days of occupying the premises to provide written proof of a PSL license. All applicants must provide written proof of a current rabies vaccination for all pets described above. 7 Port Saint Lucie Animal Control Violations & Citations Information about Animal Control Citations 92.27(a) and Animal Control Officers may issue citations to citizens who violate city Animal Control ordinances. The citations are issued for civil, not criminal, infractions. Currently, the citation amounts are as follows: First offense $50 Second Offense $100 Third offense $200 plus mandatory court appearance Animals at Large (A) (1) All domestic pets must be properly restrained at all times while outside the confines of the owner s home. Restraint is defined as being on a leash, within an enclosed area or otherwise secured within the property limits of its owner or keeper. Verbal command is not deemed to be proper restraint. Animals captured running loose are transported to the Animal Control holding facility for the owner to pick up. An impound fee of $25 is charged for each animal picked up, and $10 for each night the animal remains at the animal control compound. If the owner fails to pick up the animal, it is transported to the Humane Society of St. Lucie County (772) Noisy Animals Prohibited Noisy Animals Prohibited It shall be unlawful for any person to keep, harbor, own, or maintain any animal which causes a noise disturbance by barking, yelping, howling, screeching, squawking, chirping, cawing, crowing or whistling between the hours of 11 p.m. and 6 a.m. Additionally, the animal may not bark, yelp, howl, screech, squawk, chirp, caw, crow, or whistle for continuous periods of five minutes or more at any other time of the day. Animal Licensing All domestic pets over the age of 6 months old must have a City of Port St. Lucie animal license displayed on their collar. The cost for a license is $5 for an altered animal (spay or neutered), or $15 for an unaltered animal. Proof of current rabies vaccination from a licensed veterinarian is required, and licenses may be obtained from most Port St Lucie veterinarians, and at the Animal Control Department 1133 S.W. Macedo Blvd., or by mail. Removal of Animal Defecation It is unlawful for any person to allow an animal to defecate upon private property not owned by the person or upon public property, including but not limited to sidewalks and swales, without removing the defecation. This shall not apply to physically challenged persons or if the owner has the consent of the property owner in question. Applicant Initials Co-Applicant Initials

8 Heritage Oaks at Tradition Homeowners Association, Inc. c/o FirstService Residential 543 NW Lake Whitney Place, Suite 101 Port St. Lucie, FL Tel: Fax: LEASE ADDENDUM This document serves as an addendum to the Primary Lease Agreement executed on the day of,, between, Owner of located in Heritage Oaks (hereinafter referred to as Owner ), and, (hereinafter referred to as Tenant ). In addition to signing this Lease Addendum, the Owner and Tenant shall thoroughly read and initial each section in acknowledgement and understanding of the terms described herein. 1. Tenant agrees to abide by all provisions of the Association s Declaration of Covenants, Conditions and Restrictions, Bylaws, Rules and Regulations and all other applicable documents (the Governing Documents ). Tenant further acknowledges that Tenant s failure to abide by the terms of the Governing Documents shall constitute a material breach of this Lease Addendum and the Lease. 2. Owner and Tenant agree that all covenants and agreements contained in this Lease Addendum shall be deemed to be a part of the Primary Lease and incorporated entirely therein as if included originally. The parties further agree that, in case of a conflict between the terms of this Lease Addendum and the Primary Lease, the terms of the Lease Addendum shall take precedence. 3. The Lease is subject to and shall be consistent with the provisions of the Governing Documents, as the same may be amended from time to time. In the event of any inconsistency between the Lease and the provisions of the Governing Documents, the provisions of the Governing Documents shall take precedence. 4. Owner hereby transfers and assigns the Tenant for the term of the Lease any and all rights and privileges that the Owner has to use the Association s common elements, including, but not limited to, the use of any and all recreational facilities and amenities. Owner and Tenant acknowledge that the Association reserves the right to withhold use of certain common element facilities from Tenant for any reason that it would, under the terms of the Governing Documents, be authorized to refuse an owner such use, including Tenant s failure to comply with any of the provisions of the Governing Documents, or the Owner s failure to pay monthly assessments when due. 5. All vehicles must be registered with the Association. Tenant must submit a completed Rental Application Package, including an executed copy of the Lease and Lease Addendum; must provide a copy of the vehicle registration and driver s license; and must attend a mandatory Rental Orientation with the Association s managing agent. Tenant must follow all of the Association s parking rules and vehicle restrictions set by the Governing Documents and are subject to penalties stated therein for all violations. Revised 03/04/16

9 6. Any lease of a Unit shall, as a condition of such lease and by operation of this Section, be deemed to include an assignment by the Owner to the Association of the Owner s right to demand and collect rent payments from the leased unit directly from the tenant, if the Owner becomes delinquent for more than sixty (60) days in the payment of any general or special assessments due the Association. Once the right to demand and collect rents is so assigned to the Association, such assignment shall continue until the Owner has paid all delinquent assessments, late charges, accrued interest and any attorneys fees that are due and owing to the Association. A tenant, who remits rent payments to the Association upon receipt of a written demand given pursuant to Paragraph and Section of the Declaration, shall not be subject to eviction by any action taken by the Owner and compliance with Section by a tenant shall constitute a complete defense to an eviction action instituted by the Owner for alleged non-payment of rent. If a tenant fails to remit rent payments to the Association pursuant to a demand made in accordance with this Section, then the Association, in its own name and as the agent of the Owner, shall have the right to have the tenant and all other occupants removed from the unit by an injunction action or any other action permitted under the law or in this Declaration. 7. Owner shall be liable to the Association for any damage to Association Property caused by the Tenant, the Tenant s family or guests. Owner further agrees to reimburse the Association for any repairs necessary within 48 hours of notice from the Association or the costs incurred for the repairs will be added to the fees due to the Association. 8. In the event of default by Tenant in the performance of the terms of the Primary Lease or this Lease Addendum, or the Declaration, Bylaws, and/or Rules and Regulations of the Association, then, in addition to all other remedies which it may have, the Association or its representative shall notify Owner of the default(s) and demand that they be corrected through the Owner s efforts within 30 days of such notice. If the default(s) is not corrected within the 30-day period, the Owner shall immediately thereafter, at the Association s request and at his or her own cost and expense, institute and diligently prosecute an eviction action against the Tenant. The eviction action shall not be settled without prior consent of the Association or its representative. In the event the Owner fails to fulfill the foregoing obligation, the Association shall have the right, but not the duty, to institute and prosecute an action as agent for the Owner, at the Owner s sole cost and expense, including all legal fees incurred. The Owner hereby irrevocably names, constitutes, appoints and confirms the Association as its agent to take all such actions as it deems appropriate on his/her behalf. All costs and attorney s fees incurred by the Association to enforce the terms of the Primary Lease or of this Lease Addendum, or of the Declaration, Bylaws, and/or Rules and Regulations of the Association, or to evict Tenant pursuant thereto, will be assessed against the Unit and the owner thereof, and shall be deemed to constitute a lien on the Unit involved. The Association may enforce collection of the lien in the same manner as an assessment. 11 Any changes in use or appearance of the above described vehicle(s) must be submitted to the Board of directors with a new application. It is clearly understood that all vehicles must be parked in the driveways and/or garages. Parking in the streets, on the grass, or on sidewalks is not permitted. This is enforced by towing solely at the owners expense. No commercial vehicles, campers, mobile homes, motor homes, boats, house trailers, boat trailers, or trailers of every other description shall be permitted to be parked or to be stored at any place on any lot, except that they may be stored within enclosed garages. All vehicles must prominently display a decal issued by the Association. See Article VIII General Restrictive Covenants - section 12 for more information. 12 Heritage Oaks at Tradition Homeowners Association QUICK REFERENCE GUIDE RULES AND REGULATIONS The following is only a guideline. Please refer to your Governing Documents for explanations and details. This guide does not include all of the restrictions and may be updated as needed. All violations are subject to fines and/or loss of privileges. Appearance of Homes and Lawns: All homes and yards must be maintained in appearance at all times. All landscape beds must be mulched and free of dead plantings. All roofs must be free of mold and mildew and pressure cleaned as needed. All homes exterior paint must be maintained and painted as needed. All damaged house trim and decorative shutters must be repaired or replaced. Driveways must be kept clean and free of oil stains and debris. Exterior Changes to Home and Yards: No owner shall make any alterations additions, improvements or changes to structure or landscaping without prior approval of the Architectural Review Committee (ARC). All new landscape beds must have approval of the ARC. No approval is required when replacing plant life in existing landscape beds. Structures: No fence, screen enclosure or pool shall be installed, except as may be approved by the ARC. No above ground pools except small baby pools, and they must be emptied overnight. No carports shall be permitted. Screen enclosures must be constructed with white aluminum and charcoal screening. Playground equipment installed by homeowner must meet ARC approval and must include adequate landscaping to provide screening from neighboring properties. Garages & Doors: The doors of all garages shall be closed at all times, except as needed for ingress and egress or active use. No garage shall be converted so as not to allow access of original number of vehicles. All damaged garage door panels must be repaired or replaced. Mailboxes are the responsibility of the Resident to be kept clean, not the Associations. Damaged boxes must be replaced by owner by our approved vendor. BBQ s: May not be used in the front of the house. Grills must be stored indoors or on the lanai or patio when not in use. Satellite Dishes: Must be less than 1.0 meter in diameter, installed away from general view, and must be approved by Architectural Review Committee prior to installation. Hurricane Shutters: Shutters may only be installed during a "hurricane watch" or a "hurricane warning" and must be removed within 14 days after the storm.

13 Signs: No signs of any kind shall be displayed to the public view except a professional security system sign. Holiday Lights: Must be removed from all houses no later than January 15 th of each year Speed Limit: Posted 25 miles an hour throughout the Community. It is the Owner s responsibility to notify all guests and tenants that this rule will be strictly enforced. Parking: Residents and their guests must park in driveway or garage. No all-night parking on the street between 2AM & 6AM. Vehicles may be towed. No driving or parking on the grass No parking sideways or at an angle on driveways No vehicles may be stored on the driveway with a cover on it. Owners/Residents or Guests may not obstruct sidewalks with vehicles when they are parked in their driveways and may not park their vehicles so that they overhang into the street. No repair, except emergency repair of vehicles shall be made within the properties, except in the garage of a home. No stopping or parking at main entrance gate area or at South gate area when picking up or dropping off children for school bus stops. No parking in Clubhouse lot allowed unless vehicle has resident decal. No parking of commercial trucks, boats, campers or trailers in driveways or clubhouse lot. Owners may request additional overnight parking at Clubhouse for guests when necessary. All requests must be made through First Service. A parking permit will be issued by the guard at the front gate and must be displayed on the dashboard in clear view. Car must be moved each day by 9:00 AM. Animals and Pets: No breeding allowed. Limit of 2 household pets only. No aggressive breeds allowed. Dogs must be on a leash at all times when outdoors and owner must pick up solid waste. Yards must be kept free of animal waste. All Residents must provide a dog/cat license from PSL & proof of current rabies vaccination from a licensed veterinarian. (This is also a requirement of the PSL Animal Code) All Port Saint Lucie Animal Control Ordinances will be enforced. Trash pick-up: Trash containers must be kept in sanitary condition and always stored in the garage. They may be put out no earlier than 6:00 p.m. the evening prior to pick up. Disposable garbage bags may only be put out the day of pick up. Pick-ups are, Tuesday and Friday for garbage, Friday for recycling, and Saturday for yard debris. Home owners are responsible to clean up any debris left after pick up. Receptacles must be returned to the garage ASAP or by 7AM the day after pick up.

14 Bicycles: Must be kept inside your garage when not in use. Must be stored in the bike rack at the front of the Clubhouse and Main Entrance. Bike riding should always be on the street when possible. Sidewalks are for pedestrian use. If children are riding a bike on the sidewalk, please yield to pedestrians. Basketball Hoops: Basketball hoops must be stored at the top of the driveway next to the garage door between dusk and dawn. Basketball hoops may not be stored on the grass. Basketball hoops can only be used between the hours of 8am and 8pm Basketball hoops can only be used on the driveway Basketball hoops must be portable. Permanent type basketball hoops are NOT allowed. Basketball hoops must be kept in good order. If these guidelines are not followed, the Owner/Resident will be required to remove the basketball hoop and be subject to a fine. Yard and Garage Sales: Individual yard and garage sales are not permitted. The HOA will allow community yard sales from time to time. Gatehouse: You should always go on-line to our web portal, Securitas, to notify the guard of a Visitor. A valid driver s license is required or entry will be denied. A fine will be levied for damaging gates as well as the cost of repairs Owners are responsible for all Guests while in the community. Leasing of Units: Lease must be in writing and for not less than 6 months and not more than 12 months. Tenants must complete the Heritage Oaks HOA Lease Information Package, pay the related application fee and refundable security deposit, and receive an official HOA approval notice BEFORE moving in. Tenant understands and agrees that there will be a full criminal background check. Moving in prior to approval will result in a fine to both landlord and tenant. New Purchase Lease: If the total number of units in Heritage Oaks which are leased is equal to or exceeds 35% a new buyer cannot lease his unit for the first 24 months of ownership. After the 24 month period expires, owner may lease unit in accordance with the Association s covenants.

15 Clubhouse, Pool, and Fitness Room Rules and Hours Report all violations to FirstService at Please call the Police (911) if anyone has damaged HOA property or is trespassing and has refused to leave after being requested to do so. NO LIFEGUARD ON DUTY SWIM AT YOUR OWN RISK Pool Hours: Open from DAWN until DUSK Fitness and Meeting Rooms Hours: From 6 AM to 10 PM You Must Have a Key Card to enter Clubhouse, Pool area, & Fitness Room. NEVER ALLOW ANYONE ENTRY WITHOUT THEIR KEY CARD. Children under 16 must be accompanied & supervised by an adult in all facilities. NO DIVING IN POOL. No dangerous behavior, horse play or vulgar language on premises. NO RUNNING NO Smoking or Glassware allowed anywhere in this facility NO bicycles, skateboards, or similar wheeled items permitted anywhere in this facility. Use the outside bicycle racks provided. Alcohol is only permitted in the meeting room and only during adult only functions (21+ years old). No Alcohol is permitted anywhere else. Food & Beverage is allowed in designated FOOD AREA only. No glass permitted. Security Guard has the right to inspect all coolers & bags. Bathing suits required in pool. Babies must wear appropriate swim diapers when in pool. No children under 12 years allowed in spa No music or radios allowed without headphones NUMBER OF GUESTS ALLOWED PER FAMILY IS SIX (6) unless prior approval is obtained from Management Company. Violation of these RULES may result in suspension of all pool, clubhouse, and fitness room privileges. Any damage to HOA property shall result in a suspension of all privileges and/or fine.
