12 MINUTES PLANNING & ZONING COMMISSION June 25, 2015 The Planning and Zoning Commission met in a regular session on June 25, 2015 at 3:00 p.m. in the City Council Chambers, 800 Municipal Drive, Farmington, New Mexico P&Z Members Present: P&Z Members Absent: Staff Present: Others Who Addressed the Commission: Chair-Joyce Cardon Shay Davis Clint Freeman Cheryl Ragsdale Cody Waldroup Del Washburn Rory Jacques Kristin Langenfeld Paul Thompson Mary Holton Cynthia Lopez Toni McKnight Sam Montoia Steven Saavedra Karen Walker Sherry Blackmon Call to Order Chair Cardon called the meeting to order at 3:00 p.m. There being a quorum present the following proceedings were duly had and taken. Presentation of the Agenda There were no changes to the agenda. Approval of the Minutes A motion was made by Commissioner Davis and seconded by Commissioner Freeman to approve the minutes of the June 11, 2015 P&Z Meeting. This motion was approved unanimously by a 6-0 vote. 11

13 COMMUNITY DEVELOPMENT PETITION REPORT Petition PP Preliminary Plan for Flora Vista Hillside Estates Subdivision Planning & Zoning Commission Discussion of Petition PP on June 25, 2015 Senior Planner Cindy Lopez presented the staff report for PP 15-04, a request from Michael Smith, represented by Sakura Engineering & Surveying, for a preliminary plan for Flora Vista Hillside Estates Subdivision. The property is 6.82 acres, and is a residential subdivision with six lots located east of County Road 3451 and addressed as #6 County Road 3451 in Tier 2 of the City of Farmington s Planning and Platting Jurisdiction. This is designated as a Class 3 Subdivision. The site plan indicates that each of the six lots is 1 acre or more. Ms. Lopez went on to say the road extending to the subdivision is a 15-foot access easement that has been graded, graveled and is being maintained. The residences have been using this roadway for several years. Section 6.5 of the Unified Development Code sets the standards for rural residential subdivisions in Tier 2. Streets in Tier 2 for Class 3 subdivisions shall have: All weather, gravel or crushed stone base; and Road surfaces with not less than a double penetration chip seal surface; and Road surface width of not less than 24 feet; and Eight-foot shoulder on each side. Ms. Lopez said the petitioner is requesting a waiver to the subdivision regulations for the Flora Vista Hillside Estates Subdivision to allow the access easement to be the only access from County Road Ms. Lopez explained staff defers to the County for access and street improvement requirements. The gravel road allows for the rural-type atmosphere similar to areas within the City limit such as Hood Mesa Trail and Foothills. The Planning Division recommends approval of Petition PP for Flora Vista Hillside Estates Subdivision and the requested waiver. Commissioner Freeman asked if the road was non-compliant. Ms. Lopez said the County allows multiple homes on the lots. The parcels will have a deed recorded granting the individual properties to each family member. 12

14 Sherry Blackmon from Sakura Engineering & surveying located at 125 W. Main Street, stated that the current owner maintains the road, and she understood there to be a limit of two homes per property within San Juan County. Planning & Zoning Commission Action of Petition PP on June 25, 2015 A motion was made by Commissioner Freeman and seconded by Commissioner Waldroup to approve Petition PP for a request from Michael Smith, represented by Sakura Engineering & Surveying for a preliminary plan for Flora Vista Hillside Estates Subdivision, addressed as #6 County Road 3451 in Tier 2 of the City of Farmington s Planning and Platting Jurisdiction with the waiver to allow the 15-foot wide by approximately 280-foot long graveled access easement to be the only access from County Road 3451 to the private 60-foot wide access and utility easement ending in a cul-de-sac inside the subdivision. AYE: Chair Cardon, Commissioners Davis, Freeman, Ragsdale, Waldroup, and Washburn. NAY: None Abstained: None Absent: Commissioners Jaques, Langenfeld, and Thompson. Motion passed 6-0 COMMUNITY DEVELOPMENT PETITION REPORT Petition PP Preliminary Plan for Amburn Estates Subdivision Planning & Zoning Commission Discussion of Petition PP on June 25, 2015 Associate Planner Sam Montoia presented the staff report for PP 15-05, a request from Michael Smith, represented by Sakura Engineering & Surveying, for a preliminary plan for Amburn Estates Subdivision. The property is located along County Road 3450 and in Tier 2 of the Farmington Planning and Platting Jurisdiction. Mr. Montoia said the petitioner requests preliminary plan approval of a Class 2, 7-lot subdivision of approximately 6.24 acres located on County Road 3450 including the address of #33 County Road

15 Section 6.5 of the Unified Development Code sets the standards for rural residential subdivisions in Tier 2. Streets in Tier 2 for Class 2 and 3 subdivisions shall have: (1) All weather, gravel or crushed stone base; and (2) Road surfaces with not less than a double penetration chip seal surface; and (3) Road surface width of not less than 24 feet; and (4) Eight-foot shoulder on each side. Mr. Montoia explained an access easement will be shown along a centerline of County Road 3450 in place of what is shown on the plat as dedicated Right of way (ROW). According to San Juan County, family exemption surveys are not allowed to dedicate ROW. San Juan County maintains and will continue to maintain County Road Additionally, Lots 1 and 2 have platted access to Crescent Drive by way of Round Valley Subdivision. However, this access is not paved, and therefore a waiver to the improvements required by UDC Section 6.5 is requested for access to lots 1 and 2. Staff recommends approval of Petition PP 15-05, Amburn Estates Subdivision and the requested waiver. Sherry Blackmon from Sakura Engineering & Surveying, 125 W. Main Street, stated Lot 1 and 2 front the existing Right of Way (ROW). Sakura Engineering & Surveying is negotiating with the County on where the lot lines will be located. Planning & Zoning Commission Action of Petition PP on June 25, 2015 A motion was made by Commissioner Waldroup and seconded by Commissioner Washburn to approve Petition PP for a request from Michael Smith, represented by Sakura Engineering & Surveying, for the Preliminary Plan for the Amburn Estates Subdivision, a 7-lot subdivision on 6.24 acres located at #33 County Road 3450, with a waiver to requirements of improvements to adjacent access specifically for Lots 1 and 2 as required by UDC Section 6.5. AYE: Chair Cardon, Commissioners Davis, Freeman, Ragsdale, Waldroup, and Washburn. NAY: None Abstained: None Absent: Commissioners Jaques, Langenfeld, and Thompson. Motion passed

16 COMMUNITY DEVELOPMENT PETITION REPORT FP Sunrise Subdivision No. 23 Replat B Planning & Zoning Commission Discussion of Petition FP on June 25, 2015 Associate Planner Steven Saavedra presented the staff report for FP 15-01, a request from Ron Bliss, represented by Sakura Engineering & Surveying, for property located at 4423 Casa Bonita Drive in the City of Farmington. The submitted final plat is a 5-lot subdivision of 1.98 acres, east of Casa Bonita Dr. The petition is a Class 1 subdivision in the SF-7 Single-Family Residential District. The SF-7 district requires a minimum 7,000 square-foot lot. Staff recommends approval, subject to the following conditions: A. The shared driveway into the proposed subdivision will require a turn-around, hammerhead, or cul-de-sac, in accordance with the City s Fire Code. B. The developer is required to install sidewalks along Casa Bonita Drive adjacent to Lots 5B and 1B. (This will be required at the building permitting stage). C. The provision of both the overall Sunrise deed restrictions and the proposed deed restrictions for this specific subdivision for recordation with the final plat. D. A plat note cross referencing and indicating compliance with all deed restrictions set forth for this subdivision. Staff concludes approval of Petition FP 15-01, Sunrise No. 12 Subdivision, Replat B, is appropriate. Sherry Blackmon from Sakura Engineering & Surveying, 125 W. Main Street, stated that Sakura has followed up with the alternate hammerhead and the utility site plans. Sakura has also drafted a Joint Use Maintenance Agreement. Planning & Zoning Commission Action of Petition FP on June 25, 2015 A motion was made by Commissioner Davis and seconded by Commissioner Ragsdale to approve Petition FP 15-01, a request from Ron Bliss, represented by Sakura Engineering & Surveying, for the Final Plan for Sunrise No. 12 Subdivision, Replat B, a 5-lot subdivision on 1.98 acres located west of Casa Bonita Drive subject to conditions A-D. AYE: Chair Cardon, Commissioners Davis, Freeman, Ragsdale, Waldroup, and Washburn. NAY: None Abstained: None 15

Motion passed 6-0 COMMUNITY DEVELOPMENT PETITION REPORT FP Little Creek Subdivision Phase V Planning & Zoning Commission Discussion of Petition FP on June 25, 2015 Associate Planner Sam Montoia presented the staff report for FP 15-02, a request from Joe Kozimor for Little Creek Subdivision Phase V. It is west of Little Creek Subdivision Phase IV and south of Piedras Street. The petitioner requests final plat approval of a Class 1, 24-lot subdivision of approximately 6.24 acres located west of Little Creek Subdivision, Phase IV and south of Piedras Street. The Developer annexed the subject property into the City with SF-5 zoning in This zoning requires a minimum 5,000 square-foot lot. The subdivision has not received approval from the NMDOT for access to the subdivision from Starling Boulevard to the south. Piedras and the existing street network are adequate until the connection to the south is approved and constructed. Barriers preventing access to Starling and Primavera Streets to the south have been installed and shall remain until access to US 64 is resolved with NMDOT. Staff concludes that the approval of Petition FP 15-02, Little Creek Subdivision, Phase V, is appropriate. The Final Plat substantially conforms to the approved preliminary plan. Planning & Zoning Commission Action of Petition FP on June 25, 2015 A motion was made by Commissioner Davis and seconded by Commissioner Waldroup to approve Petition FP for a request from Joe Kozimor, represented by Cheney, Walters, Echols, for the Final Plat for the Little Creek Subdivision, Phase V, a 24-lot subdivision on 6.24 acres located west of Little Creek Subdivision, Phase IV and south of Piedras Street. AYE: Chair Cardon, Commissioners Davis, Freeman, Ragsdale, Waldroup, and Washburn. NAY: None Abstained: None 16
