This property is located adjacent to the city limits and the City Council voted to grant the petition for annexation. This property is uninhabited, vacant and is less than one-half mile in width. It is located adjacent to Interstate 10, which is zoned IDC-Interstate development Corridor. The owner of the property desires to install a billboard at the location and TxDOT will not approve the billboard unless the property is annexed into the City. Current zoning Subject property none (not in the city limits) North none (not in the city limits) South IDC Interstate Development Corridor (Interstate 10) East--none (not in the city limits) West--none (not in the City limits) The Planning and Zoning Commission will need to make a recommendation for the zoning should the City Council decide to annex the property. The recommendation of the Planning and Zoning Commission for the zoning, along with an ordinance zoning the area and an ordinance annexing the area will be presented to the City Council at a future meeting. 12 PLANNING AND ZONING COMMISSION SPECIAL CALL MEETING MINUTES TUESDAY, JANUARY 15, 2019 The Orange Planning and Zoning Commission met on Tuesday, January 15, 2019, in the meeting room of the Orange Public Library with the following members present to-wit: Commissioners Present: Weldon Smith Chairman George Mortimer Commissioner Gordon Worlow Commissioner MaQuettia Ledet Commissioner Mary McKenna Commissioner Elizabeth Lemoine..Commissioner Commissioners Absent: Jamie Wilson Vice Chairman City Council Members Present: Patrick Pullen Annette Pernell City Council Members Absent: Larry Spears, Jr. Bill Mello Brad Childs Terrie Salter Paul Burch Staff Present: Kelvin Knauf, Interim City Manager/Director of Planning & Community Development Wendy Lloyd, Planning Secretary Chairman Smith called the P & Z meeting to order at 5:30 p.m. PUBLIC HEARING None DISCUSSION/ACTION ITEMS a. Case 19:01. Consider a recommendation to the City Council on declaring Lot 45.5 x 248 of I, O/L-20, Sheldon Addition also known as 1404 Burton Avenue and owned by the City of Orange to be surplus property. 1 Page 12 of 13

13 Mr. Knauf stated the city owns this lot here on Burton Avenue. This is the Link Street water plant and at some point in the past the city acquired this lot and we do have a person that is interested in buying it. They own the lot next to it and what they would like to do is buy the city lot and then combine the lots and build a house there. The city charter requires that before the city can declare any property as surplus property, it has to have a recommendation from Planning and Zoning. Then your recommendation will be taken to Council and City Council will decide on whether or not to declare it surplus. Chairman Smith asked what it is currently zoned as. Mr. Knauf stated it is currently zoned C-S commercial special which is a mixture of commercial and residential. Commissioner Mortimer asked do we know why the property was purchased in the first place. Mr. Knauf stated I really don t. It was a really long time ago. Commissioner Mortimer stated but nothing to do with the facility behind it. Mr. Knauf stated if it was, it s no longer needed. It might be that some point in the past they thought they might put in a road into the plant but we access it from Link. Commissioner Worlow asked how it s priced. How do they arrive at a price? Mr. Knauf stated what we will do is if the Council declares it surplus property, we will take sealed bids and the high bidder will be awarded. Commissioner Worlow asked will there be a minimum bid. Mr. Knauf stated probably not because we just have no use for that property. We would rather have it on the tax roll and have it developed and that would be my recommendation. Commissioner Lemoine stated so they never used it for anything and nothing was ever put on it. Mr. Knauf stated no. Chairman Smith asked for any other discussion. None was made. Commissioner Mortimer motioned to approve recommendation. Commissioner Ledet 2 nd Vote: 6 0 Motion Carries APPROVAL OF MINUTES Chairman Smith made a request for the minutes of the November 6, 2018 special call joint meeting to be approved. Commissioner Mortimer motioned to approve Commissioner McKenna 2 nd Vote: 5 0 Motion Carries Chairman Smith adjourned the meeting at 5:35 p.m. 2 Page 13 of 13
