1 Amenity Center Rules & Regulations Amenity Center Operating Hours Amenity Center is opened from 4:00 am to 10:00 pm Fitness Center is opened from 4:00 am to 10:00 pm Pool is opened from dawn to dusk Tennis, Pickle Ball, Shuffleboard and Basketball courts & Horseshoe Pit are opened from dawn to 8:00 pm Playground is opened from 8:00 am to sunset Any violation of these rules and regulations or the Declaration of Covenants, Conditions and Restrictions for Heron Bay at Waterstone shall be strictly enforced; violations, fines, suspensions and/or legal action may be imposed. All public areas of the Amenity Center including the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas may be recorded by closed circuit cameras. Cameras are for recording purposes only, not monitoring. Assumption of Risk Pursuant to the Declaration of Covenants, Conditions and Restrictions for Heron Bay at Waterstone. All recreational facilities and playgrounds furnished by Heron Bay Association or erected within the Committed Lands, if any, shall be used at the risk of the user, and Heron Bay Association shall not be held liable to any person or persons for any claim, damage, or injury occurring thereon or related to use thereof. Amenity Center Smoking, Illegal Drugs, and Alcohol Policy Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from all areas of the Amenity Center which include the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. Any homeowner/resident and/or their guests smoking, using illegal drugs or alcohol on the Amenity Center grounds will be asked to leave and shall be subject to violations, fines, suspensions and/or legal action. As a Homeowner/Resident You are expected to abide by all the Rules and Regulation of the Amenity Center. You are expected to report any violations to this Code of Conduct to the Board of Directors. You are expected to educate your guests about the Rules and Regulations at Heron Bay and the importance of abiding by them. You are responsible for the conduct of your guests at all time. 2 GENERAL CODE OF CONDUCT 1. Homeowners/residents and their guests must conduct themselves in a manner that does not interfere with the rights and privileges of others. 2. All guests must be accompanied by a homeowner/resident at all times while using the facilities at the Amenity Center. Any guest that is not accompanied by a homeowner/resident, will be considered trespassing and will be asked to leave the area. 3. All persons under the age of 16 must be accompanied and supervised by an adult while in any area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. 4. Homeowners/residents will be held fully responsible for any damage to all areas of the Amenity Center caused by them or their guests. 5. Use of profane language or other forms of disruptive shouting is not permitted. 6. Proper attire and footwear is required at all times. Nude sunbathing is not permitted in any area of the Amenity Center or its surrounding grounds. 7. Loitering is not permitted in any area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. 8. Homeowners/residents and their guests must be able to produce identification while using the Amenity Center. Individuals who fail to do so may be asked to leave the area. 9. Gate access cards are not to be given to non-homeowners/residents. Also, homeowners/residents should not allow others to gain access to the Amenity Center gate without using their own access card. 10. Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from all area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. Any homeowner/resident and/or their guests smoking, using illegal drugs or alcohol on the Amenity Center grounds will be asked to leave and shall be subject to violations, fines, suspensions and/or legal action. (The only exception for alcohol use in the Amenity Center is for Heron Bay Home Owner Association events approved by the Board of Directors.) 11. Firearms and weapons of any kind are strictly prohibited in any area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. (The only exception applies to current law enforcement officers.) 12. Personal audio devices are only permitted with the use of ear or headphones. (The only exception for the use of radios and similar electronics with external sound in the Amenity Center is during Heron Bay Home Owner Association events approved by the Board of Directors.) 13. Homeowners/residents wishing to schedule events (e.g. birthday parties or other celebrations) at any of the Amenity Center venues shall submit, in writing, details of the proposed event to the Board of Directors for approval. (see Amenity Center Rental Policies And Rules) 14. Use of barbeque grills or any other cooking devices are not permitted in any area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. (The only exception is for Heron Bay Home Owner Association events approved by the Board of Directors.) 15. No pets or other animals (with the exception of service animals) are permitted in any area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. 16. Bicycles must be kept on the designated bicycle rack in front of the Amenity Center. At no time shall bicycles be brought inside the recreational fitness or pool area. At no time shall unattended bicycles be parked in such a manner as to block any sidewalk. Rev. 8/4/17 2
3 17. Playing near or tampering with irrigation equipment is prohibited. 18. Vehicles, strollers, bicycles, skateboards, or any other items shall not block entrances or walkways. 19. Disorderly behavior is strictly prohibited. 20. Firework of any type is not permitted anywhere at the Amenity Center grounds or community. 21. Littering or dumping of trash is not permitted anywhere at the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, Playground, and all common areas of the Amenity Center. In an effort to keep our Amenity Center clean, please place all trash in the trash receptacles. 22. The Amenity Center area shall not be used by homeowners/residents for any profit business or venture. These rules may be modified by the Board of Directors at any time Rev. 8/4/17 3
4 POOL RULES Pool is opened from dawn to dusk 1. The pool and pool area is for the exclusive use of homeowners/residents and their supervised guests only. 2. All persons under the age of 16 must be accompanied and supervised by an adult at all times while using the pool or in the pool area. 3. WARNING - No lifeguards provided. SWIM AT YOUR OWN RISK. 4. NO DIVING PERMITTED 5. All rules in the General Code of Conduct must be followed while using the pool and pool area. 6. Proper attire and footwear is required at all times. Nude sunbathing is not permitted in any area of the Amenity Center, including the pool area, or its surrounding grounds. 7. No food, beverages, or glass containers are permitted in the pool or pool area with the exception of a plastic water bottle. (The only exception is for Heron Bay Home Owner Association events approved by the Board of Directors.) 8. Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from all area of the Amenity Center which includes the pool and pool area. (Exceptions to the alcohol rule are highlighted in the General Code of Conduct section.) 9. Firearms and weapons of any kind are strictly prohibited in the pool or pool area. (The only exception applies to current law enforcement officers.) 10. Personal audio devices are only permitted with the use of ear or headphones. (Exceptions to this rule are highlighted in the General Code of Conduct section.) 11. The bathing load for the pool is 36 persons at one time. 12. For your safety, do not swallow the pool water. 13. No pets or other animals (with the exception of service animals) are permitted in any area of the Amenity Center which includes the pool and pool area. 14. Do not use the pool if you are ill with diarrhea. 15. No night swimming is permitted. 16. Please be advised, pool depths are measured in feet and the maximum water temperature shall be 104º. 17. Showering before entering the pool is required. 18. Use of profane language or other forms of disruptive shouting is not permitted. 19. No running, jumping, throwing of objects, horseplay, or disorderly or inappropriate behavior of any kind is permitted in the pool or pool area. 20. Bicycles, skateboards, roller blades, skates or hover boards are not permitted in the pool area or Amenity Center. 21. Infants and toddlers shall wear swim diapers when in the pool. No disposable or cloth diapers are permitted. 22. Floatation devices or pool equipment that shall cause harm to others or property damage are not permitted in the pool or pool area. 23. Playing near or tampering with irrigation equipment or pool equipment is prohibited. 24. In an effort to keep our Amenity Center clean, please place all trash in the trash receptacles. 25. For your safety, corded electronic devices or extension cords are not permitted near the pool or pool area. 26. The Board of Directors shall have the right to limit the use of the pool for security or liability reasons. Rev. 8/4/17 4
5 FITNESS CENTER RULES Fitness Center is opened from 4:00 am to 10:00 pm 1. Use of the Fitness Center and the equipment is AT YOUR OWN RISK. 2. The Fitness Center is for the exclusive use of homeowners/residents and their supervised guests only. One (1) guest is permitted per homeowner/resident. 3. All rules in the General Code of Conduct must be followed while using the Fitness Center. 4. Persons must be 16 year of age to use the Fitness Center unsupervised. 5. Persons age 13 to 15 must be accompanied and supervised by an adult at all times while in the Fitness Center. 6. No persons under the age of 13 are permitted in the Fitness Center. 7. Persons are advised to consult with a physician prior to engaging in physical exercise activity of any kind. 8. Unless you are engaged in using the Fitness Center equipment, loitering is not permitted in the Fitness Center. 9. Personal Trainers must provide Proof of Insurance and any Florida licenses to clients or to the HOA upon request. 10. Proper attire and footwear is required at all times. 11. Wipe down equipment after each use. Disinfectant and towels are provided. 12. Please limit your time to 30 minutes if people are waiting for the same piece of equipment. 13. Personal audio devices are only permitted with the use of ear or headphones. 14. Use of laptops, tablets or PC s are not permitted in the Fitness Center. 15. Please turn off all lights and fans before leaving the Fitness Center and ensure the door is locked. 16. Food, beverages, or glass containers are not permitted in the Fitness Center with the exception of a plastic water bottle. 17. Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited in the Fitness Center. 18. Firearms and weapons of any kind are strictly prohibited in the Fitness Center. (The only exception applies to current law enforcement officers.) 19. No pets or other animals (with the exception of service animals) are permitted in the Fitness Center. 20. In an effort to keep our Amenity Center clean, please place all trash in the trash receptacles. 21. The door to the Fitness Center shall not be opened to anyone who does not have an access card. 22. A member of the Board of Directors shall be allowed to ask any person using the Fitness Center to produce proper identification. Individuals who fail to do so shall be asked to leave the area. 23. 6 TENNIS COURT, SHUFFLEBOARD COURT, PICKLE BALL COURT, BASKETBALL COURT, AND HORSESHOE PIT RULES Courts and Horseshoe Pit are opened from dawn to 8:00 pm 1. Use of the Courts, Horseshoe Pit and the equipment is AT YOUR OWN RISK. 2. The Courts and Horseshoe Pit are for the exclusive use of homeowners/residents and their supervised guests only. Two (2) guests are allowed per homeowners/residents. 3. All rules in the General Code of Conduct must be followed while using the Courts and Horseshoe Pit. 4. Proper attire and footwear is required at all times. 5. No food, beverages, or glass containers are permitted on the Courts and Horseshoe Pit with the exception of a plastic water bottle. 6. Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from all area of the Courts and Horseshoe Pit. 7. Firearms and weapons of any kind are strictly prohibited on the Courts and Horseshoe Pit. (The only exception applies to current law enforcement officers.) 8. Personal audio devices are only permitted with the use of ear or headphones. 9. Use of profane language or other forms of disruptive shouting is not permitted. 10. No horseplay or disorderly or inappropriate behavior of any kind is permitted on the Courts and Horseshoe Pit. 11. No climbing on the fence or hanging from the basketball hoop or tennis nets is permitted. 12. Loitering is not permitted in any area in or around the Courts and Horseshoe Pit. 13. Bicycles, skateboards, roller blades, roller skates or hover boards are not permitted on the Courts. 14. No pets or other animals (with the exception of service animals) are permitted in the Courts and Horseshoe Pit area. 15. In an effort to keep our Amenity Center clean, please place all trash in the trash receptacles. 16. Use of the Courts and Horseshoe Pit are on a first come first serve basis. 17. Please limit your time to 30 minutes if people are waiting to play on the Courts and Horseshoe Pit. 18. Tennis, Pickle Ball, and/or Shuffleboard shall not be played simultaneously. 19. Playing near or tampering with irrigation equipment is prohibited. 20. A member of the Board of Directors shall be allowed to ask any person using the Courts and Horseshoe Pit to produce proper identification. Individuals who fail to do so shall be asked to leave the area. 21. 7 PLAYGROUND RULES Playground is opened from 8:00 am to sunset 1. Use of the Playground and the play equipment is AT YOUR OWN RISK. 2. The Playground is for the exclusive use of homeowners/residents and their supervised guests only. 3. All rules in the General Code of Conduct must be followed while using the Playground. 4. Children must be accompanied and supervised by an adult at all times while in the Playground. 5. No children over the age of 12 are allowed in the Playground. 6. Proper attire and shoes must be worn at all times. 7. No food, beverages, or glass containers are permitted in the Playground with the exception of a plastic water bottle. 8. Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from all area of the Playground. 9. Firearms and weapons of any kind are strictly prohibited in or around the Playground area. (The only exception applies to current law enforcement officers.) 10. Personal audio devices are only permitted with the use of ear or headphones. 11. Use of profane language or other forms of disruptive shouting is not permitted. 12. No horseplay or disorderly or inappropriate behavior of any kind is permitted in the Playground. 13. Loitering is not permitted in any area in or around the Playground. 14. Strollers, bicycles and other recreational equipment shall not block access to the entrance or pathway of the Playground. 15. No pets or other animals (with the exception of service animals) are permitted in or around the Playground area. 16. In an effort to keep our Amenity Center clean, please place all trash in the trash receptacles. 17. No person is allowed in the Playground area after operating hours. 18. Playing near or tampering with irrigation equipment is prohibited. 22. A member of the Board of Directors shall be allowed to ask any person using the Playground to produce proper identification. Individuals who fail to do so shall be asked to leave the area. 23. 8 AMENITY CENTER PARKING AREA POLICIES AND RULES 1. The Parking Area is for the exclusive use of homeowners/residents and their supervised guests only. 2. All rules in the General Code of Conduct must be followed while using the Parking Area. 3. On street parking is prohibited in Heron Bay during the evening hours. Homeowners/residents and their guests may park in the Amenity Center Parking Area during these times. 4. Parking spots shall not be reserved. 5. All vehicles parked at the Amenity Center Parking Area must have current registration, tags, insurance, and must be operational. Any vehicles that do not fit these criteria shall be towed from the property at the vehicle owner s expense. 6. The Amenity Center Parking Area is for parking of vehicles only. At no time should any type of mechanical work or maintenance be performed while a vehicle is parked at the Amenity Center Parking Area. 7. Recreational vehicles (RV), commercial trucks, any other commercial vehicles, buses, trailers, campers, boats, or any other vehicle not operated as a personal passenger vehicle is not permitted to be parked at the Amenity Center Parking Area at any time. 8. Vehicles shall not block access to the Amenity Center, walkways, or any entrances to the common areas within the Center. 9. Vehicle occupants parked at the Amenity Center Parking Area shall not play loud music or engage in any other loud, disruptive, or inappropriate behavior. 19. Illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from all areas of the Amenity Center Parking Area. 10. Firearms and weapons of any kind are strictly prohibited from all areas of the Amenity Center Parking Area. (The only exception applies to current law enforcement officers.) 11. As a courtesy, the Board of Directors asks that you move any overflow vehicles at times when a Heron Bay Home Owner Association event approved by the Board of Directors is scheduled. This will allow homeowners/residents that may be required to drive to the event to have adequate parking. 12. In an effort to keep our Amenity Center clean, please place all trash in the trash receptacles. Rev. 8/4/17 8
9 AMENITY CENTER RESERVATION POLICIES AND RULES 1. The Board of Directors approves and schedules all activities for the Amenity Center. 2. No event shall take place without prior written approval. Violators shall be subject to action by the Board of Directors which may result in fines or suspension of use of any area of the Amenity Center which includes the Pool, Fitness Center, Tennis, Pickle Ball, Shuffleboard, and Basketball courts, Horseshoe Pit, and Playground. 3. All homeowners/residents wishing to schedule an event (e.g. birthday parties or other celebrations) involving more than ten (10) guests, but not to exceed thirty (30) persons, shall submit, in writing, the following details of the proposed event to the Board of Directors for approval: The name of the homeowner/residents hosting the event The date and time requested for the event The number of guests attending the event 4. The request must be submitted fourteen (14) days prior to the requested date to ensure absence of any scheduling conflict. 5. All requests will be considered on a first-come, first-served basis. 6. The maximum number of bathers that can utilize the pool at one time is 36 persons. 7. The maximum length of the event shall not be longer than 4 hours and must be held during the Amenity Center s Operational Hours. 8. A security deposit check, for damage and cleanup, in the amount of $ and payable to the Heron Bay Homeowners Association shall accompany each request. The security deposit is due at the time of reservation. Returned checks will be charged a fee of $ Any returned check will result in any future payment being accepted by Money Order only. 9. All checks received as a security deposit shall be held by the Board of Directors pending conclusion of the event and subsequent inspection of the facility. Upon satisfactory post-event inspection, the deposit shall be returned to the owner within three (3) days. 10. All trash is to be placed in the trash receptacles provided at each venue. At no time, shall trash be left anywhere in the Amenity Center or surrounding areas outside of a trash receptacle. You must provide for the removal of any trash that does not fit into the provided receptacles. 11. Smoking, illegal drugs and all types of alcohol and alcoholic beverages are strictly prohibited from being consumed during the event in any area. Any homeowner/resident and/or their guest violating this rule will be asked to leave and shall be subject to violations, fines, suspensions and/or legal action. 12. The homeowner/resident also agrees that other members of the community shall have the right to use the Amenity Center during said event. 13. Any and all damages incurred above the cost of the security deposit will be assessed to the homeowner/resident who held the event as an additional charge. 14. At the conclusion of the event, the Amenity Center must be restored to its previous condition, as it was before the homeowner/resident took possession. This includes the proper disposal of all trash and the positioning of all chairs and tables utilized. Failure to properly restore the premise will result in part or all of the refundable security deposit being withheld by the Homeowner s Association. 15. The homeowner/resident assumes all responsibility and agrees to adhere to all city and residential ordinances for noise. 16. All rules in the General Code of Conduct must be followed during the event. 17. The Amenity Center area shall not be used by homeowners/residents for profit business or venture. 18. Disclaimer: The Heron Bay at Waterstone Homeowner s Association shall not be liable or responsible for any damages from the intoxication of any guest(s) or for injury or death to any person(s). 10 HERON BAY AT WATERSTONE AMENITY CENTER RESERVATION AGREEMENT All homeowners/residents wishing to schedule an event (e.g. birthday parties or other celebrations) involving more than ten (10) guests, but not to exceed thirty (30) persons in total, shall submit, in writing, details of the proposed event to the Board of Directors for approval.
