1 CITY OF TYLER PLANNING AND ZONING COMMISSION STAFF COMMENTS Date: June 5, 2018 Subject: A SCOTT ZHORNE Request that the Planning and Zoning Commission consider recommending adoption of an ordinance providing for the voluntary annexation of an acre tract of land lying adjacent to the present boundary limits of the City of Tyler located at the southeast corner of the U.S. Highway 69 and Interstate 20. Also consider recommending: A. The new boundary of the City Limits B. The new boundary of the City Council District #3 C. The Land Use Guide to reflect General Commercial D. Original zoning of acres of C-2, General Commercial District Page: 1 of 2 Item Reference: Texas Local Government Code Section ; Annexation of Sparsely Populated Areas The State Annexation law in Texas Local Government Code Chapter 43 allows municipalities to annex a sparsely occupied area on the petition of the area landowners. The Texas Local Government Code Section (a) authorizes annexations if an area (1) is one-half mile or less in width; (2) is contiguous to the annexing municipality; and (3) is vacant and without residents or on which fewer than three qualified voters reside. The property is contiguous to Tyler on its southern boundary, is narrower than one half-mile, and has fewer than three qualified voters. The applicant intends to development the property with commercial uses and is requesting to zone the property C-2, General Commercial District. According to the Unified Development Code (UDC), the C-2, General Commercial District allows automobile garages and sales lots, hotels, restaurants, warehouses, offices, and retail establishments with outdoor display or storage of merchandise. The maximum building height allowed within the C-2 District is three stories or 45 feet in height. The setback requirements are 10 feet in the front, 10 feet in the rear, zero feet on the interior side (10 feet if abuts a residential district) and 15 feet on the corner side. The minimum lot area is 14,000 square feet. Off-street parking for commercial-type uses is determined by the specific use proposed. Properties with a commercial designation are subject to UDC Development Standards such as landscaping and tree preservation, bufferyards, and sign regulations.

2 Case Number: A SCOTT ZHORNE Page: 2 of 2 The City of Tyler currently has a water main along Highway 69 to serve the site with water. The City has the capacity to serve the property with sewer service, but a sewer line extension is required to serve the property. The City of Tyler will be the first responder for Fire and Police services; however the City may exercise its mutual aid agreement with the Smith County Emergency Service District when responding to the property. This annexation will extend the Tyler city limits to Interstate 20 which makes Tyler eligible to be designated a Control City. This designation is required for the Texas Department of Transportation to make Tyler a noted destination on its wayfinding signs. The Tyler 1 st Future Land Use Guide (FLUG) does not identify a future land use designation for this property. The proposed original zoning would amend the FLUG to General Commercial. As of Friday, June 1, 2018, of the seven notices mailed, no notices were returned in favor or in opposition to the request. All other departments have reviewed the application and anticipate no significant impact on services and facilities by the proposed annexation request. RECOMMENDATION: Staff recommends approval of the of the annexation and to establish: A. The new boundary of the City Limits B. The new boundary of the City Council District #3 C.
