9 MINUTES OF REGULAR MEETING November 15, 2016 PLANNING & ZONING COMMISSION 1. CALL TO ORDER The meeting was called to order by Vice Chairman Bradt at 7:00 p.m. 2. CALL OF ROLL Commissioners present Vice Chairman Charlie Bradt, Mr. David Ash, Mr. Wally Westbrook and Mrs. Renee Glazer. Also present were Greg Smith, Jackie Thompson and Officer Bledsoe. 3. CITIZENS FORUM Responses to inquiries are limited by state law to a recitation of existing policy or a statement of specific factual information given in response to the inquiry. Any deliberation or decision by Planning and Zoning Commission shall be limited to a proposal to place that subject on the agenda of a future meeting. Vice Chairman Bradt stated for the record none wished to speak. 4. Presentation of a Planning and Zoning Commission preliminary report regarding the proposed zoning amendment from Interim Zoning IZ to Planned Development District # 13 PDD #13. The proposed zoning amendment is for.8727 acre tract of land situated in the William McDermott Survey, Abstract 389, and being out of a portion of the called acre tract as described in the deed to Outdoor Systems, Inc., recorded under Montgomery County Clerk s File Number Mrs. Thompson advised the Commission of the location of the property along IH 45. Stating the request is for Planned Development District #13 PDD #13. Mrs. Thompson added the property was annexed into the City in August 2016 and would be added as property into the existing Metropark development currently zoned PDD #13. Mrs. Thompson showed the commission the location of the property wishing to be rezoned. 5. Commissioner Glazer asked of the maps show the property within the City limits. Mrs. Thompson stated the property was within the City s Extra Territorial Jurisdiction ETJ, annexed in August and is now in the rezoning process. Commissioner Glazer stated that for transparency reasons the maps should show the property within the City limits. Mrs. Thompson stated that all the maps will be updated on a yearly base. Commissioner Ash asked what would happen with the sign over the years. Mrs. Smith advised the sign was not annexed into the City limits due to a ban placed on billboard signs. Commissioner Ash stated that they sign would remain on site for the time being. Mr. Smith stated yes. Commissioner Westbrook asked what section of the land would be used. Mr. Smith stated that the entire.8727 acres would be used, and is intended to be the major drive into the development. MOTION CARRIED UNANIMOUSLY. 7. Presentation of a Planning and Zoning Commission preliminary report regarding a zoning regulation amendment for Planned Development District 13 PDD #13. Mrs. Thompson stated the developer of MetroPark Square is asking for modification to the planned development district. Mr. Thompson summarized the modification, amend the name of the development from Metro Park Village to MetroPark Square, add restaurant use to the summary of the development, Correct formatting and grammar issued within the text, amend development standards to the 2015 International Code Series to govern development within the zone, amend allowed building material that are considered masonry, identify specific building setback along perimeter property lines and allow for a zero setback for all interior lots, amend the development phase criteria to account for current development plan, address off street loading spaces, address trash dumpsters and enclosures, amend requirements for wall façade articulation as require by the Integrated Development Code, address lighting of the development and amend interior landscape 11/15/2016 Page2
11 requirements, including landscape edges and planting areas. 8. Public hearing regarding a zoning regulation amendment for Planned Development District #13 PDD #13. Chairman Gristy opened the public hearing at 7:10 p.m. Mr. Smith stated that logo depicted in the drawing provided are not intended for this development. Commissioner Glazer asked what the current requirement is for the property for the minimum lot area and frontage. Mrs. Thompson stated the base zone would require a minimum lot frontage and lot areas, however the developer is subdividing the total 70 acre project and this would allow the developer to subdivide in any size lots. Commissioner Glazer asked what would be required of the site. Mrs. Thompson stated a minimum lot area of 25,000 square feet and frontage of 200 feet. Commissioner Ash asked what the request is. Mrs. Thompson stated the request to not have a minimum requirement. Commissioner Ash asked what the reason is to be able to make this reductions as requested. Mrs. Thompson stated that is for subdividing reason, so that lots can be created without meeting these requirements. Vice Chairman Bradt asked if there were any adverse effects on granting this request. Mr. Smith stated no, adding that this would allow the land to be divided into smaller parcels. Mr. Smith also stated the developer intended to developer the entire site, however if as depicted Chickfil A was to place a restaurant on the site, but wanted to purchase the land, the property owner/developer could subdivide the land and only sale what is need for the restaurant footprint. Commissioner Ash asked what opinion Staff has on the request. Mr. Smith stated that Staff does not have any issues with the request as it is presented. Adding that staff and the developer has worked closely on the request and feel that the modification are in line with the intent of the developer as presented in the beginning. Commissioner Glazer asked of there was a way to see what is existing prior, stating that the red line version includes what is being requested now. Mrs. Thompson stated that prior to this request the red lined information was not included and would have defaulted back the City s Integrated Development Code. Vice Chairman Bradt stated that the property was prior zoned commercial corridor and the Commission and Council reviewed a rezoning request and approved the property to be zoned Planned Development District #13 PDD #13. Mrs. Thompson agreed. Commissioner Glazer asked how this would affect other property within the City. Mr. Smith stated that other property owners would have to make a rezoning application with the City. Commissioner Ash asked for clarification on section and lighting reference in the PDD. Mrs. Thompson stated that the City s Vegetation Ordinance calls out for protected trees and offer means to remove these tress; being the location and condition of the site the developer has stated in the document that they intend to clear cut the lot as no trees on the site will be able to be preserved. Mrs. Thompson stated the developer will removal all vegetation from the site, raise the elevation and along with development replace the canopy to meet the 11/15/2016 Page3
12 required 50% coverage. Commission Glazer asked if this would remove the required 50% canopy coverage. Mrs. Thompson stated no. Commissioner Glazer stated that is document should read in a way as to state the 50% canopy requirement. Mrs. Thompson stated that the document would be modified to reference the vegetation section that requires the 50% coverage and would state the development is not exempt. Mr. Smith stated that Staff would have the City Attorney draft language regarding the canopy coverage. Commissioner Westbrook asked about how the City will regulate the standards on the fill to be completed on the land. Mr. Smith stated that during construction and development engineering reports and testing will be required to ensure proper standards are being meet. Commission Glazer asked for a clean copy of the zoning document prior to the request. Mrs. Thompson stated yes. Commissioner Ash stated that with the way the document reads, lighting could be allowed to extend to an unlimited height. Mrs. Thompson stated the intent is to allow lighting, as seen in other drawing provided, to extend from the roof line and trees in park and plaza areas. These lighting is called out a temporary holiday lights and is only allowed a certain time a year. Adding that the regulations also only allows it up to the highest roof line. Commissioner Ash stated the request does not limit height or limit the location of the lights. Mr. Smith stated the way it read is in plaza, open space and tree lines. Commissioner Ash asked if there is something that calls out plazas and open space. Mr. Smith stated any location other than a building. Mr. Smith stated that both locations could be included in both the definitions in the document where lighting is addressed. Commissioner Glazer asked if this project is allowed to use these other materials, would it be possible to open these material up to all other projects within the City. Vice Chairman Bradt stated that each zone stands along. Mr. Smith agreed, stating that each PDD would have to make an application to be considered to use this material. Vice Chairman Bradt closed the public hearing at 7:38 p.m. 9. Consideration and possible action to recommend to City Council approval or denial regarding a zoning regulation amendment for Planned Development District #13 PDD #13. Commissioner Ash stated they the Commission would have to make a recommendation with the expectations of receiving additional information. Commissioner Glazer asked if this item would be presented to the Commission again. Mr. Smith stated no, adding that with the Commission meeting their public hearing requirement and the time line between when this item would be taken to City Council the Commission could have a special called meeting to review the changes in writing. Presentation of a replat of Centro Section 1 being acres of land situated in the Montgomery County School Land Survey, A 305, in City of Shenandoah, Montgomery County, Texas, and being a portion of Unrestricted Reserve B of the City of Shenandoah Eastside Reserves, recorded under Cabinet Z, Sheet 1335 M.C.D.R and being a portion of a called acre tract conveyed to PUSH, LLC, from TMP Real Estate Ventures, LLC Deed No M.C.C. F. Mrs. Thompson advised the Commission the replat is for a portion of the Palmetto development known as Centro. Adding Section 1 included the portions of the North South right of way and the first half of the development. Mrs. Thompson stated the right of way being platted is a combination of City and developer owned property. Mrs. Thompson advised the commission Staff and the City Engineer have reviewed the plat and recommend approval with conditions including missing U.E file number be included and all public infrastructure required to be bonded prior to recording of plat. 11. Public Hearing regarding a replat of Centro Section 1 being acres of land situated in the Montgomery County School Land Survey, A 305, in City of Shenandoah, Montgomery County, Texas, and being a portion of Unrestricted Reserve B of the City of Shenandoah Eastside Reserves, recorded under Cabinet Z, Sheet 1335 M.C.D.R and being a portion of a called acre tract conveyed to PUSH, LLC, from TMP Real Estate Ventures, LLC Deed No M.C.C. F. Vice Chairman Bradt opened the public hearing at 7:45 p.m. Mrs. Thompson advised the Commission this is a final plat and if approved the developer would move forward with recording the plat. F. COMMISSIONER GLAZER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 13. Consideration and if determined appropriate recommend to approve the Preliminary Plat for Centro Section 2. Mrs. Thompson stated this is for a preliminary plat for Centro Section 2. The plat is for the second half of the overall development for Centro. Mrs. Thompson advised the preliminary plat is to provide the developer with security that the City agrees with that plat and would allow for construction of these lots to start. Once all the public infrastructure is completed the property owner would bring the plat back to the City for approval at which time a public hearing would be posted. Mrs. Thompson stated that Section 2 will require mitigation of wetlands and this process would allow for time to do so. Mrs. Thompson advised the Commission Staff and the City Engineer have reviewed the plat and recommend approval. Vice Chairman Bradt stated that what would happen if the developer does not move forward with construction. Mr. Smith stated nothing, he would be required to restart the process. Commissioner Westbrook asked what the property looks like with the wetlands. Mr. Smith stated that he believed the property is located in the wetlands but does not have a large amount of standing water. Commissioner Westbrook asked what mitigating the wetlands looks like. Mr. Smith explained the means the property owner would be taking to mitigate the wetlands, including purchase into a wetlands bank. Mrs. Thompson stated that the preliminary plat does not get recorded at this time, but rather stays on file with the City. Mrs. Thompson also explained this process has been completed by other residential developers in the past. Commissioner Glazer asked if the property is not developed can the land owner sale the land and then have another commercial business put on the site. Mr. Smith stated no, it must be developed as the PDD would allow. COMMISSIONER ASH MOTIONED TO RECOMMEND APPROVAL OF THE PRELIMINARY PLAT FOR CENTRO SECTION 2. COMMISSIONER GLAZER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. 14. Presentation of a Planning and Zoning Commission Preliminary Report regarding the proposed zoning amendment for special use permit to allow Tourist Accommodations: Lodging General and Restricted. The proposed special use permit is for acres out of called acres, Cole Foster Shenandoah, LLC, Shenandoah, Texas. 11/15/2016 Page6
15 Mrs. Thompson advised this is a request for tourist accommodations to allow for construction of an Even Hotel located at Shenandoah Park Drive and David Memorial. Mrs. Thompson advised the Commission the site has been granted prior special use permit and an extension to that permit which has expired due to lack of permitted. Mrs. Thompson stated the developer has reduced the room count and does have building plans under review with the City at this time. Mrs. Thompson stated the developer has stated the reason they lost the prior special use permit was due to their wetlands permit, which they have received. Commissioner Westbrook asked for a location of the site. Mrs. Thompson advised the Commission of the property location. 15. Public hearing regarding the proposed zoning amendment for special use permit to allow Tourist Accommodations: Lodging General and Restricted. The proposed special use permit is for acres out of called acres, Cole Foster Shenandoah, LLC, Shenandoah, Texas. Vice Chairman Bradt opened the public hearing at 8:00 p.m. Commissioner Glazer stated that she would like to see how many room and hotels we have approved for, under construction and existing within the City. Commissioner Glazer stated that with allowing new construction of hotels it could prove to cause an issue with the older hotels that are abutting the residential neighborhood. Mr. Smith stated that with the downturn of the business economy, there is also slowdown in the number of hotel room needed, but is expected to turn around. Mr. Smith also stated that with the way The Woodlands is being developed has caused the request for the types and brands of hotels that we see requesting development in the City. Mrs. Smith also added that he could provide the Commission with information on what is existing in the City, what is under construction, what is approved and if occupancy rate are provided we can provide them as well. Commissioner Ash stated that with the existing commercial development in the area it seems like a good location for a hotel. Commissioner Westbrook asked what is located to the west of the property. Mr. Smith stated that it is a TxDOT detention pond. Vice Chairman Bradt closed the public hearing at 8:10 p.m. 16. Consideration and possible action to approve or deny the minutes of the September 20, 2016 Regular Meeting of the Planning and Zoning Commission. Mrs. Thompson advised the Commission Commissioner Ash pointed out a few errors in the minute, included incorrect titles and spelling areas. COMMISSIONER ASH MOTIONED TO APPROVE THE MINUTES OF THE AUGUST 16, 2016 REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION AS AMENDED. COMMISSIONER 11/15/2016 Page7

Mr. Smith advised the Commission construction of the David Memorial Extension and the drilling of Water Plant 4 is in progress. Mr. Smith advised the Commission staff will be meeting with the awarded bidder for the City Pathways, which will run along the west side of IH45. Mr. Smith advised the Automated Meter Reading project is almost completed. Mr. Smith advised the Commission Lighting of the Angles is scheduled for the Tuesday after Thanksgiving. Mr. Smith set the Special called Planning and Zoning Commission Meeting for Monday, November 28 th at 7 p.m. 18. Vice Chairman Bradt asked if the City planned any additional lighting on Wellman Road. Mr. Smith stated at this time no, but could be something staff looks into and considers. CITIZENS FORUM Responses to inquiries are limited by state law to a recitation of existing policy or a statement of specific factual information given in response to the inquiry. Any deliberation or decision by Planning and Zoning Commission shall be limited to a proposal to place that subject on the agenda of a future meeting. Chairman Gristy stated for the record none wished to speak. 4. Presentation of a Planning and Zoning Commission preliminary report regarding a zoning regulation amendment for Planned Development District 13 PDD #13. Mr. Smith advised the Commission this item has been discussed prior and after discussion the City Attorney has revised language within the document. Mr. Smith advised the Commission of the modified language pertaining to the vegetation to be removed and replaced on the site, lighting on site and shown as an exhibit included. 5. Consideration and possible action to recommend to City Council approval or denial regarding a zoning regulation amendment for Planned Development District #13 PDD #13. COMMISSIONER GLAZER MOTION TO RECOMMEND TO CITY COUNCIL APPROVAL REGARDING A ZONING REGULATION AMENDMENTS FOR PLANNED DEVELOPMENT DISTRICT #13 PDD #13. COMMISSIONER ASH SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. Mr. Smith stated that the developer would be looking to modify the PDD to include signage for the site. 6. City Administration updates. Mr. Smith stated the Commission has reviewed sign exceptions and that it was believed the ordinance may need to be reviewed and modified based on request and potential requests. Mr. Smith clarified the issue with the signs not being able to meet the City s Ordinance seems to be generated by the sign companies not the 11/28/2016 Page1
18 commercial business. Mr. Smith advised the Commission of an example of the signage that would be allowed within the City, PGA Super Store. Mr. Smith advised the Commission of Lighting of the Angels. 7. Commissioner s Inquiry The Planning and Zoning Commission may inquire about a subject not specifically listed on this agenda.
